The application included the installation of three antennas mounted within a steeple like structure on the roof -top of the Hampton Heights Apartment building. The cabinet equipment was to be located within the basement of the apartment building. Cingular is now proposing to replace the three antennas with the steeple structure and replace the cabinet equipment in the basement. The City has reviewed the application materials that were submitted on December 30, 2005. For this site, Cingular is proposing removing the existing 3 antennas and replacing them with 3 new antennas at the same height within the existing copula (stealth screening) on the roof of the building along with changing out the radio cabinets in the basement of the same building.. REVIEW CRITERIA RECEIV DEC 3 0 2005 bEVELOP The review criteria for various types of projects are shown below. Please discuss development consistency with each criteria. Then, refer to the Tukwila Comprehensive Plan for project consistency with the policies. Please note that more than one category of policies may apply Criteria for Conditional Uses (TMC 18.64.030) 1. The proposed use will not be material detrimental to the public welfare or injurious to the property or improvements in the vicinity. RESPONSE: With the merger of Cingular Wireless with AT &T, Cingular is modifying their equipment and antennas to accommodate both customers of Cingular and AT &T. The proposed modifications to this existing unmanned site will include remove the existing three antennas (one per sector) and replace them with 3 antennas (one per sector). In addition, the existing equipment will be change and modified in the basement of the building. The height of the existing antennas or copula will not change. Since this existing unmanned telecommunications site is located on an existing building overlooking I5 and I405 right -of -way, past use has demonstrated that this location has not been material detrimental to the public welfare or injurious to the property or improvements in the vicinity. This is a multi - family area and is compatible with other uses in the area since the copula stealthing makes the site architecturally compatible with the building and surrounding uses. In the Utilities Section of the Tukwila Comprehensive Plan there is a Telecommunications Section. Goal 12.1 states: "Utility services and facilities that meet the community's current and future needs in a safe, reliable, efficient, economic and environmentally responsible manner." With the merger of AT &T and Cingular, Cingular Wireless is meeting the General Policies as stated in 12.1.35: Encourage utilities to consolidate facilities and minimize visual impacts of facilities where technically feasible. This isolated site not only consolidates facilities, but minimizes visual impacts on adjoining parcels. 2. The proposed use shall meet or exceed the same standards for parking, landscaping, yards and other development regulations that are required in the district in will occupy. RESPONSE: Cellular Stations and towers are permitted in a multi - family zone with a Conditional Use Permit - Title 18.30.040. The existing unmanned telecommunications site was previously approved by the City of Tukwila through the Conditional Use Permit process. The proposed replacement of antennas still meets the same standards used in the previous approval. The distance from the property line will remain the same as will the antenna/copula height. 3. The proposed development shall be compatible generally with the surrounding land uses. RESPONSE: As stated above, this is an existing unmanned telecommunications site. It has been determined with the previously approved CUP approval to be a compatible use. The site is located within a copula on the roof of a building. The existing building and screening makes the site visually compatible with the adjacent properties. Finally, other telecommunications sites are located in the general vicinity of the intersection of I5 and I405. 4. The proposed use shall be in keeping with the goals and policies of the Comprehensive Land Use Policy Plan. This proposal minimizes changes to only antenna changes and equipment changes to accommodate the merger of AT &T and Cingular into one service provider. Cingular Wireless is requesting Conditional Use Permit approval to install a wireless telecommunication facility inside the rooftop tower of Building "B" of the Hampton Heights Apartments, located at 5711 South 152 Street. The project consists of three antennas in three sectors (The sectors face to the north, west, and south). The existing roofing material in front of the proposed antennas will be replaced with simulated roofing material that will allow the passage of telecommunications signals but will be designed to match the existing roofing material and color. The associated operating equipment will be located within an existing basement room. The connecting wiring will be run inside the building with the exception of a portion that will extend along the north facing facade. An externally mounted sheet metal shroud will screen these connecting cables and will be painted to match the existing building color. Existing Development The site is located at the southeast corner of the intersection of South 152 Street and 57 Avenue S. The Hampton Heights Apartments consist of numerous two -story apartment buildings along both the south and north sides of S 152 Street. The building height is approximately 29 feet to the top of the roof with an additional 19 feet to the top of the tower (total height of tower is approximately 48 feet). Uphill of the site and north of the adjacent multi - family structures, the zoning is LDR and is developed with single - family