The City expects full compliance with the letter dated October 27, 2003 that was sent to Mr. Van Daalen. One point of clarification, the non - conforming section of the City code is inapplicable to Canopy West. The City is not referring to landscaping, rather the code requires screening, for a use such as the one contemplated by your client's testimony at the recent hearing on this issue and on the business license application. In order to locate any business that has outdoor storage, in the MIC/H District, screening must be provided. Please refer to Tukwila Municipal Code, section 18.38.020 (34). If you client uses the property in a manner that implicates the screening requirements and fails to comply with TMC 18.52.040 -D and TMC18.38.020 (37) code enforcement action will result. Mullet, Mayor Department of Community Development Steve Lancaster, Director RE: Your letter dated November 5, 2003 The Department of Community Development received your fax on November 5, 2003. After review of the letter the City has the following points of clarification. 1. In paragraph two you noted, "Following a brief discussions of your request, you consulted ...with Nora Gierloff and informed me that the City of Tukwila would issue the business license to Canopy West without further delay." I never made such a statement. The Planning Department does not have the authority to issue the business license, only the City Clerk can issue the business license. The Planning Department is one of four departments, which review and sign off on the business license application. As I noted on the phone, when the planning issues have been resolved the Planning Department will remove their hold on the business license application and allow building, fire, and police to review the application. The other departments may have additional code requirements that the applicant would have to meet before being issued a business license: 2. The letter stated in the second paragraph, "You also made it clear that failure of Canopy West to do so could result in revocation of the business license which will be issued by the City of Tukwila ". There is no such statement in your letter. 3. In the 3 paragraph it mentions, "Canopy West understands the points raised in your October 27 letter and will undertake reasonable efforts to resolve these issues with its landlord and the City of Tukwila ". It is the applicant's (Canopy West) responsibility to comply with the zoning code requirements stated in the October 27, 2003 letter from the City of Tukwila. If the applicant should run into issues regarding those requirements with the landlord that is between the applicant and the landlord. Canopy West, like all Tukwila businesses, must meet the Zoning Code development standards. 4. As I noted on the phone, Canopy West needs to provide some details on how they intend to meet the City's Code requirements. Your letter dated November 5, 2003 in its present form is unacceptable and the above comments need to be addressed. The denial was based solely on D • 0 the City of Tuwila's position that the intended use of Canopy West's proposed Tukwila 0 • Y2 location did not comply with Tukwila Municipal Code (TMC) Chapter 18.38. Canopy West I/1 appealed that decision and prevailed before a hearing examiner. A lengthy opinion dated i 0 O 14, 2003 was issued by the hearing examiner which reversed the City of Tukwila's -!- 0 denial of Canopy West's business license application. Since the City of Tukwila did not seek Ili z reconsideration or appeal the decision of the hearing examiner, Canopy West fully expected IU-_ H that it would be issued a business license without further delay. Instead, the City of Tukwila 0 decided that it would continue to oppose the issuance of Canopy West's business license on newly declared grounds which are not supported by existing law. I recently received a letter from Mr. Miles, dated November 7, 3003, which restates earlier demands made by the City of Tukwila in his October 27, 2003 letter. In short, the City of Tukwila is currently refusing to issue a business license to Canopy West unless the owner of the premises where Canopy West intends to locate upgrades its landscaping to comply with TMC 18.52.040. Additionally, Mr. Miles has cited setback and parking requirements, and further demanded that a sitemap be submitted to the City of Tukwila showing the location of all landscape areas, outdoor storage areas, location of current parking stalls, and any new parking stalls. Mr. Miles has stated that the City of Tukwila will not issue a business license to Canopy West unless the space plan he has requested is in full compliance with those sections of the TMC which he has cited. The demands made by Mr. Miles are not only unsupportable, they are in direct violation of the Tukwila Municipal Code. The grounds for denial of a business license application are set forth in TMC 5.04.110. TMC �- w 5.04.110(B) elaborates on this proposition by stating: 6 -I C.) Grounds for denial, suspension or revocation include, repetition of a violation u) o of any provision of the Tukwila Municipal Code that has been accompanied by L _ a warning notice of such violation or previous notice of the violation. The LL Notice of Denial, Suspension or Revocation shall set forth the grounds for w 0 denial, suspension or revocation and a statement advising that the person may appeal from the Notice of Denial, Suspension or Revocation to the Hearing Officer, provided that the appeal is made in writing and filed with the City = c� Clerk. Z F. This statute contemplates the prior issuance of a business license, followed by well w o uj documented violations of the TMC. Purely speculative violations by the applicant's landlord are impermissible grounds for the denial of Canopy West's business license. o N o r` Even if Mr. Miles' concerns were properly considered, his interpretation of the TMC = 0 is fundamentally flawed. TMC 18.70.090 clearly states that, "Adoption of the landscaping u regulations contained in this title shall not be construed to require a change in the landscape z improvements for any legal landscape area which existed on the date of adoption of this title, rJ =. unless and until a change of use or alteration of the structure requiring design review p �' approval is proposed (see TMC 18.60)." Neither Canopy West, nor its landlord, is currently considering any type of development which would trigger a TMC 18.60 review. Since the landscaping provisions Mr. Miles has cited appear to have been enacted in 1999, TMC 18.70.090 appears to be highly relevant to Mr. Mile's analysis, yet entirely disregarded by him. Mr. Miles has informed Canopy West that its failure to comply with his demands will result in "the Department of Community Development being unable to approve your business license application." For the reasons stated above, we do not believe there is any legal basis for the continuing refusal of the City of Tukwila to abide by the hearing examiner's decision. Thus, we hereby demand that the City of Tukwila issue a business license to Canopy West. We do not believe that a reasonable time period to do so should exceed fifteen (15) days. We hope to work with you in a cooperative fashion; however, further obstruction may result in legal action being commenced in the King County Superior Court without further delay. Any such legal action will seek attorneys fees from the City of Tukwila, in addition to any monetary damages and equitable relief which is available. Please be advised that the Hearing Examiner's decision is not a license to conduct business in the City of Tukwila. The Hearing Examiner only ruled that the use is permitted in the zone. There are still development regulations that you must be able to meet to locate on the property. In addition, other City Departments must review and approve the business license application. You have testified and Hearing Examiner concurred that the nature of your business requires outdoor storage. This is allowed in the MIC/H zone, however adequate screening must be provided. Steven M Mullet, Mayor The property currently has a minimal amount of landscaping. The screening requirements are listed in TMC 18.52.040 -D, "Outdoor storage shall be screened from abutting public and private streets and from the adjacent properties. Such screens shall be a minimum of eight feet high and not less than 60 percent of the height of the material stored ". This screening can be accomplished by.a combination of fencing and landscaping. Fences over six feet tall require a building permit. The Zoning code requires five feet of front yard landscaping in the MIC/H zone. The code also requires that the landscaped areas be served by automatic irrigation (TMC 18.52.040 H). Outdoor storage areas are also required to meet certain setbacks in the district. The site map must include the location of all landscape areas, outdoor storage areas, location of current parking stalls, and any new parking stalls. The use is required to have 2.5 parking stalls for every 1,000 square feet of usable floor area. On the business license application, the total floor area for the building was listed as 1,700 square feet. Thus, the required number of parking stalls is four. Please provide the information requested within two weeks of the date of this letter. If you require additional time please contact the department to request an extension. Failure to provide the requested information will result in the Department of Community Development being unable to approve your business license application. Also, the sign on the property has also been modified in violation of City Code. The sign was a non - conforming sign, any modification of the sign requires that the entire sign be brought up to City Code