This letter serves as a Notice of Decision and is issued pursuant to TMC 18.104.170. On September 12
2003, the Planning Director approved a SHORELINE MANAGEMENT Shoreline Substantial Development Permit at 6414 S. 143
Street, Tukwila, Washington. The permit is for a paved circulation area approximately 20,000 square
feet in area.

The 21 -day appeal period begins once Department of Ecology has received the transmittal documents.
This decision can only be appealed to the State Shoreline Hearings Board. For more information

The public notice sign must be removed from the site by the applicant after the appeal period has expired,

On May 27, 2003, the applicant submitted application for a Shoreline Substantial Development Permit.
On June 5, 2003 Planning Staff deemed the application incomplete. The applicant submitted required
information on July 14, 2003. Planning staff deemed the application complete on July 16, 2003. A
Notice of Application was distributed to other agencies, surrounding property owners, and tenants on July
21, 2003. As required by State Law a 30 -day comment period followed the Notice of Application. On
August 21, 2003 the comment period ended and no comments were recieved.
Vicinity /Site Information
Project Description
The applicant requests a Shoreline Substantial Development Permit to pave an area approximately 20,000
square feet in size. When completed the area will be used for circulation by nearby commercial
businesses. None of the proposed work will occur within the river environment of the Green River. A
small portion will be within the low impact environment. Most of the project will be within the high
impact environment.
To meet the screening requirements of TMC 18.44.140 the applicant has proposed to install a slatted
fence. The City code also requires that some type of trailing vegetation be installed. The applicant has
proposed installing Virginia Creeper. This species is a very vigorous climber, known for its autumn
color.
Existing Development
The area that will be paved has previously been disturbed. The surface of the lot consists of large rocks
that are semi - impervious. The area that is to be paved also consists of weeds and grass that have grown
up through the cracks of the rocks. Near the northern border of the property is a small landscaped area.
This landscaped area consists of a number of young, healthy trees. The topography of the property is
somewhat uneven, most likely due to past earth moving activities. The paved area will be above the
grade of the commercial building on the property. This will require the installation of a retaining wall
between the paved area and the building.
A chain link fence with barbed wire separates the property from the Interurban Trail.
Surrounding Land Uses
The predominant land use in the area is light industrial. The Interurban Trail is located between the
northern edge of the project property and the Green River. Access to the property is provided from S
143` Street.
Shoreline Permit Criteria
1. The use is in conformance with the regulations of the underlying district.
The proposed paving will serve commercial buildings that are currently located on the property.
These uses are permitted within the zoning code and the paved area would be accessory to those uses.
2. The use does not conflict with the goals and policies of the Shoreline Master Program or the
provisions of the Shoreline Act and shoreline regulations.

The project meets all the goal and policies of the shoreline master program. No work will be done
within the river environment of the Green River. Public access to the river will not be hindered from
the project. The public will continue to be able to access the river using the Interurban Trail. In
addition, water from this site will now be treated prior to entering the river. The parking area will be
screened from view using a slatted chain link fence and Virginia Creeper. Once the Virginia Creeper
has spread across the entire fence, it will improve the experience of individuals using the trail.
3. No structures or accessory facilities shall be located over the river, unless such structure protects or
promotes the public interest.
The applicant is not proposing any structures or facilities over the river. The project itself will be
outside of the river environment of the Green River.
4. There shall be no disruption of existing trees or vegetation within the river environment, unless
necessary for public safety or flood control, or if allowed as part of an approved Shoreline Substantial
Development Permit.
No work will occur within the river environment.
5. No effluents shall be discharged into the Green River, which exceeds the water quality classification
as established by the State for the adjacent portion of the river.
The applicant is not proposing to discharge any materials into the Green River. The natural
topography of the site directs all surface water towards the Green River. This water is currently
untreated on site. With this project the applicant will install water quality devices (filter). This will
improve the run -off quality from the site.
6. All State and Federal Water quality regulations shall be strictly complied with.
Water on the site currently moves downhill towards the Green River. As a result of this project, the
applicant will install filters with the storm system that is already located on the property. During
construction Best Management Practices will be utilized to minimize any impacts to the Green River.
7. Wildlife habitat in and along the river should be protected.
The paving project will have no impact on the designated river environment. The project area is
already developed and the paving will not destroy habitat area for wildlife. All significant trees on
the property will be retained.
8. All perimeters of landfills or other landforms susceptible to erosion shall be provided with vegetation,
retaining walls or other satisfactory mechanisms for erosion prevention.
During construction BMPs will be in place to prevent any erosion.
9. All Necessary permits shall be obtained from Federal, State, County, or Municipal Agencies.
The applicant has submitted for approval from the City's Public Works Department. A building
permit may be required for the engineered wall between the paved area and the commercial building
on the property.
Other governmental agencies were notified during the 30 -day comment period.