structures. Downhill of the site and southeast of other adjacent multi - family structures the zoning is RCM and contains a restaurant and convenience store. No public comments were received during or after public comment period. CONDITIONAL USE CRITERIA The proposed project must comply with criteria detailed in TMC 18.64.050, (1 -5), concerning Conditional Use Permits. Applicant's response to conditional use criteria is attached to this staff report as Attachment E. Staff makes the following findings under the city's Conditional Use Permit criteria: (1) The proposed use will not be materially detrimental to the public welfare or injurious to the property or improvements in the vicinity of the proposed use or in the district in which the subject property is situated. The applicant has included site plans, elevations and computer generated photographs showing the proposed roof modification and screening, and the external cable shroud. The three antennas will be entirely enclosed within the existing tower structure and the associated electrical equipment will be located within an existing basement room. (2) The proposed use shall meet or exceed the performance standards that are required in the district it will occupy. The proposed antennas and associated electronic equipment will be entirely enclosed within the existing apartment building. The connecting cables will be enclosed within an externally mounted shroud along the north building facade. The surrounding land uses are multi - family residences within the HDR zone. The proposed facility will generate trips during the construction period and, following the completion of construction, up to 1 trip per month for maintenance. No other impacts to pedestrian or transportation movements are anticipated. The antennas and electronic equipment will not be visible due to their internal location. The three sections of simulated roofing material, for the three communication sectors, will be designed and colored to match the existing roofing material. The external cable shroud that will be attached to the north facade of the structure will be painted to match the building color. The two -story facade to which the shroud will be attached is a blank wall (no openings or details other than horizontal vinyl lap siding) approximately 26 feet in width. The location of the cable shroud running vertically in the center of the wall to the gable peak will provide a vertical break to an otherwise blank wall. The addition of the simulated roofing panels on the tower and the cable shroud to the north building facade will be difficult to notice from the surrounding area and therefore be compatible generally with the surrounding land uses and building and site design. (4) The proposed use shall be in keeping with the goals and policies of the Comprehensive Land Use Policy Plan This project must comply with the following Comprehensive Plan policies and meet necessary Zoning Code regulations. 12.1.36. Encourage utilities to consolidate facilities and minimize visual impacts of facilities where technically feasible. Implementation strategies for this policy include the use of shared infrastructure and use of existing structures. The applicant is proposing antennae that will be located on and within an existing building. 5) All measures have been taken to minimize the possible adverse impacts, which the proposed use may have on the area in which it is located. The adverse impacts that could result from this proposal would be visual / aesthetic impacts on the surrounding community from externally mounted and unscreened antennas and equipment. The proposed location of the panel antennas, and electrical equipment cabinet will not be materially detrimental to the public welfare or injurious to the property or improvements in the vicinity. This is due to the fact that the panel antennas will be located inside of an existing steeple -like structure on top of the apartment building. The antennas will not be visible. The equipment cabinet will be located inside the building in an area that was previously used by the apartment 'anitor for st e. The placement of the equipment cabinets will not take away any sl ential unit, nor will it be visible. 2. The proposed use shall meet or exceed the same standards for parking, landscaping, yards and other development regulations that are required in the district it will occupy. This proposal will not affect the landscaping, yards, or parking standards since the entire proposal will be within a previously permitted apartment building structure. 3. The proposed development shall be compatible generally with the surrounding land uses. The area in which this site is located is labeled as High Density Residential. Surrounding land uses within 1000 -feet include multiple apartment developments, single family homes, churches, an elementary school, a furniture store, office buildings, restaurant, ARCO gas station, Denny's, Tukwila City Hall, a Xerox building and a construction site for a self storage buildin. The 1000' radius also includes Interstate 5,Interstate 405, their junction, and Southcenter Boulevard. Because the panel antennas and ground equipment will be hidden within an existing structure, there will be virtually no visual impact or affect on the surrounding land uses and development. By locating in an existing structure and using stealthing materials instead of building a new monopole, or locating antennas and ground equipment on the outside of a building, in this high density residential area, Cingular is taking great measures to minimize any visual detriment to the City of Tukwila. 4. The proposed development shall be in keeping with the goals and policies of the Comprehensive Land Use Policy Plan.