regarding setbacks, height, and sign area. The official record is recorded on tape. The hearing opened on Tuesday, September 16, 2003, at 1:35 p.m. in the Council Chambers on the seventh floor of the Renton City Hall. Parties wishing to testify were affirmed by the Examiner. The matter may be submitted back to the Examiner for reconsideration if the parties are not satisfied with the decision. He stated that the appellant had the burden of demonstrating that the City's action was erroneous, and would have to show clear and convincing evidence that the City's determination was incorrect. I-- 0 z F- w • w 0 O - CI W H H u O w Z = O~ z Peter Van Daalen Canopy West Appeal re Denial of Business License October 14, 2003 Page 2 Mr. Hoff, stated as an administrative matter there is a document submitted by the City of Tukwila with several attachments and the Staff Report, he was not sure he had a complete copy of that document and requested a clean, complete copy. That was given to him. Upon questioning by Mr. Hoff, Mr. Van Daalen stated that he is in the canopy manufacturing and retail business. He is the manager of Canopy West. Currently there are three stores in the United States, all in the Seattle area, and four in Canada. Canopy West started business in the United States in 1997 and in Canada in 1983. They are all retail stores. Canopy West manufactures aluminum canopies, stores them and also puts on automotive accessories. Bug deflecters and running boards are sold at Canopy West locations, all of which are minor parts, the canopies are still the number one product. There are some wholesale customers in Alaska, the canopies are barged from Tukwila to Alaska. Mr. Van Daalen stated that while looking for property closer to the barges, they noticed some available property owned by Mr. Bitners.' -The intended use of Mr. Bitners t■roperty was for outdoor storage, service area, and assembling of aluminum canopies. Use of this location makes delivery of units to the docks for shipping to Alaska more convenient and far less time consuming. The first year of business in the Tukwila site .would be 40% or better in wholesale sales. After that it is hard to say how much traffic would use that location. It is the intention of Canopy West to install a painting facility on site as well. Some sales are off -site at a car dealership, the customer comes to Canopy West to have the canopy installed. When questioned about the application for a business license from the City of Tukwila, Mr. Van Daalen stated that the description of the business applied for said, manufacturing aluminum canopies, crating of canopies to ship to Alaska and to store canopies for the other three yards. There was no mention of retail business. Upon further questioning by Mr. Hoff, Mr. Van Daalen looked over the staff report and other documents submitted by the City of Tukwila and agreed that these documents did reflect what has transpired in this case. The Examiner asked if the canopies would actually be manufactured on this site, or is it really the assembly of them. Mr. Van Daalen responded that the sidewalls come as a kit. The rest of the canopy comes as sheets of aluminum which are then cut, shaped and put together to make the canopy. Mr. Hoff, stated that in Chapter 18.38 of the Tukwila Municipal Code, nowhere does it discuss the sale of truck canopies. The City sees this business as an auto parts business, but it appears to be closer to businesses that are allowed by the City, specifically body and engine repair shops enclosed within a building. The actual attachment of the canopy bodies take place inside the building, and the only thing the outdoors is used for is storage of the units. Section 18.38.020 subsection 21, authorizes manufacturing, processing and assembling of electrical /mechanical equipment, vehicles and machines such as tools, airplanes, boats, or other transportation vehicles and equipment. Further study of the City Codes show that retail sales are not completely banned from business in this area. Mr. Van Daalen never applied for a retail business license and so this denial is not valid. The Examiner discussed the issue of continuous use of the property. Mr. Hoff stated that Mr. Bitners was present and his testimony could be put on the record as to the prior use of the property. Sven Bitners, PO Box 40211, Bellevue, WA 98015 stated that he was in the manufacturing business. Pacific Strapping, Inc., manufactures strapping materials for packaging purposes, similar to a textile company. Mr. Bitners is the owner of the property in question here today. It is held under an LLC and leased to Pacific Strapping. The property has been empty for a while and Pacific Strapping has been using it for storage for overflow items. Pacific Strapping is located in the second building on the tax lot. Mr. Bitners purchased this 1, Peter Van Daalen Canopy West Appeal re Denial of Business License October 14, 2003 Page 3 property in August, 2002. At the time of purchase, the property was used by George Brazil Heating and Ventilating, a Concrete Floor manufacturer, and Secret Garden Statuary, a retail garden outlet. Pacific Strapping sold scrap strapping materials and concrete blocks left by previous tenents, for the purpose of ? Z conducting some retail sales. Virtually every business on that street classifies as a retail business. 6 Brandon Miles, City of Tukwila, Commercial Development, 6300 Southcenter Blvd., Tukwila, WA, asked Mr. v p Bitners to look at a business license and describe whose business license it was. Mr. Bitners replied it was o Pacific Strapping's business license application for 2003. The stated description of the business was W = manufacturer of polyester webbing cord strapping. The address for that particular business license is listed as cn 2922 South 112th Street. Mr. Bitners continued that the address is for the other building, that 1 12th is a fairly new street, and that his address is also known as 11063 Pacific Highway South. There are separate buildings on one tax lot. When the previous tenants moved out, there was a lot of handshaking and good will going between the parties in order to make the transaction easier for everyone involved. At about or on the 9th of November = CI we closed down the billing and changed it over to the LLC which owns the property, the water service for the F- _ two buildings is one water service. The space was occupied until close to the end of November, 2002. It was ? �-- stated that a permit was not obtained to change the sign on the property. z O w Upon questioning by Mr. Miles, Mr. Van Daalen stated that he did file a business license application in June U and prior to that time he had a meeting at the City of Tukwila with some gentlemen. In the new location more O N than 50% of the business will be wholesale because the accounts will come from the Lakewood store, due to W uj the deals with the Alaska accounts. ( t ' The Examiner stated that traffic was mentioned as a potential issue in this zone, at the same time permitted in w Z this zone are brew pubs which are meant for general public participation. These are more like retail sales and t� not heavy manufacturing. 01— Mr. Miles stated that the appellant has noted that they would be allowed to operate under 2C, body and repair shops, and here the entire operation has to be enclosed in a building and that would include storage of materials. The retail sales of canopies is not permitted in this zone. It is permitted in eight zoning classifications, it is just not permitted in this one classification. The Staff Report pretty much speaks for itself. The property owners are asked to provide the City with documentation when the previous tenants vacate the property, nothing was provided. The Examiner stated that it did not appear that there was any continuous use of this building after early November for retail sales to justify the retail sales issue. The Examiner called for further testimony regarding this appeal. There was no one else wishing to speak. The hearing closed at 2:40 p.m. FINDINGS, CONCLUSIONS & DECISION Having reviewed the record in this matter, the Examiner now makes and enters the following: 1. The appellant, Peter Van Daalen, the manager of Canopy West, filed an appeal of the decision by the City Clerk of Tukwila to deny a business license. The appellant assembles and sells canopies that fit on the back of pickup trucks. Z 3. The subject site is zoned Manufacturing Industrial Center/Heavy (MIC/H). w J g Y( ) 4. The appellant submitted an application for a Business License for 2003 that was received by the City of U O Tukwila on June 11, 2002. On that application the appellant filled in the box labeled "Description of co w business (give details; also, list types of products sold or stored):." The following information was w I entered "MFG aluminum canopies, crating of canopies to ship to Alaska, store canopies for 3 other co o yards." w 0 2 5. The appellant did not check either of the sub -boxes labeled: "Will retail sales be conducted? Yes g Q N He noted this omission was inadvertant. _ S n I et I- Ili 6. The operation appears to be described as one of assembly in the actual license application. The Z 12 - appellant receives certain components in the form of "kits" which are then used to create canopies that z O fit over the rear bed of pickup trucks. The assembly involves not only assembling "kits" but cutting the 1.11 Lij aluminum used as the exterior shell, bending the material and then fastening the cut aluminum skins to 0 0 frames. The appellant also prepares canopies for shipment to Alaska and stores inventory on site until o H such shipment. It is also intended to supply canopies to its other outlets. The operation also entails W constructing the shipping crates for canopies intended for Alaska and elsewhere. H 0 LL b 7. The appellant estimates that they might receive about 20 vehicle trips per day. Some of these trips are w Z done by patrons who are only there to have the canopies installed having purchased them from their 0 original automobile dealers. The appellant limits their operations to 9 A.M to 5:30 P.M. on Mondays ~ O I through Fridays and 9 A.M to 5:00 P.M. on Saturdays. No operation occurs on Sundays. Z 8. The appellant also sells some accessory items such as bug deflectors and running boards. 