Staff Report to the Planning Commission L01 -001 Voicestream Page 3 of 6 Vicinity /Site Information Project Description Existing Development Surrounding Land Uses BACKGROUND FINDINGS Voicestream is requesting Conditional Use Permit approval to install a wireless telecommunication facility on the roof of the existing building, which is located at 1224 /26 Andover Park East. The project consists of three sector wireless facility. Each sector consists of three antennae. Associated operating equipment is proposed to be placed on ground (on the east side of the building). The existing building is 30 feet high to the top of the parapet. The antennae are setback 50 feet from the edge of the building parallel to Andover Park East. The subject site is zoned Tukwila Urban Center (TUC). All adjoining properties are zoned Tukwila Urban Center (TUC). Home Depot is located on the property immediately east of the subject site. All adjoining buildings along Andover Park East are approximately 30 feet high buildings. There is also a railroad easement along the east property line of the subject site. The applicant is requesting to co- locate antennae on an existing building. Applicant had originally proposed to locate a 60 -foot monopole at the rear of the building. The proposal was revised to be a three- sector roof top installation. Applicant submitted three different photosimulations (see attachment B), to highlight the option with the least aesthetic impact and minimum visibility from the public street. Staff Report to the Planning Commission L01 -001 Voicestream Page 4 of 6 CONDITIONAL USE CRITERIA The proposed project must comply with criteria detailed in TMC 18.64.050, (1 -5), concerning Conditional Use Permits. Applicant's response to conditional use criteria is attached to this staff report as Attachment C. Staff makes the following findings under the city's Conditional Use Permit criteria (TMC 18.64.050): (1) The proposed use will not be materially detrimental to the public welfare or injurious to the property or improvements in the vicinity of the proposed use or in the district in which the subject property is situated. The applicant has included site plans; elevations of the antennae; and computer generated photographs showing the proposed antennae in relation to the existing building and surrounding development. The existing building is 30' high. The top of the antennae will be 43' high. The subject site is zoned TUC. The facility shall comply with all federal standards related to radio frequency emissions. (2) The proposed use shall meet or exceed the performance standards that are required in the district it will occupy. The Development Standards for uses in the TUC zone are: Maximum height: Setbacks: 115' Front: 15' Side and rear: 10' The top of the proposed antennae is 43'. As proposed the project also meets all setback requirements. The equipment is approximately 5' high and is proposed to be mounted on ground on the east side of the building. It is proposed to be screened by a 6' high cedar fence that will be painted to match the existing building. No other development standards in this zone apply to this application. (3) The proposed development shall be compatible generally with the surrounding land uses in terms of traffic and pedestrian circulation, building and site design. Staff Report to the Planning Commission L01 -001 Voicestream Page 5 of 6 As with similar uses, the proposed facility will generate trips during the construction period and, following the completion of construction, up to 1 trip per month for maintenance. No other impacts to pedestrian or transportation movements are anticipated. No new building or structure is proposed. Instead the project is to install antennae on rooftop of an existing building. (4) The proposed use shall be in keeping with the goals and policies of the Comprehensive Land Use Policy Plan This project must comply with the following Comprehensive Plan policies and meet necessary Zoning Code regulations. 12.1.36. Encourage utilities to consolidate facilities and minimize visual impacts of facilities where technically feasible. Implementation strategies for this policy include the use of shared infrastructure and use of existing structures. The applicant is proposing antennae that will be located on an existing building. 5) All measures have been taken to minimize the possible adverse impacts, which the proposed use may have on the area in which it is located. The applicant has applied for a location on an existing building in lieu of proposing an additional support structure for their antennae. In order to minimize visibility of antennae, one of the options was to provide a screen wall around the antennae. However according to the applicant, if a screen wall was built, the height of the antennae had to be increased. Based on photosimulations, the option to build a high screen wall around the antennae that are proposed at an angel on the roof accentuated the mass on the roof. In order to minimize the aesthetic impact, it was determined not to build any screen wall around the antennae. Instead, based on staff's recommendation, the project design was revised to increase the setback from 20 feet to 50 feet from the edge of the roof along Andover Park East, in order to minimize visibility. It was also determined that the height of antennae must be as low as possible to meet coverage objectives. RECOMMENDATIONS Staff recommends approval of the Conditional Use Permit with the following conditions: 1. Enclosed is the application for a conditional use permit for a roof top wireless communication facility. The project will consist of three sectors with three panels per sector; each panel has a height of 72" and a width of 8 ". As you know our original proposal was to locate a 60' monopole at the rear of the building and with your direction we came up with current design of installing antennas on the roof. We were able to improve upon the aesthetics of the installation by moving the antennas back from the edge of the roof from 20' to 50' and also lowering the total height from 16' to 13' above the roof line which will conceal the mounting brackets and hardware from view on the street that fronts the building. The photo simulations that are enclosed are from the original design that show the antennas set back from the roof line 20' and at a height of 16' and with the decreased height and set back of an additional 30' this should make for a very nice installation that will fit in to the surrounding area and not be visually obtrusive. From our previous conversions we feel that the best design is to not use screening and to go with the reduced height and set the antennas back from the roof line because screening will require more height and the antennas will have to be set closer to the roof line. Looking at the photo simulation with the screening it shows that screening would be the most visually obtrusive and would not fit with the architectural design of the building or the area. VoiceStream would respectfully ask that that the city of Tukwila would accept this application as complete and that the planning department would forward a recommendation of approval to the planning commission on this wireless communication facility.
