U_ ~p: U (4' H � O Z Notice of Decision Wetland Reduction, PSE South Site, L03 -056 Page 3 of 5 Vicinity /Site Information Project Description Surrounding Land Uses BACKGROUND FINDINGS Puget Western is proposing grading activity for their parcel located south of the substation on West Valley Highway. There is an offsite Type I wetland located to the east of the property. Tukwila Municipal Code (TMC) 18.45.040 requires that 100 -foot buffer be maintained around Type I wetlands. The 100 -foot buffer for the offsite wetland extends onto the Puget Western property. The applicant has requested that the buffer area be reduced 50- percent to a 50 -foot buffer. Existing Development The property is currently undeveloped. Puget Sound Energy has an easement on the property for overhead transmission lines. This project will not impact that easement. The subject site is bound to the north by the PSE substation, to the east by the Interurban Trial, to the south by commercial properties, and to the west by West Valley Highway. The offsite wetland is located between the Burlington Northern Santa Fe Railroad line and Interurban Trail. It is important to note that the Interurban Trail goes through the wetland buffer area. The proposed work includes the grading and importing of 3,500 cubic yards of fill material. There are no specific development plans at this time. The Determination of Non - Significance was issued January 16, 2004. The project also triggered a Shoreline Permit, which was issued on January 19, 2004. The wetland area is not within the shoreline area of the Green River. • Notice of Decision Wetland Reduction, PSE South Site, L03 -056 Page 4 of 5 SPECIAL PERMISSION FROM THE DIRECTOR CRITERIA Tukwila Municipal Code 18.45.040 (C)(4)(a) states the authority that the Community Development Director has to reduce the required buffer area for a wetland: The Director may reduce the standard wetland /watercourse buffers on a case -by -case basis provided the buffer does not contain slopes 20 percent or greater. The approved buffer width shall not result in greater than a 50 percent reduction in width, and the reduced buffer shall not be less than 15 feet for wetlands and ten feet for watercourses. Any buffer reduction proposal must demonstrate to the satisfaction of the Director that it will not result in direct or indirect, short term or long -term adverse impacts to the wetland, and that: (1) The buffer is vegetated and includes an enhancement plan as may be required to improve the buffer function and value; or (2) If there is no significant vegetation in the buffer, a buffer may only be reduced only if an enhancement plan is provided. The plan must include using a variety of native vegetation that improves the functional attributes of the buffer and provides additional protection for the wetland or watercourse functions and values. Analysis The applicant is requesting to reduce the wetland buffer by 50- percent to 50 -feet. There are no slopes in the wetland buffer area greater than 20 percent. The enhanced buffer will be 23 feet of the remaining buffer area. The total enhanced area will be 5,045 square feet. A total of 98 new plantings will occur in the enhancement area. The existing buffer provides very little function as a buffer to the wetland. The vegetation in the buffer currently includes, reed canarygrass, Canadian thistle, Himalayan blackberry, and salmonberry. The applicant has proposed a planting strip between the subject property and the Interurban Trail. Vegetations to be planted in the planting strip include native vegetation such as red -twig dogwood, black hawthorn, beaked hazelnut, wood rose, and ocean spray. • The proposed wetland reduction will not have any short -term or long -term adverse impacts on the wetland. A secondary benefit of the enhancement is that the new vegetation will provide a buffer between the trail and the PSE property. The following are my comments and recommendations related to technical review of the proposed wetland buffer enhancement plan (Wetland Buffer Enhancement Planting Plan, Schedule, Notes, Materials, and Details — PSE South Site). The plan is provided, per the Sensitive Areas Ordinance, because the required wetland buffer of 100 feet will be reduced by 50 percent for the land altering permit and future development of the site. The revised buffer plan is "date received" November 14, 2003 has added an area of about 20 feet wide for enhancement plantings that is adjacent to the PSE site. This area is currently a grass swale and can be greatly improved. I recommend approval of the revised Plan as it is but offer some comments for the applicant and consultant. Due to the existing public trail and prior maintenance road use by Puget Sound Energy, the buffer area adjacent to the Type 1 wetland was cleared years ago. Therefore, the primary goal of the enhancement plan is to add native plants for habitat in an area that has little cover. Additional wetland protection is not expected to occur. II. Maintenance & Monitoring Because the enhancement site is dominated by reed canarygrass, I recommend that some of the monitoring time be used to assist with maintenance training, if needed. Many mitigation sites have been impacted by contractor weed clearing. Establishing a large diameter mulch bed around the new shrub plantings will help prevent maintenance injury. A Sensitive Areas Bond Quantity Worksheet was submitted. The total cost estimate for the project is $ 5,704.23. Using the 150% multiplier, the bond total will be $ 8,556.35. Steven M. The City of Tukwila regulates sensitive areas buffers under Tukwila Municipal Code (TMC), Section 18.45.040. The standard 100 -foot wetland buffer may be reduced by 50 percent with special permission from the director and upon meeting the requirements outlined in TMC Section 18.45.040.C.4. This plan has been written in accordance with communications between Gary Schulz of the City of Tukwila and Barghausen Consulting Engineers, Inc., ecologists, and a letter outlining the requirements of TMC Section 18.45.040.C.4 for buffer reduction (City of Tukwila, dated September 10, 2003). The current proposal as discussed with Gary Schulz includes reducing the 100 -foot wetland buffer to 50 feet and