REVIEW GUIDELINES Please discuss project consistency with the following review criteria on a separate sheets. A decision to approve, deny or conditionally approve the project will be partially based on your responses. CRITERIA FOR PROJECTS SUBJECT TO THE CITY OF TUKWILA SHORELINE REGULATIONS General Shoreline Regulations (TMC 18.44.110) All uses within the shoreline overlay district must conform to the following general regulations: 1. The use is in conformance with the regulations of the underlying zone district; 2. The use does not conflict with the goals and policies of the Shoreline Master Program or the provisions of the Shoreline Act and shoreline regulations; 3. No structures or accessory facilities shall be located over the river, unless such structure protects or promotes the public interest; 4. There shall be no disruption of existing trees or vegetation within the river environment, unless necessary for public safety or flood control, or if allowed as a part of an approved Shoreline Substantial Development permit; 5. No effluents shall be discharged into the Green River which exceeds the water quality classification as established by the State for the adjacent portion of the river; 6. All State and Federal water quality regulations shall be strictly complied with; 7. Wildlife habitat in and along the river should be protected; 8. All perimeters of landfills or other land forms susceptible to erosion shall be provided with vegetation, retaining walls or other satisfactory mechanisms for erosion prevention; 9. All necessary permits shall be obtained from Federal, State, County or Municipal agencies; 10. Dredging for purposes other than for navigational improvements or flood control is prohibited; 11. Mining is prohibited along the river shoreline; 12. Solid waste disposal is prohibited along the river shoreline; 13. No property will be acquired for public use without dedication by or just compensation to the owner; 14. Landfilling is prohibited within the river channel unless such landfill is determined by the Planning Commission to protect or promote the public interest. 15. Notwithstanding any provisions of this Code to the contrary, removal of any cottonwood tree within the river environment or the low impact environment, which tree is 12 inches or greater in diameter as measured 4.5 feet above grade, shall be subject to the requirements of TMC Chapter 18.54, Tree Regulations. Applicable City of Tukwila Shoreline Policies: Please reference the goals and policies from the Tukwila Shoreline Management Plan, that are applicable to your project. The use of this proposal is in conformance with the regulations for the Tukwila Urban Center the comprehensive plan designation is intended for high- intensity regional uses that include commercial services. Electric Lightwave intends to install a telecommunications line, which is intended for commercial services. 2. The use of this proposal does not conflict with the goals and policies of the Shoreline Master Program the proposed route is designated mostly within the road rights of way that is within 200 feet of the ordinary high water mark. 3. This proposal does not intend to cross over the river during this route. All of the proposed work is to be done in the improved road right of way. 4. There will be no disruption of existing trees or vegetation for this proposal. 5. No effluents shall be discharged into the Green River, though the proposed work is adjacent to the shoreline the work will not be done close enough to the river for anything to be discharged into it. 6. No State or Federal water quality regulations are necessary for this proposal we do not intend to disrupt the water body in any way. All of the proposed work is within the improved road right of way. 7. No wildlife habitat was found near the proposed job site. 8. No erosion prevention methods will be necessary for the proposed project. Though the project is within 200'of the shoreline and ordinary high water mark the proposal does not interfere with the existing water body. 9. All necessary permits will be obtained from all agencies required for the proposed project. Aside from the Shoreline permit and SEPA review Electric Lightwave Inc. has also applied for a City of Tukwila right of way permit and a City of Kent right of way permit for the rest of the route. 10. No flood control is necessary for Electric Lightwave's project proposal. 11. There appears to be no Coal Mine development near or adjacent to the proposed job site. 12. No solid waste will be distributed along the river shoreline as a result of our proposal. 13. This is not applicable to our proposal considering; Electric Lightwave does not plan to buy any land the proposed work is all within the City's right of way. 14. No landfill will be distributed as a result of our proposal. 