(Attachment A) This is the second time around for the proposal. The applicant originally requested re- designation from LDR to 0 during the 2002 -2003 annual amendment process (File #L02- 067). After its review in June, 2003 the Planning Commission recommended deferring the issue until 2004 pending the resolution of access and encroachment issues. In September, 2003, the City Council rejected the request, based on concerns over: 1) difficult vehicular access, especially egress and; 2) encroachment of portions of the building and retaining wall at 6550 Southcenter Boulevard from approximately 12 to 20 feet onto the adjacent lot to the north. (Attachment B) Mr. Robb was told that he could resubmit his application for consideration if he fully resolved the access and encroachment issues by the December 31, 2003 application deadline. (Attachment C) In October, 2003, Mr. Robb provided a letter from adjacent property owner Gerald Schneider who agreed in principle to allow the use of his property for access from Robb's property. Staff returned the document with a letter requesting Mr. Robb to resolve fully all access and encroachment issues, and to provide documentation before reapplying for consideration by December 31, 2003. He was also told that he needed to resolve property encroachment issues whether or not he resubmitted his application. (Attachment D) Mr. Robb reapplied for consideration on December 31, 2003 (File #L03 -079). The new application has the same letter from Gerald Schneider, but no new information or documentation about resolution of the access issues, and the property encroachment problems. Staff sent Mr. Robb a letter on January 26, 2004 requesting resolution of outstanding issues (Attachment E) On March 15, 2003, the City Council voted to pass this issue to the Planning Commission for further review, if Mr. Robb submits an application for a Boundary Line Adjustment. The Boundary Line Adjustment is to be submitted by May 3, 2004 and signed by the adjacent property owner. Vicinity /Site Information The affected properties include three individual tax lots with a combined area of approximately .74 acres. Two separate single- family residences face Southcenter 2 Surrounding Uses Land uses immediately adjacent to the site are: North Single family residential; wooded vacant land South — Southcenter Boulevard and I -405 Interchange East — Southcenter Boulevard and I -405 Interchange West — Office /commercial; park; single- family residential Staff Rept - -PC -Robb( L03- 079)(3.19,04 briefing) Boulevard and sit well above the roadway. One single- family residence occupies Tax Lot #003200018 (6542 Southcenter Boulevard /6542 S. 154 St.) and the other residence is located on Tax Lot #003200019 (6550 Southcenter Boulevard/6550 S. 154 St.). The two houses share a steep driveway which provides the only access to Southcenter z Boulevard. A third house, located at 6532 Southcenter Boulevard, but not included in the = z request, also uses the driveway to enter and leave the property. Ce Lijn J U Located in a 40' access and utility easement owned by the State of Washington 0 o cn Department of Transportation, the existing driveway is approximately 12 to 13' wide co w with a masonry wall flanking either side to a width of approximately 25'. Measurements taken from a site survey show that the driveway is approximately 22.5% grade. w p I more or less bisects the two residential properties, and lacks the 2 to 3% landing 2 r approaching the sidewalk and intersection, that is typically needed for commercial g Q purposes. (Attachment F —Aerial Photo) a = w A survey requested by the City of Tukwila in 2003 shows that portions of the building z l- a retaining wall at 6550 Southcenter Boulevard encroach from approximately 12 to 20 z o feet onto the adjacent lot to the north (Attachment G—Robb Site Survey, and Attachment LU H— Zoning with 2" Contours) v o ON The site contains steep slopes. The Sensitive Areas Overlay shows that over 50% of the 0 i– site is located within a Class 3 area of potential geologic instability. ( See Attachment I— i v Sensitive Areas Map) Class 3 areas are those where "landslide potential is high, which w I - 0 include areas sloping between 15 and 40 percent and which are underlain by relatively w z impermeable soils or bedrock, and which also include areas sloping more than 40 o percent." o 1 ' z Land uses between 500 and 1,000 feet from the site include the following: North— Condominiums South — Commercial retail and service station East —I -405 Interchange, Green River, hotel /motel West — Commercial office, single- family residential REVIEW CRITERIA Planning Commission review is required for Comprehensive Plan and Zoning Code amendments. The Planning Commission may recommend approval, recommend approval with conditions or recommend denial of the amendment based on a clear 3 Staff Rcpt - -PC -Robb( L03- 079)(3.19.04 briefing) compliance with the criteria that follow. The Planning Commission's recommendation will be forwarded to the City Council, which will make the final decision. 