Mullet, Mayor Department of Community Development Steve Lancaster, Director NOTICE OF DECISION The Short Subdivision Committee has completed review of your short plat application (No. L02- 0024), and determined that it complies with all applicable City code requirements. The City's SEPA Responsible Official has previously determined that this application does not require a SEPA threshold determination because it is categorically exempt. This letter serves as the Notice of Decision per TMC 18.104.170. Based on the latest project submittal, preliminary approval is granted subject to the conditions stated below. There are three basic steps in the short plat approval process: 1. Preliminary Approval Utilities This letter constitutes your preliminary approval. The application was reviewed by the Tukwila Short Subdivision Committee and approved with conditions. The conditions imposed are to ensure the short plat is consistent with the Criteria for Preliminary Approval listed at TMC 17.12.020 C in the Tukwila Subdivision Code. PRELIMINARY APPROVAL CONDITIONS a. Drainage design for Lots 1 and 2 shall meet City of Tukwila Surface Water Ordinance Requirements. Contact the Tukwila Public Works Department for submittal and design requirements. Submit a set of recording documents in either legal or record of survey format that meet the King County Recorder's requirements. The survey map must be revised to reflect the z changes as shown on the attached redlined map. The surveyor's original signature must be on the face of the plat. APPEALS This short plat approval decision is appealable to the Hearing Examiner. In order to appeal the decision a written notice of appeal must be filed with the Department of Community Development within 21 days of the issuance of the Notice of Decision (09/18/2002). The requirements for such appeals are set forth in Tukwila Municipal Code 18.116. If no valid appeals are filed within the time limit the decision of the Department will be final. Appeal materials shall include: 1. The name of the appealing party. Short Plat L02 -024 Page 2 Expiration 2. The address and phone number of the appealing party; and if the appealing party is a corporation, association or other group, the address and phone number of a contact person authorized to receive notices on the appealing party's behalf. 3. A statement identifying the decision being appealed and the alleged errors in the decision. The Notice of Appeal shall state specific errors of fact or errors in application of the law in the decision being appealed; the harm suffered or anticipated by the appellant, and the relief sought. The scope of an appeal shall be limited to matters or issues raised in the Notice of Appeal. Any appeal shall be conducted as an open record hearing before the Hearing Examiner. The Hearing Examiner's decision on the appeal is the City's final decision. A party who is not satisfied with the outcome of the administrative appeal process may file an appeal in King County Superior Court from the Hearing Examiner's decision pursuant to the procedures and time limitations set forth in RCW ch. 36.70C. 2. Final Approval The next steps for you are a) Obtain a demolition permit and demolish the existing garage. b) Sign and notarize the documents for dedication of the right -of -way. Please provide all documents back to the city for the Mayor's signature on the Real Estate excise tax affidavit. The documents will be recorded after the Mayor's signature. c) Submit the necessary short plat documents (survey, legal descriptions, and other required paper work) with revisions made as shown on the redlined plat drawing. The documents must meet the King County Recorder's requirements. The surveyor's original signature must be on the face of the plat. All taxes and fees assessed against the property must be current prior to final approval. Please check with the King County Assessor's Office and the City of Tukwila Finance Department prior to submitting final mylars. After the documents have been found to be in order, and the all of the requirements of the short plat have been met, the Chair of the Short Subdivision Committee signs your short plat which constitutes a grant of final approval. The final approved short plat must be filed with the King County Department of Records by August 28, 2003, one year from the date of this preliminary approval or the application will expire. The City may grant a single one -year extension if requested in writing prior to the expiration date. Short Plat L02 -024 Page 3 4 3. It is your responsibility to record the City approved short plat documents with the King County Department of Records. SITE DESCRIPTION EXISTING SITE CONDITIONS: The site is currently used for one single family residence. Vegetation consists of a lawn and shrubs around the existing house. The site generally slopes southeasterly on grades of 2 % -15 %. Surface water from the site drains to the existing storm drainage facilities in South 148th Street. PROPOSED CONDITIONS: Development of the site will include the construction of one additional single family home with the associated driveway and utilities (see Figure 3). All building lot areas will be greater than 8,113 square feet. A private road consisting of 12' wide asphalt surface with 4' gravel shoulders on each side was constructed to provide access to the new residences for a previous short plat number L96- 00040. The road was constructed with an inverted crown to direct all surface water from the asphalt surfaces to a storm drainage system installed down the center of the road. All roof downspout drains will be discharged directly into said storm drain system. The existing residence and driveway on the site will remain until some future date. The residence shown on Lot 1 of Figure 3 will be constructed under a separate permit. All disturbed soils will be seeded with native grasses or otherwise landscaped to prevent soil erosion. SOIL TYPE: The soil type on the site is Alderwood Gravelly Sandy Loam. Soil test pits dug on the site revealed 3 " -20" depth of topsoil overlying cemented glacial till. The site does not appear adequate for storm water infiltration. Perforated tightline connections to the storm drains will be installed in accordance with the 1998 King County Surface Water Design Manual. SENSITIVE AREAS: The King County Sensitive Areas Map Folio (1990) does not identify any wetlands, stream, 100 year flood plain, erosion hazards, Seismic hazards or coal mines within 200 feet of the subject parcel. None were observed. 3 ON -SITE DRAINAGE ANALYSIS ONSITE DRAINAGE BASINS Surface water runoff from the subject parcel generally flows in a southeasterly direction and exits the subject site along the east property line and enters the storm drainage system in S. 148 Street. DRAINAGE DISCHARGE AT THE NATURAL LOCATIONS All surface water runoff from the proposed project, including all pervious and impervious surfaces, such as roads, utilities, buildings, lawns, pastures and forests, must be discharged at the natural location so as not to be diverted onto, or away from, the adjacent downstream property. The existing drainage patterns on and surrounding the property will not be significantly altered by the proposed development. The drainage pattern modifications resulting from the proposed storm drainage facilities will not affect the basin drainage patterns. 4 :;19fl i,:ait. i4 4d OFF -SITE DRAINAGE ANALYSIS An off -site drainage analysis identifying the upstream tributary drainage areas and analysis of the drainage systems downstream from the proposed project is required whenever the proposed new impervious surface to be constructed is greater than 5000 square feet. The subject project includes construction of three new single family residences with an impervious surface area greater than 5000 square feet. The downstream drainage courses were surveyed in August of 1996 during a period of no rain. UPSTREAM DRAINAGE BASINS Surface water runoff entering the subject parcel from upstream properties is neglegible. DOWNSTREAM DRAINAGE Surface water exits the site along the south and east property lines as sheet flow. The on -site flows enter the storm drains in S. 148 Street on or near the site (See Figures 3, 4 & 5). From CB1 the flows travel under S. 148th Street in a 24" concrete pipe and to an open channel. The open channel is about 6' deep with vegetated side slopes. The runoff travels about 150' down the open channel to a 24" concrete pipe. The 24" pipe is the entrance to a storm drains system in 42nd Ave. S. which travels approximately 1200' to the south. It appears this storm drain discharges to the 42nd Ave. Detention Pond which ouffall to the North Fork of Gilliam Creek. DOWNSTREAM DRAINAGE -- SUMMERY ANALYSIS AND CONCLUSIONS During the field survey we observed no evidence of surface water over - topping roadways, significant scouring, bank sloughing, or significant sedimentation in the 1/4 mile downstream drainage courses. All the downstream drainage facilities appeared to be in good condition and of adequate capacity for the existing and proposed developments.
