LO1-017 AT&T WIRELES 18700 ORILLA ROAD August 5, 2002 City of Tukwila Department of Community Development Steve Lancaster, Director Chris Listfield, Alaris Group For AT & T Wireless 1530 Westlake Avenue North # 400 Seattle, WA 98109 Re: Re- application for Conditional Use Permit approval of a proposed cellular communications facility at the Bow Lake Transfer Station, 18700 Orilla Road. Previous and closed City File Numbers L01 -017 and E01 -017 Dear Chris: Steven M. Mullet, Mayor This letter is to recount our July 24 telephone discussion regarding your client's intention to pursue Conditional Use Permit approval for a new telecommunications monopole at the Bow Lake Transfer Station. In our conversation I clarified the reasons for the need to submit a new Conditional Use Permit application and SEPA checklist, outlined the information needed as part of this new submittal, and offered some guidance on a method for screening any new facility. These items are outlined below. 1) To pursue your client's proposal a new Conditional Use Permit application and SEPA Checklist application must be submitted. City Code states that an application shall be cancelled if the applicant fails to submit the additional information required within 90 days. Your application was submitted on March 5, 2001 and a request for additional information was made on April 2, 2001. Following that, the resolution of the illegal land clearing took over one year and numerous letters and phone calls between parties. Finally, on February 28, 2002, Jack Pace, the Deputy Director of DCD, notified you in writing that the application would be closed. Shortly thereafter, in a telephone conversation with your superior at the Alaris Group, he agreed to keep the files active, as a re- submittal was forthcoming. However, the next contact the City had with the Alaris Group is the July 10 request to continue with the subject permit applications. Unfortunately, the delays and lack of responses to the required additional information are too great to continue stretching the allowed window of response time. 2) As was discussed on July 24 and throughout the previous applications review process, co- location of new facilities on existing structures is the preferred method 6300 Southcenter Boulevard, Suite #100 • Tukwila, Washington 98188 • Phone: 206 -431 -3670 • Fax: 206 - 431 -3665 for installing new facilities in the City. If A T & T is unable to co- locate on an existing structure, such as the existing Qwest monopole, this inability must be clearly demonstrated. Your letter of July 10, 2002 states that King County Property Services and Qwest will not allow AT & T to "replace and / or extend the tower ". The submitted April 12, 2001 letter from Susan Stewart of King County also makes this assertion. However, the City has not received any correspondence or documentation from Qwest stating that it is not technically possible to extend or replace the existing pole with a taller pole. Only after thorough exploration of co- location issues (for example, such as the required height of a new or extended pole, its visual impacts, technical feasibility, the ability to accommodate co- location of other providers in the future, etc.) will the City be receptive to considering the installation of a second monopole, provided its location and design meet the Conditional Use Permit criteria. 3) Your letter of July 10, 2002 discusses the exploration of a utility pole at the entrance to the transfer station as an alternative location. The letter states that this location produces an obstructed signal and, anyway, will not be supported by King County due to future re- development of the transfer station. However, there are two other utility poles between the Interstate and the transfer station access road that appear to be taller than the existing monopole (and the aforementioned utility pole) and are closer to the highway corridor where the cellular service is needed. These appear to be viable co- location options and must be explored before review of a second pole is considered. 4) Finally, If a second monopole is technically necessary we will need to explore the use of screening. The wooded area along the eastern side of the hillside (to the east of the transfer station access road) serves as a background that lessens some of the negative visual impacts from the Qwest monopole as viewed from across 1 -5 to the west. The location proposed in the previous submittal, and shown in the photosimulations done by KDC Architects, indicate that the proposed monopole will not have the same level of natural screening, that is, a background of fairly dense trees. Improvements in "stealthing" or screening have fortunately made the substantial lessening of monopole, and utility, visual impacts possible. In our conversation, I described for you a monopole I observed recently along Interstate 10 close to downtown Los Angeles. It was designed and constructed to simulate a Ponderosa Pine tree. Two tiers of three sectors with one antenna per sector were attached to the "trunk ". Not until I was almost past the "tree" did I realize that it was a cellular facility monopole. Considering the existing wooded area along this hillside, a stealth monopole designed as a simulated tree could be an appropriate screening solution for a second monopole. However, the exploration of screening of a second monopole is not an issue until it can be determined that co- location at the existing Qwest site (on an extended or replaced pole) is not possible. I hope the above information and our telephone conversation of July 24 are helpful in clarifying the steps that your client must take in re- applying for and seeking approval of a new cellular facility at this site. With an understanding of the City's requirements for the siting of cellular communication facilities on your part, the City looks forward to working with you in finding an acceptable solution to your client's needs. If you have 2 questions about the above issues, or my understanding of them, please feel free to call me at 206 431.3670. I hope you will excuse the extended amount of time spent in locating and analyzing alternatives. Please recall that on March 6 of this year, you discussed the subject application with my supervisor, Bruce Morrison. Based on that discussion, AT &T was informed that the Planning Commission is not likely to support a second pole. You also requested that AT &T radio frequency engineers attempt to locate and analyze alternative locations to the proposed Bow Lake Transfer Station location. The enclosed information is submitted in consideration of your request. The result of attempting to locate viable alternative candidates and conducting radio frequency studies was that the Bow Lake__Transfer_,.Station property is the only available option. Providing seamless coverage for this area is constrained by the topography an'd curyature of I -5. As you know the Interstate curves along the side of a uc t -bank sloping downward to the east. The wireless facility must be