The requirements for such appeals are set forth in Tukwila Municipal Code 18.116. All appeal materials shall be submitted to the Department of Community Development. Appeal materials MUST include: 2. A statement identifying the decision being appealed and the alleged errors in the decision. 4. The scope of an appeal shall be limited to matters or issues raised in the Notice of Appeal. V. APPEAL HEARINGS PROCESS The City Council hearing regarding the appeal shall be conducted as a closed record hearing based on the testimony and documentary evidence presented at the open record hearing conducted by the Planning Commission. The City Council decision on the appeal is the City's final decision. Any party wishing to challenge the City Council decision on this application must file an appeal pursuant to the procedures and time limitations set forth in RCW 36.70C. Page Z10, the last page of the plans, demonstrates signage that will be located at the site. This signage is standard in the industry to adhere to the FCC signage requirements. It is not site specific but generic in nature. The Planning Commission recently approved another AT &T facility, with the same signage detail in the plans. This was for AT &T site 1/5 -518, file # L02 -002 approved by the Commission on 6/27/02. As you know, all telecommunication facilities, health related issues, are regulated by the Federal Government. Below you will find an excerpt from the FCC's FAQ's page of the FCC's RF emissions safety, rules, procedures and practical guidelines document. WHAT IS THE FCC'S POLICY ON RADIOFREQUENCY WARNING SIGNS? FOR EXAMPLE, WHEN SHOULD SIGNS BE POSTED, WHERE SHOULD THEY BE LOCATED AND WHAT SHOULD THEY SAY? Radiofrequency warning or "alerting" signs should be used to provide information on the presence of RF radiation or to control exposure to RF radiation within a given area. Standard radiofrequency hazard warning signs are commercially available from several vendors. Appropriate signs should incorporate the format recommended by the Institute for Electrical and Electronics Engineers (IEEE) and as specified in the IEEE standard: IEEE C95.2 -1999 (Web address: www.ieee.org ). When signs are used, meaningful information should be placed on the sign advising of the potential for high RF fields. In some cases, it may be appropriate to also provide instructions to direct individuals as to how to work safely in the RF environment of concern. Signs should be located prominently in areas that will be readily seen by those persons who may potentially have access to an area where RF fields are present. Abutting the central eastern side of the subject parcel the zoning is NCC and is the location of a Larry's Market Grocery Store. To the south and southwest across S 146 Street the zoning is RC and contains a mix of residential and commercial uses and structures. To the southeast of the subject site the zoning is NCC and contains various commercial uses fronting on Tukwila International Boulevard. Public Comment No public comments were received during or after the public comment period. CONDITIONAL USE CRITERIA The proposed project must comply with criteria detailed in TMC 18.64.050, (1 -5), concerning Conditional Use Permits. Applicant's response to conditional use criteria is attached to this staff report as Attachment D. Staff makes the following findings under the City's Conditional Use Permit criteria: (1) The proposed use will not be materially detrimental to the public welfare or injurious to the property or improvements in the vicinity of the proposed use or in the district in which the subject property is situated. The applicant has included site plans, elevations of the screened antennas, and computer generated photographs showing the proposed screened antennas in relation to the existing building and surrounding development. The existing building is approximately 34.25 feet in height per UBC (Uniform Building Code) and Building Department method of measurement. (i.e.: The west side of the building has three stories and measures 30 feet from grade to roof deck; the east side contains four stories and measures 38.5 feet from grade to roof deck.) The proposed antenna masts and screening on the south side of the roof will be 7.5 feet in height, for a total elevation of 41.75 above grade. The proposed antenna masts and screening on the north side of the roof will be 9.75 feet in height for a total elevation of 44.75 feet above grade. The associated electronic equipment will be flat mounted to the roof and will be screened by the existing parapet/mansard roof structure. The facility shall comply with all Federal standards related to radio frequency emissions. The two screening vents proposed for the southern end of the building will be twenty (20) inches square and 7.5 feet in height. The two 'cc w2 screening vents proposed for the northern end of the building will be sixteen (16) inches square and 9.75 feet in height. All four screening vents will be painted to o o the existing mansard roof color, a dark brown typical of aged cedar roof N shakes. N tL The proposed method of screening, the location of the electronic equipment 2 ° entirely behind the roof parapet, and the