Mullet, Mayor Department of Community Development Steve Lancaster, Director RE: Request for additional information for Shoreline Substantial Development Permit L02 -003, SEPA E02 -004 Dear Shauna: I have completed my initial review of the proposal to install underground conduit and fiber optic cable (ATT Project # 308820 -007) within the shoreland areas of the Green / Duwamish River. This letter is to inform you of a need for a correction to the proposed plans in order to be consistent with the regulations of the City of Tukwila Shoreline Master Program. Phase II of the project, as shown on sheets T2 through T7, proposes to install the conduit and two (2) vaults within the River Environment. The River Environment is the area within a 40 -foot setback from the Ordinary High Water Mark (OHWM) of the river. TMC 18.44.130, Specific Shoreline Regulations -River Environment, lists allowed uses within this setback. Utilities are not one of the listed uses. Utilities are, however, an allowed use in the Low Impact Environment. This is the area between 40 and 100 feet from the OHWM. Sheets T2 through T7 show a second conduit/cable "line" within this vironment. Initial review of this "line" indicates that it is consistent with the shoreline regulations. Placement of the "line" currently proposed for the River Environment into the Low Impact Environment would meet the minimum requirements of the shoreline regulations. In our phone conversation today, you mentioned that there may be some uncertainty as to the accuracy of the setbacks of the various shoreline environments shown on submitted sheets. Please review these drawings to assure their accuracy. Additionally, please accurately dimension the "35' Setback" line shown to the west of Southgate Creek on Sheet T2. As Ms. Dhaliwal's 2/26/02 letter indicated, Southgate Creek is a Type 2 watercourse that requires a 35 -foot setback for any uses. File numbers L02 -003 and E02 -004. The Department of Community Development received your Shoreline Substantial Development Permit for AT &T fiber optics project on February 7, 2002. Based on a review of your application for submittal requirements for SEPA and Shoreline Substantial Development permit, your application is deemed complete as of February 26, 2002. A notice of land use application will be distributed within 14 days of this date. Please note that the set of mailing labels included with the application is not a complete set. All properties within 500 feet on either side of project area that lies within the shoreline zone (200 feet from ordinary high water mark of the river) must be included. A complete set of mailing labels must be provided as soon as possible to meet the 14 -day time frame for the notice requirements. Additionally you must install the notice board on the site within 14 days of the date of this letter. You received information on how to install the sign with your application packet. Also, you must obtain a laminated copy of the Notice of Application to post on the board. Please call me to obtain this notice. After installing the sign with the laminated notice, you need to return the signed Affidavit of Posting to our office. Please note that if the notice board is installed in public right -of- way, a street use permit must be obtained from the City's Public Works Department. At this time we have started code related review of your application and the following information is required to further process your application: SEPA application Steven M. Mullet, Mayor 1. This project is subject to SEPA because it is not categorically exempt from threshold determination under WAC 197 -11 -800. The entire project including the sections that are not within the shoreline zone are subject to SEPA review. The drawings must show property lines where the fiber optic line is proposed outside the public rights -of -way. For example sheet 30 of Phase 1 and all sheets of Phase 2 must show the underlying lot layout and property lines. Easement and owner authorization must be obtained for location on any private property. A portion of the fiber optic line is proposed on property labeled `City of Seattle property' on Sheet T2 of Phase 2. Please provide documentation if that location has been approved by City of Seattle. 2. The drawings also must indicate the shoreline setbacks from the river- 40' from mean high water mark must be labeled as River Environment, the next 60' as Low Impact Environment and the next 100' as High Impact Environment. 3. Cr_o S sections along the shoreline showing the relationship of the proposed work and the existing shoreline environment including limits of the 40' River, 100' Low Impact and 200' High Impact environments. 4. A vyritten discussion of the project's consistency with the General Shoreline Regulations (TMC 18.44.110) and with the King County Code (KCC 25.16.030 General Requirements) was submitted with the application. However for the portion of the work subject to City of Tukwila Shoreline regulations, the discussion must be expanded to include consistency analysis with TMC 18.44.130, 18.44.140 and 18.44.150 (see attached) for the proposed work within River, Low Impact and High Impact environments. Also, for the portion of the proposed work subject to King County Code, the discussion must be expanded to include consistency analysis with KCC 25.16.160, Utilities in Urban Environment (see attached). 