The following is a request for an extension on the City of Tukwila Short Plat for Mr. Tien Le. Conditions were issued in a letter dated 6 February, 2004 which described in detail the requirements necessary for recording the subdivision mentioned above. During this period of time the owner has fulfilled all obligations mentioned and we feel that the project is very close to recording. The final drawings are currently under City review and we hope to have things wrapped up before the end of this month. Based upon the City's review your short plat submittal, short plat preliminary approval is granted subject to the conditions stated below. There are three basic steps in the approval process: Preliminary Approval, Final Approval and Recording. These three steps and their requirements are described as follows. I. Preliminary Approval of Short Plat This letter constitutes your preliminary approval. The application was reviewed by the Tukwila Short Subdivision Committee and approved with conditions. The conditions imposed are to ensure that the short plat is consistent with the City's policies and regulations. A. PRELIMINARY APPROVAL CONDITIONS 1. General Steven M. Mullet, Mayor a. The surveyor's original signature must be on the face of the short plat and must have adequate margins meeting King County recording requirements. b. The proposed short plat references certain easements. The easement documents must be submitted prior to final plat approval. They will be recorded at the time the time the short plat is recorded. d. Contact Public Works for submittal and design requirements. b. Pursuant to Chapter 11.28 of the Tukwila Municipal Code, all utilities shall be placed underground. c. Extension of the sewer and water lines to the lots shall be approved by the appropriate utility. As built - plants shall be provided to the Public Works Department. Access f a. A 20 -foot wide, except for the area around the house, access road with an all weather surface built to Public Works and Fire Department standards must be provided to any new structures. A fire turnaround will be required, since the access road exceeds 150' b. Prior to final approval, the applicant shall provide a copy of the maintenance agreement for the Private Access and Utility Easement. This agreement shall stipulate that the owners of individual lots are collectively responsible for maintenance of the 2 access road. The agreement shall be recorded prior to final short plat approval, and a reference to its recording number shall be made on the face of the final short plat. c. The following notes shall be shown on the face of the final short plat: "The City of Tukwila has no responsibility to build, improve, Z¢ maintain or otherwise serve the private road(s) within or providing access to the property described in this short plat ". w 2 J U Fire Protection o o a. If no valid appeals are z o filed within the time limit the decision of the Department will be final. W w In order to appeal the decision a written notice of appeal must be filed with the Department of p N. Community Development within 21 days of the issuance of the Notice of Decision (February 27, ° u_ 2004). v II. Final Approval w Z The next step is to submit the necessary short plat documents in compliance with the conditions U of approval. After the documents have been found to be in order and all requirements of the F.: 1- short plat have been met, the Chairman of the Short Subdivision Committee signs your short plat final mylar which constitutes a grant of final approval. In addition, all inspections relating to public works improvements must be completed by the time of final approval. III. Recording It is your responsibility to record the City approved short plat documents with the King County Department of Records. The short plat is not complete until the recording occurs and copies of the recorded documents are provided to the Department of Community Development. After recording, the County returns the recorded originals to the City within four to six weeks at which time your short plat is considered complete and you can obtain individual building permits for each lot. You can shorten this process by hand delivering a copy of the recorded short plat to the Department. 3 Expiration The final short plat must be filed with the King County Department of Records by February 5, 2005, exactly twelve months from the date of this preliminary approval or the application will expire. Please keep this date in mind in the coming months. The City is in no way obligated to remind you of the expiration date. The City may grant one extension of not more than twelve months. The request for an extension must be made in writing and must be submitted to the City prior to expiration of the short plat. If short plat approval expires and subsequent development permits that are related to the short plat shall also expire. After careful consideration, I am unable to grant your request. , South 148 Street is substandard and at some point in the future, the City will be required to make an improvement. 'The improvement will necessitate a right -of -way width of 60- feet in order to accommodate curb, gutters, sidewalks, and a widening of the travel lanes. In the past, the City has required the dedication of right -of -way in similar situations and it would be unfair and inconsistent to waive the requirement in your case. Therefore, I feel that it is not in the best interests of the City to waive the dedication requirement. Should you have any questions, please call me at your convenience. The Public Works Department has conformed that the dedication will be required as part of the proposed short plat. Enclosed you will find a memo from David H. McPherson with the City's Public Works Department stating the need for the dedication. You will also find a copy of section 11.12 of the Tukwila Municipal Code, which provides the code basis for the City to ask for the dedication. As it currently stands the existing property does not have sufficient square footage for three lots. You have two options regarding your proposed short plat: 1. Provide a new plat map that shows two lots being created not three. 