15. The portion of the route that is proposed in the city of Tukwila is described below. The remainder of the project is in areas of Unincorporated King County, in the city of Kent, and in the city of Renton. Beginning at the Tukwila City Limits on the east side of the Interurban Trail approximately 800 feet north of Strander Boulevard, Electric Lightwave proposes to install an aerial cable on the existing PSE utility poles. The route would continue aerially to the pole at the north side of the right of way at Strander Boulevard where the route would change from aerial to underground. The proposal is for a vault to be placed at the base of the pole and for the placement of one 4" diameter PVC conduit. The conduit would be installed by directional bore and would go to the south for 320 feet to a PSE pole. At this point the route would be aerial` again on the west side of the trail for about 5000 feet to a pole about 600 feet north of S. 43 Street. At this pole the route would again transition to underground. One 4" diameter PVC conduit would be buried along the trail north for 110' to a utility access road and then go east in the utility road to an existing MCI vault in the Union Pacific Railroad right of way. Electric Lightwave has coordinated the purchase of the conduit from MCI fro this vault to the city limit south of SW 43" Street. See sheets 24 through 26 of the attached Electric Lightwave plans for route details. The proposed project reenters city of Tukwila right of way again at the intersection of SW 43 Street and south 72 " Avenue. The proposal is for the route to be one 4" diameter PVC conduit installed by directional bore from the city of Kent right of way to the city of Tukwila right of way. The route would cross SW 43 Street and turn west. From this location, the conduit would be trenched in back of the concrete sidewalk to an existing 360 Degree Networks' vault just north of SW 43' Street /S. 180` Street on West Valley Highway. See sheets 1 through 14 of the attached (Qwest Northeast Connection) plans for route details. From the 360 Degree Networks' vault the proposal is to pull a fiber cable through existing conduit to a 360 Degree Networks' vault on South 180 Street 550 feet east of Southcenter Parkway. From a vault just west of Andover Park East, the proposal is to directional bore one 4" diameter PVC conduit along the north side of South 180 Street to the northeast corner of Andover Park West. One 4" diameter PVC conduit would then cross to the south side of South 180` Street and exist the right of way. See sheets 14 through 21 for the attached (Qwest Northeast Connection) plans for this route detail. From the existing 360 Degree Networks' vault just north of SW 43" Street/S. 180 Street on West Valley Highway, two 4 "diameter PVC conduits would cross to the south side of South 180` Street. The two 4" conduits would be directionally bored under the concrete sidewalk to Southcenter Parkway. The route then turns to the south and continues underground to a PSE pole 300 feet south of South 180` Street. At this location, the route is proposed to be aerial on existing PSE poles to the south where the project exists in the city of Tukwila right of way. LO1 -09 - Shoreline Substantial Development Permit Shauna Wals, Project Manager for Eclipse Engineering Installment of a fiber optic cable to serve the Qwest Cybercenter at 6101 South 180` St. The project is subject to a Shoreline Substantial Development permit, as work will be performed within 200 feet of the Green River. Development Permits Tukwila Valley South (TVS), Tukwila Urban Center (TUC) and Commercial/ Light Industrial (C/LI) Minnie DhaliwalBen Dowling The proposal is to install a fiber optic cable that follows an irregular route through the city of Tukwila. The route enters the city from the south on Southcenter Pkwy, turns east onto South 180' Street then turns north following the Interurban trail. Then 550 feet north of the intersection of the Interurban trail and Strander Blvd. the cable will head east until the city limits (see attached route map). This shoreline substantial development permit is for the work to be performed within 200 feet of the Ordinary High Water Mark of the Green River. There are three such areas along the route. Two are on S 180'`' St. between the Green River Bridge and Andover Park West. In those areas the cable will mostly be carried in preexisting conduit except for a small portion which will require directional boring. Junc 8, 2001 section within 200' of the river, on the Interurban trail just south of where Strander Blvd. meets the trail, will be aerial. A fifteen –foot portion of the applicant's proposed route involves trenching in a regulated wetland. In accordance with TMC 18.45.080(B), the Director administratively approved the trenching. A Determination of Non - Significance was also issued