Based on this research staff is recommending increases to Tukwila's fees. FINDINGS MEMORANDUM Tukwila's land use permit fees have not increased since 1995. We found that our fees ranged from 9% to 72% of the average fee charged by our south King County neighbors, not including cases where Tukwila charged no fee, such as lot consolidations and preapplication meetings. In calculating this average we tried to compare "apples to apples," but we also found that there were many different approaches to fee calculation. Most jurisdictions used systems more complex than Tukwila's flat fee approach, for example: ❑ Burien's flat fee acts as a retainer with any staff time over a certain number of hours charged back to the applicant at $65 per hour. The cost of any special studies is also passed through to the applicant. ❑ Many of SeaTac and Federal Way's fees are calculated on a sliding scale based on either square footage or value of construction. ❑ Kent, Federal Way and Redmond charge single family applicants a lower variance fee. ❑ When two or more applications for a project are processed together Kirkland charges the full amount for the highest fee and reduces the associated permit fees by 50 %. However on average Kirkland's fees were significantly higher than those charged in the south County. Two jurisdictions also added supplemental fees: ❑ .Federal Way adds a 5% fire district administration fee onto the cost of each permit. ❑ In Redmond all permits have a 3% technology surcharge and many are subject to a $304 stormwater fee. These changes have the potential to double our yearly permit revenue if the volume of permits remains similar to 2001. We are recommending ? z lower fees for single family applicants on many permits including boundary line adjustments, lot cc 2 consolidations, and short plats. 6 0 Redmond. Any request for a change in zoning of any district or area, or of any boundary lines thereof as shown on the zoning maps, shall be submitted to the Department. Said requests shall be made on such formal application forms as specified by the Department and filed with the Department, which shall transmit a copy to the City Clerk. All applications shall be accompanied by a filing fee as required in the Application Fees chapter of this title. All applications for a change of zoning or of any boundary lines shall be a Type 5 decision and shall be processed pursuant to TMC 18.108.050. Proposed Land Use Fee Changes Echoing comments at the previous night's COW, the committee thought it was reasonable for Tukwila's permit fees to rise somewhat, as they have not been increased since 1991. Steve L said to get recommended fees for Tukwila, they used the lower end of the average for South King County cities' fees for permits. In answer to a question about what a "binding site plan" was, Steve said it was a process used by commercial property owners to divide their land. A zoning letter is used when mortgage companies or like businesses call to find out zoning questions for clients. Preapplication meetings were discussed. Steve said staff generally likes them because they result in better applications if the developer sits down with staff before to go over the basic development issues. Other cities have charged for their service for a number of years, but it has been free in Tukwila. The current proposal is to charge a fee, then to credit that amount to any permit submitted within 90 days. Though it is generally used as it should be, occasionally people use the preapp meeting innappropriately, and a fee should discourage that. Pam asked if the new fees recovered the cost of the permits. Steve said they did not come near covering the costs, but that they benefit the process, and also that there were other building permit fees that are charged. Steve also said staff recommends we break out some of the smaller design review permits to be administrative processes instead of going to the Board of Architectural Review. The example he used was of a pre -made espresso stand replacing a stand already up. By going to an administrative design review process for minor projects, we can set the fee about $1,000 lower and save the applicant up to two months in processing time. Committee members voiced support for this. A separate ordinance for the DCD fees will be written. Recommend fee ordinance to COW. 2. Foster Clubhouse Update The committee had asked questions at their last meeting, which Bruce attempted to answer. He had two samples of rock for the building facing. Joan liked the rounded river rock; Pam preferred the straight cut rock. Joan had asked about using siding shakes as at Fire Station #54. Bruce said the cost would be $33,000 more than budgeted. The committee had also asked about a water feature in the front of the building. Bruce said it could cost from $30,000 - $45,000. He said the Arts Commission could possibly contribute some funds to this. Pam suggested roughing in the fountain and finishing it in future years when more revenues were available. The