On July 25, 2003, the City sent you a comment letter regarding the short plat application. The application was subsequently amended to a two lot short plat and on December 15, 2003 the City provided comments regarding the revised application. As of today, the City has not received a re- submittal addressing the City's concerns that were raised in the December 15, 2003 letter. City staff has expired your short plat application. If you wish to proceed with a short plat a new short plat application will have to be submitted to the City. Please note that any vesting under the old application has now been lost. The revisions submitted modify the original six lot short plat to a two lot short plat. Staff has the following comments regarding the short plat application: 1. Since the property contains a class two slope, a geotechnical report needs to be submitted. The geotechnical report for a class two slope needs to include at a minimum a site evaluation review of available information regarding the site and a surface reconnaissance of the site and adjacent areas. Subsurface exploration of site conditions is at the discretion of the geotechnical consultant (TMC 18.45.040 -E). 2. Lot B is not part of the short plat and should not be shown on the short plat map. 3. Please label the new lot created as "Lot A" and the remaining area as "Lot B ". 4. Access for Lot A is not shown. It is my understanding that Lot A and Lot B will share the common driveway that serves the house. The access needs to be shown on the short plat map. Access easements for both properties will need to be provided. 5. Show the proposed house location. on Lot A. 6. The existing house and shed on Lot B needs to be shown on the short plat. Please also show the setback for the house and shed from all property lines. Provide the total development area for Lot B, which should include the house, shed, driveway, and all areas of impervious surface. 7. Why is the five -foot area that was dedicated to the City through a BLA shown on the plat map? This area should be shown as right of way. Informational Item(s) 1. The maximum total footprint of all residential structures located on a lot in the Low Density Residential District shall be limited to 35 percent of the lot area provided: The maximum total footprint is reduced by 0.125 percent for each 100 square feet of lot area in excess of 6,500 square feet and less than 19,000 square feet (TMC 18.10.057). 2. Preliminary short plat approval will not be granted until a 90 percent complete submittal of civil plans has been approved by Public Works. If the house on the new lot is more than 150 feet from the road an approved fire department turnaround will need to be provided and shown on the plans. 3. If the proposed house location is more than 250 feet from the nearest fire hydrant by path of vehicular travel, the home shall be equipped with fire sprinklers. In 1998, the City provided preliminary approval of short plat application L97 -0078. Preliminary approval conditions included detention requirement. That requirement still stands. The pavement in S 148th St is older than 3 years, so you may cut the pavement to install utilities. Pavement mitigation fees will apply if the pavement is cut. B. Having reviewed the record with regards to your shortplat, your four letters of February 25, 2004, and personally visiting the site, the following responses are provided: • Underground Utility Relief— Since S. 148 Street is served entirely by an overhead power line, relief from the requirement to place the existing overhead lines underground is hereby granted. Please note that this relief only applies to the existing overhead lines along S. 148 Street. All utilities within the property boundaries and the power serving the site must be placed underground. • Frontage Development Relief — Denied with the exception of the aforementioned relief associated with placing the existing overhead power lines underground. Your proposed development will have a significant impact upon the neighborhood and frontage improvements will assist in mitigating these impacts. • Relief from curb, gutters, sidewalk, cul de sac, and planting strip along the access roadway — Denied. The access roadway will create a significant amount of impervious surface. The surface water runoff from this roadway needs to be properly channeled into an integrated system such that it will not adversely impact the houses you intend to build and the existing houses of the neighbors. BACKGROUND There have been several short plat applications for this site with various configurations. The current proposal consists of two options. Both options show the residential access as 20' wide. Option 1 has three access points onto S. 148 St. while Option 2 has one access point onto S. 148" St. This site is on the north side of S. 148" St. There is a 40' of right -of -way and approximately 22' of paved travel surface. The shoulders along S. 148' St. are gravel, except for the section in front of this site, which is a ditch. There is storm drainage along the north side of S. 148 St. to the west of this site. The right -of -way in front of this site slopes downward to the west and then upward to 42n Avenue South. On July 9, 2003, you defined the required frontage improvements along S 148' St. as curb, gutter, and sidewalk. On February 4, 2004, I met with the Planner, Brandon Miles, the Applicant and the engineer, Mark Tierseff. At that meeting, we discussed the TMC requirements, including the frontage improvements, undergrounding, access road and surface water detention. We also discussed the need for a site distance evaluation for the accesses shown in Option 1. DISCUSSION The engineer applied in writing (four letters) for exception to the frontage improvements, the undergrounding requirements, and the requirement that the access road have 50' right -of -way width and 28' feet of paving width. Tukwila's development guidelines and design and construction standards chapter 4.0.4 state that street improvement frontage be development when submitting for a short plat. We would like relief from this requirement, as the existing infrastructure frontage along S. 148 St. is asphalt edge and ditch at the current time. To mandate that this development produce frontage improvement per the City's standards would make them inconsistent with the existing adjacent street frontage which is unlikely to be changed in the foreseeable future. In addition, we are currently designing a Low Impact Development, as well as providing a level two detention for the site. We are trying to keep the impervious area for this property as low as possible, as we want to infiltrate the site. We feel infiltrating the site will be less imposing upon the existing storm water infrastructure in the City of Tukwila. Currently, the road has an open ditch storm drain system that we would like to impact on as little as possible. In comparison, the 4 -Lot development around the corner on 45 Ave. SE had a similar planning approach; two homes fronting along 45 Ave. SE with a center access road, surfacing the homes in the rear portion of the development. These plans are very preliminary and do not represent the formal re- submittal of the short plat. The applicant would like to get City input before resubmitting. 