5. Sheet T2 of Phase 2 shows work proposed in the vicinity of a Type 2 Watercourse. City's Sensitive Areas Ordinance requires setback of 35 feet from a Type 2 stream. Pleas, in i .ale if any work is to be_performed in the watercourse buffer. Also, according to the city's wetland and stream inventory there are wetlands and a stream in the vicinity of the proposed work on sheet 11 of the Phase 1. Depending on the scope of any work proposed in the sensitive area buffers, a Type 2 permit (Special Permission Director for Sensitive Areas Ordinance Deviation) might be required. You will be notified within 14 days of your resubmittal whether or not the issues listed above are adequately addressed or further information is needed. Your application has also been routed to other Departments for their review and additional comments will be provided to you upon conclusion of their review. This determination of complete application does not preclude the City to require that you submit additional plans or information, if such information is necessary to further review the application and ensure that the project meets the substantive requirements of Tukwila Municipal Code. Also, please be aware that a franchise agreement with the City must be approved prior to doing any construction within public right -of -way. All uses within the shoreline overlay district must conform to the following general regulations: 1. The use is in conformance with the regulations of the underlying zone district; 2. The use does not conflict with the goals and policies of the shoreline master program or the provisions of the Shoreline Act and shoreline regula- tions; 3. No structures or accessory facilities shall be located over the river unless such structure protects or promotes the public interest; 4. There shall be no disruption of existing trees or vegetation within the river environment unless necessary for public safety or flood control, or if allowed as a part of an approved shoreline substantial development permit; 5. No effluent shall be discharged into the Green River which exceeds the water quality classi- fication as established by the State for the adjacent portion of the river; 6. All State and federal water quality regula- tions shall be strictly complied with; 7. Wildlife habitat in and along the river should be protected; 8. All perimeters of landfills or other land forms susceptible to erosion shall be provided with vegetation, retaining walls or other satisfactory mech- anisms for erosion prevention; 9. All necessary permits shall be obtained from federal, State, County or municipal agencies; 10. Dredging for purposes other than for navigational improvements or flood control is pro- hibited; 11. Mining is prohibited along the river shoreline; 12. Solid waste disposal is prohibited along the river shoreline; 13. No property will be acquired for public use without dedication by or just compensation to the owner; 14. Landfilling is prohibited within the river channel unless such landfill is determined by the Planning Commission to protect or promote the public interest. 15. Notwithstanding any provisions of this Code to the contrary, removal of any cottonwood tree within the river environment or the low impact environment, which tree is 12 inches or greater in diameter as measured 4.5 feet above grade, shall be subject to -the requirements of TMC Chapter 18.54, Tree Regulations. (Ord. 1775 §2, 1996; Ord. 1758 §1(part), 1995) Page 18 -74 18.44.120 Shoreline overlay - management environments. Within the shoreline overlay district, there are the following three management environment designa- tions depending on their distance from the mean high water mark (see Figure 18 -1): 1. River environment. The area between the mean high water mark and the low impact environ- ment, having the most environmentally protective land use regulations; 2. Low impact environment. The area between the river environment and 100 feet from the mean high water mark; 3. High impact environment. The area between 100 feet and 200 feet from the mean high water mark having the least environmentally protec - tive land use regulations. It is intended that this area be aesthetically and architecturally oriented to the low impact environment. (Ord. 1758 §1(part), 1995) r1844130j'Specific shoreline regulations - river environment. A. The river environment shall consist of a 40 -foot wide management zone as measured on a horizontal plane from the mean high water mark, and shall con- tain no uses or structures other than the following: 1. Public and /or private footpaths or trails; 2. Recreation facilities such as benches, tables, viewpoints, and picnic shelters, provided no such facility shall exceed 15 feet in height; 3. Support facilities for pollution control such