9. The appellant argues that the retail sales conducted by the appellant are a permitted non - conforming use since they are a mere continuation of the prior non - conforming retail sales that the statuary business engaged in as well as another retail operation that sold fabric packaging straps. Legal non - conforming uses may only continue operation if they are uninterrupted for a period of not more than six months. (Tukwila Municipal Code, Section 18.70.040) 10. The record appears to establish that the a prior business that sold garden statuary moved its operation in October of 2002. Their last billing for electricity was the beginning of November, November 9, 2002. The prior business' billing also begins for new electric service on November 1, 2002. Their water billing shows new service on October 1, 2002. Their lease for their new location began on September 15, 2002. 11. The appellant's lessor, the property owner, Sven Bitners, also argued that even if the predominant aspect of the business is retail sales those retail sales are permitted. He noted the prior use of the subject site was retail sales and non - conforming uses may continue operating from the location. The prior use was the sale of garden statuary and similar items. He also noted that when that business moved, another retail operation, the sales of textile straps, used in packaging, occurred on the subject Peter Van Daalen Canopy West Appeal re Denial of Business License October 14, 2003 Page 5 site. 12. The retail sales of the straps was supposedly established by Bitners, the owner - lessor of the subject site. Bitners not only owns the subject site but he also owns the adjoining property where he operates Pacific Strapping. It was straps manufactured in this adjoining business that supposedly were sold at the subject site just after the statuary business closed. Tukwila staff found no evidence that retail sales were actually conducted on the site. There was no business license extending to this site, the property was surrounded by a locked chain link fence and no hours of operation were posted at the location. Bitners apparently admitted to the City that sales occurred once, on May 28, 2003. 13. This office finds that the retail use of the site by the adjacent business was not properly established, did not have a license for business at the subject site and was not of such a legal nature as to confer a continuous legal, non - conforming presence that would permit a non - conforming retail use of the subject site to be maintained. 14. The appellant did not apply for a business license until June 11, 2003. That would have been more than 6 months since the prior legal non - conforming statuary sales operation which included retail sales had concluded. 15. The City in its staff report to the examiner (Page 4) justifying its denial of the business license stated: "The proposed use, the sale of canopies by Canopy West is large -scale retail. The business licenses and the business licenses application from the City of Auburn, Lakewood and Everett demonstrate that Canopy West is engaged in direct sale of canopies to the end user. The letter dated June 4, 2003 from Mr. Bitners noted that 'Canopy West is engaged in sales and installation of truck canopies and other truck accessories and they would do the final manufacture and assembly of truck canopies and accessories. The City Zoning Code classifies Canopy West as 'Retail sales of furniture, appliances, and automobile parts and accessories, liquor, lumber/building materials, lawn and garden supplies, farm supplies. "' 16. The City Clerk in a July 28, 2003 letter titled "Notice of non - issuance - 2003 Tukwila business license" noted that the Department of Community Development reviewed the application and recommended denial. The reasons stated were: "The proposed use, retail sales of canopies, is not a permitted use in the Manufacturing Industrial Center/Heavy Industrial district. The property has lost its non - conforming status." 17. This district implements the Manufacturing Industrial Center/Heavy Industrial Comprehensive Plan designation. It is intended to provide a major employment area containing heavy or bulk manufacturing and industrial uses, distributive and light manufacturing and industrial uses, and other uses that support those industries. This district's uses and standards are intended to enhance the redevelopment of the Duwamish Corridor. (Ord. 1758 l(part), 1995) 18.38.020 Permitted uses. The following uses are permitted outright within the Manufacturing Industrial Center — Heavy Industrial district, subject to compliance with all other applicable requirements of the Tukwila Municipal Code. 1. Adult entertainment establishments are permitted, subject to the following location restrictions: a. The following uses may be allowed within the Manufacturing Industrial Center/Heavy Industrial district, subject to the requirements, procedures, and conditions established by the Conditional Use Permits chapter of this title. 1. Colleges and universities. 2. Electrical substations - distribution. 3. Fire and police stations. 4. Hazardous waste treatment and storage facilities (off -site) subject to compliance with state siting criteria (RCW 70.105; see TMC 21.08). 5. Park and ride lots. 6. Radios, television, microwave, cellular or observation stations and towers. 7. Recreation facilities (public) including, but not limited to, sports fields, community centers, and golf courses. 8. Retail sales of health and beauty aids, prescription drugs, food, hardware, notions, crafts and craft supplies, housewares, consumer electronics, photo equipment, and film processing, books, magazines, stationery, clothing, shoes, flowers, plants, pets, jewelry, gifts, recreation equipment and sporting goods, and similar items; limited to uses of a type and size that clearly intend to serve other permitted uses and/or the employees of those uses. Essential public facilities, except those uses specifically listed as permitted or conditionally permitted in any of the districts established by this title. 5. Hydroelectric and private utility power generating plants. 6. Landfills and excavations which the responsible official, acting pursuant to the State Environmental Policy Act, determines are significant environmental actions. 7. Manufacturing, refining, or storing highly volatile noxious or explosive products (less than tank car lots) such as acids, petroleum products, oil or gas, matches, fertilizer or insecticides; except for accessory storage of such materials. 8. Railroad freight or classification yards. 9. Removal and processing of sand, gravel, rock, peat, black soil, and other natural deposits together with associated structures. No on -site hazardous substance processing and handling, or hazardous waste treatment and storage facilities shall be permitted, unless clearly incidental and secondary to a permitted use. On -site hazardouswaste treatment and storage facilities shall be subject to the State siting criteria (RCW 70.105). (See TMC 21.08.) (Ord. 1758 1(part), 1995) CONCLUSIONS 1. The appellant has the burden of demonstrating that the decision of the City was either in error, or was otherwise contrary to law or constitutional provisions, or was arbitrary and capricious. TMC ARc∎ktsItu - .5.08.080(C) requires that "the decision of the hearing body on an appeal from a decision of the Clerk w\ shall be based upon a preponderance of the evidence. The burden of proof shall be on the appellant." 2. 40X 'S .'3%)z,‘ 0 37 The appellant has demonstrated that the action of the City should be modified or reversed. The decision is reversed. Arbitrary and capricious action has been defined as willful and unreasoning action in disregard of the facts and circumstances. A decision, when exercised honestly and upon due consideration of the facts and circumstances, is not arbitrary or capricious (Northern Pacific Transport Co. v Washington Utilities and Transportation Commission, 69 Wn. 2d 472, 478 (1966). An action is likewise clearly erroneous when, although there is evidence to support it, the reviewing body, on the entire evidence, is left with the definite and firm conviction that a mistake has been committed. (Ancheta v Daly, 77 Wn. 2d 255, 259 (1969). 4. The appellant has demonstrated that the decision is erroneous. It seems clear from the record that the appellant's business is anything but a "large -scale retail use." The City concluded that: "The proposed use, the sale of canopies by Canopy West is large -scale retail." The use is expected to generate approximately 20 vehicle visits per day. There is almost no way to characterize that number of visits are being associated with a large -scale retail operation. In addition, the business assembles canopies from a variety of components including sheet aluminum as well as "kit" frames. They also build crates and stockpile and warehouse canopies for transshipment to Alaska with the ability to ship to other of their locations in Washington State. 