On February 3` 2003, the applicant submitted a short plat application to the City of Tukwila for his property at 13232 37 Avenue South. 2. The property is zoned Low Density Residential and is approximately 14,034 square feet in area. There are two houses on the property, one was constructed in 1926 and the other in 1939. This property was annexed into the City in 1989. N 3. On February 5, 2003 the City deemed the application to be complete for review. 4. City staff met with the applicant on March 20, 2003 to go over issues regarding the short plat. 5. On June 5, 2003, the applicant submitted additional information to the City regarding the short plat application. 6. In a letter dated August 4, 2003, the City sent the applicant a letter requesting additional information. 7. The applicant never submitted the requested information. 8. In a letter dated January 2, 2004, City staff asked the applicant to submit a letter to the City indicating his intent to proceed with the application and to provide the information requested in the August 4, 2003 letter. The applicant never prodded this information. CONCLUSION Based upon all information provided to the City, the proposed short plat does not meet City standards and must be denied. Proposed Lot 2 is landlocked with not access to the public right of way. Due to utility equipment and the design of the road it is impossible for proposed lot two to have access via proposed lot one. To remedy this problem, the applicant proposed to have the access for proposed lot two transverse over a neighboring parcel (Parcel 7340600- 0925). The applicant would have to obtain an easement from this neighboring parcel. The applicant has never provided this easement or any documentation from the adjacent property owner that one can actually be obtained. The new access lane would have to be 20 feet in width and paved. Substantial grading would have to been done in order to accomplish the construction of the new driveway. As part of short plat approval, the City requires that Civil Plans, stamped by a Washington State Engineer be submitted. The City requires a 90 percent submittal of Civil Plans at the time short plat application to ensure that the proposed lots in a short plat can have legal access and be served by utilities. The applicant has never provided . these Civil Plans. APPEALS This Notice of Decision may be appealed to the Hearing Examiner within 14 -days from issuance of this Notice of Decision (05/24/2004). Appeal Materials shall include: 1. The name of the appealing party. 2. The address and phone number of the appealing party, and if the appealing party is a corporation, association or other group, the address and phone number of a contact person authorized to receive notices on the appealing party's behalf. 3. A statement identifying the decision being appealed and the alleged errors in the decision. The Notice of Appeal shall state specific errors of fact or error in application of the law in the decision being appealed; the harm suffered or anticipated by the appellant, and the relief sought. The scope of an appeal shall be limited to matters or issues in the Notice of Appeal. All appeal materials must be submitted to the Department of Community Development no later than 5 PM on June 7, 2004. If no appeal is submitted this Notice of Decision shall be the City's final ac on on this application. Staff comments are as followed: Steven M. Mullet, Mayor Planning 1. Lot one must grant lot two an easement for all utilities on lot one that serve lot two. The waterline is shown on the new plans, but an easement must be recorded with King County and be called out on the short plat. 2. An easement from parcel number 734060 -0925 must be granted for the shared access drive. 3. All easements must be described on sheet one of two of the short plat. 4. The new location of the moved fire hydrant must be shown on the short plat. 5. Please verify that there are not steep slopes on the property. 6. The City file number of L03 -006 needs to be placed on the short plat map. 7. Remove the signature areas for the Department of Planning and Community Development and Public Works Department. 8. A signature area for the "Tukwila Short Subdivision Committee Approval" needs to be added. It should read as follows: "Reviewed and approved by the Short Subdivision Committee and hereby certified for filing this day of . The Land Surveyor's Certificate should read as, "I , registered as a land surveyor by the State of Washington, certify that this plat is based on an actual survey of the land described herein, conducted by me or under my direct supervision; that the distances, courses, and angles are shows thereon correctly; and that monuments other than those monuments approved for setting at a later date, have been set and lot corners stacked on the ground as depicted on the plat." 10. A vicinity map needs to be added to the short plat map. 11. Civil plans for the new paved driveway must be submitted to the City. The plans must include the following: • Civil plans and analyses shall be stamped, signed and dated by a licensed professional engineer. Include a graphic scale and north arrow. • Vertical datum NAVD 1988 and horizontal datum NAD 83/91. • Existing (dashed) and proposed (solid) topography at 2; intervals (minimum 20 feet beyond the property lines). • Total expected cut and fill for construction. • Existing and proposed utility easements and improvements, on site and in street (water, sewer, power, natural gas, telephone, and cable). • Storm drainage design at least 90 percent complete, which meets the KCSWDM. Call out total existing and proposed impervious surface in square feet. Including all storm drainage conveyance systems, water quality features, detention structures, maintenance access and safety features. • Locate the nearest existing hydrant and all proposed hydrants. • Show the location and distance of proposed property lines of all existing structures. 2. The applicant shall apply for a Public Works (PW) type `C' permit for approval. A Street Use permit will be part of this permit and require bonding and issuance for work within the Right -of -Way. Plans shall be signed and stamped by a Washington State Licensed Engineer. 3. The driveway shall not have a grade greater than 15 percent. His brother is an engineer and he was to come up with a plan to show how this joint driveway will work for this short plat. It appears that the fire hyrant will need to be relocated and the drive for the back lot may envolve some fill and /or a retaining wall. We also heard from neighbors that a fill took place a few weeks ago, without a permit and involved burying a shed within this fill.