as runoff ponds and filter systems, provided they are at or below grade; 4. Information and direction signs conforming to the underlying zoning district; 5. Diking for bank stabilization, erosion con- trol, and flood control purposes; 6. Bridges; 7. Fire lanes and dike maintenance roads; 8. Plaza connectors between buildings and dikes, not exceeding the height of the dike, are permit- ted for the purpose of providing and enhancing pedestrian access along the river and for landscaping purposes. B. River environment uses shall conform to the following standards: 1. Access roads, parking or storage areas, the closest edge of which shall be a minimum of 40 feet from the mean high water mark; 2. The centerline of railroad lead tracks shall be located no closer than 40 feet from the mean high water mark, except where the railroad lead track is bridging the river; 3. Where the riverbank has been recon- structed, it shall be landscaped with suitable plant material consistent with flood control measures to include large hardy shade or fruit trees, at maximum of Printed January 26, 2001 30 feet on center, such as maple, alder, poplar, cotton- wood, sycamore, willow, oak, beech, walnut, ash and birch, or other species approved by the Director. In addition, at least one of the following landscape materi- als shall be used: a. Live groundcover at a maximum of 18 inches on center, b. Natural grass, c. Addition to the existing natural vegeta- tion where appropriate; 4. Facilities such as pumps, pipes, etc., shall be suitably screened with hardy plant material; 5. Utility easements where necessary shall be landscaped with live groundcover or natural grass cover. (Ord. 1758 §1(part), 1995) 1:8:44: =1401Specific use regulations - low impact environment. A. The low impact environment shall contain no uses other than those allowed in the river environment and the following: 1. Structures not to exceed 35 feet in height, excluding utility towers; - 2. Parking /loading and storage facilities adequately screened or landscaped; 3. Railroad lead and spur trackage or public or private roads; 4. Utilities, including towers; 5. Signs not to exceed regulations of the underlying zoning district sign code. B. Low impact environment uses shall conform to the following standards: 1. Structures shall be sited and appropriately landscaped in accordance with underlying zoning regulations; '2. Access roads shall be located no closer than ten feet to buildings, spur tracks or parking /loading and storage facilities, and the effective setback area shall be suitably landscaped. This shall not prohibit ingress and egress points between an access road and the described facilities; 3. Parking, loading, and storage facilities shall be appropriately screened from the river with: a. A solid evergreen screen of a minimum six -foot height, or b. Decorative fence six feet high. (Note: Chain link fence shall be slatted and planted with ivy or other trailing vine except where a safety hazard may exist.), or c. Large hardy shade or fruit .trees such as maple, alder, poplar, cottonwood, sycamore, willow, oak, beech, walnut, ash, birch or other species approved by the Director at a maximum of 30 feet on center, or d. Earth berms at a minimum of four feet high, suitably planted with live groundcover or natural grass; Printed January 26, 2001 TITLE 18 — ZONING 4. Railroad lead trackage shall be no closer than 15 feet to parking/loading and storage facilities, and shall be suitably landscaped. (Ord. 1758 §1(part), 1995) 1.8:44.150' Specific use regulations - high impact environment. All uses allowed in the underlying zoning district shall be allowed in the high impact environment. (Ord. 1758 §1(part), 1995) 18.44.160 Variances. Variances shall be processed by the Hearing Examiner in accordance with the shoreline regulations. (Ord. 1796 §3(part), 1997; Ord. 1758 §1(part), 1995) 18.44.170 Appeals. Appeals of any decision of the Department regarding granting or denial on shoreline substantial development permits and any decision of the Hearing Examiner regarding a shoreline variance may be appealed to the Shorelines Hearings Board pursuant to RCW 90.58. (Ord. 1796 §3(part), 1997; Ord. 1770 §24, 1996; Ord. 1758 §1(part), 1995) Page 18 -75 1029 , URBAN ENVIRO1..NT 25.16.140 - 25.16.160 F. Moorage piles are limited by the following conditions: 1. All piles shall be placed so as to not constitute a hazard to navigation. 