5. Sections 18.38.020 -18, 020 -19 and 020 -20 all seem available as sanctioning the nature of the appellant's business. Section 18.38.020 include the following permitted uses: 18. Manufacturing, processing and /or assembling chemicals, light metals, plastics, solvents, soaps,wood, coal, glass, enamels, textiles, fabrics, plaster, agricultural products or animal products (no rendering or slaughtering). 19. Manufacturing, processing and /or assembling previously prepared metals including, but not limited to, stamping, dyeing, shearing or punching of metal, engraving, galvanizing and hand - forging. 6. The cutting and assembling of aluminum shells and fastening them to the framework that results in finished canopies appears to be included as "manufacturing, processing and/or assembling... light metals ..." (18), "manufacturing, processing and/or assembling of previously manufactured metals such as iron and steel fabrication..." (19), and "manufacturing, processing and /or assembling of previously prepared metals including but not limited to, stamping, dyeing, shearing or punching..." (20). 7. In addition Sections 18.38.020 -38 and 43 permit "storage (outdoor) of materials allowed to be manufactured or handled..." and "warehouse storage and/or wholesale distribution facilities," respectively. 8. Section 18.38.020 -34 even permits sales and rental of heavy equipment. Section 18.38.020 -32 allows restaurants and cocktail lounges and nothing therein prohibits them from catering to any clientele whatsoever thereby lessening any arguments the City raises about limiting or lessening traffic in this zone. 9. The appellant has demonstrated with cogent evidence that a mistake was made. The retail sales associated with such manufacture or processing is, in this case, not large - scale, and is associated with a manufacturing use permitted in the zone. 10. It appears that the appellant has met its burden of demonstrating error. This office can only conclude that the City made the incorrect determination. The decision below must be reversed. BACKGROUND On June 11, 2003, Canopy West submitted for a 2003 City business license at 11061 Tukwila International Boulevard (TIB) (Attachment A). On July 28, 2003, upon a recommendation from the Department of Community Development, the City Clerk denied the business license (Attachment B). Following the Notice of Denial, the applicant had ten days to file for an appeal to the City's Hearing Examiner. On August 5, 2003 the applicant requested an appeal to the Hearing Examiner (Attachment C). The appeal letter provided no specific reason why the appeal was requested or how the City made a mistake in denying the business license. The City believes that there are two possible arguments that the appellant will make: 1. The use is permitted in the zone 2. The property is vested non - conforming for retail operations. II. AUTHORITY OF THE HEARING EXAMINER Section 8.45.090 of the Tukwila Municipal Code states the authority of the Hearing Examiner on this matter. The Hearing Examiner may: III. FACTS 1. Continue the review to a date certain for receipt of additional information On May 26, 2003, appellant, Mr. Peter Van Daalan and property owner, Mr. Sven Bitners met with Rhonda Berry, Acting City Administrator and Jack Pace, Deputy Director of Community Development in regards to locating Canopy West at 11061 Tukwila International Boulevard (TIB). At this meeting the appellant noted that Canopy West is engaged in the retail sales of canopies for trucks and other vehicles, and at this location the majority activity at the property will be retail sales. Canopy West is currently operating in Auburn, Lakewood and Everett. The City requested and received copies of the business licenses and business license application for Canopy West in these cities (Attachment C, D, E, F G). On the Auburn Business License the Standard Industrial Classification (SIC) for Canopy West it is listed as "Automotive Accessory Dealers, the type of business is described as retail. The 2003 Lakewood Business License Application for Canopy West describes the business, "Retail Sales and Service of Truck Accessories ". The City Everett Business License application lists the nature of the business as "retail ". At the meeting Mr. Bitners noted that the property had been vacant for about eight months. In a letter dated, May 29, 2003, Mr. Pace informed the appellant that retail sales of canopies was not permitted at that location for the following reasons (Attachment H): 1. The property is currently zoned Manufacturing Industrial Center/Heavy Industrial (MIC/H). Per Tukwila Municipal Code section 18.70.040, if a nonconforming use ceases for any reason for a period of more than six consecutive months or a total of 365 days in a three year time period, which ever occurs first, it is no longer grandfathered (Attachment L). In a letter dated June 4, 2003 (Attachment M), Mr. Bitners agreed with the City that the MIC/H zoning designation does not allow retail sales (2 " Paragraph of Attachment M). The letter also noted that Canopy West would be engaged " ...in sales and distribution, provide installation service and repair for truck canopies and other truck accessories, do the final manufacture and assembly of truck and canopies and accessories, and manufacture crates for shipment." It was also noted that the property had been vacant for less than six months and thus was still grandfathered for retail sales. No supporting documentation for this statement was provided. On June 11, 2003, the appellant filed for a business license application at 11061 Tukwila International Boulevard (Attachment A). The previous permitted use engaged in retail operations at 11061 Tukwila International Boulevard was Secret Garden Statuary Center (Secret Garden). Secret Garden is owned and operated by a Ms. Janice Taylor. Secret Garden moved to 10655 Tukwila International Boulevard (Attachment N). Lucioni Arts also operated at 11061 Tukwila International Boulevard. Lucioni Arts is owned and operated by Mario Lucioni. Lucioni Arts also moved to 10655 Tukwila International Boulevard, the same location as Secret Garden (Attachment 0). City staff contacted Ms. Taylor and she noted that she moved out of the property at 11061 Tukwila International Boulevard, the property in question, around October. City staff also contacted Seattle City Light who noted that the last billing at 11061 TIB took place on November 9, 2002. The property manager for Secret Garden's new location noted that their current lease began September 15, 2002 (See Attachment P). On October 1, 2002 water billing by the City of Tukwila began for Secret Garden at their new location at 10655 TIB (See Attachment Q). Seattle City Light noted on the phone to City staff that service for Secret Garden at their new location began on November 1, 2002. In a letter dated, June 19, 2003 City staff noted to the property owner that the City believes that the property in question has lost its non - conforming status (See Attachment R). Mr. Bitner responded to the City's letter on June 25, 2003 (See Attachment S). Mr. Bitners provided dates on when Secret Garden had vacated the property. In the letter he notes, "The Secret Garden Statuary had a separate lease for 11061 TIB and occupied the space for through November of 2002. ". No documentation was provided to the City. Mr. Bitners also mentions in the letter that on May 28, 2003 Pacific Strapping Incorporated began retail sales from that location. Mr. Bitners submitted undated photos to support his claim (Attachment T). The photos consist of changeable reader board advertising the sale of used strapping material and a lemonade stand. A visual survey of the property during hours of the day when retail operations tend to operate found the following: 1. A closed sign was hanging in the window 2. No sign indicating the hours of operations was posted 3. A chain link fence encompassed the entire perimeter of the property. City staff also discovered the following about Pacific Strapping's alleged use of the property at 11061 TIB for retail sales. 1. Pacific Strapping does not have a business license to operate at 11061 TIB. The Pacific Strapping business license is at 2922 S. 112 Street (See Attachment U). The business license application for Pacific Strapping does not mention conducting retail sales. The description of business provided by Pacific Strapping notes, "manufacturing of polyester webbing and cord strapping ". 2. There has never been a sign permit issued to Pacific Strapping for the sign that they are currently using at 11061 TIB. This freestanding sign has been modified in violation of City code. 3. There is no phone number for Pacific Strapping at 11061 TD3. 4. Mr. Sven Bitners is the owner of Pacific Strapping. There are two main issues regarding the location of Canopy West at 11061 T. The first is whether the proposed use is allowed in the MIC/H zoning. The second issue is if the property has lost its non- conforming status to conduct retail operations at 11061 TIB. A. Canopy West is a Retail Operaton The proposed use, the sale of canopies by Canopy West is large -scale retail. The business licenses and the business licenses application from the City Auburn, Lakewood and Everett demonstrate that Canopy West is engaged in the direct sale of canopies to the end user. The letter dated June 4, 2003 from Mr. Bitners noted that "Canopy West is engaged in sales and installation of truck canopies and other truck accessories and they would do the final manufacture and assembly of truck canopies and accessories ". Retail operations of this nature are excluded from the MIC/11 Tukwila's Manufacturing/Industrial Center is one of four in King County. It was established through a regional process involving the King County Growth Management Planning Council. King County's County Wide Planning Policies mentions, "Manufacturing/Industrial Employment Centers are key components of the regional economy. These areas are characterized by a significant amount of z H manufacturing, industrial and advanced technology employment (20) ". One of the underlying goals of the City's Comprehensive Plan in the MIC area is to protect the land v U O resource. Goal 11.1.5 states, "Allow uses that are commonly associated with manufacturing and industry, co f including those directly supporting such activity, such as offices and laboratories, while prohibiting w = unrelated uses (127) ". O Lu Besides protecting the land supply the City also has an interest in reducing traffic within the MIC area. Reducing traffic with the MIC area is vital to attracting and retaining manufacturing uses within the area. g Retail uses tend to have more traffic associated with them when compared to industrial or manufacturing co uses. I- Z = !