1) Is the issue already adequately addressed in the Comprehensive Plan? This request highlights the competing issues of housing and economic development. The Comprehensive Plan's highest priority objective is the following: "To improve and sustain residential neighborhood quality and livability." Transportation Corridor Goal 8.4 (Southcenter Boulevard) calls for "A corridor of low rise offices, residences, with localized commercial uses at major intersections all of which act as a buffer to the low- density residential neighborhoods to the north." 2) If the issue is not addressed in the Comprehensive Plan, is there a public need for the proposed change? The issue is adequately addressed in the Comprehensive Plan. Tukwila has good supply of land which is zoned to allow office use. Nearby areas also have large sites and sufficient auto access. The Tukwila Urban Center Market Analysis (ECONorthwest, 3/02) indicates relatively lower vacancy rates relative to elsewhere in the South King County Market. The demand is likely to be lower in 2004. There is no clear need for additional office space. The requested map change would remove three lots from the Low Density Residential (LDR) designation and add them to the Office (0) designation/zone. This would permit the Office (0) to run continuously along Southcenter Boulevard to the I -405 Interchange. No development is proposed at this time; any future office projects would require demolishing or converting two existing single - family units. If the property is redesignated to 0, more intensive future development would generate additional traffic and noise. City Engineer Brian Shelton states that the steep driveway would need improvement to support future development, since the driveway is barely workable for the three houses it now serves. Sight distance is inadequate for exiting the property. In addition, with wet or icy pavement, vehicles will have difficulty entering or leaving the property. Leaving the site is especially difficult, since a vehicle which cannot stop would be hazardous to pedestrians or vehicles along Southcenter Boulevard (Memo, June 6, 2003). These factors would be especially problematic with the increased traffic volumes which would be produced by future office development. During the 2003 review, the Traffic Study suggested that it might be possible to mitigate the driveway problems by developing alternate access via the adjacent Schneider Homes property once the City right -of -way was vacated. Mr. Schneider submitted a letter agreeing in principle to allow access from Mr. Robb's property. When Mr. Robb resubmitted his Comprehensive Plan/Rezone application on December 31, 2003, no additional information was provided regarding: 1) the location or legal 4 z w fr y ,J O 00 CD 0 J w • 0 = a w Z = zI- W O • — O I— ww tL 0 w z OH z Staff' Rcpt - -1 C -Robb( L03- 079)(3.19.04 briefing) description of the easement; 2) which of Mr. Sclmeider's properties would be used for the access easement, or 3) what area would be paved. The easement had not been recorded with King County. Further, the street vacation along Macadam Road from Southcenter Boulevard to Old Bluff Road requested by Mr. Schneider expired September 30, 2003. 3) Is the proposed change the best means for meeting the identified public need? The Comprehensive Plan identifies the Southcenter Boulevard corridor as a buffer for low density residential neighborhoods to the north. The housing currently located on the site already functions as a buffer since it sits significantly above the roadway, and is somewhat removed from the single - family neighborhood to the north. A retaining wall along Southcenter Boulevard separates the property from the roadway More intensive development at this site is problematic since site conditions include steep slopes and steep access. 4) Will the proposed change result in a net benefit to the community? Traffic, circulation and site access are primary concerns in considering redesignating this site from Low Density Residential to Office. Although no specific development is proposed at this time, the City of Tukwila requested that the applicant prepare a traffic study to give a general idea of the potential effects of office development on the site. The Traffic Impact Analysis compared the impacts of office, medical /dental and retail, and selected a medical/dental use for evaluation, since its projected average parking need was the highest of the three uses. The Traffic Impact Analysis, prepared in 2003 for the first application, considers a 9,000 square foot facility, which requires 37 parking spaces. Tukwila's Zoning Code requires a minimum of 3 spaces per 1,000 square feet of usable space, for a minimum of 27 spaces. The Traffic Report suggested that parking could be provided by terraced areas with stairways, but does not take into account the steep and unstable slopes which cover much of the site. No allowance was made for on -site circulation or landscaping. The properties' development potential for residential or office use will be limited by site considerations including: • Relatively small site size, • steep slopes, • potential geological instability and • safety concerns relating to the difficult access to and from Southcenter Boulevard The 2003 Traffic Impact Study suggests