PROJECT DESCRIPTION: The project would widen the existing Interurban Avenue South bridge by approximately 16 feet to provide an HOV -only, northbound left-turn lane onto the I -405 southbound ramp. A new pedestrian bridge will also be added over the Green River with approximately 1,900 linear feet of new trail to be added to the Interurban Trail System. 2. POLICIES OF THE SMA/SMP: The site is within the jurisdiction of the Tukwila Shoreline Master Program. The policies of the SMP are categorized into the following elements: A. The Economic Development Element requires that development be economically advantageous to the community, maximize use of the shoreline and consider the visual impact of the development on the surrounding area. B. The Public Access Element requires that the development provide for public access to the shoreline and develop or enhance the trail system. C. The Circulation Element requires that roads and transportation facilities be designed in a way that provides for pedestrian access and recreational activities. D. The Recreational Element requires that recreational opportunities along the river should be preserved and enhanced. E. The Shoreline Use Element requires that uses along the shoreline should be appropriate, protect and enhance the river, be water dependent or compatible with water dependent uses, and allow for multiple uses. F. The Conservation Element requires that the river be buffered from the effects of development, where feasible facilities for intensive recreational activities should be provided, and scenic views should be protected. G. It will not adversely affect economic development, land use, conservation or historical /cultural sites along the shoreline. The changes will improve public access, increase recreation and enhance pedestrian and vehicular circulation. The widened bridge will ease congestion and improve traffic flow by allowing HOVs to bypass the stacked traffic in the existing left hand turn lane. The City will also construct a new pedestrian bridge across the Green River that will provide a connection point for the new trail around the Family Fun Center amusement park, completing a link in the Interurban Trail system. Project related landscaping including log snags at the bridge abutments will protect and enhance the river environment. 3. SHORELINE REGULATIONS: Following are the relevant review criteria as contained in the Shoreline Overlay Zone: The Shoreline Overlay is a district which extends 200 feet landward from the mean high water mark of the Green River, throughout Tukwila. The district is divided into three management environments with specific regulations. River Environment - the first 40 feet landward of the mean high water mark. This is the most restrictive environment and only allows for limited public access, transportation and utility uses and structures. Low Impact Environment - the next 60 feet landward of the River Environment. This environment allows structures up to 35 feet, landscaped and screened parking lots, transportation and utility uses and structures. High Impact Environment - the next 100 feet landward of the Low Impact Environment. This environment allows all uses permitted in the underlying zoning district The uses proposed for the River and Low Impact Environments are landscaping, a public trail, a widened vehicle bridge and a new pedestrian bridge, all of which meet the Shoreline Overlay regulations. The area surrounding the trail extension will be extensively landscaped with native plants. General Shoreline Regulations (18.44.110): (1) The use is in conformance with the regulations of the underlying zone district; There is no underlying zone district for the bridges as they fall within right -of -way to which zoning does not apply. The property along the north bank of the River is zoned Regional Commercial Mixed Use, the property along the south bank is Commercial/Light Industrial. L97 -0048 Shoreline Substantial Development Permit Page 3 (2) The use does not conflict with the goals and policies of the shoreline master program or the provisions of the Shoreline Act and shoreline regulations. No conflicts were identified. See section 2 for a discussion of the policies of Tukwila's Shoreline Master Program. (3) No structures or accessory facilities shall be located over the river unless such structure protects or promotes the public interest. The proposed widening of the Interurban bridge promotes the public interest by reducing automobile congestion at that intersection. The benefit of the pedestrian bridge is the extension and completion of a missing link in the trail system. (4) There shall be no disruption of existing trees or vegetation within the river environment unless necessary for public safety or flood control, or if allowed as a part of an approved shoreline substantial development permit; Bridges are approved structures within the river environment management zone. Disruption of existing vegetation within the environment will be necessary to allow for bridge and trail construction. However construction and maintenance of streets and utilities within City right -of- way is exempt from the requirements of the Tree Ordinance. (5) No effluent shall be discharged into the Green River which exceeds the water quality classification as established by the State for the adjacent portion of the river; (6) All State and federal water quality regulations shall be strictly complied with; The project will require permits from the National Marine Fisheries, U.S. Department of Fish and Wildlife, State Department of Natural Resources and