on May 9, 2001. II. General Shoreline Regulations — TMC 18.44.110 Listed below are the relevant review criteria as contained in The City of Tukwila's Zoning Code (TMC 18.44.110) and the City of Tukwila's Shoreline Master Plan (6.1). Applicant responses to said criterion follow and when needed staff comment is provided. (1) The use is in conformance with the regulations of the underlying zone district; Applicant Response: The use of this proposal is in conformance with the regulations for the Tukwila Urban Center the comprehensive plan designation is intended for high - intensity regional uses that include commercial services. Electric Lightwave intends to install a telecommunications line, which is intended for commercial services. Staff Response: The proposed project lies in the TUC, C /LI and TVS zones. No specific development regulations govern the installation of fiber optic cable in these zones. Neither will the proposed project conflict with these underlying zone's regulations. (2) The use does not conflict with the goals and policies of the Shoreline Master Program or the provisions of the Shoreline Act and shoreline regulations; Applicant Response: The use of this proposal does not conflict with the goals and policies of the Shoreline Master Program the proposed route is designated mostly within the road rights of way that is within 200 feet of the ordinary high water mark Staff Response: The proposed project is consistent with the goals and policies of the SMP. It will not adversely affect land use, economic development, public access circulation or recreation along the shoreline. The Shoreline Master Plan goals are listed below and are followed by staff comment. 2 L2001 -009 - Shoreline Permit Electric Lightwave inc. June 8, 2001 a. Economic Development Element—The anticipated economic impacts are positive in nature. b. Public Access Element—The proposal will not limit public access to the shoreline. c. Circulation Element—During installation of the fiber optic cable there will be some disruption to traffic. The disruption will be temporary in nature and all required mitigating procedures will be used. d. Recreational Element—When work is done on the Interurban trail flaggers will be employed to insure trail access. No other recreational impacts are anticipated. e. Shoreline Use Element—The proposal is considered an appropriate shoreline use. f. Conservation Element—The proposal will not adversely affect scenic vistas, parkways, estuarine areas for fish or wildlife, beaches or any other conservation areas. g. Historical /Cultural Element—The proposal will not adversely affect any buildings or areas having historic, cultural, educational or scientific value. (3) No structures or accessory facilities shall be located over the river, unless such structure protects or promotes the public interest; Applicant Response: This proposal does not intend to cross over the river during this route. All of the proposed work is to be done in the improved right of way. Staff Response: When the route traverses the river the cable will be suspended from the bridge in preexisting conduit. No structures or accessory facilities are proposed for this project. (4) There shall be no disruption of existing trees or vegetation within the river environment, unless necessary for public safety or flood control, or if allowed as a part of an approved Shoreline Substantial Development permit; Applicant Response: There will be no disruption of existing trees or vegetation for this proposal. Staff Response: No disruption of trees or vegetation in the river environment is anticipated. However, as a result of trenching, some landscaping in the high impact environment will be disturbed. This disturbance will occur near the Intersection of S 180 St. and West Valley Highway. 3 L2001 -009 - Shoreline Permit Electric Lightwave inc. June 8, 2001 According to TMC 18.44.150 (high impact environment), "All uses allowed in the underlying zoning district shall be allowed in the high impact environment." Staff Response: The proposal calls for 15' of trenching in a regulated wetland. Restorative techniques will be employed to minimize any negative impacts. (8) All perimeters of landfills or other land forms susceptible to erosion shall be provided with vegetation, retaining walls or other satisfactory mechanisms for erosion prevention; Applicant Response: No erosion prevention methods will be necessary for the proposed project. Though the project is within 200' of the shoreline and ordinary high water mark the proposal does not interfere with the existing water body. Staff Response: No major erosion is anticipated. June 8, 2001 (9) All necessary permits shall be obtained from Federal, State, County or Municipal agencies; Applicant Response: All necessary permits will be obtained from all agencies required for the