— In regards to implementation strategy for the above mentioned goal, the Comprehensive Plan notes, F- O "Zoning in the MIC that permits manufacturing and industrial and related uses along with retail, eating, w and personal service establishments of limited size and location permitted, but with uses such as residential and large retail prohibited (127) ". U O N OH This implementation strategy is consistent with the goals of the GMA County Wide Planning Policies, w W which state that cities with MIC areas should, "Discourage land uses which are not compatible with v manufacturing, industrial, and advanced technology uses (25) ". u- 3 id Some retail operations are allowed in the MIC area. This would include restaurants, brewpubs, and dry = . cleaning operations. Other retail operations, such as drug stores may locate in the MIC with an approved ~ O'— Conditional Use Permit. These uses are allowed because they serve the employees of manufacturing uses Z within the MIC area on a daily basis. Employees of Boeing or King County Airport are able to have these uses nearby and can access them before, during, or after work. The employees do not have to travel out of the district for daily retail needs, which helps reduce traffic, a goal of the Comprehensive Plan in the MIC area. The sale of truck canopies is not a retail use that people use on a day to day basis and therefore was specifically not included as a permitted use in the district. The only similar permitted use within the MIC/H is body and engine repair shops. Yet, the code requires that the entire operation be enclosed within a building, this could not occur on this property. C. Retail Use Summary Since the use is not permitted within the MIC/H District a business license cannot be issued by the City. The sale of automobile parts and accessories is allowed in eight zoning classifications within the City. Canopy West is permitted in the following districts, Neighborhood Commercial, Regional Commercial, Regional Commercial Mixed Use, Tukwila Urban Center, Commercial/Light Industrial, Light Industrial, Heavy Industrial, and Tukwila Valley South. It is not listed as a permitted use in the Manufacturing Industrial Center/Heavy district. 5 City of Tukwila Staff Report Canopy West Business License Appeal, L03 -053 D. Non - Conforming Status Canopy West applied for their business license on June 11, 2003. In order for the property to be considered a continuation of a non - conforming use, the property must have been used for retail operations within six months on or after December 11, 2003. z z� The property owner has provided no documentation regarding the end dates of the previous tenants at the w property in question. The only documentation provided was undated pictures of a changeable reader 6 U board sign. The applicant noted in his June 25, 2003 letter that Pacific Strapping was using the property U O for retail operations beginning on May 28, 2003. If this is the case why wasn't it mentioned in his June 4, U o 2003 letter? The City can find no corroborating evidence and the property owner has provided no w = evidence that Pacific Strapping ever used the property for retail operations, let alone establish a retail -' i- operation. Pacific Strapping never obtained a City business license, never had a phone established for the W O location, and never obtained a permit to change the freestanding sign on the property. 2 Q . E. Based upon all information available to the City, e.g. utility records and conversations with the previous Z H tenant there is no indication that the property was even being used for retail operations after November 1, O 2003. This would mean the six -month period would have ended on May 1, 2003. z t- i ? Q The appellant has claimed that Statuary Garden had a lease that ran through November 2002 at the property in question. Once again, the property owner has never provided the City with a copy of the lease 0 H agreement. Merely having a lease for a property does not mean the property was actually used for retail W operations. H U W _ Even if Statuary Garden used the property through November, the six -month period for continuation of a Z I- non - conforming use would have ended on June 1, 2003. The business license for Canopy West was not 0 u submitted to the City Clerk until June 11, 2003. P I ; The burden of proof in establishing that the property is the continuation of a non - conforming use lies with the appellant not with the City. The City asked the property owner on numerous occasions to provide the needed documentation, which he failed to do. V. Conclusion The City action in denying the business license was not arbitrary or capricious. The City conducted an in- depth review of applicablq, City regulations and made a decision based upon all information available to the City. The proposed use, the retail sales of truck canopies, is not permitted in the underlying zoning. In addition, the property has lost its "non - conforming status and can no longer be used for this type of retail operation. VI. As we understand your business is primarily retail sales of canopies for trucks and other vehicles. The property that you• are interested in is zoned Manufacturing Industrial Center/Heavy (MIC/H). This zoning designation does not allow retail sales. We understand that this property was used for retail sales in the past. However, as you stated at our meeting, the property has been vacant for eight months. Per city's nonconforming chapter of the zoning code (TMC 18.70.040), if a nonconforming use ceases for any reason for a period of more than six consecutive months or a total of 365 days in a three year time period, which ever occurs first, it is no longer grandfathered. Please note that the City's Planning Commission will be holding a public hearing on June 26, 2003 and will look into the possibility of allowing office type of uses in this zone. If they decide to make any changes, it will probably be done as part of next year's Comprehensive Plan update. We do not know at this time what if any changes will be made. If you think this request should be broadened to include other uses besides office and would like to participate in the public process we will notify you of any scheduled public hearings by the Planning Commission and the City Council. Congestion represents a prob- lem, however, partly owing to the high number of single- occupancy vehicles. A number of street and intersection improvements will be necessary to maintain acceptable levels of service. Regional proposals for commuter rail and local rapid rail systems that include service to and through Tukwila could also provide travel alternaxtives for area employees and regional travelers. Each city in the Rural Area and King County and the Growth Management Planning Council shall work cooperatively to establish an Urban Growth Area for that city. Cities in this category include: Black Diamond, Carnation, Duvall, Enumclaw, North Bend, w w Snoqualmie and Skykomish. They have an important role as local trade and community centers. These —I t cities and towns are the appropriate providers of local rural services for the community. They also w u- contribute to the variety of development patterns and housing choices within the County. As municipali- w 0 ties, the cities are to provide urban services and be located within designated Urban Growth Areas. The urban services, residential densities and mix of land uses may differ from those of the large, generally western Urban Growth Area. co z � Z0 W • w U � O P O I— w 2 • O w Z U = O LU -37 All jurisdictions shall cooperate in developing comprehensive plans which are consistent with those of adjacent jurisdictions and with the Countywide Planning Policies. a. Include all lands within existing cities in the Rural Area; b. Be sufficiently free of environmental constraints to be able to support rural city growth without major environmental impacts; c. Be contiguous to city limits; d. Have boundaries based on natural boundaries, such as watersheds, topographical fea- tures, and the edge of areas already characterized by urban development; e. Be maintained in large lots at densities of one home per five acres or less with mandatory clustering provisions until such time as the city annexes the area; f. Be implemented through interlocal agreements among King County, the cities and special purpose districts, as appropriate, to ensure that annexation is phased, nearby open space is protected and development within the Urban Growth Area is compatible with surround- ing Rural and Resource Areas; and g. Not include designated Forest or Agricultural Production District lands unless the conser- vation of those lands and continued resource -based use, or other compatible use, is assured. D. Urban and Manufacturing /Industrial Centers Urban Centers are envisioned as areas of concentrated employment and housing, with direct service by high - capacity transit, and a wide