There are three basic steps in the short plat approval process: Steven M. Mullet, Mayor Department of Community Development Steve Lancaster, Director The Short Subdivision Committee has completed review of your short plat application (No. L03- 004), and determined that it complies with all applicable City code requirements. The City's SEPA Responsible Official has previously determined that this application does not require a SEPA threshold determination because it is categorically exempt. This letter serves as the Notice of Decision per TMC 18.104.170. Based on the latest project submittal, preliminary approval is granted subject to the conditions stated below. This letter constitutes your preliminary approval. The application was reviewed by the Tukwila Short Subdivision Committee and approved with conditions. The conditions imposed are to ensure the short plat is consistent with the Criteria for Preliminary Approval listed at TMC 17.12.020 C in the Tukwila Subdivision Code. Provide the following notes on the short plat site development plan: i) To comply with Geotechnical Engineering Evaluations, by Bruce S. MacVeigh, P.E., dated 9/12/02, 9/13/02, 6/3/03 and subsequent geotechnical evaluations and reports. ii) No runoff including downspouts, shall be infiltrated into the ground through "dry wells" or perforated infiltration pipes and trenches. c. You will need to obtain all required permits prior to beginning any construction. For water and sewer permits, contact the individual provider District. For City of Tukwila utilities, contact Tukwila Public Works at (206) 433 -0179. d. Submit a set of recording documents in either legal or record of survey format that meet the King County Recorder's requirements. The survey map must be revised to reflect the changes as shown on the attached redlined map. Also, show the address for lots 1 and 2 on Short Plat L03 -004 Page 2 the mylar for recording (Lot 1 -4724 and Lot 2- 4722). The surveyor's original signature must be on the face of the plat. e. Owner shall provide a draft Sensitive Area Covenant and Hold Harmless Agreement, for review by the City's Public Works department. The approved agreement shall be recorded at King County recorder's office prior to final recording of the short plat. This short plat approval decision is appealable to the Hearing Examiner. In order to appeal the decision a written notice of appeal must be filed with the Department of Community Development within 21 days of the issuance of the Notice of Decision (09/12/2003). The requirements for such appeals are set forth in Tukwila Municipal Code 18.116. If no valid appeals are filed within the time limit the decision of the Department will be final. Appeal materials shall include: 1. The name of the appealing party. • 2. The address and phone number of the appealing party; and if the appealing party is a corporation, association or other group, the address and phone number of a contact person authorized to receive notices on the appealing party's behalf. 3. A statement identifying the decision being appealed and the alleged errors in the decision. The Notice of Appeal shall state specific errors of fact or errors in application of the law in the decision being appealed; the harm suffered or anticipated by the appellant, and the relief sought. The scope of an appeal shall be limited to matters or issues raised in the Notice of Appeal. Any appeal shall be conducted as an open record hearing before the Hearing Examiner. The Hearing Examiner's decision on the appeal is the City's final decision. A party who is not satisfied with the outcome of the administrative appeal process may file an appeal in King County Superior Court from the Hearing Examiner's decision pursuant to the procedures and time limitations set forth in RCW ch. 36.70C. 2. Final Approval The next steps for you are Short Plat L03 -004 APPEALS a) Apply for the Public Works permit approval to construct infrastructure. Civil site plans shall be designed per City of Tukwila standards, details and specifications. An Page 3 Expiration 3. Recording Short Plat L03 -004 infrastructure design and construction standard manual is available at the Public Works Department. b) Provide a draft copy of the ingress, egress & utilities easement document for review by the City's Public Works department. After the document is approved it must be recorded at the King County Recorder's office prior to the recording of the short plat. c) Provide a draft copy of the Sensitive Area Covenant and Hold Harmless agreement, for review by the City's Public Works department. After the document is approved it must be recorded at King County Recorder's office prior to the recording of the short plat. d) Submit the necessary short plat documents (survey, legal descriptions, and other required paper work) with revisions made as shown on the redlined plat drawing. The documents must meet the King County Recorder's requirements. L -!