THIS DEED, Made this ,i0 day of ���/, , N
1977 between UNION PACIFIC LAND RESOURCES COR RATYON, a
• corporation of the State of Utah, Grantor, and
OREGON - WASHINGTON RAILROAD & NAVIGATION COMPANY, a cor-
poration of the State of Utah, Grantee:
WITNESSETH, That Grantor, for and in considera-
tion of the sum of One Dollar ($1.00), the receipt whereof
is hereby confessed and acknowledged, has granted, bargained,
sold and conveyed and by these presents does grant, bargain,
sell and convey unto Grantee, its successors and assigns, a
PERPETUAL EASEMENT for a right of way for the construction,
r '' operation, maintenance, repair, renewal, reconstruction and
relocation of railroad trackage over and across the land
situate in King County, State of Washington, described in
Q
Exhibit A hereto attached and hereby made a part hereof,
together with the right of ingress and egress to, from and
:;ft upon said land and adjacent lands of Grantor for the purr •
j pose of exercising the rights herein granted, and, if and
when necessary, removing said railroad trackage.

This easement is made subject to all outstanding
superior rights and to the right of Grantor to renew such
rights and to extend the term thereof, and subject also to
all conditions, limitations, restrictions, encumbrances,
reservations and other interests of any person with respect
to said land.
It is expressly made a condition of this easement
that if Grantee, its successors or assigns, shall abandon
the premises described in Exhibit A for railroad trackage
purposes, then and in that event all the rights herein
granted shall cease and determine and the title to the land
described in Exhibit A shall be relieved of the burden of
this easement; and it is further agreed that nonuser of the
easement herein granted for a period of one (1) year shall
be deemed an abandonment of said premises.
TO HAVE AND TO HOLD the above - mentioned easement
unto Grantee, its successors and assigns, forever.
IN WITNEF;S WHEREOF, Grantor has caused these pres-
ents to be signed by its Yiee President and attested by its
Assistant Secretary, and its corporate seal to be hereunto
affixed as of the day and year first herein written.