position of all facility equipment on the roof at a maximum of 44.75 feet above grade will assure this proposal will not be "- materially detrimental to the public welfare or injurious to the property or = w improvements in the vicinity of the proposed use or in the district. The proposed antennas and screens must be attached to the inside of the roof parapet (behind the mansard and away from public view) due to the structural inability of the flat roof surface to support the mounting poles and antennas, therefore the maximum allowable height of the antennas and screens is 45 feet. The antennas and screening on the northern end of the building will be 44.75 feet above grade (34.25 feet building height and 9.75 -foot antenna and screen height). The antennas and screening on the south side of the building will be 41.25 feet above grade (34.25 building height and 7.5 foot antenna and screen height). No other development standards in this zone apply to this application. (3) The proposed development shall be compatible generally with the surrounding land uses in terms of traffic and pedestrian circulation, building and site design. The surrounding land uses to the subject site are as described in Surrounding Land Uses above. To the north and west of the subject site are multi - family apartment structures. Larry's Supermarket is located to the east. The Villa Nelle building has an existing Sprint rooftop facility. The proposed facility will generate trips during the construction period and, following the completion of construction, up to 1 trip per month for maintenance. The proposed method of "stealth" screening will completely disguise the antennas. The proposed screening vents will add an appropriately proportioned and scaled roof top element. (4) The proposed use shall be in keeping with the goals and policies of the Comprehensive Land Use Policy Plan This project must comply with the following Comprehensive Plan policies and meet necessary Zoning Code regulations. 12.1.36. Encourage utilities to consolidate facilities and minimize visual impacts of facilities where technically feasible. Implementation strategies for this policy include the use of shared infrastructure and use of existing structures. The applicant is proposing antennas that will be located on an existing building containing an existing minor communications installation. In addition to co- location on a structure containing an existing facility, the proposed antennas will be "stealth" screened as described above resulting in the disguising of the additional antennas. 5) All measures have been taken to minimize the possible adverse impacts, which the proposed use may have on the area in which it is located. The probable adverse impacts from this proposal are visual / aesthetic impacts on the surrounding community. The applicant has proposed to mitigate these impacts by "stealth" screening of the antennas to give the appearance of normal roof top appurtenances found on this type of structure and use. Possible adverse public health impacts will be mitigated by the compliance with all federal standards related to radio frequency emissions. CONCLUSIONS 1. The proposed project meets the performance standards that are required in HDR zone. 3. The proposed project is compatible with the surrounding land uses in terms of traffic and pedestrian circulation, building and site design. The proposed method of "stealth" screening will completely disguise the antennas. The proposed screening vents will add an appropriately proportioned and scaled roof top element thereby adding visual interest to an otherwise dated mansard roof design. 4. The proposed project is in keeping with the goals and policies of the Comprehensive Land Use Plan, specifically, by placing the facility in a location with an existing facility and by the use of antenna screening. 5. Radio - frequency emission levels are regulated by Federal Communication Commission; this project must meet these requirements. The simulated roof screening vents, painted to match the existing roof color, will provide effective and aesthetically appropriate screening for the proposed facility. Our review of the roof structure near the center of the roof indicates structural upgrading will be required to transfer the imposed load through the structure to the foundations. In conclusion, TRK Engineering Ltd recommends that the antenna mounts remain positioned near the parapets to enable the imposed loads to be transferred through the exterior load bearing walls to the foundation. Also, please clarify if you are seeking permission for the future addition of three ( ?) antennae as part of this proposal or if you intend to re -apply for the additional antennae under a separate Conditional Use Permit at a later date. For the sake of simplicity for all parties the application for all antennae at this time makes the most sense. This determination of complete application and request for additional information does not preclude the City from requesting the submittal of additional plans or information if in our estimation such information is necessary to ensure the project meets the substantive requirements of the City or to complete the review process.
