DECISION SEPA Determination: The City SEPA Responsible Official has: determined that this application does not require a SEPA threshold determination because it is categorically exempt. Decision on Substantive Permit: The City Board of Architectural Review has determined that the application for a 2,844 square feet addition to the existing building located at 235 Strander Boulevard does comply with applicable City and state code requirements and has approved that application based on the findings and conclusions contained in the staff report, subject to the following conditions: 1. The rooftop HVAC units must be painted the same color as the building to minimize visibility from higher elevations of the adjoining buildings. 2. YOUR APPEAL RIGHTS The Decision on this Permit Application is a Type 4 decision pursuant to Tukwila Municipal Code 18.104.010. Other land use applications related to this project may still be pending. One administrative appeal to the City Council of the Board of Architectural Review Decision is permitted. IV. PROCEDURES AND TIME FOR APPEALING In order to appeal the Board of Architectural Review decision on the Permit Application, a written notice of appeal must be filed with the Department of Community Development within 14 days of the issuance of this Decision, that is by November 8, 2002. The requirements for such appeals are set forth in Tukwila Municipal Code18.116. All appeal materials shall be submitted to the Department of Community Development. Appeal materials MUST include: 1. The name of the appealing party. 2. The address and phone number of the appealing party; and if the appealing party is a corporation, association or other group, the address and phone number of a contact person authorized to receive notices on the appealing party's behalf. 3. A statement identifying the decision being appealed and the alleged errors in the decision. 4. The Notice of Appeal shall identify (a) the specific errors of fact or errors in application of the law in the decision being appealed; (b) the harm suffered or anticipated by the appellant, and (c) the relief sought. The scope of an appeal shall be limited to matters or issues raised in the Notice of Appeal. The City Council hearing regarding the appeal shall be conducted as a closed record hearing before the based on the testimony and documentary evidence presented at the open record hearing conducted by the Board of Architectural Review. The City Council decision on the appeal is the City's final decision. Any party wishing to challenge the City Council decision on this application must file an appeal pursuant to the procedures and time limitations set forth in RCW 36.70C. If no appeal of the City Council decision is properly filed in Superior Court within such time limit, the Decision on this permit will be final. VI. The building is currently being used for retail. The building addition is proposed to convert the drive- thru area into retail space. The site is accessed by two driveways along Strander Boulevard. The proposed addition is a one -story building with a total height of 18 feet. The project site is located along Strander Boulevard, which is one of the major east west streets in the urban center area. There is a gas station on the west side, Target development on the east side, hotel building across the street on the north side and another hotel building on the south side. An access drive to the Tukwila Pond is situated along the east property line (in between the project site and Target development. The surrounding area is zoned Tukwila Urban Center (TUC). This project is subject to Board of Architectural (BAR) design approval under Tukwila Municipal Code (TMC) Section 18.60.030. In the following discussion the Board of Architectural Review criterion is shown below in bold, followed by staff's comments. For the applicant's response to the criteria, see Attachment C. 1. Relationship of Structure to Site. a. The site should be planned to accomplish a desirable transition with streetscape and to provide for adequate landscaping and pedestrian movement; b. Parking and service areas should be located, designed and screened to moderate the visual impact of large paved areas; c. The addition is proposed along the west side of the building and it will maintain the same setback from the street as the existing building. A colored concrete pedestrian path is proposed to connect the entrance of the building to the sidewalk along Strander Boulevard. Additional plantings are proposed in the perimeter landscape area along the street. b) The existing landscape islands moderate the visual impact of the large paved area. Additional plantings are proposed in the existing landscape islands. c) The proposed addition is a one -story building and the top of the parapet is 18 feet and the existing building is 22 feet high. The maximum height allowed in the Tukwila Urban Center (TUC) zone is 115 feet. 2. Relationship of Structure and Site to Adjoining Area. a. Harmony on texture, lines and masses is encouraged; b. Appropriate landscape transition to adjoining properties should be provided; c. Public buildings and structures should be consistent with the established neighborhood character; d. Compatibility of vehicular pedestrian circulation patterns and loading facilities in terms of safety, efficiency and convenience should be encouraged; e. Compatibility of on -site vehicular circulation with street circulation should be encouraged. The existing building is about 22 feet in height and is located in the center of the site with parking along the perimeter. The addition is in scale with the existing building. The site is accessed by two driveways along Strander Boulevard. A pedestrian walkway is proposed from the sidewalk to the entrance of the building. Perimeter landscaping will be provided along the front property line. There is no minimum side or rear landscaping requirement. However there is mature landscaping along the side and rear property lines, some of which is on the subject site and some on the adjoining properties. 