that it might be possible to mitigate the driveway problems by developing alternate access via the adjacent Schneider Homes property. Existing housing could remain until replaced with office development. The property lies in an area with high potential for geologic instability, so any construction would require extra care. Site conditions make it difficult to accommodate more intensive development. Once built, any office use will generate additional traffic which would enter via the very 5 Alternatives for Action After holding its hearing, the Planning Commission could: • Recommend approval; • Modify the proposal • Recommend denial Staff Rcpt - -PC -Robb( L03- 079)(3.19.04 briefing) steep driveway. CONCLUSIONS Mr. Robb's new application does not resolve fully site access and property encroachment z problems. These issues caused the proposal to be rejected in 2003. Specifically, he is requesting "conditional approval" of the Comprehensive Plan amendment. The City Attorney has indicated this would be .. z possible. The specific condition and time frame could be placed at a later date, if the 0 Planning Commission wishes recommend this amendment on for approval. 0 1— I. Recommendation The SEPA Determination has not been made at this time due to the range of amendments to be considered. After the SEPA review is complete, staff will prepare a recommendation and provide it to the Planing Commission for the May 20, 2004 hearing. Since Gerald is not pursuing the prior R/W vacation or development of his property at this time, Eric Robb would be left trying to solve his access problems as well as Gerald's. Based on the Council's comments, Eric Robb will not be pursuing the Comp. Plan Amendment this year. He will continue working on resolving the encroachment issue with his neighbor and will keep the City informed as to his progress. Please withdraw his application from this year's packet. Annual Amendment to the Comp Plan Amendments to the Comp Plan are allowed only once a year unless there is an emergency. Staff is preparing changes to the Comp Plan, but because of their workload in other areas, they are doing minimal changes to comply with changed Growth Management Act (GMA) regulations, and three requests that have been submitted by members of the public. Anything beyond these issues will need to be proposed for the 2005 budget, as time does not allow more to be done this year. A proposed public participation schedule was reviewed, and the Committee thought it was very thorough. Expanding on the technical changes that will be proposed by staff, Steve went through the update issues briefly, and Rebecca's memo gave a little more detail. Those issues will be an expanded checklist that relies somewhat on the old comp plan EIS. Steve said some issues could be controversial though they won't be major issues. Our comp plan policies will all be reviewed, and then the GMA regulations will be reviewed to see which of our policies needs to be updated. Dave asked how we could make sure our mailing list reached everyone, and was told the most current list will be used, and anyone who shows an interest in the subject can be contacted. The Hazelnut will also be used to inform citizens about the process. Recommend resolution to COW. 2. Charles River Associates Contract Since fall of 2001 the City has contracted with Charles River in order to use the extensive knowledge and contracts of Dan Brand who works there. Mr. Brand is a pre - eminent expert in the field of parking, and has helped the City do a bit of planning for Sound Transit in this field. Now the work will intensify and his help will be more heavily relied on. Steve pointed out that the contract is not inexpensive, but that it is worth every penny. Sound Transit's original documents referenced Mr. Brand, so they can't say he's not creditable. Recommend contract to COW. 3. ECO Northwest contract Two associates from ECO NW have worked with the City as the plans for the TUC and TOD have begun. They are working with the economic and fiscal issues about the two areas. The next phase will take an in -depth look at markets for housing and development for the TUC /TOD areas. Whether it will pay to build specific housing and retail in certain areas will be looked at from a perspective of whether or not it makes sense. This company's work is paid through a grant. Pam raised the issue of this study having large implications, and said it needed to be compared to the Westfield Mall /Klickitat expansion, Tukwila Village, and the Segale developments. All will be vying for city funds, and priorities will need to be set. Pam said it's hard to compare the costs and benefits of all these projects. Recommend contract to COW. This year, Tukwila's Comprehensive Plan amendment process will include: 1) the GMA Technical Update (i.e. technical revisions required to comply with provisions of the Washington Growth Management Act) and; 2) Annual Amendments (i.e. changes proposed by members of the public as part of the City's regular process). GMA Technical Update items will include technical revisions to certain elements including housing, transportation, natural environment ; and several other