range of other land uses such as retail, recreational, public facilities, parks and open space. Urban Centers are designed to 1) strengthen existing communities, 2) promote housing opportunities close to employment, 3) support development of an extensive transportation system to reduce dependency on automobiles, 4) consume less land with urban development, 5) maximize the benefit of public investment in infrastructure and services, 6) reduce costs of and time required for permitting, and 7) evaluate and mitigate environmental impacts. Manufacturing /Industrial Employment Centers are key components of the regional economy. These areas are characterized by a significant amount of manurfacturing, industrial, and advanced technology employment. They 20 ATTACHMENT K L. Z differ from other employment areas, such as business /office parks (see FW -I6 and LU- 70 -74), in that a land base and the segregation of major non-manufacturing uses are essential elements of their operation. FW -14 Within the Urban Growth Area, a limited number of Urban Centers which meet specific criteria established in the Countywide Planning Policies shall be locally designated. Urban Centers shall be characterized by all of the following: a. Clearly defined geographic boundaries; b. Intensity /density of land uses sufficient to support effective rapid transit; c. Pedestrian emphasis within the Center; JU d. Emphasis on superior urban design which reflects the local community; U O e. Limitations on single- occupancy vehicle usage during peak hours or commute purposes; w W f. A broad array of land uses and choices within those uses for employees and residents; g. Sufficient public open spaces and recreational opportunities; and N 1- h. Uses which provide both daytime and nighttime activities in the Center. Urban Centers Designation Process LU -39 The location and number of Urban Centers in King County were determined through the joint local and Countywide adoption process, based on the following steps: a. The Countywide Planning Policies include specific criteria for Urban Centers; b. Jurisdictions electing to contain an Urban Center provided the Growth Management Planning Council with a statement of commitment describing the city's intent and commitment to meet the Centers' criteria defined in these Policies and a timetable for the required Centers Programmatic Environmental Impact Statement or identification of existing environmental documentation to be used; and c. The Growth Management Planning Council reviewed the Centers nominated by local jurisdictions consistent with policy FW -1, and the following criteria: 1. The Center's location in the region and its potential for promoting a Countywide sys- tem of Urban Centers; 2. The total number of Centers in the County that can be realized over the next 20 years, based on 20 years projected growth; 3. The type and level of commitments that each jurisdiction has identified for achieving Center goals; and 4. Review of other jurisdictional plans to ensure that growth focused to Centers is assured. 21 "a6A ra.`'.. „tea z d. Urban Centers Criteria Urban Centers vary substantially in the number of households and jobs they contain today. The intent of the Countywide Planning Policies is to encourage the growth of each Urban Center as a unique, vibrant community that is an attractive place to live and work, that will support efficient public services including transit, and that responds to local needs and markets for jobs and housing. Two approaches are used to set guidelines and track the growth of Urban Centers. First, the Countywide Planning Policies establish levels of households and jobs needed to achieve the benefits of an Urban Center. Some Urban Centers will reach these levels over the next 20 years, while for others the criteria set a path for growth over a longer term and provide capacity to accommodate growth beyond the 20- year horizon. Second, jurisdictions establish 20 -year household and employment growth target ranges for each Urban Center. The target ranges reflect the diversity of the Centers, allowing communities to envision changes over the next 20 years and plan for needed services. The target ranges set a policy for the level of growth envisioned for each Center that not only considers land capacity but also the timing and funding of infrastructure. Reaching the target ranges will require planning, public investment, and incentives for private investments. Overtime the Centers will move toward the development pattern envisioned in the Countywide Planning Policies. Within the County, Urban Centers are expected to account for up to one -half of employment growth and one - quarter of household growth over the next 20 years. Additional capacity for household and employ- ment growth is provided in the Urban Growth Areas outside of designated Urban Centers to ensure that, Countywide, 20 -year growth projections will be accommodated. LU-40 Each jurisdiction which has designated an Urban Center shall adopt in its comprehensive plan a definition of the Urban Center which specifies the exact geographic boundaries of the Center. All Centers shall be up to one and a half square miles of land. Infrastructure and services shall be planned and financed consistent with the expected rate of growth. For the purposes of achieving a long -range development pattern that will provide a successful mix of uses and densities that will efficiently support high- capacity transit, each Center shall have planned land uses to accommodate: a. A minimum of 15,000 jobs within one -half mile of a transit center; b. At a minimum, an average of 50 employees per gross acre; and c. At a minimum, an average 15 households per gross acre. LU-41 In order to be designated as Urban Centers, jurisdictions shall demonstrate both that an ade- quate supply of drinking water is available to serve projected growth within the Urban Center and that the jurisdiction is capable of concurrent service to new development. LU-42 Jurisdictions which contain Urban Centers, in conjunction with METRO, shall identify transit station areas and rights -of -way in their comprehensive plan. Station areas shall be sited so that all portions of the Urban Center are within walking distance (one -half mile) of a station. 22 LU -43 In order to reserve rights -of -way and potential station areas for high- capacity transit or transit hubs in the Urban Centers, jurisdictions shall: a. Upon adoption of specific high - capacity transit alignments by METRO, adopt policies to avoid development which would restrict establishment of the high- capacity transit system; b. Preserve rights -of -way controlled by the jurisdiction which are identified for potential tran- Z sit use; and 2 H c Provide METRO an option to acquire property owned by the jurisdiction. 'i— w = ual 2 LU-44 To encourage transit use, jurisdictions should establish mechanisms to limit the use of single- J � occupancy vehicles for commuting purposes. Such mechanisms could include charging for U 0 long -term single- occupancy vehicle parking and /or limiting the number of off - street parking co W spaces for each Urban Center; establishing minimum and maximum parking requirements J I that limit the use of the single- occupant vehicle; and developing coordinated plans that H incorporate Commuter Trip Reduction guidelines. All plans for Urban Centers shall u3 0 encourage bicycle travel and pedestrian movement. 2 LU-45 Jurisdictions' comprehensive plans for Urban Centers shall demonstrate compliance with the U Urban Centers criteria. In order to promote urban growth within Centers, the Urban Center cn d plan shall establish strategies which: I W Z h- a . Support pedestrian mobility, bicycle use and transit use; 0 b. Achieve a target housing density and mix of use; z l— c. Provide a wide range of capital improvement projects, such as street improvements, W D schools, parks and open space, public art and community facilities; ] p d. Emphasize superior urban design; U co e. Emphasize historic preservation and adaptive reuse of historic places; p F- f. Include other local characteristics necessary to achieve a vital Urban Center; and W W g. Include facilities to meet human service needs. H v LL co LU -46 The system of Urban Centers shall form the land use foundation for a regional high- capacity Z transit system. Urban Centers should receive very high priority for the location of high - capac- w ity transit stations and /or transit centers. (See also LU -59) U = 0I 3. Incentives for Urban Centers In order to help create Urban Centers, incentives to jurisdictions to establish Urban Centers, and to the community to build in Urban Centers, should be established. The provision of high- capacity transit (HCT) is one such incentive. Others include funding, and streamlined permitting. LU -47 Countywide financing strategies shall be developed by the Growth Management Planning Council or its successor, which: LU-48 Each jurisdiction electing to contain an Urban Center shall prepare a Programmatic Environ- mental Impact Statement (PEIS) for each proposed Center. The PEIS shall be prepared in a comprehensive manner and shall address probable significant adverse environmental impacts from and reasonable alternatives to the proposal. These may include, but are not necessarily limited to subjects of areawide concern such as cumulative impacts, housing, schools, public utilities, and transportation. Subsequent project - specific proposals shall not be required to perform duplicative environmental review of issues which have been adequately reviewed in the PEIS, but shall provide additional environmental review of other issues. These may include, but are not necessarily limited to the direct impacts of the specific proposal, substan- tial changes in the nature of the proposal or information regarding impacts which indicate a. Identify regional funding sources; and b. Set priorities and allocate funds for urban facilities and services including social and human services, and subarea planning efforts, in Urban Centers. 