Other land use applications related to this project may still be pending. One administrative appeal to the City Council of the Planning Commission Decision is permitted. IV. PROCEDURES AND TIME FOR APPEALING In order to appeal the Planning Commission decision on the Permit Application, a written notice of appeal must be filed with the Department of Community Development within 14 days of the issuance of this Decision, that is by September 12, 2003. The requirements for such appeals are set forth in Tukwila Municipal Code18.116. All appeal materials shall be submitted to the Department of Community Development. Appeal materials MUST include: 1. The name of the appealing party. 2. The address and phone number of the appealing party; and if the appealing party is a corporation, association or other group, the address and phone number of a contact person authorized to receive notices on the appealing party's behalf. 3. A statement identifying the decision being appealed and the alleged errors in the decision. 4. The Notice of Appeal shall identify (a) the specific errors of fact or errors in application of the law in the decision being appealed; (b) the harm suffered or anticipated by the appellant, and (c) the relief sought. The scope of an appeal shall be limited to matters or issues raised in the Notice of Appeal. The City Council hearing regarding the appeal shall be conducted as a closed record hearing before the based on the testimony and documentary evidence presented at the open record hearing conducted by the Planning Commission. The City Council decision on the appeal is the City's final decision. Any party wishing to challenge the City Council decision on this application must file an appeal pursuant to the procedures and time limitations set forth in RCW 36.70C. An appeal challenging a DNS, an MDNS or an EIS may be included in such an appeal. If no appeal of the City Council decision is properly filed in Superior Court within such time limit, the Decision on this permit will be final. VI. Project Description Vicinity /Site Information Nextel Communications is requesting Conditional Use Permit approval to install a wireless telecommunication facility with antennas on the roof of the existing apartment building, which is located at 4020 -4030 South 140 Street. The antennas are proposed on the roof of the existing building and will be enclosed within four canisters, two at the east end and two at the west end. The canisters are 30 inches in diameter and extend 5'6" above the top of the existing building. The associated equipment is proposed inside the building and two air conditioning units are placed on a concrete pad outside at the northeast end of the building. Existing Development FINDINGS The existing building is a two -story apartment building. The subject site is zoned High Density Residential (HDR). Surrounding Land Uses The surrounding land uses on the north and east side are single family homes and the properties are zoned Low Density Residential (LDR). The subject site is bounded by South 140' Street on the south side and Southgate Mobile Home Park is south of the street. The mobile home property has Neighborhood Commercial Center (NCC) and Medium Density Residential (MDR) zoning with a Commercial Development Overlay. The subject site is bounded by Laundromat on the west side zoned Regional Commercial (RC). Background The applicant originally proposed to construct a nine foot high pent house type of enclosure with antennas mounted on the outside of the enclosure, which was out of scale with the residential building. Also, the entire equipment was proposed to be located outside at the northeast end of the building. The city asked the applicant to revise their proposal to reduce the adverse aesthetic impact. Also, the applicant was asked to provide a noise report to document that the proposal met the city's noise ordinance and also to choose a location with the least noise impact. Further the applicant was asked to explore the opportunities to locate on adjoining commercial properties, particularly two hotels (Ramada Inn and Econolodge) on Tukwila International Boulevard since those locations met their coverage objectives and the existing buildings were taller than Birchcrest apartments. 3 The applicant revised the design into a set of four canisters in a row, which was further revised to split them into a set of two each at each end of the building. Also, the applicant moved the equipment inside the building except two air conditioning units. The applicant's noise report was reviewed and approved by the city's noise consultant. The applicant also submitted a copy of the lease proposal for the two hotels that was rejected by the property owner. Conditional use criteria The proposed project must comply with criteria detailed in TMC 18.64.050, (1 -5), concerning Conditional Use Permits. Applicant's response to conditional use criteria is attached to this staff report as Attachment C. Staff makes the following findings under the city's Conditional Use Permit criteria (TMC 18.64.050): (1) The proposed use will not be materially detrimental to the public welfare or injurious to the property or improvements in the vicinity of the proposed use or in the district in which the subject property is situated. The applicant has included site plans; elevations of the antennas; and computer generated photographs showing the proposed canisters that will screen the antennas and the associated equipment in relation to the existing building and surrounding development. The top of the existing building is 18' high. The top of the proposed canisters will be 23'- 6" high. The subject site is zoned HDR. The facility shall comply with all federal standards related to radio frequency emissions. The applicant submitted a noise report that was reviewed and approved by the city's noise consultant. (2) The proposed use shall meet or exceed the performance standards that are required in the district it will occupy. The Development Standards for uses in the HDR zone are: Maximum height: 45' Setbacks: Front: 15' for first floor Side and rear: 10' for first floor The top of the proposed canisters is 23'6 ". The antennas are proposed within four canisters on the roof the existing building and the building meets all setback requirements. The associated equipment shall be placed within the existing building and the two air conditioning units shall be placed outside at the northeast end of the building and will meet the setback requirements. The proposal meets the city's noise ordinance. No other development standards in this zone apply to this application. 