I. PROJECT INFORMATION Project File Number: L03 -009 Applicant: John A. Kurtti Type of Permit Applied for: Special permission approval for use of a Cargo Container Project Description: A single cargo container located in the back yard of a residence. Location: 12615 37 Ave S, Tukwila Designation /Zoning LDR IL DECISION SEPA Determination: The City SEPA Responsible Official has previously determined that this application does not require a SEPA threshold determination because it is categorically exempt. Decision on Substantive Permit: The Community Development Director has determined that the application for a single cargo container complies with applicable City and state code requirements and has approved that application subject to any conditions which are set forth in the Decision based on the findings and conclusions contained in the staff report. The following conditions must be maintained: • The container may not be moved from its current location on the site. • The existing screening must be maintained. III. YOUR APPEAL RIGHTS The Decision on this Permit Application is a Type 2 decision pursuant to Tukwila Municipal Code § 18.104.010. Other land use applications related to this project may still be pending. PROCEDURES AND TIME FOR APPEALING In order to appeal the Community Development Director's decision on the Permit Application, a written notice of appeal must be filed with the Department of Community Development within 14 days of the Z issuance of this Decision that is by March 11, 2003. z H _ Z '� Lu The requirements for such appeals are set forth in Tukwila Municipal Code 18.116. The yard is fully enclosed with a fence. Mullet, Mayor Decision Criteria TMC 18.70.130 (ord 1989) allows cargo containers installed in LDR zones as accessory structures so long as they meet the following criteria: 1. Only one container is allowed. 2. The container is sufficiently screened 3. If located next to a building, the container must be painted to match the building's color. 4. Container does not occupy any required off - street parking. 5. Container must meet the setback requirements for LDR CONCLUSIONS The existing cargo container will remain in the present location; all screening is to be maintained.
