The container will be used for storage of non - hazardous and non - flammable items. The cargo container will be 24 feet long by eight feet wide and will be painted beige to match the primary commercial building on the property. The cargo container will eliminate one parking space on the property. The property is currently being used for light industrial activities. Light industrial activities are the primary use in the area. Surrounding land uses are light industrial uses. A portion of the property appears to be within the 200 -foot Shoreline Area of the Green River, but the area of the property where the cargo container will be located is outside of the 200 -foot area of shoreline jurisdiction. SPECIAL PERMISSION CRITERIA Cargo Containers are permitted in the Commercial/Light Industrial District. All new cargo containers must comply with criteria detailed in Section 18.50.060 of the Tukwila Municipal Code: 1) Only two cargo containers will be allowed per lot, maximum length 30 feet. The proposed cargo containers will be 24 feet in length, six feet less than the 30 -foot requirement. There are no cargo containers located on this property. 2) The container is located to minimize the visual impact to adjacent properties, parks, trials and rights -of -way as determined by the Director. The cargo container will be shielded from view to the east and north by the primary building on the property. The container will be screened from the south by large trees and other vegetation that are on the same property as the proposed cargo container. The trees to the south will also aid in screening for the properties to the west. The cargo container may be visible from Interurban Avenue. Due to the angle of the street to the property the cargo container will not be highly visible from Interurban Avenue. The cargo container will also be painted to match the primary building on the property. 3) The cargo container is sufficiently screened from adjacent properties, parks, trails and rights -of -way, as determined by the Director. Screening may be a combination of solid fencing, landscaping, or the placement of the cargo containers behind, between or within buildings. No additional screening is proposed. The proposed location and color of the cargo container will aid in minimizing any visual impacts from the cargo container. 4) If located adjacent to a building, the cargo container must be painted to match the buildings color. The cargo container will be painted beige to match the existing building on the property. S) Cargo containers may not occupy any required off parking spaces. As noted, the cargo container will occupy one off - street parking space. Yet, this is not a required parking space for the business. The current use. on the property requires 1 parking space for every 1,000 square feet of useable floor area. The current building on the property has an area of about 17,420 square feet. Using the given parking ratio the use requires 17 parking stalls. There are currently well 70 parking stalls on the property. Thus, the removal of one parking space for the cargo container will not create a parking deficiency on the property. 6). Cargo containers shall meet all setback requirements from the zone. The setback requirement for the C /LI District are as follows: Front: 25 feet Second Front: 12.5 feet Sides: 5 feet Rear 5 feet The proposed cargo container will meet all setbacks for the district. The nearest property line for the cargo container is the rear property line. The cargo container will be within 20 feet of this property line, where below the five -foot requirement. 7) Outdoor cargo containers may not be refrigerated. The applicant is not proposing to have a refrigerated unit. Staff Report to the Planning Commission L03 -027 T- Mobile at Fairway Center Page 4 of 4 8) Outdoor cargo containers may not be stacked. The applicant is not proposing to stack cargo containers. CONDITIONS 1. The cargo container cannot be used for human occupancy. 2. Items stored in the container cannot be hazardous or flammable. CONCLUSIONS 1. The zoning for the property allows the location of a cargo container. 2. The proposed project meets the performance standards that are required in C/LI zone. 3. The proposed location of the cargo container will not have a negative visual impact on surrounding properties. bm ern APPEALS This decision may be appealed to the Planning Commission within 14 days from the issuance of this Notice of Decision.
