DECISION III. YOUR APPEAL RIGHTS SEPA Determination: The City SEPA Responsible Official has previously determined that the project, as proposed, does not require a threshold determination under SEPA because it qualifies as a planned action pursuant to WAC 197 -11 -172, that the probable significant adverse environmental impacts of the project were adequately analyzed in the EIS previously prepared for the planned action and will implement the conditions and mitigation measures imposed by the planned action approval. Decision on Substantive Permit: The City Community Development Director has determined that the application for a Shoreline Substantial Development Permit does comply with applicable City and state code requirements and has approved that application, subject to the condition which are set forth in the Decision based on the findings and conclusions contained in the staff report. The Decision on this Permit Application is a Type 2 decision pursuant to Tukwila Municipal Code §18.104.010. Other land use applications related to this project may still be pending. One administrative appeal to the Shorelines Hearings Board of the Decision is permitted. Any person appealing to the Shorelines Hearings Board may raise certain SEPA issues as part of the appeal to the Shorelines Hearings Board. Appellants should consult the rules and procedures of the Shorelines Hearings Board for details. IV. PROCEDURES AND TIME FOR APPEALING The requirements and procedures for appeals to the Shorelines Hearings Board are set forth in RCW 90.58 and WAC 461.08. V. Project Description The project is to install an air sparging and soil vapor extraction system for groundwater remediation purposes. The purpose of this system is to mitigate the migration of volatile organic compounds present in site groundwater and reduce the potential of these compounds to discharge to the Duwamish Waterway located adjacent to the western property boundary. The scope of the work includes sawcutting and removal of approximately 2,300 square feet of asphalt and concrete pavement, excavation of approximately 260 cubic yards of material from the sawcut area, backfilling of the excavation following installation of the air sparging and soil vapor extraction systems and restoration of the asphalt and concrete surface. Mullet, Mayor II. Policies of the Shoreline Management Act /Shoreline Master Program The site is located in an area that was annexed by Tukwila from King County in 1989. As no new shoreline master program has been adopted for this area, the project is subject to King County Shoreline Master Program and regulations. Tukwila is the agency responsible for administering King County shoreline regulations as they pertain to this site. III. Shoreline Regulations Following are the relevant review criteria as contained in the King County Shoreline Regulations as applied by the City of Tukwila: King County Code (KCC) Section 25.16.030 General Requirements: A. Non -water related development shall not be permitted waterward of the Ordinary High Water Mark (OHWM). Response: The proposed project is not water ward of the ordinary high water mark. B. ...No structure shall exceed a height of a thirty -five feet ... Response: No structures are proposed as part of this project. C. All development shall be required to provide adequate surface water retention and sedimentation facilities during the construction period. Response: The proposed project will meet all King County Surface Water Design Manual requirements for retention and sedimentation facilities during the construction period. D. Development shall maintain the first fifty feet of property abutting a natural environment as required open space. Response: This criterion is not applicable, as the King County shoreline environment designation adjacent to this site is "Urban Environment ". E (1) Parking areas must be located beneath or upland of the development... E (2) Any outdoor parking area perimeter...must be maintained as a planting area with a minimum of five feet. E (3) One live tree...shall be required for each thirty linear feet of planting area. E (4) One live shrub...for each 60 inches of planting area shall be required. E (5) Additional perimeter and interior landscaping of parking areas may be required when large parking areas are proposed. Response: No parking is proposed as part of this project. 2 F. Collection facilities to control and separate contaminants shall be required where storm -water runoff from impervious surfaces would degrade or add to the pollution of receipt waters or adjacent properties. Comprehensive Plan Shoreline Policies The site is located within the Manufacturing/Industrial Center along the Green/Duwamish River. The Tukwila Comprehensive Plan establishes the following priorities in this shoreline environment: V. SEPA and other approvals The proposed project was determined to be a Planned Action and a Notice of Decision was issued on January 2, 2004. Based on the determination of the project as a Planned Action, it was concluded that all impacts associated with this project were mitigated as part of 1998 EIS and no further SEPA review or threshold determination was required. The applicant is responsible for meeting all state and federal regulations related to contamination issues on the site. V. For estimating purposes lets assume that we may remove up to 500 cubic yards of soil in an area extending approximately 25 feet both east and west of the trench along