DECISION SEPA Determination: The City SEPA Responsible Official has previously: determined that this application does not require a SEPA threshold determination because it is categorically exempt. Decision on Substantive Permit: The Community Development Department has determined that the application for administrative design review does comply with applicable City and state code requirements and has [approved that application, subject to any conditions which are set forth in the Decision based on the findings and conclusions contained in the staff report. 1. YOUR APPEAL RIGHTS The Decision on this Permit Application is a Type 2 decision pursuant to Tukwila Municipal Code §18.104.010. Other land use applications related to this project may still be pending. One administrative appeal to the Planning Commission of the Decision on the Permit itself is permitted. A party who is not satisfied with the outcome of the administrative appeal process may file an appeal in King County Superior Court from the Planning Commission decision. IV. PROCEDURES AND TIME FOR APPEALING In order to appeal the Community Development Department's decision on the Permit Application, a written notice of appeal must be filed with the Department of Community Development within 14 days of the issuance of this Decision, that is by November 19, 2003. The requirements for such appeals are set forth in Tukwila Municipal Code 18.116. All appeal materials shall be submitted to the Department of Community Development. Appeal materials MUST include: 2. The address and phone number of the appealing party; and if the appealing party is a corporation, association or other group, the address and phone number of a contact person authorized to receive notices on the appealing party's behalf. 3. A statement identifying the decision being appealed and the alleged errors in the decision, including any specific challenge to an MDNS. 4. The Notice of Appeal shall identify (a) the specific errors of fact or errors in application of the law in the decision being appealed; (b) the harm suffered or anticipated by the appellant, and (c) the relief sought. APPEAL HEARINGS PROCESS Any administrative appeal regarding the Permit shall be conducted as an open record hearing before the Planning Commission based on the testimony and documentary evidence presented at the open record hearing. The Planning Commission decision on the appeal is the City's final decision. Any party wishing to challenge the Planning Commission decision on this application mu st file an appeal pursuant to the procedures and time limitations set forth in RCW 36.70C. VI. El Charro occupies a building on the northwest edge of the property and Ace Hardware occupies a building on the south edge of the property. There is nothing proposed for the Ace Hardware building. Most of the property is developed with the two commercial buildings and the associated parking areas. Direct access to the property is provided off of International Boulevard, which is located in the City of Seatac. The property can also be accessed by going through the parking area of the Lewis and Clark Recreation Center. The existing El Charro restaurant was constructed in 1961. The construction class for the building is wood framed and the building quality is average. The existing building is non - conforming for its front and side setbacks. The property is also non - conforming in terms of landscaping, parking, and signage. The addition will require additional parking spaces. To address additional parking needs the applicant will re -stripe the existing parking lot. The property is bordered to the west by International Boulevard, to the north and east by the Lewis and Clark Recreation Center, and to the south by various commercial buildings. The predominant land use in the area is commercial. There is a slight grade on the property that runs west to east. The property sits below the grade of International Boulevard. About 99 percent of the property is composed of impervious surfaces (either buildings or asphalt). There is small planting area located near the main entrance of the restaurant. Background Application for administrative design review was submitted June 4, 2003. On July 10, 2003 it was deemed complete. A Notice of Application was sent to State agencies and adjacent jurisdictions, which might have had an interest in the project. The comment period ended on July 24, 2003 and no comments were received. An initial revision letter was sent to the applicant on July 30, 2003. The applicant provided revisions addressing the comments in the August 13, 2003 letter. Decision Criteria - Design Review Per TMC 18.24.070, design review is required for all commercial structures located in the Regional Commercial District and located along Tukwila International Boulevard corridor. In the following discussion, the Design Review criteria are shown below in bold, followed by staff's comments. 