proposed project. Aside from the shoreline permit and SEPA review Electric Lightwave Inc. has also applied for a City of Tukwila right of way permit and a City of Kent right of way permit for the rest of the route. Staff Response: A Determination of Non Significance was issued by the City of Tukwila on May 9, 2001. (10) Dredging for purposes other than for navigational improvements or flood control is prohibited; Applicant Response: No flood control is necessary for Electric Lightwave's project proposal. Staff Response: No dredging will occur. (11) Mining is prohibited along the river shoreline; Applicant Response: There appears to be no Coal Mine development near or adjacent to the proposed job site. Staff Response: No mining will occur. June 8, 2001 (14) Landfilling is prohibited within the river channel unless such landfill is determined by the Planning Commission to protect or promote the public interest. Applicant Response: No landfill will be distributed as a result of our proposal. Staff Response: No landfilling will occur. (15) Notwithstanding any provisions of this Code to the contrary, removal of any cottonwood tree within the river environment or the low impact environment, which tree is 12 inches or greater in diameter as measured 4.5 feet above grade, shall be subject to the requirements of TMC Chapter 18.54, Tree Regulations. Applicant Response: No trees shall be removed because of our proposal. Staff Response: No trees will be removed. III. Specific Shoreline Regulations —TMC 18.44.130, 140 and 150 The following headings discuss the specific shoreline regulations to be used by the Director in making a determination (TMC 18.44). (1) 18.44.130 (river environment) No trenching or boring will occur in the river environment. (2) 18.44.140 (low impact environment) No trenching or boring will occur in the low impact environment. (3) 18.44.150 (high impact environment) According to TMC 18.44.150, "All uses allowed in the underlying zoning district shall be allowed in the high impact environment." Most sections of the route subject to the Shoreline Substantial Development Permit are in the high impact environment. Trenching is called for in the West Valley Highway Right of Way (ROW) just north of S 180` St. and boring is called for in the South 180` St. ROW just east of Andover Park West. GENERAL 1. All materials and work in public rights of way shall be in conformance with the 2000 Standard Specifications for Road, Bridge and Municipal Public Works Construction except for cost, Standard Specifications for Municipal Construction as published by the Washington State Chapter of APWA, King County Road Standards, ELI Construction Procedures, the ELI Fiber Optics Manual, and Design and Construction Standards and Specifications for any of the local jurisdictions. If there is a conflict in standards, the most stringent shall apply. 2. The locations of utilities shown on the plans are approximate. All utility locations shall be verified prior to construction. The contractor, at his own expense, shall make excavations and borings ahead of the work, as necessary, to determine the exact locations of utilities and underground structures. It is understood that there will be interfering utilities and other underground pipes, drains or structures encountered that are not shown or areas shown incorrectly on the plans or that have not been previously discovered in the field. The contractor agrees this is a normal and usual occurrence in the construction of underground improvements. Furthermore, bidders understand and agree that work in some cases must be done in close proximity to said utilities and underground pipes, drains and structures not shown on the plans which may require a change in operations and may cause sloughing of the trench, additional traffic control, additional pavement and backfill costs and time. The contractor agrees that a reasonable number of these occurrences is usual and ordinary, and are reflected in the bid and plan of operation. The bidders agree to provide for these conflicts and agrees to provide for a reasonable amount of time for design changes and /or utility relocations due to said conflicts. Call the Utilities Underground Location Center at 1 -800- 424 -5555. 3. Inspection -- The Contractor shall notify local jurisdictions for required inspection services. 4. Excess Water -- Shall water be encountered during construction, it shall be the Contractor's responsibility to dewater before construction continues. 5. No silt laden water is to be discharged from the site without passing through an erosion control system. 6. The Contractor shall schedule and control his work so as to comply with all applicable ordinances to prevent any hazards to public safety, health and welfare. 7. All streets shall be kept free of dirt and debris on a continuous basis. 