located to provide, as much as possible, an unobstructed signal while also maintaining the ability to "see" nearby AT &T Wireless sites. Therefore the location necessary is at the apex of the I -5 curve. As the RF modeling demonstrates, locating a site on the other side of the freeway results in coverage holes because the signal is blocked by topography and cannot travel continuously to the next site. The only available structure east of I -5 that could be a potential candidate was a utility pole at the entrance to the Transfer Station. Although the utility pole was ...tested at 80', the signal is still obstructed enough to leave a coverage hole in the 15 WESTLAKE AVENUE NOR]'I-!, SI ITE 400 SEATTLE, \VA 98109 JUL 12 2002 . ,....xr..ri::r::asa;afYLai.a+e d::usuivax.r.:k4. tisuk; srA:.,:'mttfcSr;rd;:+i i4. Cellular Division July 8, 2002 City of Tukwila Department of Community Development 6300 Southcenter BV Tukwila, WA 98188 -2544 Subject: AT &T Wireless Services, Site SS21A Bow Lake Transfer Station \Ot Recycled Paper AT&T AT &T Wireless Services P.O. Box 9159 617 Eastlake Avenuq' E. Seattle, WA 98109 206 624 -5700 Dear Reviewing Parties: I have been asked to review possible alternatives capable of meeting coverage objectives for the subject site. Currently AT &T customers experience dropped calls when traveling along I -5 in this area due to a "coverage hole" in the network. Therefore the primary function of the proposed facility is to fill the gap in coverage, primarily the bend in I -5 near the proposed facility. A second ary bene it of the proposed facility will be additional capacity for the large call volume that occurs in this area, particularly during stop- and -go tra `fic. Providing coverage to this area is challenging due to the topography of the area and lack of available structures capable of providing enough height for a wireless facility. A minimum heig of 60' its necessary in order for the site to meet coverage objectives and properly function within the network. Therefore the utility transmission pole south of the proposed site at the entrance of the Bow Lake Transfer station was plotted as Alternative Candidate 1. In order for this location to work, a total height of 80' is necessary due to significant signal loss to the north. The proposed facility must also "see" neighboring sites in order for the system to hand -off calls from one site to the next as a caller travels through a given area. The remaining 2 candidates were chosen on the other side of I -5 as there are no remaining available structures at the transfer station. Alternative Candidate 2 is a utility pole located north of South 188 and west of Military Road. This location is on a hill that would shadow our signal along I -5. It a smisses a portion of I -5 right at the bend, the primary coverage objective of this proposed site (see the coverage plot). Alternative Candidate 3 is almost due west of the proposed site at the transfer station. This location also leaves a coverage gap caused by the hill and cannot provide the seamless coverage necessary for this facility. Please understand that all networks require numerous sites to provide seamless coverage within a given community. Terrain, vegetation, elevation, as well as enough distance between existing sites owned by the same carrier to avoid frequency conflicts are technical factors which limit the siting of these facilities. The alternatives described .......... ; _7'_ ,.....e, , .. .wu1iL•: w.. No other suitable location containing a structure capable of providing enough height could be found. AT &T Wireless Services P.O. Box 9159 617 Eastlake Avenue E. Seattle, WA 98109 206 624 -5700 Please see the attached RF propagation maps that have been prepared showing the signal levels at the proposed location in contrast to the alternative sites discussed above. These maps demonstrate that without the requested facility, AT &T Wireless customers will continue to have gaps in service and dropped calls. This puts AT &T Wireless at an unfair disadvantage in the highly competitive and growing wireless market, especially with quite a few of our competitors being in our desired ideal location. Dear Mr. Listfield: This letter is to notify you that the above referenced applications have been currently closed as no re- submittal was received from you in response to the City's request for additional information dated April 2, 2001. The Conditional Use Permit (CUP) and SEPA applications were submitted on March 5, 2001. A notice of complete application and request for additional information was sent to you on April 2, 2001, which listed the additional information that was required to further process your application. The letter also stated that the information must be submitted within 90 days of that letter. Since there was no response received from you to address the issues raised in the April 2, 2001 letter within 90 days of that letter, the city has presently closed the Conditional Use Permit and SEPA files. If you wish to pursue this project, anew CUP and SEPA applications must be filed. If the project is revised to locate antennae on the existing monopole or any other structure on the subject site, a SEPA application may not be required. Please note that the illegal clearing matter is a code violation of the City's code and city will pursue a resolution of that issue regardless of the status of the CUP and SEPA applications. Sincerely, Chris Listfjeld The Alaris Group — a L. 1 ,- southbound lanes of I -5 near 178` Furthermore, King County will not allow AT &T to locate at this location due to future re- development of the transfer station. The existing Qwest tower was not modeled, because it is not a viable candidate. The Qwest tower was not structurally designed for, and is not capable of supporting a 4 carrier. In addition, because the existing 60' tower contains 3 carriers, the necessary height for AT &T is not available Both King County Property Services and Qwest will not allow AT &T to replace or extend the tower. Nor will King County Property Services rent ground space in this location due to the future redevelopment plans of the transfer station (please see the letter from Susan Stewart, King County Property Services dated April 12, 2001.) Finally, extending the Qwest tower is simply poor planning. The existing 60' Qwest tower is currently below a significant treeline behind the site to the east. This feature softens the appearance of the tower and camouflages it from being a dominant feature on the landscape. Extending the tower would bring it above the tree horizon and potentially impact views of Mount Rainier and the Cascades. The proposed facility is the only option available to AT &T Wireless Services. They have exhausted all possible alternatives, while continuing to have gaps in service and dropped calls. The initial contact at Alaris, Mr. Dave Warwick, is chiefly responsible for the deterioration of this situation. His work crews began clearing this area without permits back in April of 2001, and he was immediately