4 (3) The proposed development shall be compatible generally with the surrounding land uses in terms of traffic and pedestrian circulation, building and site design. As with similar uses, the proposed facility will generate trips during the construction period and, following the completion of construction, up to 1 trip per month for maintenance. No other impacts to pedestrian or transportation movements are anticipated. No new building is proposed. Instead the project is to construct install antennas on rooftop of an existing building. (4) The proposed use shall be in keeping with the goals and policies of the Comprehensive Land Use Policy Plan This project must comply with the following Comprehensive Plan policies: 12.1.36. Encourage utilities to consolidate facilities and minimize visual impacts of facilities where technically feasible. Implementation strategies for this policy include the use of shared infrastructure and use of existing structures. The applicant is proposing antennas that will be located on an existing building. 5) All measures have been taken to minimize the possible adverse impacts, which the proposed use may have on the area in which it is located. The applicant has applied for a location on an existing building in lieu of proposing a new monopole for their antennas. A total of four canisters (two on each end of the building) that are consistent with the architecture of the building are proposed in order to screen the antennas. The associated equipment is proposed to be placed inside the existing building. The two air conditioning units will be placed outside at the northeast end of the building and will be screened by a wood fence. The canisters and the wood fence enclosure for the air conditioning units must be painted to match the existing building. The project shall meet all requirements of the City's noise ordinance. Also the project must meet all Uniform Building Code and Fire Department requirements, which will be reviewed as part of the building permit review process. The facility will meet all federal standards related to radio frequency emissions. 5 CONCLUSIONS 1. The proposal to install additional antennas on an existing building will not be materially detrimental to the public welfare or injurious to the property or improvements in the vicinity. 2. The proposed project meets the performance standards that are required in HDR zone. 3. The proposed project is compatible with the surrounding land uses in terms of traffic and pedestrian circulation, building and site design. w • 0 4. The proposed project is in keeping with the goals and policies of the Comprehensive Land Use Policy Plan. 5. The radio frequency emissions are regulated by Federal Communication Commission and this project must meet all their requirements. The canisters to screen the antennas and the wood fence enclosure to screen the air conditioning units shall be painted to match the existing building to reduce their visual impact. If approved as conditioned, it can be stated that all measures have been taken to minimize the possible adverse impacts this project may have on the area in which it is located. RECOMMENDATIONS Staff recommends approval of the Conditional Use Permit with the following condition: The canisters to screen the antennas and the wood fence enclosure to screen the air conditioning units must be painted to match the existing building. INFORMATIONAL ITEMS Applicant shall obtain a building permit prior to starting any construction. O I No physical hazards would be present at the site that would present a danger or Z nuisance to the surrounding community. Given the facility's appropriate location, no hazards to life or property would occur from its development and operation. Proposed fencing would provide additional security. The facility would be remotely monitored by Nextel for fire, smoke, intrusion and power failure on a 24 hour basis, 7 days a week. Best construction / management practices would be implemented to ensure safety during construction. Project design and facility operations would adhere to all FCC rules regarding radio frequency propagation exposure limits. The proposed wireless communications facility would operate in a frequency range between 806 to 821 and 851 to 866 Megahertz (Mhz). Transmissions would be low power, (average of 100 watts per sector at full activation) with a maximum of four (4) channels per antenna. As such, the transmissions would be below the Federal Communications Commission (FCC) and the American National Standards Institute (ANSI) standard set forth in IEEE/ANSI C95.1 -1992, of 657.3 microwatts per square centimeter (see attached Nextel RF Certification Form). The project would not interfere with surrounding properties or their uses. Specifically, ESMR facilities operate at extremely low power and thus the facility would not be a source of interference with electronic equipment, including radio, television, and telephone transmissions. Interference is governed by the Federal Communications Commission's (FCC) regulation of radio transmissions. The attached