issues. Annual amendments include requests for policy and map changes from private parties. We will consider the GMA Technical Update and Annual Amendments as part of the same process. They will be reviewed and adopted together before December 1, 2004, the deadline which the State has set for adopting GMA - related changes. This memo will describe the Annual Amendments as well as the process used to review and adopt them. It will also describe how the GMA Technical Update and Annual Amendment processes will be combined and coordinated. The accompanying draft memo (Attachment 1) provides a resolution adopting a public process and work plan for the 2004 Comprehensive Plan amendment process, including the GMA Technical Update and Annual Amendments. Annual Amendments: We received three applications for Comprehensive Plan amendments from private parties by the December 31, 2003 deadline. The applications are as follows: Robb Property – 6550 and 6542 Southcenter Boulevard - Proposal to change land use designation and zoning from Low Density Residential (LDR) to Office (0). This proposal was originally considered last year, but was denied with an option to reapply for reconsideration if vehicular access and encroachment issues were resolved by the 12/31/03 application deadline. The applicant has submitted some new information for City consideration during this year's review process, but it appears that the outstanding issues are not fully resolved. Sabey Corporation — Between 34 Avenue South and Tukwila International Boulevard, south of S. 126 -- Proposal to change land use designation and zoning from CAP memo re amdmts 2 -10 -04 mtngl z Low Density Residential (LDR) to Commercial / Light Industrial (C /LI). This is a new proposal relating to property that is part of the Department of Homeland Security property currently under construction at Intergate East. Coordination of Annual Amendments with GMA Technical Update: Distinct from the Annual Amendments proposed by private parties discussed above, staff has reviewed existing Comprehensive Plan policies and evaluated the need for revision based on the provisions of the Growth Management Act. As a result of the analysis, staff has prepared a proposed work plan and public process for the GMA Technical Update portion of the 2004 Comprehensive Plan amendments. On February 23, 2004, the same night that it is briefed on the Annual Amendments, the Council will be briefed on the proposed process and work plan for the GMA Technical Update portion of the Comprehensive Plan amendments. On March 1, 2004, the same date as the public meeting on the Annual Amendments, a public hearing will be held on the work plan and public process for the GMA Technical Update. RCW 36.70A.130 requires legislative action to adopt the work plan and public process for the GMA CAP memo re amdmts 2 -10 -04 mtng2 ; fi r Technical Update. Once the Council is satisfied with the GMA work plan and public process, it will pass a resolution to finalize these items. Next Steps: After the threshold decision is made for the Annual Amendments and the resolution adopting the GMA Technical Update work plan and public process is passed, all potential amendments will be forwarded to the Planning Commission for review and recommendation. Any proposed amendments that are referred by the Council to the Planning Commission will return before the Council for a final public hearing and a decision prior to the December 1, 2004 deadline set by the State of Washington. To accomplish - this, staff reviewed all Comprehensive Plan policies, comparing them with GMA w 0 requirements as well as changes since the Tukwila Comprehensive Plan was adopted in 2 1995. Staff further reviewed comments from Washington Department of Community g Trade and Economic Development dating from initial Comprehensive Plan adoption in c a 1995 to make sure that all issues had been resolved. = w _ Z I- As a result of this review, staff has identified the following revisions that are needed. z O These, combined with three proposed amendments submitted by members of the public, w w comprise the majority of the Comprehensive Plan work program as follows: v o 0 — State Requirements for the 5 -year Plan and Development Regulations Update o I. ECONOMIC DEVELOPMENT ELEMENT 0 u-- o . Discussion: The Growth Management Act (GMA) requires individual jurisdictions' w Z plans to be consistent with Countywide Planning Policies, including household and employment targets aimed at reaching appropriate densities in Urban Growth Areas 0 F' (UGAs). Population and employment targets were adopted by King County and included Z in Tukwila's 1995 Comprehensive Plan. King County Countywide Planning Policies, adopted May, 2003, set updated growth targets for Tukwila and other cities within the County. Conclusion: Information contained in the Economic Development Element and Background Report will be revised to incorporate current population and employment targets specified in the Countywide Planning Policies. II. HOUSING ELEMENT Discussion: Staff has considered whether the Housing Element addresses the following as required by GMA, including: 1) Targets or objectives for providing affordable