providing vegetation enhancement along the east property boundary pursuant to the wetland buffer enhancement plan. The wetland buffer does not contain slopes 20 percent or greater. The proposed buffer width will not result in greater than a 50 percent reduction in width and the buffer is proposed to be enhanced to improve the existing buffer functions and values. The approximately 0.50 -acre (22,000- square foot) site is currently undeveloped and is located within the 200 -foot shoreline of the Green River. The site is located within an area commercially developed, bounded by the Interurban Trail to the east, a power substation to the north, and commercial development to the south. For a complete description of the subject property, refer to the Wetland Determination Report for Puget Western Inc., PSE South Site (Barghausen Consulting Engineers, Inc., 2003). A palustrine scrub -shrub wetland is located approximately 50 feet east of the subject site adjacent to the Interurban Trail. The off -site wetland is inventoried and rated by the City of Tukwila as a Type 1 wetland with a buffer requirement of 100 feet, of which approximately 50 feet extend onto the project site. The wetland buffer on the project site includes reed canarygrass, Canadian thistle, Himalayan blackberry, and salmonberry. The enclosed planting plan is limited to the planting of native trees and shrubs as enhancement for the proposed wetland buffer reduction. Species to be planted and planting specifications are shown on the enclosed Sheet WL -1. 1. Mitigation Goals and Objectives: The goal protect existing off -site wetlands includes establishing non - invasive, native vegetation in the on -site wetland buffer that is proposed to be reduced. The specific compensatory objective is to increase the wetland buffer function by increasing the plant species diversity and habitat structure of the wetland buffer. The wetland buffer reduction will not result in direct or indirect short- or long -term adverse impacts to the wetland. Enhanced wetland buffer vegetation has been designed to result in higher function than currently exists in the wetland buffer. The proposed plantings will provide a dense screen of native vegetation between the project site and the Interurban Trail. 2. Mitigation Implementation Procedures: A wetland ecologist will be present on site during construction of the wetland buffer plantings to monitoring activities, including placement and planting of the specified plants. After the wetland buffer enhancement project has been completed and vegetation has been established, the wetland ecologist will provide an as- built/baseline monitoring report and photographs from field- determined established photograph points to the City of Tukwila for approval. 3. Mitigation Monitoring: The wetland buffer plantings will be monitored for two years to document the degree of success or failure in achieving the performance objectives and to identify remedial action. For this mitigation project we propose to use the health of vegetation to gage the success of the project. The planted species will be monitored for vigor and survival. The overall target survival rate will be 100 percent the first year and 80 percent of the planted shrub and tree species, as measured in representative plots, for year two. Mitigation trees and shrubs will be guaranteed by the landscape contractor for one year. No more than 10 percent cover of nonnative or other invasives, e.g., Himalayan blackberry, Japanese knotweed, evergreen blackberry, Scot's broom, English ivy, and morning glory, is permissible in the overall mitigation area in any monitoring year. The site is currently dominated by reed canarygrass; therefore, it is not anticipated that annual maintenance will establish 10 percent or less cover of reed canarygrass in the mitigation area. Removal (weed - eating) of reed canarygrass within 24 inches of the planted trees and shrubs should be completed in May and September for two years. Monitoring will be accomplished by tallying survival of trees and shrubs by species and photographing the mitigation area from established photograph points. Photographs will be taken from established photograph points to evaluate vegetation community response over time. If it is determined that planted tree and shrub species are being replaced or out - competed by native shrubs or trees that grow voluntarily, the success criteria will be met only if the number of volunteer and planted shrub and tree species in the mitigation area meet or exceed the number of shrub and tree plants required in the area for that year. If these performance standards are not met, the cause of the failure to meet the performance standard will be evaluated, and action will be taken to rectify the problem until the objectives are achieved. After the wetland buffer mitigation project has been completed and vegetation has been established, the wetland specialist will provide an as- built/baseline monitoring report to the City of Tukwila for approval. After the initial assessment, the mitigation project will be monitored in the late (August to mid - September) growing season for the first and second years. A letter documenting survival of mitigation plants and photographs of the mitigation area will be submitted to the City of Tukwila by December for years one and two. 4. Contingency Plan: The following events could affect the success of the wetland and buffer mitigation project. Prior to implementing any of the contingency plans, the regulatory agency will be contacted for approval. The two identified events and the contingency for the events follows. Gust Erickson Puget Western, Inc. -3- November 10, 2003 Event: Mortality of planted vegetation in accordance with performance standards. Contingency: The landscape contractor must conduct quarterly monitoring of the health of all the newly introduced plant material for one year after the date of acceptance of the planted material. Replace planted material as necessary during the appropriate planting seasons. After the first year, plant survival will be monitored by the wetland specialist, and if plant mortality in the monitoring plots is greater than 20 percent in one year, the causes for observed plant mortality will