manufacture's specifications for the equipment cabinet's HVAC mechanical equipment states that the noise emissions would be limited to 50 dB at 15 feet from the unit which is greater than the distance from the equipment cabinet to the property line. The visual impact of the proposal would not be significant given the screening to be achieved by the penthouse structure proposed to be constructed on the roof of the building, on which Nextel's antennas would be flush mounted, and the landscaping proposed for the ground mounted equipment cabinet. Further, the proposed project would not obstruct views form any residential properties. Best construction / management practices would be implemented as required to ensure no erosion damage would result from the minor site grading required for installation of the equipment cabinet pad. No landslide or other geological hazard areas are associated with the subject property and therefore would not present an issue during construction. As the proposed facility would not be materially detrimental to the public welfare or injurious to property or improvements in the area, no increase in the City's development standards or criteria would be necessary. 2. The proposed use shall meet or exceed the same standards for parking, landscaping, yards and other development regulations that are required in the district it will occupy. As depicted within Nextel's Conditional User Permit application plans, it is Nextel's intent that its wireless communications facility design adhere to the City of Tukwila's development standards, including: Setback: Ten feet (10') satisfies 18.14.070 of the City of Tukwila Zoning Code. Height: Zoning Parking: Landscape: Twenty -seven feet (27') satisfies 18.50.080 of the City of Tukwila Code given that the new antenna screen structure is set back ten feet (10') from the roof line and at ten feet (10') high does not exceed he twenty foot (20') height limit. No parking areas are being eliminated by this proposed wireless communications facility. In addition, as the facility would be unmanned, except during routine maintenance visits, no additional parking is required. Ten feet (10') of Type 1 landscaping satisfies 18.52.020 of the City of Tukwila Zoning Code. Coverage: At 32 %, including the proposed wireless communications facility, the maximum 50% lot coverage limit per 18.50.085 of the City of Tukwila Zoning Code is met. 3. The proposed development shall be compatible generally with the surrounding land uses. The proposed wireless communications facility would provide needed and beneficial communications services to the public in a manner that does not generate any nuisances or impacts to the surrounding area. By collocating proposed wireless communications facility's antenna on and adjacent to an existing structure, rather than proposing construction of an new communications tower on or in the vicinity of the site, the proposed project would ensure the highest degree of compatibility and would reduce the number of new communications support structures required within the city. The proposed facility would not impact property values on adjacent properties given the small size of the facility coupled with the landscape screening for the ground equipment and the screening structure proposed for antenna flush mount attachment, both of which will be painted to match that of the host building. In summary, given the attributes listed herein, there would be little esthetic impact on the subject and surrounding properties. The facility is minor in nature and has been designed to reduce impacts to views. Accordingly, the project is not deemed to be detrimental to the surrounding area and would provide needed and beneficial wireless communication services to the area. 4. The proposed use shall be in keeping with the goals and policies of the Comprehensive Land Use Policy Plan. The subject property is zoned "High Density Residential - HDR ". Chapter 18.14.040 of the City of Tukwila Zoning Code stipulates that radio, television, microwave, . cellular or observation stations and towers may be allowed within the HDR district, subject to the requirements, procedures, and conditions established by the requested Conditional Use Permit. Nextel's proposed ESMR facility falls within the referenced categorization of this provision. By collocating proposed wireless communications facility's antenna on and adjacent to an existing structure, rather than proposing construction of an new communications tower on or in the vicinity of the site, and designed to be integrated with the architecture of the host structure, the proposed project would be consistent with the City of Tukwila's Zoning Code for wireless communications facilities. All measures shall be taken to minimize the possible adverse impacts which the proposed use may have on the area in which it is located. As previously noted, overall project design and best construction / management practices would be employed to ensure minimization of possible adverse impacts that may result from the proposed wireless communications facility. Specifically: The facility would be unmanned and will impose no burden on any improvements, facilities, utilities, or services. The proposed wireless communications facility's minor nature would not impact property values on adjacent properties. The landscape screening for the ground equipment would limit the esthetic issues relating to the improvements proposed for the property. The screening offered by the penthouse structure proposed for antenna flush mount attachment, both of which will be painted to match that of the host building, would limit the esthetic issues relating to the proposed roof mounted equipment. • The proposed project would not interfere with surrounding properties or their uses given that this wireless communications facility operates at