issues which need to be decided will go to the COW. Refer design issues to COW. 3. Park Hours A discussion about park hours ws initiated from Bruce's memo and presentation. Joe asked Ms. Huggett what her opinion was of park hours. After a discussion of "nice" users and "not nice" users she related the park hours issue back to her issue of park users being able to see into her home easily since the water tank construction. Ms. Huggett still has no screening from the park, and people still look into her house and yard at all hours whether the park is open or closed. The Water District believes they have fulfilled their obligation to screen her property because they provided landscaping and negotiated a cash settlement for a legal easement in a complicated process involving her mother, who is the legal owner. The mother gave a final approval of the landscaping work completed even though Wendy had been doing all the negotiation until then and was not in this final approval part. Bruce will try to talk to the Water district or see if the City can do anything to help resolve her problem. Bruce had brought copies of the U.S. Naval Observatory's definitions of rising and setting of the sun as well as twilight definitions. They had a chart of sunrise and sunset times for each day of the year at Tukwila's latitude and longitude. Bruce had done a chart of the park openings and closings from 15 other cities. The most common was 5 a.m. to 10 or 11 p.m. unless otherwise posted. The committee members talked about 5 a.m. for an opening time, and maybe 10 p.m. in summer and 8 p.m. in winter. They wanted the whole Council's viewpoint on this matter. Recommend to COW. 4. Contract Award Cascade View Park for Artistic Design, Build The Arts Commission selected Lydia Aldredge of Archetype as the best person to design an artistic, gazebo, artistic light standards, Terrazzo world map, and Basalt columnar sculpture at Cascade View park. Rick said the contract is the standard city contract for commissioning an artist. Attachment A or Scope of Work is the main specifics. Attachment A has a brief description of the art to be made and the associated fee and time line. The time line in the contract was determined to keep schedule with the park construction . Rick described the ethnic patterns and colors that would be used in the art, and he briefly described the process of how the artistic gazebo artistic light standards would be used, including the use of an anti - graffiti coating. The artist, in good faith of the contract approval, provided preliminary sketches of the artwork for committee review and for construction information for the city's permit process. The "art" in this park is to provide something unique and special and that represents the diverse population living in close proximity to the Cascade View park. The committee discussion included functionality of the artwork imbedded in the ground and the Council process for the contracted art. The committee did not want the ground artwork to be slippery or sharp. They also wanted to define whether the committee or Council should give the authorization to proceed to the next step in the Scope of Work Staff was hopeful the contract would be approved and the contract would stay on park construction schedule in order to help with coordination of footing and electrical needs. The committee said they were o.k. with the current contract. Recommend contract and design issues to COW. 5. CDBG 2003 Recommendations Evie explained that she had a group of city employees help in deciding where to allocate 2003 funding. Funding includes both the projected amount of federal dollars expected, plus any unexpended or paid -back funds from 2002. The funds were put into Public Service (community center recreation leader); Planning and Administration (South King Domestic Violence Service Planner); and Capital Projects ( Major and Minor Home Repairs, Friends of Youth McEachern House, and Cascade View design of a surface water system for the neighborhood). The 2002 projects cancelled were Duwamish sidewalks (already cancelled by Council) and utility connections. Though some of those funds were put into playground replacement, there was still money left that can be used in 2003. The committee questioned the two persons representing the Domestic Violence planning position and the McEachem House project. Both were projects the committee supported, especially after hearing from their proponents. Recommend project funding to COW, including canceling utility project. 6. Name That Park There had been a suggestion to re -name Cascade View Park. The process is to seek potential names and then have the Park Commission recommend a name to the City Council. Five names were submitted and the Park Commission recommended Cascade Community Park. Committee members liked Cascade View Neighborhood Park, Cascade View Community Park, and Cascade View International Park. The committee suggested the whole Council decide the name. Recommend to COW.