3. Landscaping and Site Treatment. 3 a. Where existing topographic patterns contribute to beauty and utility of a development, they should be recognized, preserved and enhanced; b. Grades of walks, parking spaces, terraces and other paved areas should promote safety and provide an inviting and stable appearance; c. Landscape treatment should enhance architectural features, strengthen vistas and important axis, and provide shade; In locations where plants will be susceptible to injury by pedestrian or motor traffic, mitigating steps should be taken; e. Where building sites limit planting, the placement of trees or shrubs in paved areas is encouraged; f. Screening of service yards, and other places which tend to be unsightly, should be accomplished by use of walls, fencing, planting or combina- tion; g. In areas where general planting will not prosper, other materials such as fences, walls and pavings of wood, brick, stone or gravel may be used; h. Exterior lighting, when used, should enhance the building design and the adjoining landscape. Lighting standards and fixtures should be of a design and size compatible with the building and adjacent area. Lighting should be shielded, and restrained in design. Excessive brightness and brilliant colors should be avoided. Pursuant to TMC 18.70.090, the site must meet all landscaping requirements if a design review application is required for the proposal. The Board of Architectural Review may modify the standards if strict compliance with the landscaping standards would create substantial practical difficulties, the existing and proposed additional landscaping will adequately screen and soften the barren appearance of parking areas and will adequately enhance the premises appropriate to the use district. The applicant requests a waiver from 15 feet requirement since there is only eight feet between the existing parking and the edge of the existing sidewalk. There is sufficient width available at the corners to meet the 15 feet requirement. Staff is recommending approval to reduce the standard width requirement for the portion in between the access driveways as increasing the width of the landscape area would reduce the parking and drive aisle area to below minimum dimensions required under code. Also the applicant is proposing to plant shrubs at 6 feet on center instead of the 7 feet requirement. The proposed planting of trees at 30 feet on center, shrubs at 6 feet on center and retaining mature groundcover will meet the objectives of Type I landscaping that are to enhance streetscape, provide a visual separation between uses, screen parking areas and allow views to building entryways and signage. Foundation landscaping is provided along the east facade to soften the impact of the proposed building. Landscaping in the existing landscaping islands in the parking area is proposed to be augmented to soften the impact of paved areas. Wheel stops are provided where the parking stalls abut the landscaped area along Strander Boulevard. Garbage /recycling area will be repainted to improve its appearance. Also, additional landscaping is proposed around the enclosure. No changes are proposed to the existing lot lighting. 4 r 4. Building Design. f u a. Architectural style is not restricted, evaluation of a project should be based on quality of its design and relationship to its surroundings; b. Buildings should be to appropriate scale and in harmony with permanent neighboring developments; c. Building components such as windows, doors, eaves, and parapets should have good proportions and relationship to one another. Building components and ancillary parts shall be consistent with anticipated life of the structure; d. Colors should be harmonious, with bright or brilliant colors used only for accent; e. Mechanical equipment or other utility hardware on roof, ground or buildings should be screened from view; Exterior lighting should be part of the architectural concept. Fixtures, standards, and all exposed accessories should be harmonious with building design; g. Monotony of design in single or multiple buildings projects should be avoided. Variety of detail, form and siting should be used to provide visual interest. Applicant was asked to provide modulation and foundation landscaping along the east facade to break the monotony of the large facade. The applicant revised the design to add a roofline along the east facade and also included foundation landscaping. Applicant was asked if the proposal included painting the entire building. If so, then there was opportunity to provide articulation and break the monotony by introducing addition colors and texture. The applicant stated that no changes are proposed to the existing building. The proposed addition will be painted to match the existing building. HVAC equipment shall be screened by the parapet of the building. See graphic on the south elevation. The equipment must be painted the same color as the building to minimize visibility from the higher buildings in the area. S. Miscellaneous Structures and Street Furniture. a. Miscellaneous structures and street furniture should be designed to be part of the architectural concept of design and landscape. Materials should be compatible with buildings, scale should be appropriate, colors should be in harmony with buildings and surroundings, and proportions should be to scale; b. Lighting in connection with miscellaneous structures and street furniture should meet the guidelines applicable to site, landscape and buildings. 