The Department of Community Development received your Conditional Use application on
February 9, 2001, for Qwest to install antennas on an existing building and place ground equipment
inside the building located at above referenced address.
Based on a review of your application for submittal requirements for Conditional Use Permit,
your application is deemed complete as of March 6, 2001. Per Tukwila Municipal Code, a notice
of land use application must be distributed within 14 days of this date. Also, a notice of public
hearing must be mailed, posted and published at least 14 days prior to the hearing.
If we schedule this project for the March 22, 2001 hearing, all notice requirements must be met
by March 8, 2001. The next step is for you to install the notice board on the site by February 8,
2001. You received information on how to install the sign with your application packet. Also, you
must obtain a laminated copy of the Notice of Application to post on the board. This notice is also
available at DCD. After installing the sign with the laminated notice, you need to return the signed
Affidavit of Posting to our office.
This determination of complete application does not preclude the ability of the City to require that
you submit additional plans or information, if such information is necessary to ensure the project

Vicinity /Site Information
Project Description
Qwest is requesting Conditional Use Permit approval to install a wireless
telecommunication facility on the roof of the existing building, which is located at 5200
Southcenter Boulevard. The project consists of antennae that are camouflaged within the
accelerator housing that is approximately 18 to 22 inches in diameter and approximately
six feet in height. Associated operating equipment is proposed to be within the existing
building.
Existing Development
The existing building is an office building. The top of the roof of the existing building is
33 feet above average grade level. The accelerator housing the antennae is setback 30 feet
from the east edge of the roof and 42 feet from the south edge of the roof. The subject site
is zoned Regional Commercial mixed use (RCM).
Surrounding Land Uses
All adjoining properties are zoned Regional Commercial Mixed Use (RCM). All
adjoining buildings are approximately 30 feet high buildings.
BACKGROUND
FINDINGS
The applicant is requesting to co- locate antennae on an existing building. All antennae are
consolidated in one tube approximately 18 to 22 inches in diameter and six feet in height.
The existing building is built on a slope and per Uniform Building Code, the building
height is measured from average grade. The top of the antennae will be at 41'6" above
average grade. Maximum permitted height in RCM zone is 35 feet. Staff is treating roof
top cellular facilities that typically resemble other HVAC units as roof top appurtenances.
Pursuant to TMC 18.50.080, roof top appurtenances are exempt from height limitations
of the underlying zone as long as they are setback 10 feet from the edge of the roof and
are no higher than 20 feet above the roof.

(2) The proposed use shall meet or exceed the performance standards that are required
in the district it will occupy.
The Development Standards for uses in the RCM zone are:

The top of the proposed antennae is 41' -6 ". The proposal meets all requirements to be
considered a roof top appurtenance and thus meets height regulations. As proposed the
project also meets all setback requirements.
The equipment is proposed to be located inside the existing building.
No other development standards in this zone apply to this application.

(3) The proposed development shall be compatible generally with the surrounding land
uses in terms of traffic and pedestrian circulation, building and site design.
As with similar uses, the proposed facility will generate trips during the construction
period and, following the completion of construction, up to 1 trip per month for
maintenance. No other impacts to pedestrian or transportation movements are
anticipated. No new building or structure is proposed. Instead the project is to install
antennae on rooftop of an existing building.
(4) The proposed use shall be in keeping with the goals and policies of the
Comprehensive Land Use Policy Plan
This project must comply with the following Comprehensive Plan policies and meet
necessary Zoning Code regulations.
12.1.36. Encourage utilities to consolidate facilities and minimize visual
impacts of facilities where technically feasible.
Implementation strategies for this policy include the use of shared infrastructure and use
of existing structures. The applicant is proposing antennae that will be located on an
existing building.
5) All measures have been taken to minimize the possible adverse impacts, which the
proposed use may have on the area in which it is located.
The applicant has applied for a location on an existing building in lieu of proposing an
additional support structure for their antennae. In order to minimize visibility of antennae,
all antennae are proposed in one location inside a tube that is approximately 18 to 22
inches in diameter and approximately six feet in height. The associated equipment is
proposed to be placed inside the building. The facility will meet all federal standards
related to radio frequency emissions.
CONCLUSIONS
1. The proposal to install additional antennae on an existing building will not be materially
detrimental to the public welfare or injurious to the property or improvements in the
vicinity.
2. The proposed project meets the performance standards that are required in RCM zone.

Response: The base station equipment for the proposed facility will be located
within the parking level of the building, out of view from surrounding properties
and public rights -of -way. The antennas will be camouflaged within the accelerator
housing that is approximately 18 to 22 inches in diameter and approximately six
feet in height. The accelerator housing will be mounted on a non - penetrating tripod
attached to the roof of the building. The accelerator housing can be painted as
directed by the City of Tukwila. The height of the accelerator above average grade
will be approximately 41'6 ".

land uses.
Response: The surrounding land uses consist mainly of commercial and office
uses. The proposed installation of this facility would not be inconsistent with these

and constructed directly to the south and to the northwest of the proposed project.

