Please let me know if I have p I - incorrectly summarized your position. z Re: Wynn property 14607 Tukwila Int'l Blvd Dear Mr. Miles: Your letter included a couple of inaccuracies which I want to bring to your attention. First, your assertion, in the third paragraph of the first page, that the property was not used in conjunction with auto sales is wrong. After Mr. Lancaster's 2001 letter my client resumed renting the lot to the adjoining auto dealer, prior to December, 2001, and the auto dealer has continued to use the property ever since. Second, the effects of allowing a conforming use to operate on the property was not discussed with the property owner and was not an issue in Mr. Lancaster's 2001 letter. That letter cited TMC 18.70.040(3), dealing with discontinuance of a non - conforming use, not TMC 18.70.040(6), cited in your letter. In any event, under the circumstances neither section would prohibit use of the property for auto sales. TMC 18.70.040(3), discussed in my prior exchange with Mr. Lancaster, concerns the abandonment of a nonconforming use. Under the Tukwila Municipal Code, "Use" means the nature of the occupancy, the type of activity, or the character and form of improvements to which land is devoted or may be devoted." Under Washington case law, there must be some intent, or manifestation of intent, to abandon the use before a non - conforming use may be deemed abandoned under a code like Tukwila's, see Andrew v. King County, 21 Wn.App. 566, 586 P.2d M 509 (1978), and University Place v. McGuire, 102 Wn.App. 658 (Sept. 2000). The time element set forth in Tukwila's code serves as evidence of that intent. In this case, the same use that supported Mr. Lancaster's determination that the nonconforming use had not been abandoned prior to January, 2001, was resumed prior to December 2001, and has not been abandoned since. In other words, there has been no abandonment of the established nonconforming use. TMC 18.70.040(6), deals with abandonment which is manifested through substitution of a permitted use. In this case, a portion of the land was rented to a nursery on a temporary (three months) basis so the nursery could evaluate the location while it considered buying the land. If the nursery had been satisfied with the location it would have completed the purchase and made a permanent change in the use. As it turned out, the nursery was not satisfied with the location and declined to buy the land. Even while the nursery was using the site, the auto dealer continued to use a portion of the site in the same manner as it had previously. Inclusion of a permitted use does not mean abandonment of the nonconforming use in the absence of some other manifestation of intent to abandon the use. See Summit - Waller Ass'n v. RE: Business License Denial V and K Auto Sales DATE: November 18, 2003 Steve Lancaster, Director of Community Development Jack Pace, Deputy Director Community Development Shelly Kerslake, City Attorney Nora Gierloff, Planning Supervisor The Department of Community Development has reviewed the business license for V and K Auto to operate an auto sales lot at 14607 Tukwila International Blvd. Based upon our review the business license should be denied. • The proposed use is not allowed within the Neighborhood Commercial Zone. • The property has lost any non - conforming rights to operate an automobile sales lot at the subject property. The Community Development recommendation is based upon the following findings of fact: 1. The property is located at 14607 Tukwila International Boulevard, Tukwila Washington 98168. 2. The property is zoned Neighborhood Commercial Center (NCC). 3. The proposed use would be an automobile car lot where cars are displayed and sold. 4. The City would classify the proposed use listed in the business license as, "Automobile, recreational vehicles or travel trailer sales rooms and travel trailer or used car sales lots ". 5. "Automobile, recreational, vehicles or travel trailer sales rooms and travel trailer or used car sales lots," is not listed as a permitted use in the NCC zoning (TMC 18.22.010). z • -I U. 00 U 0 II, = w • o 2 U Q =a I- w z F .. "Automobile, recreational, vehicles or travel trailer sales rooms and travel trailer or used car sales lots," are permitted in the following zones, Regional Commercial (RC), Regional Commercial Mixed Use (RCM), Tukwila Urban Center, (TUC), Commercial /Light Industrial (C /LI), Light Industrial (LI), Heavy Industrial (HI), and Tukwila Valley South (TVS). 7. Previously there had been an auto sales lot on the property. In June of 2001, the owners demonstrated to the City that the property has been used on a continuous basis for the storage of overflow inventory for the neighboring A to B auto lot. 8. In a letter dated June 15, 2001 the Director of Community Development informed the owners that property would be grandfathered. Yet, in order for the property to be continued to be grandfathered an auto sales lot must begin operation on the lot no later than December 15, 2001. 9. There is no evidence that the property was used for auto sales between June 15, 2001 and December 15, 2001. 10. Section 18.70.040 (5) of the Tukwila Municipal Code states, "If any non- conforming use ceases for any reason for a period of more than six consecutive months, or a total of 365 days in a three year time period, which ever occurs first, any subsequent use shall conform to the regulations specified by this title for the district in which such use is located ". 11. On May 17, 2002, a City of Tukwila business license was issued to Rio's Sunnydale Yard Supply at 14607 Tukwila International Boulevard. The description of the business listed was nursery and landscape supply. 12. Section 18.22.020 (18) states that commercial greenhouses and nurseries are a permitted use within the Neighborhood Commercial Center (NCC). 13. Section 18.70.040 (6) notes, "Any structure, or structure and land in combination, in or on which a non - conforming use is superseded by a permitted use, shall thereafter conform to the regulations for the zone in which such structure is located, and the non - conforming use may not thereafter be resumed ". 14. On the business license application it asked, "Is your business use different than the previous use of this building/space ?" The applicant did not respond to the question. This business was a permitted use within the Neighborhood Commercial Center (NCC). The accompanying documentation consisted of photocopies of six (6) checks made payable to you, from A to B Auto. These checks were written in November and December of 1999, in February, June, and November 2000, and. in January of 2001. These checks indicated variously that they were for "storage space," "additional space," or "parking space." You indicated in your letter and via our recent telephone conversation that these checks were in payment for the use of your property for additional storage /display /sales space, when the neighboring A to B automobile sales lot had an overflow of inventory. "Home occupation" means an occupation or profession which is customarily incident to or carried on in a dwelling place, and not one in which the use of the premises as a dwelling place is largely incidental to the occupation carried on by a member of the family residing within the dwelling place; provided, that: 1. There shall be no change in the outside appearance of the surrounding residential development; 2. No home occupation shall be conducted in any accessory building; 3. Traffic generated by such home occupations shall not create a nuisance; 4. No equipment or process shall be used in such home occupation which creates noise, vibration, glare, fumes, odor, or electrical interference detectable to the normal senses off the lot; 5. The business involves no more than one person who is not a resident of the dwelling; and 6. An off - street parking space shall be made available for any non - resident employee. The above conditions are interpreted to mean at a minimum that • Employees do not come to the property on a daily or weekly basis. • No more than one work car will be parked on or near the property at any one time. • Outside storage of materials will not occur. • Customers do not come to the premise.