5 (3) (5) As referenced earlier the enclosure around garbage /recycling area shall be repainted to improve its appearance. Bicycle parking is proposed along the north west corner of the building. There are four illegal signs that were recently installed. All illegal signs must be removed. No changes are proposed to the existing signs. A separate sign permit will be required if any changes are proposed in the future and the proposed sign shall meet all sign code requirements. CONCLUSIONS The structure is located in the center of the subject site with parking• around the building and the addition is proportionate to the site area. It is a one -story addition and meets all TMC height and setback requirements. A colored concrete pedestrian path connects the main entrance of the building to the sidewalk along Strander Boulevard. Planting in the landscape islands will be augmented in order to moderate the visual impact of the large paved area. (2) Relationship of Structure and Site to Adjoining Area. The addition is in scale with the existing building. The site is accessed by two driveways along Strander Boulevard. A pedestrian walkway is proposed from the sidewalk to the entrance of the building. Perimeter landscaping will be provided along the front property line. There is mature landscaping along the side and rear property lines that provides visual buffer from the adjoining sites. Perimeter landscaping along the Strander Boulevard will be upgraded to include trees, shrubs and groundcover although the width of the landscape area will be eight feet instead of fifteen due to existing site constraints. Foundation landscaping is provided along the east facade to soften the impact of the proposed addition. Additional landscaping is proposed in the existing landscape islands in the parking area (4) Building Design. Modulation and foundation landscaping is provided along east facade to soften the monotony of the large facade. The proposed addition meets the TMC height regulations. HVAC equipment shall be screened by the parapet of the proposed building. Additionally it should be painted the same color as the building to minimize visibility from the higher elevations of the adjoining buildings. Miscellaneous Structures and Street Furniture. Miscellaneous structures shall be compatible with the design of the building. Illegal signs must be removed to reduce clutter. 6 RECOMMENDATIONS Staff recommends approval of the Design Review application with the following conditions: 1. The rooftop HVAC units must be painted the same color as the building to minimize visibility from higher elevations of the adjoining buildings. 2. Mullet, Mayor 1. The landscape plan must be signed by a landscape architect licensed in the state of Washington. The landscape plan shall include type, quantity, spacing and location of plants and materials, typical planting details and the location of irrigation systems. Pursuant to TMC 18.70.090, the site must meet all landscaping requirements if a design review application is required for the proposal. The Board of Architectural Review may modify the standards if strict compliance with the landscaping standards would create substantial practical difficulties, the existing and proposed additional landscaping will adequately screen and soften the barren appearance of parking areas and will adequately enhance the premises appropriate to the use district. Your letter requests a waiver from 15 feet requirement since there is only eight feet between the existing parking and the edge of the existing sidewalk. There is sufficient width available at the corners to meet the 15 feet requirement. Staff would recommend approval to reduce the standard width requirement for the portion in between the access driveways if the standard Type I landscaping requirement is augmented with additional shrubs. Also, please note that standard Type I landscaping requirements includes shrubs at 7 feet on center. The current plan shows shrubs at 25 feet on center. Refer to the attached landscaping chapter for plant size and quantity requirements. One option may also be to plant shrubs closer than 7 feet on center. The interior of the parking lot is configured and planted to meet the code intent, but it is at the North property line on the shoulder where there is conflict. To rectify this situation, street trees to match existing in the area will be added to this proposal. Foundation landscaping will be added along the addition to soften the long facade. 3. Landscaping: Pursuant to TMC 18.70.090, the site must meet all landscaping requirements if a design review application is required for the proposal. The Board of Architectural Review may modify the standards if strict compliance with the landscaping standards would create substantial practical difficulties, the existing and proposed additional landscaping will adequately screen and soften the barren appearance of parking areas and will adequately enhance the premises appropriate to the use district. If any of the requirements listed below cannot be met, please submit a request for waiver. The request must include the reasons why these requirements cannot be met and how the proposed landscaping will substitute for the requirement. Fifteen feet of Type I landscaping is required along the north property line. Type I landscaping consists of trees, shrubs and groundcover. Refer to the attached landscaping chapter for plant size and quantity requirements. Interior parking lot landscaping must meet the standards listed in TMC 18.52.035(3), i.e. a minimum of 15 square feet for each parking stall visible from the street and a minimum of 10 square feet for each parking stall screened from the street must be provided. Also, per TMC 18.52.035(4), landscape islands shall be placed at the ends of each interior row with no stall more than 10 stalls or 100 feet from the landscape area. The minimum size of interior parking lot islands is 100 square feet and they must be minimum of 6 feet in any direction and generally the length of adjacent parking space. Also, a minimum of one evergreen or deciduous tree is required per landscape island with remaining area to contain a combination of shrubs, living groundcover and mulch. Please document how the interior landscaping requirements are met. Foundation landscaping must be provided along the proposed addition to soften the large facade. 3. Building Design: The long building facade for the proposed addition on the east side must be modulated to provide some interest and break the monotony.