2 2 El Charro Addition Design Review 3 L03 -033 November 3, 2003 1. Relationship of Structure to Site a. The site should be planned to accomplish a desirable transition with the streetscape and to provide for adequate landscaping and pedestrian movement. b. Parking and service areas should be located, designed and screened to moderate visual impact of large paved areas. c. The height and scale of each building should be considered in relation to the site. Response: The proposed addition will be located to the east of the property directly behind the existing building. This is the only possible location for any addition to the restaurant. The entrance to the restaurant is located near International Boulevard. This will remain unchanged with the proposed addition. Parking for the restaurant will be provided near the Ace Hardware building to the south, a small parking area to the east, and a shared parking agreement with the Lewis and Clark Theater. These parking areas require that pedestrians go across vehicular paths of travel to access the restaurant, this is unavoidable due to the existing development of the site. In order to reduce any conflicts between pedestrians and automobiles a stripped walkway will be provided between the main parking area to the east. The accessible parking area will be provided on the eastside of the building near the service entrance. A stripped walkway will be provided along the side of the building to the accessible ramp located on the east property line. A breezeway will be provided on the south side of the building. The breezeway will help separate pedestrian traffic from automobile traffic and protect patrons from the natural elements. The addition of the building is proposed to be about 15 feet in height. The maximum height for this zoning district is 35 feet. The addition will be the same height as the existing building. The proposed addition will require that a total of 41 parking stall be available on the lot. The applicant has proposed to re -stripe the existing parking lot to achieve the required number of parking stalls. The parking stalls provide on the premises will be a mix of compact and regular stalls. Wheel stops will be added to the parking stalls near the edge of the property line. This will prevent hangover to adjacent properties and prevent damage to buildings. It is the applicants responsibility to ensure that the fire department turnaround is maintained. 2. Relationship of structure and site to adjoining area a. Harmony of texture, lines, and masses is encouraged. b. Appropriate landscape transition to adjoining properties should be provided c. Public buildings and structures should be consistent with established neighborhood character. d. Compatibility of vehicular and pedestrian circulation patters and loading facilities in terms safety, efficiency, and convenience should be encouraged. e. Compatibility of on -site vehicular circulation with street circulation should be encouraged. ti 3 El Charro Addition Design Review L03 -033 November 3, 2003 Response: The proposed addition design will continue the rectangular and horizontal lines of the existing restaurant. The addition will be the same height as the existing building. The height of the building is keeping with the size and scale of adjacent buildings. A breezeway will be provided to separate pedestrians from automobiles. The accessible parking will be located in such a way to mitigate any conflicts between automobiles. A stripped access path will be provided between the adjacent parking areas and the restaurant. The City of SeaTac has recently added sidewalks next to the restaurant. The sidewalks will aid in allowing pedestrians to access the property. 3. Landscaping and Site Treatment a. Where existing topographic patterns contribute to the beauty and utility of a development, they should be recognized, preserved and enhanced. b. Grades of walk, parking spaces, terraces and other paved areas should promote safety and provide an inviting and stable appearance. c. Landscape treatment should enhance architectural features, strengthen vistas and important axis, and provide shade. d. In locations where plants will be susceptible to injury by pedestrian or motor traffic mitigating steps should be taken. e. Where building sites limit planting, the placement of trees or shrubs in paved areas is encouraged. f. Screening of service yards, and other places which tend to be unsightly should be accomplished by use of walls, fencing, planting, or combination. g. In areas where general planting will not prosper, other materials such as fences, walls and paving of wood, brick, stone, or gravel may be used. h. Exterior lighting, when used, should enhance the building design and adjoining landscape. Lighting standards and fixtures should be of design and size compatible with building and adjacent area. Lighting should be shielded, and restrained in design. Excessive brightness and brilliant colors should be avoided. Response The required landscaping area for uses within the Regional Commercial District are as followed: Front: Ten feet of type one Sides: Five feet of type two Rear: None Parking: Ten feet for each additional stall 4 As previous noted the site has been fully developed, this presents problems for landscaping with this particular project. The building is also encroaching on its front and side setback, which prevents additional landscaping being added in these two areas. Parking on the property is also limited, thus adding landscaping in the parking areas will reduce the total number parking spaces available to the business on the property. 4 El Charro Addition Design Review 5 L03 -033 November 3, 2003 The applicant has proposed installing cylinder planters near the front of the building. The planters will be constructed of fiberglass and are five feet in diameter. The planters have a total area of 19.65 square feet and will be painted terra cotta. The applicant is proposing to plant dwarf lavender and dwarf rosemary as under story in the planters. The dominant plant in the planters will be New Zealand Flax. New Zealand Flax are large strap- leafed evergreen perennials originally from New Zealand (San Marcos Growers Website). The plants can grow up to nine feet tall with a three foot spread. In the summer the plants bloom. The flowers are tubular in shaped and can measure up to 15 feet tall (Desert - tropicals.com). Once established the plants require little water. The plant selection is appropriate for the use of the building. The new breezeway will be lighted with down lights, which will aid patrons entering and exiting the building. A wall pak light will be installed on east wall of the new addition. This will provide lighting to the patrons in the parking area. The garbage dumpster that is located on the property is currently unscreened. When the addition is constructed a concrete masonry unit will be installed on the sides and rear of the dumpster. A slatted chain link fence will be installed at the front of the garbage dumpster. 