23 . iln NV. V... ' Z probable significant adverse environmental impacts which were not adequately analyzed in the PEIS. Examples of project - specific direct impacts include local traffic impacts, site aes- thetics, and other issues not addressed by the PEIS. LU -49 In support of Centers, additional local action should include: a. Strategies for land assembly within the Center, if applicable; b. Infrastructure and service financing strategies and economic development strategies for the Centers; c. Establishing expected permit processing flow commitments consistent with the PEIS; and d. Establishing a streamlined and simplified administrative appeal process with fixed and certain timelines. LU -50 Jurisdictions should consider additional incentives for development within Urban Centers such as: a. Setting goals for maximum permit review time and give priority to permits in Urban Cen- ters; b. Policies to reduce or eliminate impact fees; c. Simplifying and streamlining of the administrative appeal processes; d. Eliminating project - specific requirements for parking and open space by providing those facilities for the Urban Center as a whole; and e. Manufacturingllndustrial Center Criteria u co o LU -52 Each jurisdiction which contains a regional Manufacturing /Industrial Center shall adopt in its p F comprehensive plan a definition of the Center which specifies the exact geographic bounda- Z ries of the Center. Jurisdictions with Manufacturing /Industrial Centers shall have zoning and detailed plans in place to achieve the following goals by the year 2010. a. Preserve and encourage the aggregation of vacant or non - manufacturing /industrial land parcels sized for manufacturing /industrial uses; b. Discourage land uses which are not compatible with manufacturing, industrial and advanced technology uses; c. Accommodate a minimum of 10,000 jobs; and d. Limit the size of offices and retail unless as an accessory use. LU -53 All jurisdictions support the development of a regional industrial siting policy to promote indus- trial activity. LU -54 Jurisdictions shall design access to the regional Manufacturing /Industrial Centers to facilitate the mobility of employees by transit, and the mobility of goods by truck, rail or waterway as appropriate. Regional comprehensive plans shall include strategies to provide capital improvement projects which support access for movement of goods. LU -55 Jurisdictions which contain regional Manufacturing /Industrial Centers in conjunction with tran- sit agencies, shall identify transit station areas and rights -of -way in each jurisdiction's compre- hensive plan. Where transit stations exist or are planned, jurisdictions in conjunction with transit agencies shall identify various options such as feeder systems, bicycle routes and pedestrian systems to link the Center with its transit stations. 25 LU -56 In order to reserve rights -of -way and potential station areas for high- capacity transit or transit hubs in the regional Manufacturing /Industrial Centers, jurisdictions shall: a. Upon adoption of specific high- capacity transit alignments by METRO, adopt policies to avoid development which would restrict establishment of the high- capacity transit system; b. Preserve rights -of -way controlled by the jurisdiction which are identified for potential tran- sit use; and c. Provide METRO an option to acquire property owned by the jurisdiction. LU -57 Transit agencies shall strive to provide convenient and economical mass transit service for the Manufacturing /Industrial Centers that will result in a decrease in single- occupancy non -com- mercial vehicle trips within the Centers. LU -58 Jurisdictions' comprehensive plans for regional Manufacturing /Industrial Centers shall demon- strate compliance with the criteria. In order to promote manufacturing /industrial growth, the Manufacturing /Industrial Center plan for each jurisdiction shall establish strategies: a. To provide capital facility improvement projects which support the movement of goods and manufacturing /industrial operations; b. To coordinate planning with serving utilities to ensure that utility facilities are available to serve such Centers; c. To provide buffers around the Center to reduce conflicts with adjacent land uses; d. To facilitate land assembly; and e. To attract the type of businesses that will ensure economic growth and stability. LU -59 Each Manufacturing Center containing a minimum of 15,000 jobs and having sufficient employment densities to support high- capacity transit should be served by high- capacity transit. It is recognized that by their nature, Manufacturing /Industrial Centers may not achieve densities necessary to make high- capacity transit service viable. Nevertheless, Manufacturing /Industrial Centers which are located on the regional high- capacity transit alignment and which meet the transit - friendly criteria in policies LU -54 through LU -58 above should receive one or more high- capacity transit stations and /or transit centers. 6. Incentives for Manufacturing /Industrial Centers LU -60 Countywide financing strategies shall be developed by the Growth Management Planning Council or its successor which: a. Identify regional funding sources; and b. Set priorities and allocate funds for urban facilities and services including social and human services in regional Manufacturing /Industrial Centers, and subarea planning efforts in Manufacturing /Industrial Centers. LU -61 Jurisdictions shall consider conducting detailed State Environmental Policy Act review for the regional Manufacturing /Industrial Center at the planning stage so that project - specific environ- mental review is minimized. While I concur that the MIC /H zoning designation within which this site lies does not allow retail sales I have researched the Tukwila Municipal Code (TMC) and I believe that the business that Canopy West would conduct at this location is consistent with those as stated in TMC 18.38.020. To summarize Canopy West's business, they intend to warehouse truck canopies and other accessories for sale and distribution, provide installation service and repair for truck canopies and other truck accessories, do the final manufacture and assembly of truck canopies and accessories, and manufacture crates for canopies for shipment. I believe these uses are consistent with the stated purpose in 18.38.010. I also feel that their business is allowable under subsection 2.b. and c. of Section 18.38.020 in conjunction with Section 44. Canopy West would also qualify under Section 18.38.020, Subsection 18 and 43. I also believe that their business is permitted under 18.38.040 Subsection 8. In regards to the retail use of the property I believe that virtually all of the businesses in this area offer sales to retail customers and that this use could comprise a majority of their business. Canopy West would likewise provide sales to both consumer and commercial accounts. Also, during our meeting I stated I thought it was about 6 months since the previous tenant had vacated the property. In looking back at my records the property in actuality-has_ not been out of use for more than 6 consecutive months. Therefore, this site is grandfathered for retail use under 18:70.040: I have asked Canopy West to proceed with their Tukwila Business License Application and would hope that the license can be issued promptly so that we may proceed assuredly with the repairs and maintenance and any improvements that may be made to the site with ample time to procure the permits that might be required. The first issue the letter address is the non - conforming status of the property followed with staff's response on whether the sales of canopies is an allowed use in the zone. The City believes that the property in question has lost its non - conforming status, based upon the information you have provided and staff research. Section 18.70.040 of the Tukwila Municipal Code notes if a non - conforming use ceases for any reason for a period of more than six consecutive months it will lose its nonconforming status. When you met with Rhonda Berry and myself in May, you noted that the property has been vacant for about eight months. Yet, in your letter dated June 4, 2003 it is now noted that the property has not been vacated for six consecutive months. Conversations with previous occupants noted that they had moved out around October. Utility records from Seattle City Light show the last billing for Lucioni Arts being November 9, 2003. These two facts support your earlier comment that the property has been vacant for eight months. My staff and you have been unable to find any facts that the property has been used for retail in the past six months. If you have any records that show that the property was actually used for retail sales prior to June 11, 2003, the date of business license application, the City will like to review the information and based upon new information would reconsider the loss of non - conforming status for the property. You noted in your letter that Canopy West's intends to "...warehouse truck canopies and other accessories for sale and distribution, provide installation service and repair for truck canopies and other truck accessories, do the final manufacture and assembly of truck canopies and accessories, and manufacture crates for canopies for shipment." Certain small -scale retail uses are allowed as a conditional use, but are limited to service establishments that serve other