housing suited to income levels of people who live or work in Tukwila; 2) Strategy and mechanisms for achieving targets; 3) Group homes, foster care, accessory dwelling units and manufactured housing; 4) Housing inventory and analysis for future needs; 5) Support and provide for efficient use of land and housing opportunities Countywide Planning Policies. Tukwila has among the most affordable housing in the region. Strategies and policies are in place to continue providing Tukwila's fair share of future regional low- and moderate - income housing. Some strategies include: • Smaller lots in single- family zones • Accessory dwelling units allowed on lots at least 7,200 square feet • Increased density allowable through Planned Residential Development ? Z w � • Use of Community Development Block Grant funds to support low- income home 2 repair programs v U O As explained above, the Growth Management Act (GMA) requires individual W jurisdictions' plans to be consistent with Countywide Planning Policies, including • 1- updated household and employment targets adopted in 2003. Tukwila's population w 0 targets are derived from an allocation by the County based on population projections for the state Office of Financial Management. Current targets are more realistic than earlier • Q targets, and reflect a reduction from 6,000 new living units to 3,200. These can be single cn family houses, apartment or condo units. As required by GMA, Tukwila will need to = w update the Comprehensive Plan Housing Element and Background Report to include z King County's most recent household targets. We will also prepare an updated housing z o analysis and inventory to guide future policy. w • w o . Conclusion: Updated household targets, housing inventory and analysis for future o S2 needs will be completed as part of GMA Technical Update. ° I-- w • U II. NATURAL ENVIRONMENT ELEMENT o z Discussion: v Comprehensive Plan Natural Environment element Policies 4.1.4 through 4.3.4 pertain z t— to environmentally - sensitive areas. TMC Chapter 18.45 (Zoning Code Sensitive Areas ordinance) guides development near environmentally sensitive areas such as steep slopes, wetlands and watercourses. Per RCW 36.70A.172 and .030(5), the City is required to: 1) review the critical (sensitive) areas ordinances to see if they incorporate the best available science and special consideration for anadromous fisheries; 2) identify sources of best available science used to develop the critical areas regulations; and 3) have policies that give guidance to its critical areas regulations, based on best available science. 02/10/042 Tukwila is in the process of reviewing its Comprehensive Plan policies and Development Codes relating to Sensitive Areas to incorporate "best available science" and consideration of anadromous fish. Tukwila's Sensitive Areas Ordinance (TMC Chapter 18.44) will be updated to incorporate the best available science and special consideration for anadromous fisheries as required in RCW 36.70A.172. The Natural Environment Element of the Comprehensive Plan will be evaluated and updated as necessary, based on = best available science to guide policies and regulations for environmentally sensitive areas, including wetlands, fish and wildlife habitat conservation areas, geologically v hazardous areas, and frequently flooded areas o 0 u�w Conclusion: Tukwila is required to complete this information. TUKWILA URBAN CENTER ELEMENT Discussion: The Tukwila Urban Center (TUC) Sub -area Plan, now being prepared, is = considered part of Tukwila's Comprehensive Plan. TUC Plan work will set policy z direction and contain redevelopment specifics for the Tukwila Urban Center. I-. 0 z w Sub -area plans may not be inconsistent with the adopted Comprehensive 0 Plan. RCW 36.70A.130(2)(a)(i), amended in 2002, allows a plan amendment more 0 u) frequently than once a year for "[T]he initial adoption of a sub -area plan that does not 0 modify the comprehensive plan policies and designations applicable to the sub - area." = 0 A sub -area plan that does not change Comprehensive Plan policies can be adopted at any „ o time, however a sub -area plan such as the TUC plan which proposes a change in policy w z may only be considered once a year, together with other proposed comprehensive plan c� amendments. 01-- Policy wording will be ready prior to development guidelines. The entire TUC Plan will not be ready for review and adoption until late 2004 or early 2005, after the December 1, 2004 deadline for amending the Comprehensive Plan has passed. Since the TUC Plan will contain policy changes and will not be completed until later in 2004, it would be necessary to delay Plan adoption by nearly a year, until the 2005 annual amendment process. To avoid this delay and in order to make the most efficient use of staff time, TUC - related policy changes will be considered separate from the rest of the Plan, and included in the 2004 annual Comprehensive Plan update. Once TUC - related policy changes are adopted, the entire TUC Sub -area Plan can be considered and adopted when it is completed in later 2004 or early 2005, rather than waiting nearly an additional year. Conclusion: The