4. Building Design a . b. c . d. e . f. g. Architectural style is not restricted, evaluation of a project should be based on quality of its design and relationship to its surroundings. Buildings should be to appropriate scale and in harmony with permanent neighboring developments. Building components such as windows doors, eaves, and parapets should have a good proportion and relationship to one another. Building components and ancillary parts shall be consistent with anticipated life of the structure. Colors should be harmonious with bright or brilliant colors used only for accent. Mechanical equipment or other utility hardware on roof, ground, or buildings should be screened from view. Exterior lighting should be part of the architectural concept. Fixtures, standards, and all exposed accessories should be harmonious with building design. Monotony of design in single or multiple buildings projects should be avoided. Variety of detail, form and sitting should be used to provide visual interest. Response The use of the building as a Mexican restaurant has influenced the style of the building. The addition will have textured stucco walls; the breezeway will have columns and tile roofing all of these design, which emulates architectural styles of the American Southwest and Mexico. The color of the addition will match the existing building, which is a bright red. The code encourages that bright colors be used for accent only, yet the color of the building keeps with the architectural style of the building. Miscellaneous Structures and Street Furniture a. Miscellaneous structures and street furniture should be designed to be part of the architectural concept of design and landscape. Materials should be compatible with buildings, scale should be appropriate, colors, should be in harmony with buildings and surroundings, and proportions should be to scale. 5 Response El Charm Addition Design Review L03 -033 November 3, 2003 b. Lighting in connections with miscellaneous structures and street furniture should meet the guidelines applicable to site, landscape, and buildings. The only miscellaneous structures proposed are bike racks. These will be located near the entrance of the restaurant. No changes are proposed to the non - conforming pole sign. Design Review Guidelines Relationship of Structure to Site: DESIGN REVIEW CONCLUSIONS The proposed development has been designed to meet the functional requirements for this type of land use while being responsive to the special characteristics of the site. The building is proportion to the property size. The new addition will meet all required setbacks. Relationship of Structure and Site to Adjoining Areas: The proposed buildings form and scale is in keeping with the existing development in the area. The site is currently non - conforming in terms of landscaping, number of parking spaces, and setbacks. The applicant has addressed these concerns as much as possible considering the constraints that exist on the property. Landscape and Site Treatment: According to section 18.70.090 of the Tukwila Municipal Code when a development triggers design review the landscaping on the property must be brought into conformance with the standards of the code. Yet, the section also notes, The Director may modify the standards imposed by this title when compliance with the landscaping standards would create a substantial practical difficulties, the existing and proposed additional landscaping and screening materials together will adequately screen or buffer possible use incompatibilities, soften the barren appearance of parking or storage areas, and/or adequately enhance the premises appropriate to the use district and location of the site. As noted, the applicant will be adding a small amount of landscaping in the front of the building. This landscaping will consist of two planters with New Zealand Flax. 6 Increasing the perimeter landscaping is not feasible. The building already encroaches on its front and north (side) setbacks. Thus, there is no space for additional landscaping. In addition the property is below grade with International Boulevard. The Ace Hardware building on the property also encroaches on its front and south (side) setbacks. Parking on the property is limited thus adding landscaping in the parking area would reduce the required parking stalls for the use. Building Design: 6 El Charro Addition Design Review L03 -033 November 3, 2003 The building addition design is appropriate for the use of the building. The addition will match the existing commercial building in terms of color, texture, and roofline. Miscellaneous Structure and Street Furniture: The applicant will be installing bike racks at the front of the building. The non - conforming sign will have to comply with city regulations if changes are proposed to the sign face, structural, or electrical service. Design Review Recommendation Staff recommends approval of the El Charro Addition with the following conditions. 1. The parking stalls on the property shall be open to all patrons that are visiting Ace Hardware and/or El Charro Mexican Restaurant or their successors. 