notified to cease and desist by Public Works and King County. Minnie [Dhaliwal] told Mr. Warwick months ago what he needed to do in order to get right with the Lord, but he has moved at sub -snail speed in procuring the necessary permits to perform his scope of work. Further, Minnie has repeatedly requested Geotech reports, erosion control implementation, restoration plans, etc. from Alaris Group representatives, over the last 6 months. She has received minimal cooperation from Alaris until recently. Their permits are now ready to pick up, yet they have not done so. They now contend they need to sit down with King County Officials to get a permit or some kind of special permission in order to fulfill the obligations of restoring the slope. King County is on board with us. They have told Alaris that there will be no meeting, and that they will expedite their permission in 1 -5 days. King County also wants some specific vegetation planted in the restoration area above and beyond what we are requesting. The 10 -day deadline is a result of trying to get the sloped area re- vegetated during the optimal planting window. The planting window is now essentially closed, as approaching frost and cold weather patterns will severely inhibit the chances of survival of the new plantings. At this stage of the game, we want our issues addressed. Period. No talk, no exceptions, no extensions. It is officially time to show me the money. hope this clarifies matters for you. If you have any additional requirements for information, please let me know. You have asked me to assess the slope stability and erosion potential resulting from land clearing activities that took place earlier this year. I also understand that additional work is proposed at this time including the removal of approximately 4 debris piles and planting (5) 2- inch caliper trees. For purposes of reference, the site can be generally split into 3 areas: (1) an existing unimproved access road that serves the existing wireless facility at the south end of the property; (2) a gently sloping upland area running parallel to I -5, and; (3) a new unsurfaced access located at the northeast corner of the site connecting the upland area to the paved transfer station internal roadway. The upland area has good ground cover consisting of a reasonable growth of low grass. The slope between the upland arca and internal road is vegetated and undisturbed, except for the extreme northern portion where an access road traverses the slope in an east -west direction. There are 2 hay -bale check dams installed across the roadway alignment in this area, with a light treatment of straw placed on the disturbed ground surface. No aggressive erosion was evident at the time or our site visit, nor was there indication of sloughing or landslide hazards. We suggest that remediation involving heavy equipment be accomplished as soon as possible to avoid protracted periods of wet weather. If severe rutting occurs, any disturbed areas should be smoothed by back - blading as much as possible to avoid areas of ponded water. Upland areas disturbed by the removal operations should be mulched and covered with at least 2- inches of straw. I have spoken with the other people involved in working on this site regarding the site condition prior to clearing and have learned the following: The topography at the site has not been changed. The only work that was done was removal of existing vegetation at the site. This vegetation consisted of grass, weeds, blackberry bramble and 3 small alder trees (less than 8 inch diameter trunks). The site is presently overgrown by weeds and the blackberries are returning rapidly. What I am going to propose as a final plan is: 1. Remove the debris piles (after obtaining the Hauling Permit) 2. Plant 5 (Five) alder trees at the top of the slope (2.5 -inch caliper deciduous). - Per Tukwila Code section 18.54.130 only 3 would be required (1:1 for number removed) - The trees that were removed from the top of the slope (none existed on the slope) - Planting and maintenance shall be in accordance with best management practices for landscaping which ensure the vegetation's long -term health and survival. 4. So far you have only applied for land altering permit for hydro- seeding the disturbed areas. You were informed in writing originally on April 2 and then again on May 30 that you need to submit a geo- technical report and landscaping plan for the restoration and re- vegetation work. As the window of opportunity for the Fall planting season is closing, the land altering permit for the second phase must be submitted within one week from today. Also, the hydro- seeding work also must be completed as soon as possible. I have been informed by City's Code Enforcement Officer that if we do not receive the second land altering permit within one week and hydro- seeding work is not started within the same time period, he will contact the City Attorney's office to seek an injunction against the Alaris Group as well as AT & T for failure to obtain the necessary permits to resolve the code violation. In doing so, the City of Tukwila and King County will access the property, and jointly replant the hillside. All City expenses incurred with legal, payroll, permitting, vegetation acquisition, and equipment leases will be assessed to the Alaris Group as well as A T & T in the form of a lien or lawsuit. The lien /lawsuit will be filed upon completion of the work. If you have any questions, please call me at 206 - 431 -3685. I received your voicemail today regarding your concerns about the Bow Lake Transfer Station. My understanding is they have obtained one permit, but have not started replanting the area. Since the window of opportunity for the Fall planting season is closing, I am not prepared to waste any additional diplomatic efforts to try and coax them to resolve a code violation. I am however, willing to give them 1 week in September to begin replanting the hillside. If they do not take advantage of this time, I will be forced to go to Plan B. Plan B In anticipation of a lack of cooperation, I have contacted the City Attorney's office to seek an injunction against the Alaris Group as well as AT & T for failure to obtain the necessary permits to resolve the code violation. In doing so, the City of Tukwila and King County will access the property, and jointly replant the hillside according to King County requirements. All City expenses incurred with legal, payroll, permitting, vegetation acquisition, and equipment leases will be assessed to the Alaris Group as well as A T & T in the form of a lien or lawsuit. The lien /lawsuit will be filed upon completion of the work. No cell phone towers will be built, no permits will be issued, and no further work at this site will be completed. Both entities can therefore start the entire process all over again, and go from there. It is regrettable that this has to be our next course of action, but I do not see any other way to accomplish our objective. You indicated that you were going