extremely low power and thus the facility would not be a source of interference with electronic equipment, including radio, television and telephone transmissions. The potential for interference is governed by the Federal Communications Commission's (FCC) regulation of radio transmissions. Attachment E r Nextel Communications, Foster/ uirch Crest Noise Study June 4, 2003 INTRODUCTION Page 1 • This report documents the results of an environmental noise study for the proposed Nextel Foster/ Birch Crest site located at 4020 -4030 South 140 Street in Tukwila, Washington. The intent of the study was to predict.noise emissions from the equipment associated with operation of the proposed Nextel site. The predicted sound levels were evaluated for compliance with state and ,local noise codes. An analysis of applicable noise codes and ordinances is contained in this study.. Noise on this site is governed by the City of Tukwila Municipal Code. NOMENCLATURE Noise is generally considered unwanted sound. The noise level is characterized by the magnitude of pressure intensity fluctuations. Decibel (dB) levels are a form of shorthand. ,that, characterize, with a convenient numerical scale, the auditory response to the broad range of perceptible pressure intensities. The decibel scale is logarithmic: a doubling or halving of energy causes the sound level to change by 3 dB; it does not double or halve the original level. The minimum sound level variation perceptible to a human observer is approximately 3 decibels; a 5 decibel change is clearly perceptible and an 8 to 10 decibel change is associated with a perceived doubling or halving of loudness. The human ear has a unique response to sound pressure fluctuations. It is less sensitive to higher and lower frequencies - those sounds falling outside the speech frequency range. Sound level meters and monitors utilize a weighting system to approximate human perception of sound. Calculations made' utilizing this weighting system are referred to as 11 A weighted" And are called "dBA". Most applicable regulatory criteria are written using the A weighting; therefore, all sound levels presented are A weighted. The 11 A" may be dropped from the decibel notation for convenience, as they have been in this report. METRICS Responses to noise are subjective and unique to each listener. Metrics have been developed to provide more convenient descriptors of sounds that vary with time and with human responses to noise. The following metrics have been adopted by the City of Tukwila Administrative Code to describe noise emissions and their limitations. . Equivalent Sound Level; L Leq is the level of a constant sound having the same energy content as the actual time - varying level during a specified interval. The L is used to characterize complex, fluctuating sound levels with a single number. Percent Sound Level, L The A- weighted sound level exceeded n% of time. The L90 descriptor, or sound level exceeded 90% of the time, typically referred to as a background noise level. REGULATORY CRITERIA The City of Tukwila Municipal Code governs site noise level restrictions at the proposed site. Section 8.22.040 of the Tukwila Municipal Code regulates the noise levels produced by the proposed project and received by surrounding property. These maximum permissible sound levels are summarized in the table below: Maximum Permissible Sound Levels per the Tukwila Municipal Code District of Sound Source Residential Commercial Industrial The code also establishes the following modifications (section 8.22.050) to maximum permissible sound levels: 1. Reduce the 'noise limitations by 10 dBA between the hours of 10:00 p.m. and 7:00 a.m. during. weekdays, and between the' hours of 10:00 p.m. and 9:00 a.m. on weekends where the receiving property is zoned residential. 2. For sound levels of a short duration, this ordinance is also modified to increase the limits as specified below: Any installation of mechanical equipment in regions under this jurisdiction will be required to comply with the most stringent code noise levels. The site is abutted by residentially zoned properties on the north, south and east sides and a commercially zoned property on the west side. Nextel equipment is scheduled to be installed inside of the existing building. Two air condensing units are installed outside north of the building. The closest property lines are situated at a distance of 14 feet north and about 15 feet east from the proposed condensing units. The existing building shields the adjacent south property line. There is a nighttime penalty of 10 dB imposed on the noise level between the hours of 10 PM and 7 AM (10 PM and 9 AM on the weekends), thereby reducing the maximum allowable level at the property line to 45 d BA. Page 3 Our acoustical analysis is based on information submitted to our office by Nextel and KDC Architects. Copies of the Nextel site plan are included with this letter for reference. Two air condensing units model PU36EK manufactured by Mitsubishi Electric are installed on a concrete slab north of the building. Only one condensing unit is operating at a time, the second one is a stand by unit. The manufacturer's sound data, in terms of sound pressure levels as measured at reference distances, were used in our acoustical analysis. According to these data the air conditioning unit produces a level of 55 dBA at a distance of 3 feet. The noise levels produced by the mechanical equipment associated with Nextel operation were predicted at the closest property lines. Noise Level Predictions. Again relating available antennas' "gain" characteristics, there are no smaller antennas that would satisfy Nextel's in- building coverage objectives. In summary, the currently proposed four -foot (4') Decibel 844H40E -SX panel antennas are the smallest available antennas that will meet Nextel's coverage