the State Department of Fish and Wildlife. These agencies will enforce their own water quality regulations. (7) Wildlife habitat in and along the river should be protected. The project lies within the Pacific Flyway migration route for various waterfowl. The river is part of a migration route for anadromous fish. The existing wildlife habitat along the riverbank consists of trees, brush, grasses and blackberries and is of generally low value. Some of this vegetation will be removed for the construction of pile supported piers (two piers for the pedestrian bridge and two for the widening of the Interurban bridge). After construction completion rip rap will be placed around the foot of each pier to prevent erosion. The majority of this area is within the High Impact Environment. The disturbed area will be hydroseeded, then planted with shrubs and some trees. The area around the pedestrian bridge and trail will be extensively landscaped with native species. (7) All perimeters of landfills or other land forms susceptible to erosion shall be provided with vegetation, retaining walls or other satisfactory mechanisms for erosion prevention. Best Management Practices (BMPs) will be used to prevent erosion and sedimentation during construction of the project. A temporary erosion and sediment control plan must be approved by the City of Tukwila prior to construction. Upon completion of construction, slopes will be seeded with standard erosion control grasses and protected from erosion until the grasses are established. If necessary additional erosion control measures (e.g. fiber matting) will be included as part of the project. (9) All necessary permits shall be obtained from federal, State, county or municipal agencies. This is the responsibility of the applicant and was accomplished at the time the project was originally proposed. 4. COMPREHENSIVE PLAN SHORELINE POLICIES The policies of the Comprehensive Plan that affect shoreline development are found in the Shoreline Element. Shoreline Element - Development should minimize impacts on important habitat features, protect and restore degraded riverbanks, and mitigate unavoidable disturbance of vegetation and habitat - Development should minimize water pollution, provide erosion control, and protect water quality - Capital improvement projects and private development should not endanger public health, safety, welfare, or the capacity of the river to provide long -term community benefits - Over -water structures or reinforcement of the riverbank allowed only when it provides long -term public benefit or is essential to a water - dependent use - Development should reflect the river's role in Tukwila history, protect the long -term public use of the river, and reflect community traditions z _I- ;i . z rt w JU 0 u, o cn w z J F— U) w • 0 LL Q = • a �.w z t— z w t- w 0 O co O — O I— O W u- w Z — • I 01 z L97 -0048 Shoreline Substantial Development Permit Page 5 - Development should include high - quality site planning, architecture, landscaping, provide for open space, and provide a trail for public access along the river (for areas included in Green River Trail Plan) - Development should maintain views of the water, encourage water enjoyment uses, provide for multiple uses, and encourage efficient use of land The existing habitat along he riverbank is of low value. A portion of this will be removed during construction and will be reseeded (and in some areas landscaped) at completion. Water quality will be protected during project construction through the use of Best Management Practices. The proposed project includes over -water structures which will further the public good by relieving traffic congestion and increasing public access to the shoreline. The project will not endanger public health, safety, welfare or the capacity of the river to provide long -term community benefits. The pedestrian bridge and trail extension will increase the public's access to and enjoyment of the river. 5. SEPA: A determination of non - significance was issued on June 16, 1998. 6. The Interurban Avenue South bridge, pedestrian bridge and associated trail are all located in the Shoreline Overlay zone and are allowable uses in that zone. There is no underlying zone district for the roadway bridge as it is a right -of -way (to which zoning does not extend). The property along the northeast side of the Interurban Avenue South bridge (on north bank of the river) is zoned Regional Commercial /Mixed Use (RCM) and the property along the southeast side of the bridge (on south bank of the river) is zoned Commercial /Light Industrial (C /LI). Public trails are a permitted use in the RCM. There is no underlying zone district for the pedestrian bridge as it is a right -of -way over the river (to which only the Shoreline Overlay zone applies). (2) The use does not conflict with the goals and policies of the Shoreline Master Program or the provisions of the Shoreline Act and shoreline regulations. No conflicts have been identified after reviewing the goals and policies of the Shoreline Master Program, the Shoreline Act, and shoreline regulations. The project is a City of Tukwila capital project and every effort was made to create improvements that meet the goals and policies established to protect and enhance the shoreline for the environment and the public. No structures or accessory facilities shall be located over the river, unless such structure protects or promotes the public interest. The proposed widening of the Interurban Avenue South bridge promotes the public interest by reducing automobile congestion in