City will revise Tukwila Urban Center policies per guidance of TUC Sub -area Plan work and Background Report update (in progress) III. UTILITIES ELEMENT Discussion: Staff prepared a new Comprehensive Surface Water Management Plan which proposes new or revised policies to the Comprehensive Land Use Plan per 02/10/043 z revisions to the Growth Management Act. In addition, significant changes have occurred in other City utilities, including telecommunications and solid waste management. Conclusion: Staff will update data and revise policies requiring changes due to preparation and anticipated adoption of the Surface Water Management Plan, as well as any background information which is significantly out of date. IV. TRANSPORTATION ELEMENT • Discussion: Staff review showed that the City has done the following as required by GMA: 1) worked with the regional planning organization to designate the levels of service on highways that are not of statewide significance; 2) incorporated the levels of service set by WSDOT for highways of statewide significance and eliminated these highways from the City's concurrency management system; 3) included an inventory of state transportation facilities in the City's jurisdictional area. In addition, Tukwila uses a variety of transportation strategies such as: Commute Trip Reduction (CTR), Transportation Management Plans (TMP), multi -modal facilities (trails, bus stops, commuter rail). Tukwila has designated LOS for local arterials. It has not as yet designated LOS for Regionally Significant State Highways (non -HSS) as recently required by the Puget Sound Regional Council, and needs to complete traffic estimates to several state -owned facilities, primarily Interstate -5. Conclusion: Most of the GMA requirements are met. However, Tukwila needs to amend the Transportation Element to address the following: • LOS standards for non -HSS, and certain state -owned facilities; • Update planning horizon Include any new or changed policies which result from updates to the Transportation Plan or Concurrency Ordinance. V. CAPITAL FACILITIES ELEMENT Discussion: Staff review of comments made from Washington CTED from the 1995 Comprehensive Plan adoption showed that information on the projected needs, current capacities and funding sources is scattered through various documents and sources. Conclusion: We recommend updating and consolidating capital facilities information to show assets and funding sources more clearly. IV. MAINTENANCE OF THE PLAN ELEMENT Discussion: The City is required to monitor the Comprehensive Plan, including: 1) a method for monitoring how well Comprehensive Plan policies and associated development regulations are achieving the goals of the Plan and of the GMA; 2) a process for amending the Comprehensive Plan; and 3) a definition of "emergency" for the purpose of amending the plan or development regulations outside of the yearly amendment process. This letter addresses both state - mandated completeness issues, and substantive topics. Completeness: The application packet does not include two copies of labels to all property owners and tenants within 500' of the properties. Please provide these required materials by Wednesday February 4, 2004. Substantive Comments: • Background: On September 2, 2003, the City Council rejected your request for a Comprehensive Plan and zoning change from LDR to C /LI, stating that you could reapply without charge for consideration if access and encroachment issues were resolved before December 31, 2003. In late October, you submitted a document from Gerald Schneider pertaining to access easements. This document was returned to you via a letter (copy enclosed) from Rebecca Fox, dated October 28, 2003. Rebecca's letter repeated the City Council's decision that all access and encroachment issues needed to be resolved prior to the December 31, 2003 application deadline. The latest application, received December 31, 2003, included the same access easement document from Gerald Schneider. No further information on this topic was provided. The new Comprehensive Plan application also made no mention of the encroachment issues. In a conversation with consultants from Barghausen Engineering, staff learned that you plan to apply for a Boundary Line Adjustment after purchasing property from your neighbor. At this point, the access and encroachment issues have not been resolved; documentation has not been provided. In this case, staff will recommend that your application be deferred until the 2004 -2005 review cycle. On February 23, 2004, the City Council will hold a public meeting on all the proposed amendments at 7 p.m. in the Tukwila City Council Chambers at 6200 Southcenter Boulevard at 7 p.m. The purpose of the public meeting is to give the City Council members the information which will allow them to make a decision on whether or not they feel proposed amendments, including yours, should be forwarded to the Planning Commission for further study or whether they should be dropped without further consideration. At the public meeting, you may comment briefly on your proposal, if you wish. Once your application is determined to be complete, you will need to install the notice board on the site per information included with your application packet. A comprehensive plan and Zoning Code amendment to allow office use as Stand Alone Uses in the MIC /H• designation of the Duwamish Corridor. 