the proposed 40 foot length to a depth of 7 feet. A revised map of the potential excavation area is attached. Please note that the excavation will only extend as far as necessary to remove impacted soil which may ultimately be very limited in extent. Also please note that my main interest is to start the excavation work quickly to resume construction of the Air Sparging /Soil Vapor Extraction System. If removal of 200 cubic yards of soil is more likely to be approved than 500 then please follow -up with the original request. We believe that this removal action is consistent with the requirements of WAC 173 -27 -100. Please advise as to what further steps we need to take or approvals to seek. The impacted soil was discovered during the excavation of a trench to accommodate an Air Sparging /Soil Vapor Extraction System (AS /SVE) on the west side of the facility. This project is being conducted under a Voluntary Cleanup Program with the WA Department of Ecology. The City of Tukwila already granted the Shoreline Permit #L03 -067 for the AS /SVE construction. The Shoreline permit was necessary since the location of the AS /SVE system is within 200 feet from the Duwamish River. As discussed, soil potentially impacted with petroleum hydrocarbons appears to extend for 30 linear feet along the trench and up to 6 feet deep. PACCAR wishes to remove the soil, properly dispose of it and backfill the excavation prior to continuing with the AS /SVE installation. It is not possible at this time to predict the lateral extent of the impacted soil and the quantity of soil that will be necessary to remove. PACCAR is planning to extend the soil removal for at least 10 feet on both sides of the system. The volume of soil to be removed will be a minimum of 40 feet long, 20 feet wide and 7 feet deep. Allowing for 20% additional soil, this amounts to a range of between 200 to 240 cubic yards of soil. The proposed excavation area is showed in the attached drawing. The actual soil excavation may have a different shape from what is indicated in the drawing depending upon the actual location of impacted soil. We believe the proposed work is in conformance with the existing shoreline permit and will have a beneficial environmental impact. PACCAR wishes to proceed immediately with the soil removal in order to finalize the construction of the AS /SVE system and to meet the project schedule previously agreed with the Department of Ecology. Based on our conversations with Mr. Brandon Miles, it is our understanding that the PACCAR Inc site is subject to the King County Shoreline Master Plan. We understand that the City of Tukwila z will review the Shoreline Permit Application against the King County Shoreline Regulations (K.C.C.25.16), particularly the general requirements of K.C.C.25.16.030, which were specifically w w listed in the Shoreline Permit Application. Development proposed on shorelines of the State shall maintain setbacks, provide easements or otherwise develop the site to permit a trail to be constructed or public access to continue where: 1. There is a proposed trail in the King County Trail System; or 2. Part of the site is presently being used and has historically been used for public access. The scope of the work included sawcutting and removal of approximately 2,300 square feet of asphalt and concrete pavement, excavation of approximately 260 cubic yards of material from the sawcut area, backfilling of the excavation following installation of the air sparging and soil vapor extraction systems and restoration of the asphalt and concrete surface. The purpose of this system is to mitigate the migration of volatile organic compounds present in the site groundwater and reduce the potential of these compounds to discharge to the Duwamish Waterway located adjacent to the western property boundary. This project is being performed under the Ecology's Voluntary Cleanup Program. Description of the revision: During construction of the trench for the installation of the air sparging and soil vapor extraction system, contaminated soil (with petroleum hydrocarbons) was discovered in the vicinity of the trench. In addition to the original scope of work, the applicant is proposing to remove and properly dispose the contaminated soil. The additional volume of soil to be removed will be about 40 feet long, 50 feet wide and 7 feet deep, which amounts to approximately 500 cubic yards. Review of the revision SEPA addendum was issued for the revised scope of work. The revised scope of work is within the "scope and intent of the original" Shoreline permit consistent with the criteria for listed under WAC173 -27- 100(2). ctions on any such permit or approval. It is the respon- tty of the applicant to inform the local government of the ndency of other permit applications filed with agencies other than the local government and of any related adminis- trative and legal actions on any permit or approval. If no notice of the pendency of other permits or approvals is given to the local government prior to the date established by the shoreline permit or the provisions of this section, the expira- tion of a permit shall be based on the shoreline permit. (4) When permit approval is based on conditions, such conditions shall be satisfied prior to occupancy or use of a structure or prior to commencement of a nonstructural activ- ity: Provided, That an alternative compliance limit may be specified in the permit. (5) Revisions to permits under WAC 173 -27 -100 may be authorized after original permit authorization has expired under subsection (2) of this section: Provided, That this pro- cedure shall not be used to extend the original permit time requirements or to authorize substantial development after the time limits of the original permit. (6) Local government shall notify the department in writ- ing of any change to the effective date of a permit, as autho- rized by this section, with an explanation of the basis for approval of the change. Any change to the time limits of a permit other than those authorized by this section shall require a new permit application. [Statutory Authority: RCW 90.58.140(3) and (90.58).200. 