objectives. Future Antennas In designing its wireless communications facilities where appropriate and feasible, Nextel incorporates flexibility to mount additional antennas likely to be needed. These additional antennas and related equipment provide the flexibility necessary to make continually evolving system improvements, based upon changing technology, subscriber demographics and related requirements, all in conjunction with Nextel's adjacent wireless facility coverage areas. Of specific concern to Nextel is the anticipated addition of new frequency allocations to its system operations that will require equipment re- configuration. The design flexibility proposed enables Nextel to make changes to its system and equipment, within the scope of an approved land use application, without the necessity of making multiple re- applications for modifications that are anticipated at the time of the initial application. In the case of this proposed wireless facility project, Nextel has modified its initial antenna mount design from a roof mounted antenna screen structure to four (4) roof mounted canisters positioned as requested by the City. This modified design accommodates the future antennas from an esthetic standpoint. Specifically, Nextel's proposed thirty -inch (30 ") diameter canister units can accommodate two future panel antennas each. Nextel's equipment manufacturers do not have an approved smaller diameter canister available with the exception of a sixteen -inch (16 ") single antenna canister that would not be suitable for this project given that it propagates in a 360 - degree pattern. Nextel's current design calls for an initial single sector operation. Propagation in a 360 -degree pattern would currently interfere with operations of Nextel's adjacent wireless facility areas Even if the sixteen -inch (16 ") canister were designed to accommodate a single sector antenna, the difference in diameters from such a canister, versus the proposed thirty inch (30 ") diameter canister, is negligible from any relevant distance said canister would be visible on the ground from the subject building. z _� ;�. z � w J 00 u 0 i w w = -J CDw w gQ w z = 1-0 z U ON 0L- wW -4: 0 w O~ z Ms. Minnie Dhaliwal August 4, 2003 Page 3 Square Versus Circular Canisters In response to the City's inquiry as to the feasibility of square versus circular antenna canisters, the circular canister was selected given that there exists minimum separation criteria between antennas. Although Nextel's current development plans stipulate twenty feet (20') separation for esthetic purposes, a minimum of ten feet (10') from antenna to antenna would be required to prevent cross interference. This criterion is specific to Nextel's equipment and performance characteristics. Accordingly, a rectangular roof mounted screening structure, approximately twelve feet (12') in length, for each of the two sets of antennas would be required to accommodate the separation requirements. These rectangular screening structures would be counter productive relative the City's stated intent that the visual impacts of Nextel's antenna mounting structure be minimized. In retrospect, such rectangular antenna mount structures would begin to resemble that included within Nextel's initially proposed design that was abandoned at the City's request in favor of split canisters. As depicted within Nextel's currently revised site development plans, the City's request for implementation of a split canister antenna mount design has been satisfied as well as every other expressed concern and design objective. The applicant has addressed the noise concerns by providing the city with a noise report to show that the proposed project meets the city's noise ordinance. The associated equipment is now proposed to be installed inside the building but the air condensing units are still proposed to be located outside at the east end of the building. The city's noise consultant has reviewed and approved the applicant's noise report. Also, the applicant has revised the proposal from a penthouse installation on the roof to four canisters on the roof, two on the east end and two on the west end of the building. Please note that while the city was in the process of reviewing Nextel's applications, T- mobile filed an application to site their wireless facility at the same location. Paragraph No. 1 of that letter requests that Nextel "look into the opportunities for combining the two facilities for Nextel and T- mobile," and sets forth the city code provisions that you believe authorize this requirement. Nextel respectfully disagrees with your analysis, for the reasons below. The first sentence of paragraph no. 1 reads: "The City has received a separate Conditional Use Permit and SEPA application from T- mobile for a wireless facility at the same site as your proposal." Please note that T- mobile's application is not for the same site as Nextel's. While the sites are very near each other, they are on different support structures, on separate properties, and involve lease agreements with different property owners. In order to "combine facilities," one or the other carrier would need to give up its proposed site and reapply to locate on the other's site. While it is certainly appropriate for prospective applicants to evaluate opportunities to co- locate with existing or pending facilities, it would be unreasonable, and unprecedented, to require Nextel, seven months into the review process, with a hearing and permit approval imminent, to abandon its site because another provider now requests permission to build nearby. The letter identifies two code provisions as the basis for your request. The first is CUP criterion no. 4, that the use shall be in keeping with the goals and policies of the • comprehensive plan, which includes a policy that consolidation of utility