2. No pile shall be placed more than eighty feet waterward of the ordinary high water mark. 3. All moorage piles shall be placed in a water depth not thirteen feet below the ordinary high water mark. 4. No more than two moorage piles per residence are permitted. G. Launching ramps and lift stations are limited by the conditions: 1. No portion of a launching ramp or lift station shall be placed more than sixty feet'waterward of the ordinary high watermark. ,2. All portions of a launching ramp or lift /station shall be placed at a depth not to exceed eight feet below the ordinary high water mark. 3. Avoid disruption of critical aquatic and wildlife stages. D. Rehabilitation of areas disturbed by the construction and /or maintenance of utility facilities shall: 1. Therefore, two diverse conduit routes are necessary for this project. Industry standards require that the routes be separated by a distance of 30 feet minimum. These two routes are proposed to be installed in previously disturbed areas as described below. Building address 12628 North Entrance: The proposed route starts on the NE corner of Interurban Ave. South and Tukwila Corporate Limits. Heading north east parallel to the Duwamish River with an approximated offset of 32LF from the shoreline, the route will be trenched under the grass area for approximately 201 LF; the route will continue to be directionally bored under the concrete sidewalk for approximately 371LF. FICATIONS GENERAL All materials and work in public rights of way shall be in conformance with the 1998. Standard Specifications for Rood, Bridge and Municipal Public Works Construction except for cost, Standard Specifications for Municipal Construction as published by the Washington State Chapter of APWA, King County Rood Standards, AT &T Construction Procedures, the AT &T Fiber Optics Manual, and Design and Construction Standards and Specifications for any of the local jurisdictions. If there is a conflict in standards, the most stringent shall apply. 2. The locations of utilities shown on the plans are approximate. All utility locations shall be verified prior to construction. The contractor, at his own expense, shall make excavations and borings ahead of the work, as necessary, to determine the exact locations of utilities and underground structures. It is understood that there will be interfering utilities and other underground pipes, drains or structures encountered that are not shown or areas shown incorrectly on the plans or that have not been previously discovered in the field. The contractor agrees this is a normal and usual occurrence in the construction of underground improvements. Excess Water -- Shall water be encountered during construction, it shall be the Contractor's responsibility to dewater, as per the Standard - Specifications, before construction continues. 5. No silt laden water is to be discharged from the site without passing through an erosion control system. 6. The Contractor shall schedule and control his work so as to comply with all applicable ordinances to prevent any hazards to public safety, health and welfare. 7. All streets shall be kept free of dirt and debris on a continuous basis. 8. An approved copy of these plans will be on the job site whenever construction is in progress. 9. The Contractor shall be solely and completely responsible for the conditions of the job site, including safety of all persons and property during the performance of the work. This requirement will apply continuously and not be limited to normal working hours. . 10. Pedestrian and vehicular access to adjacent properties shall be maintained at all times except where prior written approval from the property owner has been obtained. 11. Barricade open depressions and holes occurring as part of this work, and post warning lights on adjacent properties with public access. Operate warning lights during hours from dusk to dawn each day and as otherwise required. 12. IL TRAFFIC CONTROL 1. The Contractor is advised that all lane closures shall be kept to a minimum. Local jurisdictions will approve only those lane and roadway closures determined to be necessary for the Contractor to accomplish a specific task. No lane or roadway closures will be permitted without prior approvals. 2. The Contractor shall keep all traffic lanes and shoulders clear of equipment and materials during non - working hours. Equipment and materials shall not be stored on the streets. The Contractor's employees and agents shall not park private vehicles along the roadway or median. PERMIT III. SITE PREPARATION 1. Sod and Lawn to be removed shall be cut to a neat vertical line 6" minimum beyond the trench line. Sod shall be either removed from the site, or carefully stockpiled for reuse. 2. Saw. cut pavement to a neat vertical line 8" to 12" minimum beyond the trench line. Replace pavement with like material (i.e., asphalt with asphalt, concrete with concrete). 3. Except as noted herein, all material removed shall be taken from the site and disposed of by the contractor. IV. TRENCH EXCAVATION AND BACKFILL 1. All trench excavation shall be in accordance with Section 7- 10.3(07) of the Standard Specifications. 2. Trench backfill - Where material excavated from trenches is unsuitable for backfill, the Contractor shall backfill with bank run gravel or may elect to use CDF in lieu of the compaction /proctor process. Stoneway mix 351 is acceptable in all locations. Quick setting mix 1004 is acceptable in non - traffic areas. Mix 1121 is to be used in traffic- bearing locations. 3. UTILITY DUCT 1. Buried duct shall be Schedule 40 PVC. Galvanized steel pipe shall be used under roadways, for the lower 10 feet of risers and in exposed locations. Minimum cover shall be 24" with a minimum slope of 1/2 % to vault. Schedule 40 PVC may be used on rooftops, under eaves and in locations with minimal exposure to damage. 