YOUR APPEAL RIGHTS The Decision on this Permit Application is a Type 4 decision pursuant to Tukwila Municipal Code 18.104.010. Other land use applications related to this project may still be pending. One administrative appeal to the City Council of the Planning Commission Decision is permitted. No administrative appeal of a DNS is permitted. IV. PROCEDURES AND TIME FOR APPEALING In order to appeal the Board of Architectural Review decision on the Permit Application, a written notice of appeal must be filed with the Department of Community Development within 21 days of the issuance of this Decision, that is by November 15, 2002. The requirements for such appeals are set forth in Tukwila Municipal Code 18.116. All appeal materials shall be submitted to the Department of Community Development. Appeal materials MUST include: 1. The name of the appealing party. 2. The address and phone number of the appealing party; and if the appealing party is a corporation, association or other group, the address and phone number of a contact person authorized to receive notices on the appealing party's behalf. 3. A statement identifying the decision being appealed and the alleged errors in the decision. 4. The Notice of Appeal shall identify (a) the specific errors of fact or errors in application of the law in the decision being appealed; (b) the harm suffered or anticipated by the appellant, and (c) the relief sought. The scope of an appeal shall be limited to matters or issues raised in the Notice of Appeal. V. APPEAL HEARINGS PROCESS The City Council hearing regarding the appeal shall be conducted as a closed record hearing before the based on the testimony and documentary evidence presented at the open record hearing conducted by the Planning Commission. The City Council decision on the appeal is the City's final decision. Any party wishing to challenge the City Council decision on this application must file an appeal pursuant to the procedures and time limitations set forth in RCW 36.70C. An appeal challenging a DNS may be included in such an appeal. If no appeal of the City Council decision is properly filed in Superior Court within such time limit, the Decision on this permit will be final. VI. Centered the structure on the ridgeline of the existing building. 2. Reduced the height by two feet so that the top of the cupola is at 33 feet instead of 35 feet. 3. Faux windows have been added to the proposed structure instead of louvers. CONDITIONAL USE CRITERIA The proposed project must comply with criteria detailed in TMC 18.64.050, (1 -5), concerning Conditional Use Permits. Following is the analysis of the revised design under the city's Conditional Use Permit criteria (TMC 18.64.050): (1) The proposed use will not be materially detrimental to the public welfare or injurious to the property or improvements in the vicinity of the proposed use or in the district in which the subject property is situated. The proposal to install additional antennas on an existing building will not be materially detrimental to the public welfare or injurious to the property or improvements in the vicinity. 2 (2) The proposed use shall meet or exceed the performance standards that are required in the district it will occupy. The Development Standards for uses in the RCM zone are: Maximum height: Setbacks: 3 stories or 35' Front: 20' Side and rear: 10' The top of the proposed cupola is 33'. The antennas are proposed within the new cupola on the roof the existing building and the building meets all setback requirements. The associated equipment shall be placed within an existing unit of the motel. No other development standards in this zone apply to this application. The proposed project meets the performance standards that are required in RCM zone. (3) The proposed development shall be compatible generally with the surrounding land uses in terms of traffic and pedestrian circulation, building and site design. (4) The proposed use shall be in keeping with the goals and policies of the Comprehensive Land Use Policy Plan 12.1.36. Encourage utilities to consolidate facilities and minimize visual impacts of facilities where technically feasible. In order to reduce the aesthetic impact, the exterior treatment of the cupola structure has been revised to include windows instead of louvers. The height of the structure has been lowered two feet to so that ceiling height is similar to that of the existing building and it is proportioned similar to the other stories. The structure is centered on the ridgeline of the existing building (see west elevation). The exterior treatment of the new cupola shall be such as to reduce the visual impact of a large structure on the roof of the existing building. In order to reduce the visual impact the vertical wall of the cupola shall be aligned with the gable end of the existing roof ridge. 2. Existing Development The existing building is a motel; Towne and Country Suite with 11 separate detached buildings on a lot that is approximately 145,490 square feet. The subject site is zoned Regional Commercial Mixed Use (RCM). Surrounding Land Uses The surrounding land uses are all commercial and office buildings. All adjoining properties are zoned Regional Commercial Mixed Use (RCM). The subject site is bounded by Interurban Avenue on the west side and the Duwamish River on the east side. BACKGROUND Verizon Wireless is proposing to construct a Wireless Communication Facility within and on Building B of the motel complex located at 14800 Interurban Avenue South. The support facility will be located in first floor end unit B -29. The antennas are proposed to be mounted in a new architectural feature, a cupola with a top height of 35 feet located on the roof of the west end of Building B. Within the cupola there will be four antennas in each of the three sectors. Each antenna will be approximately 51" tall, 5" wide and 3" deep. The support facility will be located inside Unit 13-29 and will be approximately 625 sq. ft. that will hold radio equipment, servers and two HVAC units to cool the equipment. There will be approximately 5 "x3" notice signs posted on the door of unit B -29 stating only authorized personnel allowed. One similar notice may be posted on the roof notifying that there are radio frequency transmitters. See attachment D for examples of these signs. 