to talk with the City Landscape Architect to find out what recommendations Tukwila has regarding the erosion control/ restoration plantings at the Bow Lake Transfer Station. I know that King County has discussed their recommendations for the re- vegetation of this site with the City of Tukwila. I would, however, like a more definitive determination of what is required from the City. Additionally, you were going to look into the viability of location of a taller pole at this site. You had previously indicated that AT &T would likely be unable to permit a second pole at this site but that we could locate a replacement pole with all the existing carriers up to the zone height limit of 115 feet. I was hoping that you could provide guidance as to the maximum height that you feel we would be able to permit at this location. I also wanted to make sure that you were aware that there is a strong potential for additional wireless carriers to locate facilities in this area. Some thought should be given to providing future co- location opportunity at this site. There is a limit to the number of carriers that can locate on a monopole. Thank you for your help. AT &T Wireless ( "AT &T ") requested to lease property owned by King County for a telecommunication facility at the Bow Lake Transfer Station at 18700 Orillia Road in Tukwila. The Bow Lake Transfer Station is home to an existing telecommunication (monopole) site which accommodates three telecommunication providers: Qwest, VoiceStream and Verizon. That site is fully collocated —as required by King County and consistent with King County policy. The existing monopole's height was limited to sixty feet in order to accommodate views of a neighboring community. This height limitation defined the maximum collocation potential for the monopole as being a total of three providers. In addition —and putting the issue of views aside—the county was recently advised that the monopole cannot be extended, as it does not have sufficient structure to support a necessary extension which would accommodate a fourth telecommunication provider, such as AT &T. Currently, the access road to the existing monopole site is a small road originating from the southern end of the Transfer Station. The county, however, is in the initial stage of planning to redevelop the Transfer Station. The county intends to move its gate house north of its present location and improve the lanes of traffic to the scale house. These changes will require elimination of the existing access road. The Bow Lake Transfer Station constitutes a popular and important site for telecommunication providers, largely due to its location along Interstate 5. The county determined that it was an appropriate use of its property (subject to permit approval by the City of Tukwila) to require AT &T to develop a second monopole site at the Station, capable of full collocation by at least two additional telecommunication providers. Thus, as a condition to leasing the site, the county asked AT &T to design the site whereby collocating companies could locate their antennas on a Roo]. •• . .05/01/.2001 TUE 14:28 FAX 206 322 ' 3 '1'HE ALARIS GROUP, LLC City of Tukwila April 12? 2001 Page 2 . monopole constructed by AT &T and could locate their electronic (radio) ground equipment within a compact area around the base of the proposed monopole. King County discussed possible collocation on this proposed site with both GTE (now Cingular) and Sprint. While neither company committed to Locating at the site, both expressed interest. It is the county's experience that, once a site is constructed, other telecommunication providers' interest in the site becomes more certain Thus, the county believes that the potential for quickly and fully collocating a second monopole site at the Bow Lake Transfer Station is very good. In regulating communication facilities, King County follows a policy which encourages the joint use of tower and monopole sites, thereby minimizing the total number of monopoles and towers throughout the community. See K.C.C. 21A.26.010.A and B. Consistently, the county follows this same policy when it acts in its proprietary capacity as a landlord. Thus, when the county authorizes a communication provider to locate a communication facility on property it owns, it insures that the provider designs the site to reasonably accommodate the site's maximum collocation potential. Generally, this includes designing a site to accommodate a total of three to four communication providers. The county now believes that a second telecommunication site on the property which is also fully collocatable will avoid the future need to have a proliferation of telecommunication sites (potentially three additional sites) along this important stretch of Interstate 5. Designing for maximum collocations serves another important policy —one inherent in the federal Telecommunications Act of 1996 —to enhance the ability of telecommunication providers to provide services to the community quickly, effectively and efficiently. See K.C.C. 21A.26.010.E. Collocating on a monopole built to support at least three antenna facilities at a site already planned for additional providers saves time, effectively utilizes resources and prevents economic waste. With regard to the telecommunication site proposed by AT &T, the county believes that the proposed site efficiently utilizes the county's property by delineating a small, compact area in which to locate a second monopole capable of supporting three antenna facilities and the ground equipment of three telecommunication providers. This area does not interfere with any redevelopment plans the county has for the Transfer Station, will not interfere with neighbors' views and will be screened by vegetation to the extent practical while not interfering with the facility's usefulness. In this particular case, the county believes that the Transfer Station's appearance, at least from. Interstate 5, may be enhanced as a result of the landscape work proposed by AT &T in relation to this proposed site. Finally, it is my understanding that, even though the King County Solid Waste Division is only in its earliest planning stage, it has already conferred with both land use planners and public works managers at the City of Tukwila concerning its proposed redevelopment of the Transfer I j 002 .. ... — .::;:J73.% '' 1.'3= `r+Sia`.