2. Thoroughly clean conduit before using or laying. During construction and after the duct line is completed, plug ends of conduits to prevent water washing into conduit or manholes, take particular care to keep conduits clear of concrete, dirt and any other substance during the course of construction. 3. After duct placement has been completed, proof and clean debris from each duct, its entire length. Install pull rope and place watertight compression plugs at both ends. 4. Outside innerduct shall be 1 1/4" optic -guard non - metallic flexible, in color such as red or orange, with pull ropes & plugs. Exposed innerduct inside of buildings shall be plenum- rated. VI. CEMENT CONCRETE • PAVEMENT 1. All concrete pavement removed or damaged by this work shall be replaced according to the requirements of Section 5 -05 of the Standard Specifications. -. VII. ASPHALT CONCRETE PAVEMENT 1. All asphalt concrete pavement removed or damaged by this work shall be replaced with Class B asphalt concrete according to the requirements of Section 5 -04 of the Standard Specifications. VIII. GRAVEL AREAS 1. All grovel areas damaged or removed by this work shall be replaced with crushed surfacing top course in accordance with the requirements of Section 9- 03.9(3) of the Standard Specifications. IX. SITE RESTORATION 1. All disturbed or damaged areas shall be restored to a condition equal to, or better than, that which existed prior to placement of the conduit and structures. 2. Vegetation removed Jar this work shall be replaced with in -kind plant material and shall be properly planted and watered in to ensure its survival. 3. Site restoration shall include replacing existing cabling and pull ropes in existing conduit as they existed prior to construction. X. WATER QUALITY . 1. All installed backboards shall be painted with fire - resistant paint. 2. All fire sealed duct ends and cores shall be 2 hour fire - rated. All fire seal in existing locations shall be repaired or replaced upon duct or cable placement. XIII. NOTES 1. All additional work to be approved by AT &T before any work is performed. 2. APWA, King County Rood Standards, AT &T Construction Procedures, the AT &T Fiber Optics Monuol, and Design and Construction Standards and Specifications for any of the local jurisdictions. If there is a conflict in standards, the most stringent shall apply. 2. The locations of utilities shown on the plans are approximate. All .utility locations shall be verified prior to construction. The contractor, at his own expense, shall make excavations and borings ahead of the work, as necessary, to determine the exact locations of utilities and underground structures. It is understood that there will be interfering utilities and other underground pipes, drains or structures encountered that are not shown or areas shown incorrectly on the plans or that hove not been previously discovered in the field. The contractor agrees this is a normal and usual occurrence in the construction of underground improvements. Furthermore, bidders understand and agree that work in some cases must be done in close proximity to said utilities and underground pipes, drains and structures not shown on the plans which may require a change in operations and may cause sloughing of the trench, additional traffic control, additional pavement and bockfill costs and time. The contractor agrees that a reasonable number of these occurrences is usual and ordinary, and are reflected in the bid and plan of operation. The bidders agree to provide for these conflicts and agrees to provide for o reasonable o''mount of time for design changes and /or utility relocations due to said conflicts. Call the Utilities Underground Location Center at 1- 800 - 424 -5555. 3. Inspection -- The Contractor shall notify local jurisdictions for required inspection services. 4. Excess Water -- Shall water be encountered during construction, it shall . be the Contractor's responsibility to dewoter, as per the Standard Specifications, before construction continues. 5. No silt laden water is to be discharged from the site without passing through an erosion control system. 6. The Contractor shall schedule and control his work so as to comply with all applicable ordinances to prevent any hazards to public safety, health and welfare. 7. All streets shall be kept free of dirt and debris on a continuous basis. 8. An approved copy of these plans will be on the job site whenever construction is in progress. 9. The Contractor shall be solely and completely responsible for the conditions of the job site, including safety of all persons and property during the performance of the work. This requirement will apply continuously and not be limited to normal working hours. 10. Pedestrian and vehicular access to adjacent properties shall be maintained at all times except where prior written approval from the property owner has been obtained. 