- - O W Z co ~ The final approved short plat must be filed with the King County Department of Records by August . z 22, 2004, one year from the date of this preliminary approval or the application will expire. The City may grant a single one -year extension if requested in writing prior to the expiration date. All taxes and fees assessed against the property must be current prior to final approval. Please check with the King County Assessor's Office and the City of Tukwila Finance Department prior to submitting final mylars. The signature of the Chairman of the Short Subdivision Committee certifies that your short plat application is ready for recording. It is your responsibility to record the City approved short plat documents with the King County Department of Records. You will need to pay the recording fees and submit your approved original short plat to King County, see the Recording Procedures handout. The short plat is not complete until the recording occurs and copies of the recorded documents are provided to the Department of Community Development. Page 4 Sincerely, After recording, the County returns the recorded original to the City of Tukwila within 4 -6 weeks, at which time your short plat is considered complete. You can shorten this processing time by hand - delivering a copy of the recorded short plat to the project planner. In many circumstances, building permits on the short platted property may not be issued until a copy of the recorded short plat (or original) is returned to the Department of Community Development. Soils Discussion: From miscellaneous Guts on the site for terracing and along the lower bank it appears that the soils are the fairly typical sandy clayey loam common in the upper elevations and hillsides in Tukwila, These soils have from low to moderate permeability and typically do not allow significant flows of groundwater. These soils have typically low erosion potential in an undisturbed state, and from low to moderate in a moderately compacted or weathered. These soils have good bearing capacity in the undisturbed state. They cannot be recompacted for structural bearing in foundation areas, and significant trench backfills under foundations must use mechanically compacted pit run or suitable equivalent in these areas. Conclusions and Recommendations: The soils on site are acceptable for common footing and stem wall foundations, Footing should be a minimum of 18" below finished outside grade. Soils in an undisturbed state will have a safe working soil bearing pressure for footings of 2,000 psf. Due to the poor drainage characteristics of the soils, a positive footing drain is required around the entire building perimeter. Runoff from the roof should be collected and directed away from the location of the foundation. The finished grade around the building should positively slope away from the building for a distance of 5 feet or more, and the yard should be contoured to lead any uphill runoff running in the direction of the building around it to the lower yard, There should be no "low spots" in the finished yard contour to trap runoff during wet weather. The site has an existing single family residence and driveway. The residence will be removed and a new residence constructed. The existing driveway will be largely abandoned, with only the first 35 feet into the property retained and upgraded to allow turning into the new driveway. Attached is a surveyed topographic map of the site, with the new residences for Lots 1 and 2, and driveway configuration sketched in. Some supplemental topography relating to the bank beyond the property line has been added based on information from today's visit. Discusion: From miscellaneous cuts on the site for terracing and along the bank itself it appears that the soils are the fairly typical sandy clayey loam common in the upper elevations and hillsides in Tukwila. These soils have from low to moderate permeability and typically do not allow significant flows of groundwater. These soils have typically low erosion potential in an undisturbed state, and from low to moderate in a moderately compacted or weathered state. These characteristics are noted from personal observation. No evidence of spring activity or areas of existing concentrated surface runoff were noted, although minor springs would not be active during summer months. The bank appears to have not been disturbed since its initial construction and is presently vegetated with natural vegetation and brush. The bank is noted in sensitive mapping of the area used for screening by the City of Tukwila staff, and as such has been identified as a potential Sensitive Area. Field measurements indicate the bank to be typically eight feet high and fourteen feet wide, with level ground above and below it. It was produced probably 30 to 50 years ago to provide a level parking area for the house on the site, and to produce usable Ievel land below the site, to the east. The bank was probably produced by equal heights of cut at the bottom and fill at the top. The typical slope is 57 percent (1.75:1), greater than 40 