•1t.w3.e%+luc4ai 05/01/ ?.001 TUE 14:29 FAX 206 322 ' City of Tukwila April 12, 2001 Page 3 Station. Thus, planning ahead for this redevelopment project, the county required AT &T to locate the small access road serving its proposed antenna facility from the north — rather than from the south, which is the area of the Station's future redevelopment. The county intends that this new access road shall also serve the first, existing telecommunication site on the property since the redeveopment (changes in traffic lanes) will eliminate the existing access route to that facility. From the county's perspective, an access road from the north constitutes the only viable access to the telecommunication sites, in light of the county's redevelopment plans. As I explained, our home is on the ridge along Military Road, and our view overlooking Kent valley will most likely be affected by this monopole. While the existing 60' monopole is somewhat obstructed in the spring and summer by foliage, I believe the proposed 70' monopole, because of its height and location further north and on higher ground, will be an eyesore. I understand AT &T has been asked to consider extending the current monopole rather than constructing a new one, and I hope that solution will be acceptable. This height limitation defined the maximum collocation potential for theepno ple as being.a,to at 1 of three providers. In acid Pion -and putting he issue of views aside - -the county was recently advised that the monopole cannot be extended, as it does not have sufficient structure to support a necessary extension which would • } accommodate a fourth telecommunication provider, such as AT &T. Thus, as a condition to leasing the site, the county asked AT &T to design the site whereby collocating companies could locate their antennas on a ;;i tg3y::•:rASy.;ai iii.3ir4 Sr "t.kti USr ' i City of Tukwila April 12, 2001 Page 2 monopole constructed by AT &T and could locate their electronic (radio) ground equipment within a compact area around the base of the proposed monopole. King County discussed possible collocation on this proposed site with both GTE (now Cingular) and Sprint. While neither company committed to locating at the site, both expressed interest. It is the county's experience that, once a site is constructed, other telecommunication providers' interest in the site becomes more certain. Thus, the county believes that the potential for quickly and fully collocating a second monopole site at the Bow Lake Transfer Station is very good. .' In regulating communication facilities, King County follows a policy which encourages the joint use of tower and monopole sites, thereby minimizing the total number of monopoles and towers throughout the community. This area does not interfere with_any redevelopment plans the county has for the Transfer Station, will not_interfere with _ neighbors' views and will be screened by vegetation to the extent practical while not interfering with the facility's usefulness. In this particular case, the county believes that the Transfer Station's appearance, at least from Interstate 5, may be enhanced as a result of the landscape work j proposed by AT &T in relation to this proposed site. Finally, it is my understanding that, even though the King County Solid Waste Division is only in its earliest planning stage, it has already conferred with both land use planners and public works managers at the City of Tukwila concerning its proposed redevelopment of the Transfer • • 1 City of Tukwila April 12, 2001 Page 3 Station. These landscape design recommendations are designed to: Recommended Landscape Design: Exclusive Plant Types: Big -leaf maple (Ater macrophyllum) Red alder (Alnus rubra) Douglas fir (Pseudotsuga menziesff) Shore pine (Pinus contorta) Baldhip rose (Rosa Deodar cedar (Cedrus deodara) Grass(es): medium to tall, drought- tolerant, with red clover PROPERTY SERVICES PAGE 02 • stabilize the soil to prevent erosion • stabilize the top of the steep slope to prevent slope failure • stabilize the slope at the location of the slope cut and prevent erosion • obtain a high, long -term survival rate for newly planted vegetation without prolonged (manual) watering • eliminate the reoccurrence of Blackberries (Himalayan and Evergreen, listed as Weeds of Concern on the King County Noxious Weed. List) Placement: Along top of slope (eastside of plateau area) and over slope cut (except for narrow access road): plant maples interspersed with alder In center (of plateau area): plant firs interspersed with alders Along west perimeter (of plateau area) along Interstate 5: plant cedars where ultimate tree height won't interfere with antenna beam paths; in all other places where shorter, slower growing trees are needed to avoid interference with beam paths, plant pines with roses in front In all areas: plant grass(es) with red clover, as thick ground cover Explanation: the maples and alders will help to stabilize the top of the slope and slope cut if planted thickly, and their shade will discourage the entry of blackberries onto the plateau from below. Firs and alders will grow very quickly, providing shade cover which will discourage the reoccurrence of blackberries along the surface of the plateau. These plants are very hardy and have a high rate of survival in this region without Page l of 3 . Cedar and pine grow well along the I -5 corridor, as seen in numerous sites along the freeway and, thus, provide a pleasing - -and consistent -- visual barrier. Cedar is a very fast - growing, taller tree; pine is a slower growing, smaller tree — useful in providing a visual barrier without interfering with antenna beam paths in the z area. Roses grow successfully in front of evergreens and, also, are useful as a lower -level = I-.: visual barrier. The grasses will stabilize the soil. The infusion of red clover will put t w nitrogen back into the soil, providing for healthier plant growth. The county believes that 6 = by utilizing this landscape design in the manner described, there will be a high rate of v p success, thereby minimizing costs over the life of the three -year maintenance project. u) w J H Recommended Planting and Maintenance Procedure: in addition to the u) o following, use standard, prudent planting and maintenance practices generally accepted in the profession. g a u) ° ca Planting: It is recommended that the entire mitigation site be spread with three inches I- w (3 ") of vegetative compost and then mixed into the soil to a depth of twelve inches (12 ") z I- using a rototiller or shovel. However, an alternative soil preparation is described below z o as part of the planting instructions for each tree and shrub. In addition, since the site is a 2 D former landfill, any garbage found during the planting process must be properly disposed o ° of off -site. o 1-. Ili _w Specifications: Plant at least 5 gallon nursery size trees (except that 2 gallon nursery size may be used L1-: rd .z for alders and roses) v Plant alders and maples 8 -feet apart, on center 17- rz - Plant pines, cedars and firs 10 -15 feet apart, on center z Plant roses 5 feet apart, on center, to form a thicket Hydroseed or broadcast grass /clover mix ■ Recommended time of planting for most successful results: plant grass as soon as possible for erosion control and plant trees and roses in October 2001 • Put plants in their places according to approved mitigation plan. • Dig square- bottomed holes for plants, twice the size of container. • Score edges of planting hole with shovel, so that roots can travel outside hole. • Loosen plant roots slightly and place in center of hole, upright and level with ground surface. ■ Mulch each tree and