2. Revisions to the Sensitive Areas Ordinance policies in order to bring them into compliance with "best available science" requirements of State law. 3. A rezone from Low Density Residential to Office for property located at 6550 and 6542 Southcenter Boulevard. Once public testimony is considered, Council may approve amendments as recommended by the Planning Commission, make modifications to the recommendations, reject the proposed amendments or defer the amendments until a subsequent year for consideration. 7:18 p.m. Mayor Mullet opened the public hearing. Addressing proposed amendment number 1, Mr. Lancaster relayed that under the current Comprehensive Plan and Zoning Code designation, Office uses are allowed in the MIC /H area only when they are supportive of manufacturing or other permitted uses in that district. The proposal which came forward allows stand -alone office as its own use in this area. The Planning Commission recommends support of the proposed amendment, subject to a conditional use permit, with a maximum size of 100,000 gross square feet in floor area, per lot, legally established on the effective date of the ordinance, or before. No new offices shall be allowed on lots that abut the Duwamish River, and are north of the Turning Basin. Any existing office development (established prior to the effective date of the Comprehensive Plan [1995]) shall be allowed to exceed the 100,000 gross square foot maximum, and become legal conforming uses through the conditional use permit process. Said letter speaks in support of the Planning Commission's recommendations, yet seeks to include "all property in the Manufacturing Industrial Center (MIC). Several existing office buildings could become non - conforming uses if shoreline properties are carved out of the zoning reform as suggested by the Planning Commission." Additionally, Ms. Hyde brought one of Boeing's Strategic Planners and one of their Development Managers for the Tukwila Corridor should questions arise from the Council. Councilmember Linder stated her understanding that dredging the river would be difficult and expensive. She asked if the Army Corps of Engineers would grant a permit for it. John Powers, Warren Realty, same address as Ms. Hvde, stated one of the biggest problems with dredging the river is the Army Corps of Engineers currently takes 7 to 10 years to obtain required permits. This includes studies and related issues. As it relates to proposed amendment #2, Mr. Lancaster relayed the Planning Commission recommends deferring consideration of the item until 2004. Staffing levels and current workloads do not allow for appropriate amounts of review, study and /or work necessary. No citizen comments were received on this issue. As it relates to proposed amendment #3, Mr. Lancaster described this proposal as being brought forth by the property owner for property located at 6550 and 6542 Southcenter Boulevard. The request seeks to amend zoning from Low Density Residential to Office. Review of the proposal brought about complications and problems, with two primary issues being discrepancies related to property boundaries and access limitations to the property. If denied, the applicant intends to reapply if complications are resolved. The Planning Commission recommends denial of this proposal. City staff received a letter today from a representative of the applicant. A copy of the letter was provided to Council. The letter, addressed to Rebecca Fox, was penned by Eric LaBrie, AICP, Senior Planner, with Barghausen Consulting Engineers, Inc. and notified Ms. Fox that the applicant (Eric Robb) has requested deferral of his proposed amendment until 2004 "in order to resolve issues that were raised during this year's "review." If Council approves deferral, it means the applicant would not have to reapply. Staff will gather new information and the item would be "carried into next year's program automatically." If Council denies the deferral, the applicant is forced to submit a reapplication and pay a reapplication fee of approximately $1,000.00. Anna Bernhard, 14241 — 59 Avenue South, Tukwila, when reviewing the site recently, called it an "insane plan to have people working in that building and coming down that steep little driveway." She hopes the applicant can figure other ways to enter the site. 7:37 p.m. Mayor Mullet closed the public hearing. Mayor Mayor Mullet introduced Mr. Fletcher who reported on happenings at Crestview Park. Mr. Fletcher noted Curt Treadwell, a neighbor to the park, has been disturbed (recently) with watchdogs and other things that bother him in light of the fact he works an odd schedule. In a voicemail (today) to Mr. Fletcher, Mr. Treadwell stated his dissatisfaction with park users, the need for moving of a picnic shelter, moving of a play structure and his desire to move a couple trees so that his satellite TV dish is not obstructed. Mr. Treadwell intended to "go over" Mr. Fletcher's head