Response: The city's Comprehensive Plan provides limited policy guidance on
proposals such as this; however, there are two policies that do generally relate to
the proposed action.
12.1.34 Actively coordinate project implementation with individual utilities
based upon Tukwila's Comprehensive Plan and development regulations.
12.1.36 Encourage utilities to consolidate facilities and minimize visual
impacts of facilities where technically feasible.
This proposal by Qwest Wireless meets the above noted Comprehensive Plan
policies in that the project will be utilizing an existing building to provide the
necessary elevation for the antennas. Moreover, the antennas will be camouflaged
by the accelerator housing and will not be externally visible. The base station
equipment will be housed in the existing building in the parking garage floor and
like the antennas will be not be visible from surrounding properties and rights -of-
way.

measures are: 1) the use of an accelerator -type antenna enclosure (as opposed to
skid - mounted antennas) that will be camouflage the antennas from surrounding
properties and streets; and 2) the base station equipment will be located within the
existing building in the parking garage area and will be virtually invisible from
surrounding properties and streets. These measures will reduce the impacts of this
project to nearly zero on the immediate area and the city overall while providing
citizens and visitors to the area improved wireless communications coverage.

Why this interpretation developed?
CODE INTERPRETATION
Code Interpreted: Zoning, Title 18
Rooftop cellular facilities that typically consist of antennae and associated operating
equipment shall be considered similar to other roof top appurtenances for the purposes of
meeting Tukwila Municipal Code (TMC) height regulations.
Rooftop appurtenances qualify for exemptions from height limitations of the undelying
zoning district, subject to meeting requirements listed under TMC 18.50.080, which
include minimum setback of 10 feet from the edge of the roof and a maximum height of
20 feet above the roof. However, for rooftop cellular facilities, it is not clear whether to
apply the height restrictions of the underlying zoning district or to consider them similar
to other roof top appurtenances.
What is the justification for the interpretation?
1. Absent any definition of an `appurtenance' in TMC, the dictionary definition is used.
Dictionary defines an `appurtenance' as "a subordinate part or adjunct, something
joined or added to another thing but not essentially part of it." Rooftop cellular
facility can be considered a rooftop appurtenance according to this definition.
2. Pursuant to TMC 18.50.080, "The height limitations specified in this chapter shall not
apply to church spires, monuments, chimneys, water towers, elevator towers,
mechanical equipment, and other similar roof top appurtenances usually required to
be placed above the roof level and not intended for human occupancy or the
provision of additional floor area; provided that mechanical equipment rooms or
attic spaces area is set back at least 10 feet from the edge of the roof and do not
exceed 20 feet in height." Rooftop cellular facilities are similar in bulk and scale to
other common roof top appurtenances such as HVAC units.

3. If it is a freestanding cellular facility such as a monopole, it shall meet the maximum
height requirements of the underlying zoning district.
4. The City's policy is to encourage co- location of cellular facilities on existing
structures. Considering them similar to other rooftop appurtenances for the purposes
of determining height requirements will encourage such co- location instead of
building new towers.

LOCAL AND STATE JURISDICTIONAL CODES BEARING N ON THE PERFORMANCE OF

5. GENERAL CONTRACTOR SHALL PROVIDE AT THE PROJECT SITE A FULL SET OF
CONSTRUCTION DOCUMENTS UPDATED WITH THE LATEST REVISIONS AND
ADDENDA OR CLARIFICATIONS FOR THE USE BY ALL PERSONNEL INVOLVED
WITH THE PROJECT.
6. THE STRUCTURAL COMPONENTS OF THIS PROJECT SITE /FACILITY ARE NOT TO
ALTERED BY THIS CONSTRUCTION PROJECT UNLESS NOTED OTHERWISE.
7, DETAILS INCLUDED HEREIN ARE INTENDED TO SHOW END RESULT OF DESIGN.
MINOR MODIFICATIONS MAY BE REQUIRED TO SUIT JOB CONDITIONS OR
MODIFICATIONS SHALL BE INCLUDED AS PART OF THE

8. THE CONTRACTOR SHALL MAKE NECESSARY PROVISIONS TO PROTECT EXISTING

UPON COMPLETION OF WORK, CONTRACTOR SHALL REPAIR ANY DAMAGE THAT
MAY HAVE OCCURRED DUE TO CONSTRUCTION ON OR ABOUT THE PROPERTY.
9 CONTRACTOR SHALL SEE TO IT THAT GENERAL WORK AREA IS KEPT CLEAN
AND HAZARD FREE DURING CONSTRUCTION AND DISPOSE OF ALL DIRT, DEBRIS,
RUBBISH AND REMOVE EQUIPMENT NOT SPECIFIED AS REMAINING ON THE
PROPERTY. PREMISES SHALL BE LEFT IN CLEAN CONDITION AND FREE FROM
PAINT SPOTS, DUST, OR SMUDGES OF ANY NATURE.
10. THE ARCHITECTS /ENGINEERS HAVE MADE EVERY EFFORT TO SET FORTH IN
THE CONSTRUCTION AND CONTRACT DOCUMENTS THE COMPLETE SCOPE OF
WORK. CONTRACTORS BIDDING THE JOB ARE NEVERTHELESS CAUTIONED THAT
MINOR OMISSIONS OR ERRORS IN THE DRAWINGS AND OR SPECIFICATIONS