2. The parking stalls along the edge of the property lines shall have wheel stops installed. This project was subject to design review and the applicant had noted that all mechanical equipment would be screened from view. The plans submitted for the mechanical permit, show a mechanical unit extending above the parapet wall. In a letter dated August 8, 2003, the architect for the project noted, "The parapet will be tall enough to screen the new 3 ton HVAC unit that will be installed on the top of the roof." The owners have decided to pursue this route in order to avoid the hassle of a long term shared parking easement agreement. RE: El Charro Design Review (L03 -033) In early September, the City was provided with a copy of a draft agreement. The next day the City commented on changes that needed to be made on the agreement. The City has now been asked to issue design review approval without receiving and approving the parking agreement. This is no acceptable to the City and a copy of the parking agreement must be provided to the City prior to design review approval being granted. There are some other options that the property owner may wish to consider: 1. The applicant may wish to do a boundary line adjustment (BLA) to have the stalls that are intersected by the east property line completely on their property. Before the City comments on this section a site map showing the proposed location needs to be submitted. 3. In regards to the agreement being terminated. The need for the shared parking agreement will still exists, regardless if the Sterling Property redevelops. If the agreement is modified or terminated the owner of the spaces (Sterling) must notify the Director of Community Development. In addition, all affected parties shall provide documentation to the City that a minimum of 50 percent of the required parking will be available within 90 days following termination of the agreement, with the remainder to be available 365 days following termination of the agreement (TMC 18.56.070). The language regarding termination upon redevelopment needs to be removed or the language above needs to be added to the agreement. 4. This agreement must be binding to any future landowners that purchase either the Sterling property or the Dougherty property. The building plans show that a HVAC system will be installed on the top of the new addition. Tukwila Municipal Code, section 18.60.050 (4) (e) requires that mechanical equipment and other utility hardware on the roof be screened from view. • What is the height of the HVAC equipment as well as any other mechanical equipment that will be placed on the building? • The mechanical equipment must be screened from view. How will this be accomplished? 2. The existing dumpster should be screened from view. Section 18.52.090 of the TMC notes the following: • An opaque wall or fence of sufficient size and height to provide complete screening shall enclose any outside collection points. Architectural design shall be consistent with the design of the primary structure on site. • Collection points shall be identified by signs not to exceed two square feet. Landscaping and Lighting (A copy of the landscaping requirements is attached to this letter) eather protection of recyclables and garbage shall be ensured by using weather -proof containers or providing a roof over the storage area. 3. Will the materials for the addition match the existing building in texture and style? 4. When the addition is complete will the entire building be painted to ensure that the addition matches the existing building? If the entire building will be painted please consider colors that are not as bold as the current colors. Section 15.60.050 of the TMC notes that colors should be harmonious with other buildings in the area, with bright or brilliant colors used only for accent. 5. A striped area between the parking areas and the breezeway should be provided to reduce any possible conflicts between pedestrians and automobiles. 6. Show the nearest fire hydrant on the plans. A fire hydrant shall be within 150 feet of building by path of vehicle travel. Under section 18.70.090 of the TMC, when an application for a building permit triggers design review, the proposed use and structure must meet the landscaping requirements of the code. The property has the following perimeter landscaping requirements, ten feet in the front with type I landscaping and five feet for the sides, with type II landscaping. The landscaping requirements for the parking area are ten square feet for each parking stall. There are 12 parking stalls on the property, thus 120 square feet of landscaping is required in the parking area. 1. What is the width of the nine existing stalls located between El Charro and the Lewis and Clark Theater? One idea for landscaping is to make these compact stalls and use the extra space for landscaping. 2. The small landscaping area in the front of the building has the possibly of being improved. Currently the space is very small and the plantings are limited. Is it possible to increase the size of the landscaped area and add some type of deciduous trees? In lieu of landscaping, is it possible to have this area be used for outdoor seating? Staff understands that this property is limited in size and shape and that it may be difficult to conform to all landscaping standards. The landscaping standards may be modified if the standards imposed by the code would create practical difficulties. A request must be made in writing to the City explaining the need for relief from any landscaping requirements. 3. The plans are unclear about what type of lighting will be used on the property. • Lighting should be installed along the breezeway to aid patrons entering and exiting the building. • Is it possible to add any lighting within the parking areas? This could be incorporated within landscaped areas. General 1. Are there any future plans for upgrading or replacing the existing pole sign? This sign is currently non - conforming and detracts from the visual appearance of the property. 2.
