Decision on Substantive Permit: The City Planning Commission has determined that the application for a conditional use permit does comply with applicable City and state code requirements and has approved that application based on the findings and conclusions contained in the staff report, subject to the following condition: 1. Prior to issuance of the building permit and miscellaneous permit, the applicant shall submit material and color samples of the proposed penthouse. The penthouse must be finished and painted to match the existing building. III. YOUR APPEAL RIGHTS The Decision on this Permit Application is a Type 4 decision pursuant to Tukwila Municipal Code 18.104.010. Other land use applications related to this project may still be pending. One administrative appeal to the City Council of the Planning Commission Decision is permitted. IV. PROCEDURES AND TIME FOR APPEALING In order to appeal the Planning Commission decision on the Permit Application, a written notice of appeal must be filed with the Department of Community Development within 14 days of the issuance of this Decision, that is by Friday, May 10, 2002. The requirements for such appeals are set forth in Tukwila Municipal Code 18.116. All appeal materials shall be submitted to the Department of Community Development. Appeal materials MUST include: 1. The name of the appealing party. 2. The address and phone number of the appealing party; and if the appealing party is a corporation, association or other group, the address and phone number of a contact person authorized to receive notices on the appealing party's behalf. 3. The Notice of Appeal shall identify (a) the specific errors of fact or errors in application of the law in the decision being appealed; (b) the harm suffered or anticipated by the appellant, and (c) the relief sought. The scope of an appeal shall be limited to matters or issues raised in the Notice of Appeal. The City Council hearing regarding the appeal shall be conducted as a closed record hearing based on the testimony and documentary evidence presented at the open record hearing conducted by the Planning Commission. The City Council decision on the appeal is the City's final decision. Any party wishing to challenge the City Council decision on this application must file an appeal pursuant to the procedures and time limitations set forth in RCW 36.70C. An appeal challenging a DNS, an MDNS or an EIS may be included in such an appeal. If no appeal of the City Council decision is properly filed in Superior Court within such time limit, the Decision on this permit will be final. VI. INSPECTION OF INFORMATION ON THE APPLICATION Project materials including the application, any staff reports, and other studies related to the permits are available for inspection at the Tukwila Department of Community Development, 6300 Southcenter Blvd., Suite 100, Tukwila, Washington 98188 from Monday through Friday between 8:30 a.m. and 5:00 p.m. The project planner is Carol Lumb, who may be contacted at 206 -431 -3661 for further information. The proposed site is an existing office building located at 5200 Southcenter Blvd., Tukwila and is zoned RCM, Regional Commercial Mixed. Nextel is seeking an approved Conditional Use Permit to construct the facility as it is considered a conditional use in the RCM zone. The project includes the installation of twelve (12), approximately 1' x 4' directional panel antennas on the roof of the building. The antennas would be attached to a proposed penthouse designed to appear as a rooftop appurtenance (see Attached Plans). The proposed antennas and penthouse would be painted and to match the color of the building and all other rooftop appurtenances. In addition, the proposed project includes an approximately 255 square foot equipment room located on the basement floor of the building. The equipment room would be used to house radio transmitters, receivers, and other essential equipment. The project also includes two (2) receive only Global Positioning System (GPS) antennas, which are 2" high x 4" wide x 4" long disks which would be attached to the building parapet. One of the GPS antennas would be operational; the second antenna would be for backup purposes. The facility would be remotely monitored for fire smoke and intrusion and AC power failure by Nextel's 24 -hour electronic monitoring system. The project will not interfere with surrounding properties or their. uses. An ESMR facility operates at extremely low power and thus the facility will not be a source of interference with electronic equipment, including radio, television, and telephone transmissions. Interference is prevented by the Federal Communications Commission's (FCC) regulation of radio transmissions. Nextel and ESMR Nextel is the largest operator of ESMR systems in the United States. ESMR is an advanced form of wireless communications that offers a combination of features and services not previously available from cellular telephone or other wireless communications companies. ESMR is an integrated digital communications system that includes mobile telephone, group communication, messaging, paging, dispatch, and data transmission. Like cellular telephone calls, ESMR calls are handed off from one facility to another as a caller moves through an area. Handing a call off means that a call can be passed from one site to another without being disconnected. Handing off ensures a continuous flow of communications as users move between communications sites. Once the need for a new site has been established, Nextel's system engineers identify a target area or "search ring" in which to locate a facility. ~ w Local topography and geographic features