shrub with three inches (3 ") of vegetative compost to the dripline of each tree /shrub. Past the dripline, spread two feet (T) wide areas of green wood chips (to deter invasion by weeds). ■ Water the entire site with two inches (2 ") of water right after planting. • Stake all trees; remove stakes at the end of the third (3') year. Maintenance: required for three (3) year period, including weeding, watering and replacing dead plants: PROPERTY SERVICES PAGE 03 Page 2 of 3 N:t•Vrf 45P , , 7!IWT IN.IS5V,,I,}^.a)?tt4.1 , ,A c. n-- 05/01/2001 14:38 206- 296 -0196 PROPERTY SERVICES PAGE 04 Weeding: efforts must be taken to eliminate any reoccurrence of blackberries and other invasive weeds. Schedule should include weeding three (3) times during growing . season: on or about May 1, July 1 and September 1 during all three (3) years. Watering: water after planting, as directed above. Water the entire site with one inch (1 ") of water every week from July 1 to October 15 during the first two (2) growing (summer) seasons after planting. During the third (3' growing season after planting, water the entire site a minimum of one inch (1 ") of water every two (2) weeks from July 1 to October 15. For example, if grass is planted May 2001, and trees and roses are planted in October 2001: during July — October 2001, water one inch (1") every week (first growing season for grass); during July — October 2002, water on inch (1") every week (first growing season for trees /roses and second growing season for grass); during July — October 2003, water trees/roses one inch (1 ") every week (second growing season for trees/roses) and water grass one inch (1") twice (2x) a week (third growing season for grass). Plant Replacement: Replace any dead plant at the end of that year's growing season (in October). In other words, if a plant should die between October 2001 and September 2002, it should be replaced in October 2002. If a plant should die between October 2002 and September 2003, it should be replaced in October 2003. Page 3 of 3 z i~ 11— 6L1 - 0 , 0 0 0 . w1 U) w. w ga d = w z F- 0 z E- c ri 0 —. Torn sheets must be replaced and open seams repaire\ 2. If the plastic begins to deteriorate due to ultraviolet radiation, it must be completely removed and replaced. 3. When the..plasticis no longer needed, it shall be completely removed. PERMANENT SEEDING I D -13 D.4.2 —COVER MEASURES Purpose Seeding is intended to reduce erosion by stabilizing exposed soils. A well - established vegetative cover is one of the most effective methods of reducing erosion. Conditions of Use 1. Seeding shall be used throughout the project on disturbed areas that have reached final grade or that will remain unworked for more than 30 days. 2. Vegetation -lined channels shall be seeded. 3. Retention/detention ponds shall be seeded as required. 4. At the County's discretion, seeding without mulch during the dry season is allowed even though it will take more than seven days to develop an effective cover. Mulch is, however, recommended at all times because it protects seeds from heat, moisture loss, and transport due to runoff. 5. At the beginning of the wet season, all disturbed areas shall be reviewed to identify which ones can be seeded in preparation for the winter rains (see Section D.5.2). Disturbed areas shall be seeded within one week of the beginning of the wet season. A sketch map of those areas to be seeded and those areas to remain uncovered shall be submitted to the DDES inspector. The DDES inspector may require seeding of additional areas in order to protect surface waters, adjacent properties, or drainage facilities. 6. At final site stabilization, all disturbed areas not otherwise vegetated or stabilized shall be seeded and mulched (see Section D.5.5). Design and Installation Specifications 1. The best time to seed is April 1 through June 30, and September 1 through October 15. Areas may be seeded between July 1 and August 31, but irrigation may be required in order to grow adequate cover. Areas may also be seeded during the winter months, but it may take several months to develop a dense groundcover due to cold temperatures. The application and maintenance of mulch is critical for winter seeding. 2. To prevent seed from being washed away, confirm that all required surface water control measures have been installed. 3. The seedbed should be firm but not compacted because soils that are well- compacted will not vegetate as quickly or thoroughly. Slopes steeper than 3H:1 V shall be surface roughened. Roughening can be accomplished in a variety of ways, but the typical method is track - walking, or driving a crawling tractor up and down the slope, leaving cleat imprints parallel to the slope contours. 4. In general, 10 -20 -20 N -P -K (nitrogen - phosphorus - potassium) fertilizer can be used at a rate of 90 pounds per acre. Slow- release fertilizers are preferred because they are more efficient and have fewer environmental impacts. It is recommended that areas being seeded for final landscaping conduct soil 9/1/98 SECTION D.4 ESC MEASURES 9/1/98 tests to determine the exact type and quantity of fertilizer needed. This will prevent the over - application of fertilizer. Disturbed areas within 200 feet of water bodies and wetlands must use slow - release low- phosphorus fertilizer (typical proportions 3 -1 -2 N -P -K). 5. The following requirements apply to mulching: A. Mulch is always required for seeding slopes greater than 3H: 1V (see Section D.4.2.1). B. If seeding during the wet season, mulch is required. C. The use of mulch may be required during the dry season at the County's discretion if grass growth is expected to be slow, the soils are highly erodible due to soil type or gradient, there is a water body close to the disturbed area, or significant precipitation (see Section D.5.2) is anticipated before the grass will provide effective cover. D. Mulch can be applied on top of the seed or simultaneously by hydroseeding. 6. Hydroseeding is allowed as long as tackifier is included. Hydroseeding with wood fiber mulch is adequate during the dry season. During the wet season, the application rate shall be doubled because the mulch and tackifier used in hydroseeding break down fairly rapidly. It may be necessary in some applications to include straw with the wood fiber, but this can be detrimental to germination. 7. Areas to be permanently landscaped shall use soil amendments. Good quality topsoil shall be tilled into the top six inches to reduce the need for fertilizer and improve the overall soil quality. Most native soils will require the addition of four inches of well -rotted compost to be tilled into the soil to provide a good quality topsoil. Compost used should meet Ecology publication 98 -38 specifications for Grade A quality compost. 