facilities is to be encouraged. Second, comprehensive plan policies cannot be used in lieu of development regulations to create requirements that don't exist in the development code. (In addition, the intent of the o policy is unclear from the partial quotation provided in the letter.) o co o co w. The T- mobile application does not affect the w 0 requirements for meeting this criterion. It is our understanding that T- mobile's antenna facilities cannot be located on the roof of the building with Nextel's antennas because the roof is well below the height identified by T- mobile as the minimum required to meet its coverage objectives. Introduction Environalysis was asked by the Department of Community Planning of the City of Tukwila to review and comment on a noise study prepared for communications equipment proposed to be located at the Birch Crest Apartments, 4020 -4030 South 140 Street, Tukwila, Washington. The review process included reviewing the noise reports by Nextel's acoustical consultants, visiting the project site and conversations with the City and Nextel's acoustical consultants. Both the original (dated March 17, 2003) and a revised noise study (dated June 4, 2003) were examined. Environalysis obtained noise data from the equipment manufacturer and calculated the potential noise impacts with and without noise reduction measures at several locations. Applicable Noise Regulations The City of Tukwila regulates noise from a "source" and defines the maximum permissible noise level upon a "receiving property" in Section 8.22.040 of its Municipal Code. For this project the source and receiving properties are the same single property, It is multi- family residential with a maximum permissible noise level of 55 dBA during the day (7 AM to 10 PM weekdays, 9 AM to 10 PM weekends and holidays and 45 dBA at night. Like most cities and counties in Washington State, Tukwila's noise code is closely modeled upon the State's WAC 173 -58 and like the WAC states that the "receiving property" is being impacted by noise from a source outside of itself; i.e. another piece of real property. The City understands its Section 8.22.040 as requiring a noise source located on residential property to meet the maximum permissible noise level of 55/45 dBA for receivers on that same residential property when the use is multi- family and tenants must be protected from noise sources agreed to by the landlord. This interpretation is the one that will apply to the review of the Nextel project. Review of the Noise Studies The review of the two noise studies indicated that Nextel's design was revised from one where the air conditioning units were unitary packaged models to one with split- systems- - with the outdoor units located at the northeast end of the building. The split system selected by Nextel has a low noise rating for its cooling capacity (55 dBA at 3 feet for a unit with 34,200 BTU cooling capacity). The advantage of the design change is that the revised design will be quieter because the indoor portion of the units, with a maximum noise rating of 49 dBA, will be fully muffled by being in the apartment's basement. Nextel's acoustical consultant's calculated noise levels of 42 dBA at the north property line and 41 dBA at the east property line. Because of the City's desire that keep noise levels below 45 dBA at night on the Birch Crest property, Nextel's acoustical consultants provided a calculation of noise levels with a 6' solid wood enclosure around the outdoor units. Environalysis performed a similar calculation using methodology specified by the ■ Distance from 6' Barrier Noise Level (SPL)' Noise Level (SPL) 1 foot 42 dBA 43 dBA 3 feet 40 dBA 41 dBA 15 feet- east property line 34.5 dBA 31 dBA Air Conditioning and Refrigeration Institute (ARI- 275 -97), with the following (basically similar) results: Source: ' The Greenbusch Group, 2 Environalysis The barrier would be four - sided, open on top, made of painted exterior grade marine plywood with a solid door allowing access for maintenance. A clearance of 3 feet would be provided between the barrier and the air conditioning units and at least 6 feet clearance between the barrier and the existing door at northeast end of the apartment building. Discussion of the Noise Issues Environalysis had discussions with Nextel's acoustical consultants, the City's Department of Community Development and the City's attorney regarding the types of mitigation suitable for this project. Some alternate noise reduction designs were mentioned and rejected, such as: • Relocating air conditioning units to roof- The applicant says there are structural reasons why this cannot be done. • Relocating units to the west end of the Birch Crest property- No advantage compared to the proposed location. • Relocating units inside the basement- A free movement of air is required to dissipate the heat discharged by the outdoor units. It would be difficult to ensure this free air flow in the basement. • Relocating the outdoor units midway along the north side of the building. No advantage over the proposed location. There would be more apartment units and opening windows closer to the units than at the proposed location. The proposed location represents the best possible ground -level site for the outdoor units on the Birch Crest property for two reasons: • The air conditioning units are as far as possible from opening windows and as far as possible from the north and east property lines. • The area where the units would be placed does not appear to be used for outdoor activities by residents of the apartment building; the nearest operating door is more than 75 feet to the west; there are no playground toys, barbeques etc. in this area. z = w JU 00 N fQ W W = J � LL w w a =w z � z1 w w n o U o - o �— = • U u. O Z iu : UW 0 z Summary The construction of the 6 foot high barrier