to meet with Police Chief Haines and Mayor Mullet to bring some resolve to these issues, not to mention more signage, changing of park hours, removal of basketball hoops, and other similarly related issues. Mr. Fletcher suggests referral of the issues to the Community Affairs and Parks Committee for review as Mr. Treadwell is unhappy with Mr. Fletcher and decisions he makes. Mayor Mullet spoke to Mr. Treadwell and they discussed costs necessary to fix the problems as well as the potential for adjusting park hours. Ultimately, however, Council must make decisions on requests being brought forward. This item was discussed amongst Councilmembers and then to the Community Affairs and Parks Committee for consideration. b. City Council Councilmember Duffle enjoyed a recent swim at the City of Tukwila Pool. Additionally, Mr. Duffle and Ms. Lauterbach had a recent opportunity to meet with Muhammed Accord (a Somali leader). They spoke of issues regarding the number of Somali population within Tukwila schools and the potential need for a full -time interpreter on staff. Modify the Comprehensive Plan and Zoning Code 1. Allow some office use but limit the size to 100,000 sq. ft. and list it as a conditional use to address traffic mitigation. No change is required to the County Wide Planning Policies. It will require Comprehensive Plan and Zoning Code amendments. 4. Allow all existing office development to continue to be used for office use. This would allow offices that are currently accessory to other permitted uses to be used as stand alone offices. Existing office buildings associated with manufacturing uses and exceeding 100,000 sq. ft. could be allowed to convert to stand alone office uses subject to a Conditional Use permit. Shaunta Hyde, from the Boeing Company gave testimony in support of the proposed Comprehensive Plan and Zoning Code Amendments. The Boeing Company agrees with staff's recommendation as they represent a good balance for the future. Ms. Hyde also answered questions. Minnie Dhaliwal and Steve Lancaster answered several additional questions for the Commission. Staff will provide the Planning Commission with the current price value for the industrial zone lands vs. the office zone land. The Planning Commission asked staff to take a look at the possibility of preserving the area along side of the river where there is availability to deeper waters for industrial use only. Staff will prepare an ordinance based on the Planning Commission's recommendation for their review. There were no further comments. Staff recommended approval of the Design Review application. Bruce Fetcher, Director, Parks and Recreation, the lead staff on the project, gave some history on how the City acquired the park and how Starfire entered into an agreement with the City. Mr. Fetcher explained what the agreement entitles and how it will allow the City to keep the park open. Mr. Fetcher expressed the agreement between the City and Starfire as a true winning partnership that will give the residents a quality 54 -acre sports park. Christopher Slatt, for the applicant, explained how Starfire came to approach the City with the idea of a non - profit organization to create, "a world class facility". Jud Youell, Landscape architect, for the applicant, described what the Sports Park would offer, discussed the design of the field, and the material used for turf on the field, and the advantages of using the material. Mr.Youell also explained what will happen with the landscaping, as well as, answered questions. Christopher Slatt, answered questions concerning parking issues. Mr. Slatt explained it's hard to model parking and that they did the best they could to estimate from experience and by talking to others. Mr. Slatt stated Starfire is required to provide a monitoring plan, which the City must approve. Don Carlson, architect, for the appliant, gave an overview discussing the characteristics of the building. Mr. Carlson stated his company has learned a lot of lessons about how to make large buildings friendly to the environment, stating it's the kind of background they are bringing to the project. Mr. Lancaster explained there are two studies going -on, 1) a very specific parking management strategy, which needs to be approved by him, as the City's SEPA official, before Starfire can occupy the facility. The second study is a traffic analysis, to determine the traffic impact. This will be a program to monitor those events that are too hard to analyze before they happen. Mr. Lancaster also, addressed a question regarding handicap access. Mr. Lancaster stated that the project would be evaluated against the Washington State Accessibility code as part of the building permit review process. There must be a sufficient number of handicap parking spaces based on an analysis of the occupancy of the structure, and if possible the spaces must be located to prevent people from crossing drive ways or other obstacles. Christopher Slatt addressed a question regarding when the food court will be open. Mr. Slatt hopes the concession will be open as often as people want to use it, the main purpose of the concession is to support the athletes and the events.