then be evaluated. If performance standards have not been met, replacement plant material will be prescribed based on this evaluation. The landscape contractor is responsible for replacing plant material during the first year after implementation. After the first year, the project owner is responsible for plant replacement. Event: Non - availability of specified native plant materials. Contingency: Plant species substitutions, other than those listed as alternate, must first be authorized by a wetland specialist and the regulatory agency. Replacement species will be specified at a schedule appropriate and consistent with species planting requirements and the overall wetland buffer mitigation objectives. The findings and conclusions documented in this report have been prepared for specific application to this property. They have been developed in a manner consistent with that level of care and skill normally exercised by members of the environmental science profession currently practicing under similar conditions in the area. Our work was also performed in accordance with the terms and conditions set forth in our proposal. The conclusions and recommendations presented in this report are professional opinions based on an interpretation of information currently available to us, and are made within the operation scope, budget, and schedule of this project. The City of Tukwila regulates sensitive areas buffers under TMC, Section 18.45.040. The standard 100 -foot wetland buffer may be reduced by 50 percent with special permission from the director and upon meeting the requirements outlined in TMC 18.45.040.C.4. This plan has been written in accordance with communications between Gary Schulz at the City of Tukwila and Theresa Dusek from Barghausen Consulting Engineers, Inc, and a letter outlining the requirements of the Tukwila Municipal Code 18.45.040.C.4 for buffer reduction (City of Tukwila, dated September 10, 2003). The current proposal as discussed with Gary Schulz includes reducing the 100 -foot wetland buffer to 50 feet and providing vegetation enhancement along the east property boundary per this Wetland Buffer Enhancement Plan. The wetland buffer does not contain slopes 20 percent or greater, the proposed buffer width will not result in greater than a 50 percent reduction in width, and the buffer is proposed to be enhanced to improve the existing buffer functions and values. The approximately 0.50 acre (22,000 - square foot) site is currently undeveloped, and is located within the 200 -foot shoreline of the Green River. The site is located within an area commercially developed; bounded by the Interurban Trail to the east, a power substation to the north, and commercial development to the south. For a complete description of the subject property, refer to the Wetland Determination Report for Puget Western Inc., PSE South Site ( Barghausen Consulting Engineers, Inc., 2003). A palustrine scrub -shrub wetland is located approximately 50 feet east of the subject site, adjacent to the Interurban Trail. The off -site wetland is inventoried and rated by the City of Tukwila as a Type 1 wetland with a buffer requirement of 100 feet, of which approximately 50 feet extend onto the project site. The wetland buffer on the project site includes reed canarygrass, Canadian thistle, Himalayan blackberry, and salmonberry. The enclosed planting plan is limited to the planting of native trees and shrubs as enhancement for the proposed wetland buffer reduction. Species to be planted and planting specifications are shown on the attached Sheet 1. The goal protect existing off -site wetlands includes establishing non - invasive, native vegetation in the on -site wetland buffer that is proposed to be reduced. The specific compensatory objective is to increase the wetland buffer function by increasing the plant species diversity and habitat structure of the wetland buffer. The existing wetland buffer has been highly impacted due to the Interurban Trail, a paved multi - purpose trail, bisecting a large portion of the wetland buffer. The proposed plantings will provide a dense screen of native vegetation between the project site and the Interurban Trail. A wetland ecologist will be present on -site during construction of the wetland buffer plantings to monitoring activities including placement and planting of the specified plants. After the wetland buffer enhancement project has been completed and vegetation has been established, the wetland ecologist will provide an as- built/baseline monitoring report and photographs from field- determined established photo points to the City of Tukwila for approval. The wetland buffer plantings will be monitored for one year to document the degree of success or failure in achieving the performance objectives and to identify remedial action. For this mitigation project we propose to use the health of vegetation to gage the success of the project. The planted species will be monitored for vigor and survival, with a required survival rate of 100 percent the first year. Mitigation trees and shrubs will be guaranteed by the landscape contractor for one year. Monitoring will be accomplished by tallying survival of trees and shrubs by species and photographing the mitigation area from established photo points. Photographs will be taken from established photo points to evaluate vegetation community response over time. A letter documenting survival of mitigation plants and photos of the mitigation area will be submitted to the City of Tukwila by December one year after implementation of the mitigation plan. The findings and conclusions documented in this report have been prepared for specific application to this property. They have been developed in a manner consistent with that level of care and skill normally exercised by members of the environmental science profession currently practicing under similar conditions in the area. Our work was also performed in accordance with the terms and conditions set forth in our proposal. The conclusions and recommendations presented in this report are professional opinions based on an interpretation of information currently available to us, and are made within the operation scope, budget, and schedule of this project.