8. The seed mixes listed below include recommended mixes for both temporary and permanent seeding. These mixes, with the exception of the wetland mix, shall be applied at a rate of 120 pounds per acre. This rate can be reduced if soil amendments or slow - release fertilizers are used. Local suppliers should be consulted for their recommendations because the appropriate mix depends on a variety of factors, including exposure, soil type, slope, and expected foot traffic.. Alternative seed mixes approved by the County may be used. Table D.4.B presents the standard mix for those areas where just a temporary vegetative cover is required. Other mixes may be appropriate, depending on the soil type and hydrology of the area. Apply this mixture at a rate of 60 pounds per acre. The meadow seed mix in Table D.4.G is recommended for areas that will be maintained infrequently or not at all and where colonization by native plants is desirable. Likely applications include rural road and utility right -of -way. Seeding should take place in September or very early October in order to obtain adequate establishment prior to the winter months. The appropriateness of clover in the mix may need to be considered as this can be a fairly invasive species. If the soil is amended, the addition of clover may not be necessary. Maintenance Standards for Temporary and Permanent Seeding 1. Any seeded areas that fail to establish at least 80 percent cover within one month shall be reseeded. If reseeding is ineffective, an alternate method, such as sodding or nets/blankets, shall be used. If winter weather prevents adequate grass growth, this time limit may be relaxed at the discretion of the County when sensitive areas would otherwise be protected. After adequate cover is achieved, any areas that experience erosion shall be reseeded and protected by mulch. If the erosion problem is drainage related, the problem shall be fixed and the eroded area reseeded and protected by mulch. 3. Seeded areas shall be supplied with adequate moisture, but not watered to the extent that it causes runoff. Purpose The purpose of sodding is to establish permanent turf for immediate erosion protection and to stabilize drainage ways where concentrated overland flow will occur. Sodding may be used in the following areas 1. Disturbed areas that require short -term or long -term cover 2. Disturbed, areas that require immediate vegetative cover ti 3. All wa erways that require vegetative lining (except biofiltration swales —the seed mix used in most sod.is not appropriate for biofiltration swales). Waterways may also be seeded rather than sodded, and protected with a net or blanket (see Section D.4.2.2). Design and Installation. Specifications Sod shall be free of weeds, of uniform thickness (approximately 1 -inch thick), and shall have a dense root mat for mechanical strength. The following steps are recommended for sod installation: 1. Shape and smooth the surface to final grade in accordance with the approved grading plan. 2. Amend two inches (minimum) of well- rotted compost into the top six inches of the soil if the organic content of the soil than Compost used should meet Ecology publication 98 -38 specifications for Grade A quality compost. 3. Fertilize according to the supplier's recommendations. Disturbed areas within 200 feet of water bodies and wetlands must use non - phosphorus fertilizer. 4. Work lime and fertilizer 1 to 2 inches into the soil, and smooth the surface. 5. Lay strips of sod beginning at the lowest area to be sodded and perpendicular to the direction of water flow. Wedge strips securely into place. Square the -ends of each strip to provide for a close, tight fit. Stagger joints at least 12 inches. Staple on slopes steeper than 3H:1 V. 6. PERMIT CENTER RE: Conditional Use Permit — AT &T Wireless — Orillia North SS 21 AT &T AT &T Wireless Services 617 Eastlake Avenue E. Seattle, WA 98109 The purpose of the AT &T Wireless Services proposed Orillia North site is to fill a small coverage hole on I -5 between our existing sites Orilla and Southcenter. The Bow Lake Transfer Station location is ideal due to its location on the curve of 1 -5. At this location an antenna rad center of 67' 9" is the minimum necessary to provide the adequate targeted network coverage due to the height of the existing trees and topography of the area. We need our antennae to be above the tree line to provide good coverage at the horizon. Additionally, AT &T Wireless Services needs that height for the number of antennas required (4 per sector), and allowance for future technologies. We investigated use of a replacement utility pole located approximately 50' to the South of the existing monopole. Due to the 60 -foot separation required by collocation interference rules and Verizon Wireless we were unable to locate here. Additionally, location south of the existing monopole would not achieve AT &T's objective because the terrain is much lower and would not meet our minimum height restrictions. AT &T Wireless Services certifies that the antenna usage will not interfere with other adjacent or neighboring transmission or reception functions of other communications facilities. Finally, AT &T Wireless Services complies with all FCC and Washington State laws relating to Emergency 911 regulations. Please feel free to contact me at 206.389.5130 if you need additional information, and thank you very much for helping AT &T provide quality services to its customers. z I-Z w 6 J U 00 U c cn w J H w w -± z w ~ uj co U O — O I— wW ..z w • = 0 ~ z Date 315/01 Date Submitted (File made for Planning Manager) Action Planning Manager Assigns Notice of Incompleteness Ltr. The property is located in a TVS (Tukwila Valley South) zone. The facility will consist of a new 70' tall Monopole with a 3 sector, 15 antenna arrays located at the top of the monopole with a (12' x 28') prefabricated equipment shelter located near the base of the pole. Interstate 5 is directly to the west and the remainder of the surrounding properties are undeveloped and mostly wooded. Orillia Rd. South and the I -5 on -ramp to the southwest are the only other surrounding land uses. CRITERIA FOR CONDITIONAL USES (TMC 18.64.030) (1) The proposed use will not be materially detrimental to the public welfare or injurious to the property or improvements in the vicinity. The applicant has included site plans, elevations and photosimulations showing the proposed new monopole as well as potential future co- locations. The facility consists of telecommunications equipment that falls within the safety parameters set forth by the American National Standards Instihrte (ANSI) and operates below the standards set by the Federal Communications Commission (FCC) standards for safe levels of exposure to radio frequency emissions. 