percent, which per TMC 18.45 rates as a Class 3 Potential Geotechnical Instability slope. As noted above, the height of the bank is only eight feet. The proposed driveway will follow the existing driveway routing to the site and then will turn west into the new garage upon entering the site. As such, the proposed driveway will have a lesser loading on the bank area, although as noted above, the previous long term use had no apparent adverse effect on the bank. The new house will be located in the eastern portion of the site, roughly 14 feet from the top of bank and 24 feet from the toe of the bank, giving a toe of bank to foundation slope of flatter than the 2:1 recommended for the 8 foot high slope. The existing house is approximately 60 feet from the bank. Runoff from the new house and reconstructed driveway will be collected and piped to S. 164th Street, whereas current runoff is uncontrolled. Conclusions and Recommendations: The proposed new driveway will impose less load on the bank than the present one. The existing house at 60 feet from the bank imposes no Ioad on the bank. The new house at 80 feet from the bank will also impose no load on the bank. The existing house has uncontrolled runoff, The new house will have house and driveway runoff collected and piped to S. 164th Street. As such, surface and groundwater potentially affecting the bank is reduced, In order to produce a nominal 2;1 maximum load prism within the bank, as a matter general practice recommended by this office for existing stable slopes with no groundwater problems, a two foot (2') top of slope set back is recommended. It is recommended that the vegetation on the slope of the bank not be disturbed. It is recommended that the brush, weeds and blackberries above the top of bank, if removed for landscaping, be re- vegetated with minimum delay, and that interim surface protection ,measures may be used if re- vegetation is deferred. This would be in accordance with usual residential clearing practice. A filter fence is recommended at top of bank during disturbance. Due to the bank being only eight feet high and stable, and the new construction on the site being 24 feet from the toe of bank, any requirement for additional geotechnical evaluation for this site and for this bank is not warranted. From miscellaneous cuts on the site for terracing and along the lower bank it appears that the soils are the fairly typical sandy clayey loam common in the upper elevations and hillsides in Tukwila. These soils have from low to moderate permeability and typically do not allow significant flows of groundwater. These soils have typically low erosion potential in an undisturbed state, and from low to moderate in a moderately compacted or weathered. These soils have good bearing capacity in the undisturbed state. They cannot be recompacted for structural bearing in foundation areas, and significant trench backfills under foundations must use mechanically compacted pit run or suitable equivalent in these areas. Conclusions and Recommendations: The soils on site are acceptable for common footing and stem wall foundations. Footing should be a minimum of 18" below finished outside grade. Soils in an undisturbed state will have a safe working soil bearing pressure for footings of 2,000 psf. W w • .Z: W U =. O Z PROJECT OVERVIEW This project proposed to create two lots from an existing lot at 4724 South 164 Street. The tax number for the existing lot is 5379800472 (Figure 1). The existing lot slopes from west to east with a driveway along the east property line and a short rockery (2 -3 feet high) along the west side of the driveway. Slopes range from nearly flat on the driveway to around 25% for short slopes along the west side of the property (Figure 2). The lot has an existing house and shed on it. Both the house and the shed will be removed. The rest of the lot is a mixture of landscaped and unmaintained areas. The eastern portion of the lot above the rockery is mostly lawn while the western portion of the lot is mostly blackberries, which have recently been cut to ground level. There are several large pine trees along the north property line and above rockery. There is a large cedar tree near the southwest corner of the property. The eastern 35 feet is an existing driveway with a slope from the eastern edge of the driveway to the east property line. This slope is mainly covered with blackberries and other weeds. The width of the driveway appears to taper from about 21 feet wide at the middle of the lot to about 10 feet wide at the north property line. The northeast comer of the driveway was covered with blackberries and, according to the topography survey, slopes down so it was not considered impervious surface. However, the sewer line extends under this area and the area was likely used as an access road for the installation of the sewer line. Therefore, the existing impervious area may be higher than that stated below in the Flow Control and Water Quality Analysis and Design section. The soils in this area have been mapped as Qt (Vashon till) with sections of Qyg (younger gravel) (Figure 3). There was nothing identified in this investigation to contradict that mapping. Two soil logs with dug on the site to document subsurface conditions. Soil log 1 was approximately 15 feet south and 35 feet east of the northwest corner of the property. Soil log 2 was approximately 18 feet south and 75 feet east of the northwest property corner. The soil profile in both holes was very similar and described as follows: 0 - 12" brown silty sand or sandy silt with many roots and a few small rocks. 