permitted uses or employees of MIC/H area. The comprehensive plan strictly prohibits general retail operations such as the one proposed that serve a market area larger than the MIC/H area. In regards to the proposed use being consistent with subsection 2 (b) and 2 (c) of section 18.38.020, staff does see how the sale of canopies is similar to a car wash or a body and engine repair shop. These uses do not engage in direct retail sales of products as the proposed use would. These uses are not intended to serve a consumer base outside of the MIC/H district. In addition, the body and engine repair shop must be enclosed within a building. The proposed use would not meet this condition. In order for the proposed use to qualify under section 18.38.040 subsection 18 and 43 retail sales to the public could not be the predominant use. Summary As noted, City staff believes that the property has lost its non - conforming status. In addition, the proposed use is not an allowed use in the MIC/H district. The Department of Community Development has received the business license application from the City Clerk's Office for Canopy West. The Department allow you time to provide any documentation that the property has been used for retail sales within the last six months. In regards to the continuation of a non - conforming use for my property at 11061 Tukwila Intl Blvd. the information the previous tenants provided the city is not factually or technically correct. There were two separate leases that the Lucionis had made with the previous owner of the property. Lucioni Arts (the manufacturing company op ted by Marco Lucioni) moved out of the building at 2922 S. 112 St. during the month of October 2002. The Secret Garden Status ad a separate lease for 11061 Tukwila Intl Blvd and occupied that space through November of 2002At this location Janice Lucioni operated a totally retail only operation targeting a regional, not local ci sumer market. With these correct data the continuation of non - conforming use becomes valid. I calculate that the 6 -month grandfathering of the non - conforming use would extend through May 2003. On May 28 of 2003 Pacific Strapping Inc. began retail sales from that location. Enclosed are postmarked photos of their retail operations at the former gas station site. Given these accurate facts and data I would ask that the city issue the business license to my prospective tenant, Canopy West so that we may proceed and consummate the lease between Nevsco, LLC and Canopy West and bring another quality business that will further enhance and serve the residents of the City of Tukwila. In regards to General Retail Sales in MIC /H I believe that City staff are misinterpreting the Comprehensive Plan. Please tell me how the selling of canopies to the final consumer does not directly support the manufacture of canopies. It is the final step in the distribution cycle that is the economic engine that this country is built upon. Every retail sale supports manufacturing. The city is cutting off its' toe to spite its' foot. Mr. Miles also states, " The comprehensive plan strictly prohibits general retail operations such as the one proposed that serve a market area larger than the MIC /H district." There is nothing general about Canopy West's operation; they are very specific and directly related to manufacturing. Every business in the MIC /H district relies heavily on serving a market area larger than the MIC /H district. I would warn the City of Tukwila and it's staff to be very careful about applying double standards in its' application and enforcement of statutes. The Constitution of the United States says in the XIV Amendment, Section 1 that, " No State shall make or enforce any law which shall abridge the privileges or immunities of citizens of the United States; nor shall any State deprive any person of life, liberty, or property, without due process of law. " By not granting the Business License to Canopy West the City of Tukwila is violating my rights under the Constitution. The proposed use is not a permitted use in the underlying zoning classification. 1. The proposed use is not a permitted use in the Manufacturing Industrial Center/Heavy Industrial • Retail sales of canopies are not permitted in the MIC/H district. The proposed use would be permitted in the following zoning classifications Neighborhood Commercial, Regional Commercial, Regional Commercial Mixed Use, Tukwila Urban Center, Commercial/Light Industrial, Light Industrial, Heavy Industrial, and Tukwila Valley South. 2. The property has lost its non - conforming status • In May of 2003, City staff met with the property owner and the business owner about locating at the proposed site. At this meeting it was noted that the property at 11061 Tukwila International Boulevard had been vacant for about eight months. In a letter dated May 29 2003, Mr. Jack Pace noted to the business owner and the property owner that per section 18.70.040 of the Tukwila Municipal Code, "if a nonconforming use ceases for any reason for a period of more than six consecutive months or a total of 365 days in a three year time period, which ever occurs first, it is no longer grandfathered ". • In a letter dated June 4, 2003 the property owner, Mr. Sven Bitners noted that the property has only been vacant for six months and not eight as previously noted. Mr. Bitners also concurred with the City that the MIC/H zoning designation does not allow retail sales. In response to the letter, the Planning Department called the previous tenants of the property Steven M. Seattle City Light had the last billing for Lucioni Arts being November 9, 2003. Planning staff asked for documentation from Mr. Bitners that would show the dates of when retail operations had taken place on the property. • A letter dated June 25, 2003 from Mr. Bitners and accompanying photographs were received by the Planning Department on June 27, 2003. In the letter, Mr. Bitners noted that Pacific Strapping has been using 11061 TIB for retail sales since May 28, 2003, yet this was not mentioned in the June 4, 2003 letter. No documenation was provided showing the end dates for the Lucioni Arts or The Secret Garden Statuary. Mr. Bitners submitted photographs of the site showing a changeable sign face advertising used strapping for sale. City staff has conducting research and has found no indication that Pacific Strapping or any business is using the property for retail activities. 1. Pacific Strapping does not have a business license to operate at 11061 TIB. The Pacific Strapping business license is at 2922 S. 112 Street. The business license application for Pacific Strapping at 2922 S. 112 Street mentions nothing of conducting retail sales. The description of business provided by Pacific Strapping notes, "manufacturing of polyester webbing and cord strapping." 2. There has never been a sign permit issued to Pacific Strapping for the sign that they are currently using at 11061 TIB. This freestanding sign and has been modifying in violation of City code. 3. There is no phone number for Pacific Strapping at 11061 TIB 4. A letter was sent to the site and was returned by the Post Office as "not deliverable, vacant ". Upon a visual survey of the property during hours of the day when retail businesses tend to be open, the following was observed: 1. A closed sign was hanging in the window 2. No hours of operations were posted 3. There is chain link fence around the entire perimeter of the property. The gate for the fence is closed and locked 4. There were no employees within the building 5. There are eight zoning classifications in the City that would permit the proposed use outright. Thank you also for your letter of May 29, 2003 regarding the location of a Canopy West Service Center on the site owned by Nevsco, LLC at 11061 Tukwila Int'I Blvd. (This is the actual address, not as stated in your letter.) While I concur that the MIC /H zoning designation within which this site lies does not allow retail sales I have researched the Tukwila Municipal Code (TMC) and I believe that the business that Canopy West would conduct at this location is consistent with those as stated in TMC 18.38.020. To summarize Canopy West's business, they intend to warehouse truck canopies and other accessories for sale and distribution, provide installation service and repair for truck canopies and other truck accessories, do the final manufacture and assembly of truck canopies and accessories, and manufacture crates for canopies for shipment. I believe these uses are consistent with the stated purpose in 18.38.010. I also feel that th i usiness is allowable under subsection 2.b. and c. of Section 18.38.020 in conjunction with Section 44. Canopy West would also qualify under Section 18.38.020, Subsection 18 and 43. I also believe that their business is permitted under 18.38.040 Subsection 8. In regards to the retail use of the property I believe that virtually all of the businesses in this area offer sales to retail customers and that this use could comprise a majority of their business. Canopy West would likewise provide sales to both consumer and commercial accounts. Also, during our meeting I stated I thought it was about 6 months since the previous tenant had vacated the property. In looking back at my records the property in actuality has not been out of use for more than 6 consecutive months. Therefore, this site is grandfathered for retail use under 18.70.040. I have asked Canopy West to proceed with their Tukwila Business License Application and would hope that the license can be issued promptly so that we may proceed assuredly with the repairs and maintenance and any improvements that may be made to the site with ample time to procure the permits that might be required.