achieves two goals: it defines a distinct area within which the noise levels will be higher than the City's nighttime standard of 45 dBA and it reduces those noise levels to below the standard outside of the barrier. Although the second goal is the primary aim of the City's Noise Code, the first goal is also important in that it allows the owner full use of their property. Environalysis recommends that the outdoor portions of the air conditioning units be located approximately as shown in plans dated 5/28/03. A 6 foot high solid wooden barrier with a solid gate will be erected around the units. Clearance between the barrier and the units will be as required by the manufacturer (we assume 3 feet will be adequate). The owner should be consulted regarding the clearance required between noise barrier and the large metal door at the northeast end of the building. The City may require modifications for aesthetic reasons. The intent of the study was to predict.noise emissions from the equipment associated with operation of the proposed Nextel site. The predicted sound levels were evaluated for compliance with state and ,local noise codes. An analysis of applicable noise codes and ordinances is contained in this study.. Noise on this site is governed by the City of Tukwila Municipal Code. NOMENCLATURE Noise is generally considered unwanted sound. The noise level is characterized by the magnitude of pressure intensity fluctuations. Decibel (dB) levels are a form of shorthand. ,that, characterize, with a convenient numerical scale, the auditory response to the broad range of perceptible pressure intensities. The decibel scale is logarithmic: a doubling or halving of energy causes the sound level to change by 3 dB; it does not double or halve the original level. The minimum sound level variation perceptible to a human observer is approximately 3 decibels; a 5 decibel change is clearly perceptible and an 8 to 10 decibel change is associated with a perceived doubling or halving of loudness. The human ear has a unique response to sound pressure fluctuations. It is less sensitive to higher and lower frequencies - those sounds falling outside the speech frequency range. Sound level meters and monitors utilize a weighting system to approximate human perception of sound. Calculations made' utilizing this weighting system are referred to as "A weighted" and are called "dBA ". Most applicable regulatory criteria are written using the A weighting; therefore, all sound levels presented are A weighted. The "A" may be dropped from the decibel notation for convenience, as they have been in this report. METRICS Responses to noise are subjective and unique to each listener. Metrics have been developed to provide more convenient descriptors of sounds that vary with time and with human responses to noise. The following metrics have been adopted by the City of Tukwila Administrative Code to describe noise emissions and their limitations. Equivalent Sound Level; L L is the level of a constant sound having the same energy content as the actual time - varying level during a specified interval. The L is used to characterize complex, fluctuating sound levels with a single number. Percent Sound Level, L„ The A- weighted sound level exceeded n% of time. The L90 descriptor, or sound _ level exceeded 90% of the time, typically referred to as a background noise level. REGULATORY CRITERIA The City of Tukwila Municipal Code governs site noise level restrictions at the proposed site. Section 8.22.040 of the Tukwila Municipal Code regulates the noise levels produced by the proposed project and received by surrounding property. The proposed Nextel Foster/ Birch Crest site is located in a residentially zoned district. The site is abutted by residentially zoned properties on the north, south and east sides and a commercially zoned property on the west side. Nextel equipment is scheduled to be installed inside of the existing building. Two air condensing units are installed outside north of the building. The closest property lines are situated at a distance of 14 feet north and about 15 feet east from the proposed condensing units. The existing building shields the adjacent south property line. There is a nighttime penalty of 10 dB imposed on the noise level between the hours of 10 PM and 7 AM (10 PM and 9 AM on the weekends), thereby reducing the maximum allowable level at the property line to 45 dBA. Our acoustical analysis is based on information submitted to our office by Nextel and KDC Architects. Copies of the Nextel site plan are included with this letter for reference. Two air condensing units model PU36EK manufactured by Mitsubishi Electric are installed on a concrete slab north of the building. Only one condensing unit is operating at a time, the second one is a stand by unit. The manufacturer's sound data, in terms of sound pressure levels as measured at reference distances, were used in our acoustical analysis. According to these data the air conditioning unit produces a level of 55 dBA at a distance of 3 feet. The noise levels produced by the mechanical equipment associated with Nextel operation were predicted at the closest property lines. Noise Level Predictions. Since our property abuts the northeast end of the Birchcrest, the noise from the equipment would have a great impact on our property. Our bedroom windows and family room sliding glass door face the Birchcrest so any noise generated would affect our quality of sleep and the use of our family room, particularly during the warmer months of the year. A more suitable location for this noisy equipment would be the western side of the Birchcrest by the Laundromat. We want to be clear that we have no objections to the roof antennas or the equipment cabinet placement; it is only the noise generated by the equipment which causes our objections. We have lived