including tree canopy, buildings, mountains, and water bodies further _10 define the selection and design of a specific ESMR site. Because ESMR signals must travel in an unobstructed co 0 path from the facility to the user, the presence of any one or all of these features can negatively influence the quality of transmissions and reception. Other factors that influence site selection include potential visual co o impacts, the compatibility of the proposed facility with existing and future land uses, and the ability to negotiate a mutually beneficial lease with a landlord. The location as well as the height of each Nextel site is, therefore, based upon the ability of the site to effectively function with these parameters. co In The purpose of the proposed TukwilalParkside facility is to provide in building coverage on 1-405 from 51S` z Avenue South east to Southcenter Parkway and on I -5 from South 147th Street south to I -405. The proposed o facility would also provide in car coverage around the I -5/1 -405 Interchange. It is crucial for Nextel to have w w adequate coverage in these locations in order to serve customers in compliance with its Federal Communications Commission (FCC) licensing obligations. 0 cn 0E- Applicable City of Tukwila Conditional Use Permit Decision Criteria TMC 18.64.030 = 0 Listed below are the applicable CUP decision criteria applicable to the proposed project. A response to each u.. criterion is provided in bold. w z • co 1. The proposed use will not be materially detrimental to the public welfare on injurious to the property or p improvements in the vicinity. Response: The proposed facility would not be materially detrimental to the public welfare or injurious to property or improvements in the area. The proposed antennas are relatively small in size and would appear as a normal rooftop appurtenance to the building once constructed. No residential uses occur immediately around the site and thus no views would be blocked or altered. In addition, the proposed equipment room would be located on the basement floor of the building out of immediate views. 2. The proposed use shall meet or exceed the same standards for parking, landscaping, yards, and other development regulations that are required in the district it will occupy. Response: All applicable development standards would be complied with as required. No parking or landscaping would be impacted, as the proposed facility would be located on or within an existing building and no existing parking spaces would be occupied as a result. The facility is allowed to exceed the base height for buildings of 35 feet in the RCM zone, as it would appear as an appurtenance to the building similar to the existing Quest facility currently located on the roof. 3. The proposed use shall be generally compatible with the surrounding land uses. Response: Surrounding land uses consist mainly of commercial and office uses. In addition, the proposed facility is consistent with other, rooftop wireless communications facilities occurring on the building and on similar buildings located in the immediate area. 4. The proposed use shall be in keeping with the goals and policies of Comprehensive Plan. Response: The City's Comprehensive Plan provides some policy guidance on the siting of wireless communications facilities as discussed below. 12.1.34. Actively coordinate project implementation with individual utilities based on the Tukwila's Comprehensive Plan and development regulations. 12.1.35. Encourage utilities to consolidate facilities and minimize visual impacts of facilities where technical feasible. Response: The proposed facility is consistent with the above policies as it will comply with all development regulations and has been sited and designed to minimize visual impacts through camouflaging and architectural sensitivity to the building design. 5. All measures shall be taken to minimize the possible adverse impacts, which the proposed use may have on the area, which it is located. Response: Several measures as discussed above have been taken to minimize and /or eliminate any potential adverse impacts from the proposed facility. These include: (1) the use of an antenna configuration designed to resemble a rooftop penthouse or appurtenance commonly found on office building roofs; (2) the painting of all antennas and associated antenna structures to match the color of the building and building features; (3) locating the proposed associated equipment on the basement floor of the building out of view of surrounding properties; and (4) locating the proposed facility in a commercial zone at a commercial/office use consistent with other uses and zones in the immediate area. Conclusion The proposed wireless communications facility is consistent with the City of Tukwila Development Regulations and Comprehensive Plan and meets the City's conditional use decision criteria. The facility has been sited on an office building in a commercial zone away from residential areas. The facility would utilize an existing building eliminating the need for an additional support structure and would provide needed and beneficial wireless communications service to the area. The proposed project has been carefully designed to resemble the existing building and would not require the expansion of public facilities and services for its construction, operation and maintenance. The facility would be unmanned and therefore would not require waste treatment, water or management of hazardous materials. Once installation of the facility has been completed, approximately one visit per month would occur for routine maintenance. No other traffic would be associated with the project.
