The City review indicates that the application complies with applicable City regulations. In our review of the documents submitted the proper information that is needed for King County has not been provided. Please provide the following: 1. Legal descriptions need to be provided of the lots before the lot consolidation and after the lot consolidation. 2. A neat and readable plan drawn to a scale showing the following: • A north arrow • Property lines, with those that remain in their existing location shown as solid line, those that are being moved or removed shown as dashed lines, and those that have been relocated as solid line and clearly identified as a relocated line. • The map also needs to show the City of Tukwila right of way that will transverse through the lot. • Location of any adjacent roads. Please note that the map does not have to be professionally created. 3. In preparing these documents they must meet the format requirements of the King Count Recorder's Office. You will find those format requirements with this letter. Once the documents are prepared, please submit them to the City for the necessary City signatures. Her home sits on Lots 2, and 4 of Block 15. She owns of Lots 2, 3, 4, 5, & 6 of Block 15 and Lots 1, 2, 3, 4, 5 6 of Block 14 (with the exception of the Seattle City Light right of way) and Lots 1, 2, 3, 4, 5, 6 of Block 13 of Best's Replat of a portion of Pottery Works and would like to build a barn uphill from her existing house. She proposes consolidating Lots on the west side of 47 Av. S. with the lots on the east side of 47 Ay. S. 47 Av. S. is a public right of way that is unimproved and has been unimproved since its recording in 1963. According to Bob Meinick, J.D.S. of Municipal Research Services, the proposal does not create substandard lots, the consolidation does not create more lots than currently exist, and therefore the proposed action is not illegal. Background The property owner would like to build a barn on lot other than the lot on which her home is located. Private stables are permitted accessory uses in the LDR zone (18.10.030 TMC.) "Accessory uses" means a use incidental and subordinate to the principal use and located on the same lot or in the same building as the principal use. (18.06.070 TMC.) Proposed Action Process a Lot Consolidation application and approve the lots of Block 15 to be consolidated with the Lots of Block 14 and allow a right of way to bisect the new consolidated lot. Additional legal lots may not be created. A Lot Consolidation is the elimination of property lines and the consolidation of two or more lots into fewer lots. REQUIREMENTS: All amended lots must meet minimum lot sizes and otherwise satisfy the review criteria. The current standards apply even if the original lots did not conform. No amended lots may create a nonconformity or increase the level of non - conformity with any current regulations. PROCEDURE: The process for both a Boundary Line Adjustment and for a Lot Consolidation consists of three steps: preliminary approval, final approval and recording. Within 28 days of receiving your application, City staff will determine if it is complete based on the attached "Complete Application Checklist ". 'If not, you will be mailed a letter outlining what additional information is needed. PRELIMINARY APPROVAL: Once the application is complete it will be reviewed by the Short Subdivision Committee, made up of Fire, Public Works and Community Development department heads. The Committee will issue a decision to approve, modify or deny the application based on the review criteria in Chapter 17.08 of the Tukwila Municipal Code. FINAL APPROVAL: After the preliminary approval conditions have been met, an application for final approval shall be submitted to DCD for final review. A complete final application shall consist of the documents required for recording including: 1. Drawing or survey of the Boundary Line Adjustment/Lot Consolidation, 2. Before and after legal descriptions of the affected lots, 3. Affidavit of Ownership signed by all owners, 4. Application on a form provided by the Department of Community Development, 5. Other documentation necessary to demonstrate the conditions of the approval have been met. Upon receiving approval from the City, the applicant will be responsible for picking up the documents from DCD and recording them with King County Recorders Office.