8. An approved copy of these plans will be on the job site whenever construction• is in progress. 9. The Contractor shall be solely and completely responsible for the conditions of the job site, including safety of all persons and property during the performance of the work. This requirement will apply continuously and not be limited to normal working hours. 10. Pedestrian and vehicular access to adjacent properties shall be maintained at all times except where prior written approval from the property owner has been obtained. 11. Barricade open depressions and holes occurring as part of this work, and post warning lights on adjacent properties with public access. Operate warning lights during hours from dusk to dawn each day and as otherwise required. 12. Protect structures, utilities, pavements, and other facilities from damage caused by settlement, lateral movement, undermining, washout and other hazards created by operations under this section. II. TRAFFIC CONTROL 1. The Contractor is advised that all lane closures shall be kept to a minimum. Local jurisdictions will approve only those lane and roadway closures determined to be necessary for the Contractor to accomplish a specific task. No lane or roadway closures will be permitted without prior approvals. 2. The Contractor shall keep all traffic lanes and shoulders clear of equipment and materials during non - working hours. Equipment and materials shall not be stored on the streets. The Contractor's employees and agents shall not park private vehicles along the roadway or median. III. SITE PREPARATION 1. Sod and Lawn to be removed shall be cut to a neat vertical line 6" minimum beyond the trench line. Sod shall be either removed from the site, or carefully stockpiled for reuse. 2. Saw cut pavement to a neat vertical line 8" to 12" minimum beyond the trench line. Replace pavement with like material (i.e., asphalt with asphalt, concrete with concrete). 3. Except as noted herein, all material removed shall be taken from the site and disposed of by the contractor. IV. TRENCH EXCAVATION AND BACKFILL 1. All trench excavation shall be in accordance with Section 7- 10.3(07) of the Standard Specifications. 2. Trench backfill - Where material excavated from trenches is unsuitable for backfill, the Contractor shall backfill with bank run gravel or may elect to use CDF in lieu of the compaction /proctor process. Stoneway mix 351 is acceptable in all locations. Quick setting mix 1004 is acceptable in non - traffic areas. Mix 1121 is to be used in traffic- bearing locations. 3. Compaction, when necessary, shall be performed in accordance with local requirements. V. UTILITY DUCT 1. Buried duct shall be a minimum of Schedule 80 PVC. 2. Thoroughly clean conduit before using or laying. During construction and after the duct line is completed, plug ends of conduits to prevent water washing into conduit or manholes, take particular care to keep conduits clear of concrete, dirt and any other substance during the course of construction. 3. After duct placement has been completed, proof and clean debris from each duct, its entire length. Install pull rope and place watertight compression plugs at both ends. 4. Outside innerduct shall be 1" optic -guard non - metallic flexible, in color such as red or orange, with pull ropes & plugs. VI. CEMENT CONCRETE PAVEMENT 1. All concrete pavement removed or damaged by this work shall be replaced according to the requirements of Section 5 -05 of the Standard Specifications. VII. ASPHALT CONCRETE PAVEMENT 1. All asphalt concrete pavement removed or damaged by this work shall be replaced with Class B asphalt concrete according to the requirements of Section 5 -04 of the Standard Specifications. VIII. GRAVEL AREAS 1. All gravel areas damaged or removed by this work shall be replaced with crushed surfacing top course in accordance with the requirements of Section 9- 03.9(3) of the Standard Specifications. IX. SITE RESTORATION 1. All disturbed or damaged areas shall be restored to a condition equal to, or better than, that which existed prior to placement of the conduit and structures. 2. Vegetation removed for this work shall be replaced with in -kind plant material and shall be properly planted and watered in to ensure its survival. 3. Site restoration shall include replacing existing cabling and pull ropes in existing conduit as they existed prior to construction. X. WATER QUALITY 1. Construction activities occurring adjacent to storm drainage structures shall comply with the State of Washington's Water Quality Standards 2. The contractor shall limit the use of petroleum products on the site. XI. BORING 1. When boring roadways, install a 4" casing with 4 -1" innerducts with pull ropes and plugs. 2. Protect Existing Utilities -- coordinate with local jurisdictions to pothole as required to locate existing utilities.