11. Barricade open depressions and holes occurring as part of this work, and post warning lights on adjacent properties with public access. Operate warning lights during hours from dusk to down each day and as otherwise required. 12. Protect structures, utilities, pavements, and other facilities from damage caused by settlement, lateral movement, undermining, washout and other hazards created by operations under this section. II. TRAFFIC CONTROL 1. The Contractor is advised that all lane closures shall be kept to a minimum. Local jurisdictions will approve only those lone and roadway closures determined to be necessary for the Contractor to accomplish a specific task. No lone or roadway closures will be permitted without prior approvals. 2. The Contractor shall keep all traffic lanes and shoulders clear of equipment and materials during non- working hours. Equipment and materials shall not be stored on the streets. The Contractor's employees and agents shall not park private vehicles along the roadway or median. III. SITE PREPARATION 1. Sod and Lawn to be removed shall be cut to a neat vertical line 6" minimum beyond the trench line. Sod shall be either removed from the site, or carefully stockpiled for reuse. 2. Saw cut pavement to a neat vertical line 8" to 12" minimum beyond the trench line. Replace pavement with like material (i.e., asphalt with asphalt, concrete with concrete). 3. Except as noted herein, all material removed shall be taken from the site and disposed of by the contractor. IV. TRENCH EXCAVATION AND BACKFILL 1. All trench excavation shall be in accordance with Section 7- 10.3(07) of the Standard Specifications. 2. Trench backfill - Where material excavated from trenches is unsuitable for backfill, the Contractor shall bockfill with bank run grovel or may elect to use CDF in lieu of the compaction /proctor process. Stoneway mix 351 is acceptable in all locations. Quick setting mix 1004 is acceptable in non - traffic areas. Mix 1121 is to be used in traffic- bearing locations. 3. Compaction, when necessary, shall be performed in accordance with local requirements. V. UTILITY DUCT 1. Buried duct shall be Schedule 40 PVC. Galvanized steel pipe shall be used under roadways, for the lower 10 feet of risers and in exposed locations. Minimum cover shall be 24" with a minimum slope of 1/2 % to vault. Schedule 40 PVC may be used on rooftops, under eaves and in locations with minimal exposure to damage. 2. Thoroughly clean conduit before using or laying. During construction and after the duct line is completed, plug ends of conduits to prevent water washing into conduit or manholes, take particular care to keep conduits clear of concrete, dirt and any other substance during the course of construction. 3. After duct placement has been completed, proof and clean debris from each duct, its entire length. Install pull rope and place watertight compression plugs at both ends. 4. Outside innerduct shall be 1 1/4" optic -guard non - metallic flexible, in color such as red or orange, with pull ropes & plugs. Exposed innerduct inside of buildings shall be plenum- rated. VI. CEMENT CONCRETE PAVEMENT 1. All concrete pavement removed or damaged by this work shall be replaced accordirg to the requirements of Section 5 -05 of the Standard Specifications. VII. ASPHALT CONCRETE PAVEMENT 1. All asphalt concrete pavement removed or damaged by this work shall be replaced with Class B asphalt concrete according to the requirements of Section 5 -04 of the Standard Specifications. VIII. GRAVEL AREAS 1. All gravel areas damaged or removed by this work shall be replaced with crushed surfacing top course in accordance with the requirements of Section 9- 03.9(3) of the Standard Specifications. 6. All disturbed or damaged areas shall be restored to a condition equal to, or better than, that which . existed prior to placement of the conduit and structures. 2. Vegetation removed for this work shall be replaced with in -kind plant material and shall be properly planted and watered in to ensure its survival. 3. Site restoration shall include replacing existing cabling and pull ropes in existing conduit as they existed prior to construction. X. WATER QUALITY 1. Construction activities occurring adjacent to storm drainage structures shall comply with the State of Washington's Water Quality Standards . 2. The contractor shall limit the use of petroleum products on the site. , XI. BORING 1. When boring roadways, install a 4" casing with - 3 -1 1 /4" innerducts with pull ropes and plugs. 2. Protect Existing Utilities -- coordinate with local jurisdictions to pothole as required to locate existing utilities. XII. FIRE PROTECTION 1. All installed backboards shall be painted with fire - resistant point. 2. All fire sealed duct ends and cores shall be 2 hour fire - rated. All fire seal in existing locations shall be repaired or replaced upon duct or cable placement. XIII. NOTES 1. All additional work to be approved by AT &T before any work is performed. 2. Provide Lump Sum Bid with a unit breakdown for billing. 3. Unit cost will include all restoration as required by the local municipality. . 4.