in the house at the East end of the building for about sixteen years now, and have seen a steady decline in the "neighborhood appeal" of the apartments every since Mr. Lee has taking ownership of the property. We have had a continual problem with the dumpsters overflowing and garbage blowing through out the neighborhood and have asked the city (code enforcement and city council) as well as the owner, to install enclosures around them, as I believe new codes require. We received no reasonable response from either. We have also had a problem with tenants throwing trash out of the windows into our yard and garden, some of it being not only disgusting and vial, but also a bio- hazard (dirty diapers, used condoms, crackpipes, ect.). Again we tried talking to the manager and the owner, trying to get screens installed. A very simple and inexpensive solution to a fairly serious problem. We were told that it would be to expensive, and to mind our own business. Again we tried to get help from the city and again we received no reasonable response. Virtually nothing as changed except for the problem, it continues to get worse. The manager has since changed the phone number, and there is no listing for the Birchcrest apartments. The plan that was sent out was somewhat unclear as to what the equipment consists of but shows the lower part of the equipment being installed about fifty feet from our bedroom window. We know nothing about wireless communication equipment but feel like that may be a little to close for comfort. It looks like it would include some type of cooling fans according to the picture. Which means that this equipment is will produce at least a little noise, whether it's fans running or buzzing radio equipment. When we were talking with code enforcement and city council about some of the previous problems, we were told that that property was "grandfathered in" and therefore did not have to meet some of the newer codes. Shouldn't we then be grandfathered in and not have to put up with any additional noise or whatever other potential problems may come with the equipment? We feel that the Nextel equipment being installed is simply another source of income for Mr. Lee at the expense of the community and do not think that the permits should granted. The proposed use will not be materially detrimental to the public welfare or injurious to the property or improvements in the vicinity. As depicted within Nextel's Conditional Use Permit application plans, it is Nextel's intent that the design of its wireless communications facility would have minimal impact to the property and surrounding community. Specifically: The facility would not generate any smoke, light, odors, solid waste, or discharges of any substance to air, soil, surface water or ground water. The proposed facility would not generate any hazardous substances. The proposed facility would have no impact on traffic flow or safety. The facility would be unmanned and is expected to require approximately two (2) vehicle trips per month by maintenance personnel after construction. No physical hazards would be present at the site that would present a danger or nuisance to the surrounding community. Given the facility's appropriate location, no hazards to life or property would occur from its development and operation. Proposed fencing would provide additional security. The facility would be remotely monitored by Nextel for fire, smoke, intrusion and power failure on a 24 hour basis, 7 days a week. Best construction / management practices would be implemented to ensure safety during construction. Project design and facility operations would adhere to all FCC rules regarding radio frequency propagation exposure limits. The proposed wireless communications facility would operate in a frequency range between 806 to 821 and 851 to 866 Megahertz (Mhz). Transmissions would be low power, (average of 100 watts per sector at full activation) with a maximum of four (4) channels per antenna. As such, the transmissions would be below the Federal Communications Commission (FCC) and the American National Standards Institute (ANSI) standard set forth in IEEE /ANSI C95.1 -1992, of 657.3 microwatts per square centimeter (see attached Nextel RF Certification Form). The project would not interfere with surrounding properties or their uses. Specifically, ESMR facilities operate at extremely low power and thus the facility would not be a source of interference with electronic equipment, including radio, television, and telephone transmissions. Interference is governed by the Federal Communications Commission's (FCC) regulation of radio transmissions. The attached manufacture's specifications for the equipment cabinet's HVAC mechanical equipment states that the noise emissions would be limited to 50 dB at 15 feet from the unit which is greater than the distance from the equipment cabinet to the property line. The visual impact of the proposal would not be significant given the screening to be achieved by the penthouse structure proposed to be constructed on the roof of the building, on which Nextel's antennas would be flush mounted, and the landscaping proposed for the ground mounted equipment cabinet. Further, the proposed project would not obstruct views form any residential properties. Best construction / management practices would be implemented as required to ensure no erosion damage would result from the minor site grading required for installation of the equipment cabinet pad. No landslide or other geological hazard areas are associated with the subject property and therefore would not present an issue during construction. As the proposed facility would not be materially detrimental to the public welfare or injurious to property or improvements in the area, no increase in the City's development standards or criteria would be necessary. 2.
