Mullet, Mayor After looking at the letter sent regarding Checker Transportation I think a letter from the Community Development Department would best regarding charter vehicles in the Manufacturing Industrial Center/Heavy (MIC/H) District. For purpose of defining "charter vehicle ", the current definition used by the Washington State Utilities and Transportation Commission shall be used. The letter you sent notes, "Checker Transportation will be permitted... ". The Department of Community Development does not approve or deny business license applications. Approval or denial is done by the City Clerk's Office after receiving comments from various City Departments. The Department of Community Development has concluded that a charter vehicle operation would be similar in nature to other permitted uses in the district, such as truck terminal, bus stations, and car rental facilities. Thus, a business engaged in charter vehicle operations, if it met all other requirements would be permitted in the MIC/H zoning. Please be aware that there are still other development standards that Checker Transportation will have to meet, such as parking requirements, signage, etc. In addition, other City Departments may have additional requirements that may have to be met. This is all part of the business license review process. In no way is this letter intended to imply that Checker Transportation will be granted a license to conduct business in the City, only that charter vehicle operations are allowed in the Manufacturing Industrial Center/Heavy Zoning. I represent Checker Transportation, Inc. Mr. Millman, owner of the company, applied for a 2003 Tukwila business license for his transportation company, and received a Notice of Denial dated July 15, 2003. We have since filed an Appeal. In the meantime, as suggested in the Notice, we have contacted Brandon Miles of your office. We advised Mr. Miles that my client has been doing business, and paying license fees to Tukwila for over twelve years. During that time, he or his companies have conducted various businesses in the city in the Manufacturing /Industrial Center- Heavy (MIC /H) District. One of the businesses he operated was a taxi cab business until 1995, and since that time a transportation company which among other business activities provides limousine service. At minimum, it would appear that Mr. Millman's business is entitled to status as a non - conforming use for the many years he has been operating in Tukwila, but this issue and those relating to his previous licenses, we will address on appeal if necessary. The purpose of this letter is to follow up on Mr. Miles' suggestion that we send your office a letter explaining why we believe that my client is entitled to a determination by you that his business falls within the class of "Other uses" under paragraph 44 of 18.38.020 of the Tukwila Municipal Code, and thus within the uses of the MIC /H District. We will set forth our reasons that the Checker's use meets the three requirements necessary for you to make a favorable determination. a. similar in nature to and compatible with other uses permitted outright in the district; My clients' transportation business involves purchasing and selling of vehicles ( the company already has an authorized auto sales license), maintaining, repairing, salvaging, RECEIVED AUG 0 4 2003 also admitted in Hawaii August 1, 2003 Page 2 and storing the vehicles, and also providing limousine services to individuals and businesses. The business is obviously similar in nature to many authorized businesses in the MIC /H District such as the various auto services including gas stations, car washes, body and engine repair shops, auto sales, auto parts and manufacturing businesses, salvage and wrecking operations, tow truck operations ( another business activity conducted in Tukwila by an affiliated company of my client), and truck terminals. The business is compatible with other uses permitted outright in the district. For example, he has supported these businesses by providing transportation and limousine services to the airport, city and other places. Some of these businesses are Museum of Flight , City of Tukwila, King County Airport , Galvin Flight Center, Clay Lacy, Penske Trucks, BCTI, and others. b. consistent with the stated purpose of this district; The purposes for the District as stated in 18.30.010 emphasize manufacturing and industrial uses, but include "other uses that support those industries ". As set forth above Checker Transportation provides services which support other stated uses, and furthermore, it purchases materials, supplies, and goods and services from those industries such as the nearby Chevron gas station, Husky International, Horizon Fort, Bernard Motors ( all of these businesses on the same street), Napa auto parts and Shucks. In connection with both a. and b. above we can supply letters from the above businesses in support of our statements above. c. consistent with the policies of the Tukwila Comprehensive Plan; The Tukwila Comprehensive Plan devotes considerable detail to the Tukwila's Manufacturing /Industrial Center (MIC) which includes the subject District. Noteworthy is a statement on page 125 which reads " The center is a major distribution hub well - served by automobile, truck, air, rail, and water transportation facilities. Congestion represents a problem, however, partly owing to the high number of single- occupancy vehicles." (underscoring supplied). Checker Transportation currently has 17 vehicles which fit the category of limousine or buses ( the latter are 10 in number and authorized as motor carriers under WUTC for 12 passengers) available to service the District and the entire MIC. In other words, Checker Transportation is essentially a bus system that has and will curtail congestion by reducing single- occupancy vehicle travel. In conclusion, we submit that Checkers Transportation is similar to and compatible with the other stated uses in the MIC /H District, and consistent with the stated cc client trul ours, rt ack n August 1, 2003 Page 3 purposes of the District, and consistent with the policies of the Tukwila Comprehensive Plan. In difficult business climate that most of them cities find themselves in today, I would expect that most cities would be happy to have an active, successful business providing revenue, supporting and patronizes other businesses in the community, and reducing congestion. We respectfully submit that you make a determination confirming this so that my client can continue conducting the businesses that he has operated in Tukwila for over twelve years. Z .