2. Obtain addition square footage from adjacent property owners giving you sufficient square footage for a three lot short plat. 3. Request that the City proceed with reviewing the three lot short plat. As has been noted, the property in question has insufficient space for a three lot short plat. If you wish to proceed with this option, the Short Plat Review Committee will deny your application, you can then file an appeal that will be heard by the City's Hearing Examiner. Before proceeding with option three, I would recommend that you write a letter to Jim Morrow, Public Works Director, asking for a reduction in the right of way dedication. Mullet, Mayor Department of Community Development Steve Lancaster, Director RE: Short Plat L03 -014 Dear Mr. Tien Le: Upon review of the revised short plat map that was provided to the City, the City has determined that the proposed short plat does not meet the intent of City code. 1. Per City code, Lot one cannot include the easement areas as part of the total lot area. When the easement areas are removed, lot one has an area of 5,978 square feet. The minimum lot area in the Low Density Residential zone is 6,500 square feet. Thus, the proposed lot one is too small (TMC 18.06.505, 18.10.060). 2. Lot two only has a build able area of 3,453 square feet. Lot two should have a north property line that is straight and perpendicular to the east and west property lines. The small flagging of the lot that is proposed is being done to give lot two a lot area of 6,500 square feet. When the north property line is drawn straight, lot two does not meet minimum lot size for the Low - Density Residential district (TMC 17.20.F.2, 18.10.060). Staff has looked at ways of drawing the lots so that they meet the intent of the City Code. Yet, staff was unable to find a method that would allow all three lots to remain. Staff has concluded that a three lot short plat is not feasible for this property and that the number lots must be reduced by one. There is an existing house that will remain on lot 1. The 2 new lots will gain access from a private joint -use access tract and easement along .the west property line. This access easement will connect to S. 148 St. The access easement will be 313 ft. in length as measured from the centerline of S. 148 St. It will be designed to act as a "hammer head" Fire Dept. turn- around with 90 degree extensions into Lot 1 and Lot 2. The width of the pavement will be 19 ft., within a 20 ft. wide easement. All of the new lots will have a sewer connection to the existing sewer main in S. 148 St. The existing lot is generally covered with sporadic trees, grass and shrubs. The existing house has a direct driveway onto S. 148 St., which will be removed and replaced by the new private access joint driveway. The site slopes down to the northeast and to the southeast. The steepest slope on the site is approx. 8 %, except for a low bank near the southwest corner. The lot is highest in the center, sloping away to the north and south. There is an existing drainage pipe along the south shoulder of S. 148 St. This pipe is approx. 2.0 ft. deep and has a catch basin near the northwest property corner. There will be a new catch basin at the south end and at the north end of the private access joint driveway. The catch basins will collect all of the runoff from the new joint driveway and houses and pipe it to the public drainage system in the road. The existing drainage appears to sheet flow towards the existing residential lot to the east/southeast and to the road. DRAINAGE ASSESSMENT �, t Oj✓/4 in �3 d iry z. This site will be subject to the 1998 King County Drainage Manual as adopted by the City of Tukwila. Several pages from that manual are referenced and reproduced in this report. The drainage manual defines several levels of drainage review. This site qualifies for a Small Site Drainage Review. The thresholds that determine this level of drainage review includes the following: (These criteria are shown on page 1 -9 of the drainage manual). • The new impervious surface that is produced as a result of this project is limited to between 2000 SF and 10000 SF. • The site must be a single family residential project. • The project clears less than 2 acres or 35% of the site area , whichever is greater. • Our site meets these three requirements. The proposed new impervious surface that will be produced as a result of this project is 8965 SF as shown on the attached calculation sheet. This includes the removal of a portion of the existing concrete driveway along the west property line and the removal of the garage along the west line. This includes the new paved joint access driveway and Fire Dept. turn -around and an assignment of 2500 SF of house "footprint" and new driveway per lot, for the 2 new lots. By definition (page 1 -4 of the manual), this site is a single family residential project. Short plats and plats fall within this definition. Finally, the site will clear less than 2 acres, since the entire site is only 0.51 acres. (2 acres governs since it is greater than 35% of the parcel area). Counting the new access road and the new houses, the percentage of impervious coverage will be ill be 46.2% of the entire site. The manual requirements for small site drainage review has several options that