10. Dredging for the purposes other than for navigational improvements or flood control is prohibited.
No dredging is proposed for this project.
11. Mining is prohibited along the river shoreline.
No mining is proposed for this project
12. Solid waste disposal is prohibited along the shoreline.
As part of this project no solid waste will be disposed along the riverbank.
13. No property will be acquired for public use without dedication by or just compensation to the
property owner.
Not applicable
14. Land filling is prohibited within the river channel unless such landfill is determined by the Planning
Commission to protect or promote the public interest.
No land filling within the river channel is proposed.
15. Removal of any cottonwood tree within the river environment or the low impact environment, which
tree is 12 inches or greater in diameter as measured from 4.5 feet above grade, shall be subject to
obtaining a Tree Permit.
The applicant is not proposing to remove any trees.
Conclusion
The proposal meets all goals and policies of the City Shoreline Master Program. Water quality from
the site will be improved with the installation of filters in the storm drains. The installation of the
slatted fence and Virginia Creeper will improve the buffer between the property and the river.
Recommendation
Approve with the following condition:
1) Temporary tree fences shall be installed during construction to protect the trees to the north of the
property in the landscaped area.

As was required by State Law the application was filed with the Department of Ecology on
September 17, 2003. A 21 -day appeal period began when the application was filed with the
Department of Ecology. The 21 -day appeal period ended on October 8, 2003 and the City did
not receive an appeal.
The Shoreline Permit is ready to be picked up at the front counter. The final plans that show the
plantings need to be submitted to the City. You can drop the plans off when you pick up the
Shoreline Permit.

The Department of Community Development received your Conditional use application on May
28, 2003. The project is for site improvements involving the paving of approximately 20,000
square feet of impervious surface. When finished the area will be used for circulation by nearby
commercial activities.
Based on a review of your application for submittal requirements for a Shoreline Substantial
Development Permit, your application was deemed incomplete on June 6, 2003. On July 15,
2003 additional materials were submitted to the City and on July 16, 2003 the application was
deemed to be complete.

Based on conversations with City staff we have addressed the items in your June 5, 2003 "Notice
of Incomplete Application." Our responses to each of the items in your letter are provided
below:
1. The written discussion addressing the project's consistency with shoreline goals does not
provide enough detail. For example, statement number seven notes that wildlife habitat in
and along the river should be protected. Please provide more information on how this will
be accomplished or how the proposed work will no interfere with wildlife habitat.
Response: Based on our conversation, we have added language such as "No trees will
be impacted ", and "No work is proposed in the river ", and "Existing site is
impervious," so that the reader understands that the condition of the site, with the

Enhancement of the existing landscape strip located on the North end of the project will
be realized through the use of drought tolerant plant species as depicted in the
Landscape plan. This strip will also visually screen the site for benefit of the public.

unless necessary for public safety or flood control, or if allowed as a part of an approved
Shoreline Substantial Development permit.

On May 27, 2003 application was submitted to the City for a Shoreline Permit for 6414 143
Street. The project is for site improvements involving the paving of roughly 20,000 square feet
of impervious surface.
After a review of the application material submitted, City staff has determined that key elements
of the submittal requirements are absent and the City requires that this information be submitted
to thoroughly review the project.
1. The written discussion addressing the project's consistency with shoreline goals does not
provide enough detail. For example, statement number seven notes that wildlife habitat in
and along the river should be protected. Please provide more information on how this will
be accomplished or how the proposed work will no interfere with wildlife habitat.