1) Will frontage improvements be required? If so can we be specific regarding requirements? Is it possible for the applicant to defer the requirement or enter into some agreement with the City regarding future installation? 2) In the original comment letter sent to the applicant we referenced drainage requirements referenced as part of a previously approved short plat. The applicant is wondering what those requirements will be. 3) In one of the submitted conceptual drawings, the applicant shows two new accesses on S 148th Street. This is one existing access, thus the short plat would have three accesses on S. 148 Would this be allowed? The reason they are doing this is to keep the total number of lots accessing the private drive below four so that they don't have to construct the street to public standards. Based upon this review City staff requires that modifications be made to the short plat and additional information submitted. There is no order in how the lots are arranged. Ideally, lots one, two, five and six should be fronting on the private access road. With the current configuration of the short plat these lots could front on South 148 Street or front on the private access drive. A goal of the Comprehensive Plan is to create a focal point within the development. Section 17.20 notes, insofar as practical, side lot lines shall be at right angles to street lines or radial to curved street lines. In keeping with the goals of the Comprehensive Plan staff would like to see the proposed short plat redesigned. Enclosed with this letter you will find a sketch that could work for the property. The key to this sketch is that the private access road becomes the focal point of the development. Lots one, two, five and six will front on the private access drive. This will also improve privacy between houses. Another design option is to have a Fire Department bulb head at the end of the drive. I have enclosed a survey of this same property that shows this type of development. This survey was done for a short application a few years ago. The advantage that the first design has over the second is that less space is used for the private access road. The runoff will then be conveyed to the public storm system along the north side of S. 148 Street. II. CONDITIONS AND REQUIREMENTS SUMMARY The core requirements of the King County Surface Water Design Manual (KCSWDM) have been or will be provided as follows: Core Requirement #1, Discharge at the Natural Location: The site's "drainage pattern currently tends to sheet flow from the northeast to the southwest toward S. 148 Street. Runoff will be routed to a combined detention/wet vault prior to being released to the storm system located along the north side of S. 148 Street. Core Requirement #2, Offsite Analysis: An offsite analysis is provided in Appendix A. Core Requirement #3, Flow Control: Runoff will be conveyed to a combined detention /wet vault located at the southwest corner of the project. Offsite drainage systems were also inspected downstream approximately 1/4 mile(s) from the discharge point of the site. The inspection involved investigation of the ten specific items of a Level 1 Inspection per the King County Surface Water Design Manual, 1998. The inspection yielded the following findings: 1. There were no existing or potential problems observed. 2. The existing drainage system capacity was adequate. There were no existing or potential flooding problems. There were no existing or potential sedimentation, scouring or bank sloughing problems. No significant destruction of aquatic habitat or organisms was noticeable. 6. Qualitative data such as land use, impervious surfaces, topography, and soil types was noted and can be found in Task 4 information. 7. Information was collected on pipes, ditches, and structures. There are three basic steps in the short plat approval process: Preliminary Approval, Final Approval and Recording. These three steps and their requirements are described as follows: 1. Preliminary Approval This letter constitutes your preliminary approval. The application was reviewed by the Tukwila Short Subdivision Committee and approved with conditions. The conditions imposed are to ensure the short plat is consistent with the City's policies and regulations. PRELIMINARY APPROVAL CONDITIONS Utilities a. Detention will be required at the time of application for Lot 2 building permits. Drainage design for Lot 2 shall meet City of Tukwila 'Surface Water Ordinance Requirements. The reason for this requirement is that the site drains to Gilliam Creek, which is beyond capacity and is considered a critical drainage area. The four inch water main which serves the proposed lots has been identified as deficient for future area service. The applicant shall execute a Water Proportional Share Agreement (copy attached). This document will be recorded with the Short Plat. d. For adequate fire protection and safety, water pressure must be at 1000 gallons per minute. Your Certificate of Water Availability, dated November 4, 1997, indicates that only 959 gallons per minute are available to the site. The requirement shown below must be placed on the face of the recorded plat and must be met prior to issuance of any building permits for Lot 2. Prior to the development of Lot 2, the following will be required. The developer shall either install a fire hydrant capable of a 1000 gallon per minute flow OR any future house(s) will be required to provide interior sprinklers, to be approved by the Fire Department. e. The surveyor's original signature must be on the face of the plat and must have adequate margins meeting King County recording requirements. h. Install all required site improvements, including those proposed in the short plat application and those identified above as a conditions of approval. You will need to obtain all required permits prior to beginning any construction. For water and sewer permits, contact the individual provider District. For City of Tukwila utilities, contact Joanna Spencer of Public Works at 433 -0179. The final approved short plat must be filed with the King County Department of Records by July 9, 1998, six months from the date of this preliminary approval or the application will expire. The City may grant one six month extension if requested in writing prior to the expiration date. 2. Final Approval The next step is to submit the necessary short plat documents (survey, plat map, and other required paper work), comply with the conditions of approval and install the required site improvements., Installation of the site improvements may be delayed up to six months beyond final approval when a financial guarantee is provided to ensure installation. After the documents have been found to be in order, and the all of the requirements of the short plat have been met, the Chairman of the Short Subdivision Committee signs your short plat which constitutes a grant of final approval. 3. Recording It is your responsibility to record the City approved short plat documents with the King County Department of Records. The short plat is not complete until the recording occurs and copies of the recorded documents are provided to the Department of Community Development.