12.- 36" light brown silty sand or sandy silt with layers of clay and significant mottling below 24 inches. Runoff from the driveway either flows south to South 164 Street or over the edge of the driveway onto the adjoining properties depending on the condition of the driveway. In the developed condition, runoff from the driveway will be directed to the south into the drainage system along the north side of South 164 Street. The drainage system along the north side of South 164 Street is a mixture of enclosed pipe and open ditch between this site and 51" Avenue South. At 51h` Avenue South, the drainage system is an enclosed pipe that crosses south under South 164 Street then east under 51" Avenue South. The system then continues east in South 164 Street to the east end of the public right -of -way. From this point, a 12 inch concrete pipe leaves the right -of -way pointing directly at a house. A 12 inch pipe enters the drainage system below this house on 53 Place South While it was not confirmed that the 12 inch pipe leaving the South 164 Street right -of -way is the same as the one entering the 53' Place South right -of -way, there were no other pipes found entering the downstream drainage system that could be connected to the drainage system in South 164 Street. From 53' Place South, the drainage system goes north to Slade Way then east to 54 Avenue South where the drainage system leaves the public right -of -way again and flows towards Interstate 5 (Figure 4). The point at which the drainage system leaves the 54 Avenue South right -of -way is a little over four tenths of a mile downstream. The drainage system is entirely within the public right -of -way except for the section between South 164 Street and 53' Place South. Although it was sunny and dry during the downstream investigation with no rain for several days prior to the investigation, there was sign of erosion of the ditch sections or overflow of the enclosed sections for that portion of the drainage system in the public right -of -way. No flow from upstream properties enters this property because the private access road along the west property line has an asphalt berm along its east edge. Per Exemption #1 to Core Requirement #3 of the 1998 King County Surface Water Design Manual (Manual), no flow control facility will be required for this project (Figure 6). Although no flow control measures are required for this project, it is recommended that flow control best management practices, specifically perforated tightline connections as described in Appendix C, Section C2.5 of the Manual, be incorporated into the construction of the houses on the completed short plat. This project will create approximately 1117 square feet of new pollution generating impervious surface (Figure 5). EROSION AND SEDIMENTATION CONTROL ANALYSIS AND DESIGN The Temporary Erosion and Sedimentation Control (TESC) plan for this project can be summarized by not clearing 9utside the approved clearing limits and installing sedimentation control measures on the driveway between the south property line and the catch basin in South 164 Street. Such sedimentation control measures could include, but not be limited to, filter fabric placed in the inlet of the catch basin, constructing the driveway during a dry period, and hay bales or check dams in the conveyance path along the driveway. This person shall have full authority to make decisions, both managerially and financially, concerning the temporary erosion and sedimentation control measures on this site. 2) No clearing shall take place outside of the approximate clearing limits shown on this plan unless approved by the City of Tukwila prior to clearing beyond said limits (Figure 8). 3) All TESC measures shall be in accordance with he 1998 King County Surface Water Design Manual unless otherwise approved by the City of Tukwila. 4) The implementation of this TESC plan and the construction, maintenance, replacement, and upgrading of the TESC facilities is the responsibility of the applicant/TESC supervisor until all construction is approved. 5) The TESC facilities shown on this plan must be constructed prior to or in conjunction with all clearing and grading so as to ensure that the transport of sediment to surface waters, drainage systems, and adjacent properties is minimized. 6) The TESC facilities shown on the attached plan are the minimum requirements for the anticipated site conditions.