that segment of roadway and the intersections at both ends. This is accomplished by creating an additional left turn lane to allow the HOV's turning onto the southbound I -405 on -ramp to bypass the general purpose traffic queued in the existing left turn lane. Bridges are approved structures within the river environment's 40 -foot wide management zone (TMC 18.44.130(f)). Disruption of existing trees and vegetation within this environment will be necessary to allow construction activities in connection with the proposal. Additionally, under TMC 18.54.050(2)(f), the construction and maintenance of streets and utilities within City - approved rights -of -way and easements do not require a Tree Clearing Permit and are exempt from the application of that chapter of the TMC if located within the Shoreline zone. No effluents shall be discharged into the Green River which exceeds the water quality classification as established by the State for the adjacent portion of the river. The Green River has a water quality designation of Class A. The project will not discharge effluent into the river. (6) All State and Federal water quality regulations shall be strictly complied with. The project will require permits or approvals from National Marine Fisheries, U.S. Fish and Wildlife, the State Department of Fish and Wildlife, and the State Department of Natural Resources. These agencies will enforce their own water quality regulations. (7) Wildlife habitat in and along the river should be protected. The project lies within the Pacific Flyway migration route for various waterfowl. The river is part of a migration route for anadromous fish. The existing wildlife habitat along the riverbank consists of brush, grasses and blackberries and is of low habitat value. Some of this vegetation will be removed for the construction of pile supported piers (two piers for the pedestrian bridge and four piers for the Interurban Avenue South bridge). None of the proposed piers is within the Ordinary High Water Mark (OHWM). After construction completion, riprap will be placed around the foot of each pier to prevent erosion. Any remaining areas disturbed by pier placement will be relatively small in size and will be hydroseeded. The only work occurring at or below the OHWM will be installation of habitat enhancements. Additionally, approximately $ trees will be removed to permit widening of the Interurban Avenue bridge. The majority of this area is within the High Impact Environment with approximately 60 feet within the Low Impact Environment. Initially, this area will be regarded and hydroseeded. The area will then be planted with shrubs (or if possible, trees) to provide visual screening for the proposed development on the adjacent property. The plantings will be the responsibility of the development as part of its permit requirements. The area surrounding the pedestrian trail extension will be extensively landscaped with such plants as Raywood Ash, Douglas Fir, Western Red Cedar, California Wax Myrtle, Smooth Sumac, White Rockrose, Oregon Grape, and Boston Ivy. 2 01/24/2003 . (8) All perimeters of landfills or other land forms susceptible to erosion shall be provided with vegetation, retaining walls, or other satisfactory mechanisms for erosion prevention. Best Management Practices (BMP's) will be used to prevent erosion and sedimentation during construction of the project. A temporary erosion and sediment control plan must be approved by the City of Tukwila prior to construction. Upon completion of construction, slopes will be seeded with standard erosion control grasses and protected from erosion until the grasses are established. If necessary, additional erosion control measures (e.g. fiber matting) will be included as part of the project. (9) All necessary permits shall be obtained from Federal, State, County or Municipal agencies. This is the responsibility of the applicant. All necessary permits have been obtained as this project was advertised once previously. A previous Shoreline Permit was obtained from the City of Tukwila for this project, but has since expired. (10) Dredging for purposes other than for navigational improvements or flood control is prohibited. No dredging is proposed as part of this project. (11) Mining is prohibited along the river shoreline. No mining is proposed as part of this project. (12) Solid waste disposal is prohibited along the river shoreline. No solid waste disposal is proposed as part of this project. (13) No property will be acquired for public use without dedication by or just compensation to the owner. The property acquisition procedures used on this project have been certified by State and Federal agencies, which includes just compensation to the owner for any property obtained. (14) Landfilling is prohibited within the river channel unless such landfill is determined by the Planning Commission to protect or promote the public interest. No landfilling within the river channel is proposed as part of this project. 3 01/24/2003 (15) Notwithstanding any provisions of this Code to the contrary, removal of any cottonwood tree within the river environment or the low impact environment, which tree is 12 inches or greater in diameter as measured 4.5 feet above the grade, shall be subject to the requirements of TMC Chapter 18.54, Tree Regulations. Under TMC 18.54.050(2)(f) the construction and maintenance of streets and utilities within City - approved rights -of -way and easements do not require a Tree Clearing Permit and are exempt from the application of that chapter of the TMC if located within the Shoreline zone.