1530 W ST AKE AVENI'E NORTH, SPITE 400 SEA VI \\'A 98109 l (2) The proposed use shall meet or exceed the same standards for parking, landscaping, yards and other development standards that are required in the district it will occupy. The development standards for uses in the Tukwila Valley South (TVS) zone include an allowed maximum height of 115 feet. The proposed monopole will be 70 feet tall. The proposed equipment location meets or exceeds the setback standards for the TVS zone. The required front yard setback is 25 feet. Our proposed site is approximately 250 feet from the front (South) property line. The required side yard setback is 5 feet. Our proposed site is 13 feet from the side property line abutting Interstate 5 to the West and is nearly 1000 feet from the property line to the East. The required rear setback is 5 feet. Our proposed site location is approximately 330 feet from the rear (North) property line. Only one service visit per month is required and adequate off - street parking exists for this vehicle. No landscaping is required at this location due to its commercial nature as well as the adequacy of existing screening at the site. An existing slatted chain link fence will screen the view from Interstate 5. The view from adjacent properties will be adequately screened from view by existing vegetation. z ;= z w • 2 O 0 CO 0 • LU J w • 0 g< = w m in h0 w ~ The site is presently developed as a solid waste transfer station and has an existing o I— wireless communication monopole located near Interstate 5 on the West side of the w W property. An additional wireless communication facility is completely compatible with 1 this use. Interstate 5 abuts the entire West side of the property and the remainder of the u- 0 surrounding properties are undeveloped and mostly wooded. The proposed development will have no impact on vehicular or pedestrian circulation or access. O (3) The proposed development shall be compatible generally with the surrounding land uses. (4) The proposed use shall be in keeping with the goals and policies of the Comprehensive Land Use Policy Plan. 12.1.36. Encourage utilities to consolidate facilities and minimize visual impacts of facilities where technically feasible. Location of our proposed monopole at the site of an existing solid waste transfer station with an existing (but full) wireless monopole is in keeping with the Comprehensive Plan goal of consolidation of utilities. Location on this site will reduce the likelihood of additional monopoles being required in the vicinity. Additionally, as the use of wireless services increases, new and expanding utilities are necessary to meet the demand for these services. This facility is necessary to provide continuous and reliable AT &T Wireless service in the area. The Federal Communications Commission (FCC) requires the holders of their licenses to provide thorough coverage within their license area. As stated above the facility is designed to have minimal adverse impacts on the surrounding area. The height of the pole has been reduced to the minimum required in order to achieve the required coverage objective. The site has been located on a parcel occupied by a solid waste transfer station and already has an existing wireless monopole on site. The owners of this monopole (US West/ Qwest) were approached with regard to co- location but the existing structure will not support additional antennas. The location of the site was chosen to minimize visual impacts to surrounding parcels. The permit was issued to perform restoration activities at the Bow Lake Transfer Station relating to an AT &T application. Subsequent to that permit being issued, the City of Tukwila directed that the restoration only occur between March 20, 2002 -May 31, 2002. The window mentioned above is now upon us. In order to restore the site, the subject permit will need to be re- issued, or if possible, extended. Please direct me on how best to proceed. Please also let me know anticipated processing fees so that I may submit a check request. Thank you. Chris Listfjeld The Alaris Group (206) 267 -0443 April 25, 2002 Mr. William J. Petschl Petschl's Quality Meats 1150 Andover Park East Tukwila, WA 98188 Dear Mr. Petschl: City of Tukwila Department of Community Development Steve Lancaster, Director RE: Landscaping and Curb Cut for D98 -0226 On December 27, 1999, you provided a $4,800 bond to the City to ensure that the parking lot installed through the building permit D98 -0226 was paved, a curb cut located to provide access to the parking lot and landscaping would be installed based on the approved plans in the file. There was a delay in completing the landscaping and constructing the curb cut until construction on the adjacent property to the east was completed. The work on your site was to be completed by December 31, 2000. It appears that the construction on the adjacent property is complete, which should permit the completion of the remaining site improvements on your property. I am enclosing a copy of a letter sent to John Rowley, the contractor for the refrigeration project, that identifies the landscaping issues that remain from 1999. Steven M. Mullet, Mayor On the issue of the curb cut/access way, at the time your building permit was under review, you were exploring the possibility of combining your curb cut/access driveway with the adjacent property to the east. Currently, gravel is being carried from your unpaved parking lot over to the sidewalk and Saxon Drive roadway by cars leaving your site, which creates unsafe driving and pedestrian conditions. Tukwila code requires that the parking lot be paved. The City is ready to look at any possible solution you may wish to propose to resolve the curb cut issue and bring this project to closure. „ t 3 :4u i9.,41.lt c G. , ,.r+:..4.,N..., Ia. d:, nl` Y3' r,. rY{'1ti.'. 6300 Southcenter Boulevard, Suite #100 • Tukwila, Washington 98188 • Phone: 206 - 431 -3670 • Fax: 206 - 431 -3665 z w 6 JU 00 N O = 1/1 H N w LLQ _ a 2w Z O Z w w Jo U 0— OH w W L - LIO z w U = 0 ~ z Carol Lumb FW: Permit # S- 135 -01 /City of Tukwila C and Grading Permit No. M101 -143 From: To: Date: Subject: Thanks BT "Thompson, Bernard" <Bernard.Thompson @METROKC.GOV> "'clumb @ci.tukwila.wa.us "' <clumb @ci.tukwila.wa.us> 5/2/02 3:03PM 145— 01 -(L&3 FW: Permit # S- 135 -01 /City of Tukwila Clearing and Grading Permit No. M101 -143 Original Message From: Thompson, Bernard Sent: Thursday, May 02, 2002 3:01 PM To: 'clistfjeld @thealarisgroup.com' Cc: 'clumb @ci.tukwila.wa.us'; Ugwoaba, Dwin; Stewart, Susan Subject: RE: Permit # S- 135 -01 /City of Tukwila Clearing and Grading Permit No. M101 -143 Chris, considering the time duration between the issuance of this permit by the City of Tukwila, all we are looking for is a response from the City of Tukwila that gives you the green light to perform the work authorized under the 11 -16 -01 approval. This could just be a formality. So what I would suggest is that you give Carol Lumb a call or send an Email regarding the permit you obtained from the City and if you could have her send me an Email advising me (King County) that you have the authorization to perform the work under the terms and conditions of permit M- 101 -143 without any amendments or revisions to this permit. I don't foresee any major complications associated with obtaining this approval. My intent is to make sure that we are all on the same page, avoid delays, and reduce or elimination any complications associated with the performance of this work..