are to be evaluated in a preferred order. The preferred option is infiltration for roof downspout drains and driveways. A couple of the requirements for the use of infiltration is that the soils must be medium or coarse sands. The soils in this area are mapped as an Alderwood series soil. Essentially, the soils are too fine to qualify for total site infiltration. The soils can be categorized as loamy sand or silt. They are not the medium sands that are recommended in the manual for infiltration applications. Additionally, it is anticipated that there is a high water table in this area, generally due to a restrictive layer of dense soils that are relatively shallow. In the event that infiltration is not available, the drainage manual allows for other alternatives. If the lots are over 22000 SF, then splash blocks or dispersal trenches are an option. The splash blocks require a minimum discharge travel length of 50 ft. before reaching a property line. The size of these lots do not allow for this option. Another option is a perforated tightline drainage connection. This requires the availability of a direct connection to the drainage system within the street or other approved drainage system. This option is available to this site due to the proposed drainage system and the existing public drainage system along the frontage road. As such, the engineering plans .show the detail and notes for the perforated tightline connection. Several pages from that manual are referenced and reproduced in this report. The drainage manual defines several levels of drainage review. This site qualifies z for a Small Site Drainage Review. The thresholds that determine this level of drainage := z review includes the following: (These criteria are shown on page 1 -9 of the drainage W manual). 6 0 • The new impervious surface that is produced as a result of this project is u) w limited to between 2000 SF and 10000 SF. The proposed new impervious surface that will I H w be produced as a result of this project is 8965 SF as shown on the attached calculation z i_ sheet. This includes the removal of a portion of the existing concrete driveway along the 1--. o west property line and the removal of the garage along the west line. This includes the new paved joint access driveway and Fire Dept. turn- around and an assignment of 2500 D a SF of house "footprint" and new driveway per lot, for the 2 new lots. By definition (page O F 1 -4 of the manual), this site is a single family residential project. Short plats and plats w '— fall within this definition. Finally, the site will clear less than 2 acres, since the entire site F =.. v is only 0.51 acres. (2 acres governs since it is greater than 35% of the parcel area). u- p Counting the new access road and the new houses, the percentage of impervious coverage iu z co will be ill be 46.2% of the entire site. o O The manual requirements for small site drainage review has several options that are to be evaluated in a preferred order. The preferred option is infiltration for roof downspout drains and driveways. A couple of the requirements for the use of infiltration is that the soils must be medium or coarse sands. The soils in this area are mapped as an Alderwood series soil. Essentially, the soils are too fine to qualify for total site infiltration. The soils can be categorized as loamy sand or silt. They are not the medium sands that are recommended in the manual for infiltration applications. Additionally, it is anticipated that there is a high water table in this area generally due to a restrictive layer of dense soils that are relatively shallow. In the event that infiltration is not available, the drainage manual allows for other alternatives. If the lots are over 22000 SF, then splash blocks or dispersal trenches are an option. The splash blocks require a minimum discharge travel length of 50 ft. before reaching a property line. The size of these lots do not allow for this option. Another option is a perforated tightline drainage connection. This requires the availability of a direct connection to the drainage system within the street or other approved drainage system. This option is available to this site due to the proposed drainage system and the existing public drainage system along the frontage road. As such, the engineering plans show the detail and notes for the perforated tightline connection. This connection z includes a 10 ft. long by 2 ft. wide rock - filled trench with an outlet piped connection f , 1 2 433 the street drainage system. Containsor is adjacent to a floodplain, stream, lake, wetland, or closed depression, or another sensitive area as defined by the Sensitive Areas Ordinance (codified in KCC 21A.24), excluding seismic, coal mining, and volcanic hazard areas, OR 4. Single family residential and small subdivision projects may address the SWDM flow control, water quality, and erosion control requirements by using the Best Management Practices (BMPs) outlined in this appendix IF the project: 1. Adds no more than 10,000 square feet of total impervious surface to a threshold discharge area, AND 2. Clears less than 2 acres or 35% of the site, whichever is greater. (Note: An open space tract or easement may be required to protect uncleared areas. Some areas of King County have more stringent clearing limitations.) Many projects that qualify for Small Site Drainage Review can completely meet drainage requirements using the BMPs outlined in this Appendix. Other small site projects may require use of a combination of these BMPs and professional engineering design. Targeted Drainage Review is required when drainage conditions are more complex and require evaluation by a professional engineer registered in the State of Washington.