3 CONDITIONAL USE CRITERIA The proposed project must comply with criteria detailed in TMC 18.64.050, (1 -5), concerning Conditional Use Permits. Applicant's response to conditional use criteria is attached to this staff report as Attachment C. Staff makes the following findings under the city's Conditional Use Permit criteria (TMC 18.64.050): (1) The proposed use will not be materially detrimental to the public welfare or injurious to the property or improvements in the vicinity of the proposed use or in the district in which the subject property is situated. The applicant has included site plans; elevations of the antennae; and computer generated photographs showing the proposed cupola that will screen the antennas and associated equipment in relation to the existing building and surrounding development. The top of the existing building is 21' 10" high. The top of the proposed cupola will be 35' high. The subject site is zoned RCM. The facility shall comply with all federal standards related to radio frequency emissions. (2) The proposed use shall meet or exceed the performance standards that are required in the district it will occupy. The Development Standards for uses in the RCM zone are: Maximum height: Setbacks: 3 stories or 35' Front: 20' Side and rear: 10' The top of the proposed cupola is 35'. The antennas are proposed within the new cupola on the roof the existing building and the building meets all setback requirements. The associated equipment shall be placed within an existing unit of the motel. No other development standards in this zone apply to this application. (3) The proposed development shall be compatible generally with the surrounding land uses in terms of traffic and pedestrian circulation, building and site design. As with similar uses, the proposed facility will generate trips during the construction period and, following the completion of construction, up to 1 trip per month for 4 maintenance. No other impacts to pedestrian or transportation movements are anticipated. No new building is proposed. Instead the project is to construct a cupola to screen the proposed antennas on rooftop of an existing building. (4) The proposed use shall be in keeping with the goals and policies of the Comprehensive Land Use Policy Plan This project must comply with the following Comprehensive Plan policies and meet necessary Zoning Code regulations. 12.1.36. Encourage utilities to consolidate facilities and minimize visual impacts of facilities where technically feasible. Implementation strategies for this policy include the use of shared infrastructure and use of existing structures. The applicant is proposing antennas that will be located on an existing building. S) All measures have been taken to minimize the possible adverse impacts, which the proposed use may have on the area in which it is located. The applicant has applied for a location on an existing building in lieu of proposing a new monopole for their antennas. A cupola that is consistent with the architecture of the building is proposed in order to screen the antennas. The associated equipment is proposed to be placed inside the existing building. The existing building has vertical wood siding and brick fascia on the sides. The exterior of the cupola is proposed to be partial vertical wood siding and partial horizontal siding in the form of louvers. This treatment will help in breaking up the mass of the cupola while still being architecturally consistent with the existing building. Applicant was asked to provide a materials and colors board to verify that the proposed new cupola shall match the existing structure and the proposed exterior treatment shall help in making the bulk and mass of the new structure in scale with the existing building. Applicant requested that they provide the materials board at the public hearing. The associated equipment that is proposed inside one of the units of the motel shall meet all requirements of the City's noise ordinance. Also the project must meet all Uniform Building Code and Fire Department requirements, which will be reviewed as part of the building permit review process. The proposal is to install a rooftop wireless telecommunication facility on an existing building. The existing building is located within 200 feet of the Mean High Water Mark (MHWM) of the Duwamish/Green River. The project also meets all underlying height and setback requirements of the underlying zone. 2. The use does not conflict with the goals and policies of the shoreline master program or the provisions of the Shoreline Act and shoreline regulations: The use is consistent with the goals and policies of the shoreline master program and the provisions of the Shoreline Act and shoreline regulations. 3. No structures or accessory facilities shall be located over the river unless such structure protects or promotes the public interest. 4. There shall be no disruption of existing trees or vegetation within the river environment unless necessary for public safety or flood control, or if allowed as part of an approved shoreline substantial development permit. The project is to install antennas within a new cupola structure that is proposed to be constructed on the roof of an existing building. There will be no disruption of existing vegetation in this river environment as a result of the proposed project. 5. No effluent shall be discharged into the Green River which exceeds the water quality classification as established by the State for the adjacent portion of the river. No discharge of effluent will occur due to proposal. 6. All States and federal water quality regulations shall be strictly complied with. N/A 7. The associated equipment is proposed to be located within one unit of the motel building. The project location is within high- impact environment. Specific use regulations -high impact environment (18.44.150) All uses allowed in the underlying zoning district shall be allowed in the high impact environment. Rooftop wireless telecommunication facilities are permitted in the underlying RCM zone as a conditional use. Applicant shall obtain Conditional Use permit prior to construction. Also, the City's building and fire department have the following comments that you must address as part of building permit application: 1. The proposed project is a possible form building code perspective. However, there are several code - related issues that will have to be resolved. For example a `true" one hour fire resistive occupancy separation will be required between the support facility and any dwelling unit exposure. A sound transmission co- efficient of 50 will be required between the support facility and dwelling unit(s) and this will have to be confirmed by test. The cupola must be of the same fire resistive construction as the main building. Containment provisions for the lead/acid batteries will be required. Structural provisions of the building code will have to be integrated into the existing structure. 2. Fire Department will need additional information on the number and volume of batteries for emergency power. A fire alarm system monitored by a city approved U. L. Central Station will be required. This determination of complete application does not preclude the City to require that you submit additional plans or information, if such information is necessary to further review the application and ensure that the project meets the substantive requirements of Tukwila Municipal Code.