96-20-075 (Order 95 -17), § 173 -27 -090, filed 9/30/96, effective 10/31/96.] WAC 173-27-100 Revisions to permits. A permit revi- sion is required whenever the applicant proposes substantive changes to the design, terms or conditions of a project from that which is approved in the permit. Changes are substantive if they materially alter the project in a manner that relates to its conformance to the terms and conditions of the permit, the master program and/or the policies and provisions of chapter 90.58 RCW. Changes which are not substantive in effect do not require approval of a revision. When an applicant seeks to revise a permit, local govern- ment shall request from the applicant detailed plans and text describing the proposed changes. (1) If local government determines that the proposed changes are within the scope and intent of the original permit, and are consistent with the applicable master program and the act, local government may approve a revision. "Within the scope and intent of the original permit" all of the following: (a) No additional over water construction is involved except that pier, dock, or float construction may be increased by five hundred square feet or ten percent from the provisions of the original permit, whichever is less; (b) Ground area coverage and height may be increased a maximum of ten percent from the provisions of the original permit; (c) The revised permit does not authorize development to exceed height, lot coverage, setback, or any other require- ments of the applicable master program except as authorized under a variance granted as the original permit or a part thereof; [Title 173 WAC —p. 162] Title 173 WAC: Ecology, Department of (d) Additional or revised landscaping is consistent with any conditions attached to the original permit and with the applicable master program; (e) The use authorized pursuant to the original permit is not changed; and (f) No adverse environmental impact will be caused by the project revision. (3) Revisions to permits may be authorized after original permit authorization has expired under WAC 173 -27- 080(2). The purpose of such revisions shall be limited to authoriza- tion of changes which are consistent with this section and which would not require a permit for the development or change proposed under the terms of chapter 90.58 RCW, this regulation and the local master program. If the proposed change constitutes substantial development then a new per- mit is required. Provided, this subsection shall not be used to extend the time requirements or to authorize substantial development beyond the time limits of the original permit. (4) If the sum of the revision and any previously approved revisions under former WAC 173 -14 -064 or this section violate the provisions in subsection (2) of this section, local government shall require that the applicant apply for a new permit. (5) The revision approval, including the revised site plans and text consistent with the provisions of WAC 173- 27 -180 as necessary to clearly indicate the authorized changes, and the final ruling on consistency with this section shall be filed with the department. In addition, local govern- ment shall notify parties of record of their action. (6) If the revision to the original permit involv a condi- tional use or variance, local government shall submit the revi- sion to the department for the department's approval, approval with conditions, or denial, and shall indicate that the revision is being submitted under the requirements of this subsection. The department shall render and transmit to local government and the applicant its final decision within fifteen days of the date of the department's receipt of the submittal from local government. Local government shall notify parties of record of the department's final decision. (7) The revised permit is effective immediately upon final decision by local government or, when appropriate under subsection (6) of this section, upon final action by the department. (8) Appeals shall be in accordance with RCW 90.58.180 and shall be filed within twenty -one days from the date of receipt of the local government's action by the department or, when appropriate under subsection (6) of this section, the date the department's final decision is transmitted to local government and the applicant. Appeals shall be based only upon contentions of noncompliance with the provisions of subsection (2) of this section. Construction undertaken pursu- ant to that portion of a revised permit not authorized under the original permit is at the applicant's own risk until the expi- ration of the appeals deadline. If an appeal is successful in proving that a revision is not within the scope and intent of the original permit, the decision shall have no bearing on the original permit.
