City of Tukwila staff have reviewed your short plat application and have the following
comments on either needed corrections or additional materials in order to continue review of the
short plat. If you have questions about any of the comments, please contact the person identified
under each section.

1. The hydrant must be installed at the road entrance.
2. The east/west road will be addressed as "150 Place" and all lots will be addressed off 150
Place. The north/south road will be addressed as 63` Place South.
3. The road must not exceed 15% grade.
4. The road and turn around must have an all weather surface prior to acceptance by the City.

Access Road
1. Public Works will allow the existing 20 -foot access road to serve as a private access road for
this proposed short plat, until development of adjoining parcels occurs. At that time, the
owners of the platted lots shall dedicate property to the City for a public road. To ensure
right -of -way for this future public road, the applicants shall agree to provide a 25 -foot
easement running north -south along the westerly property line and shall make legal provision
that, at the City's request, property owners of lots, new and existing, resulting from this short

After evaluating your request for changing your home address, the Fire Department has
agreed that this problem needs clarifying. The proposed subdivision will create the z
potential for the construction of two additional homes on the long private drive. The
Private Drive will become S 149 Place. Because you are the proponents of this change
and because the street will remain a private drive, you will be responsible for installing
and maintaining the street sign. I have enclosed the detail sheet for the sign provided by
Tukwila Public Works Department. In addition, the private drive will become a Fire Lane
and shall be maintained as such. You will need to ensure that you have 13'6" of vertical
clearance and 20' in width, with an all weather driving surface capable of supporting a
Fire Engine. You will have 90 Days from the date of this letter to have this work
completed.

Prior to any new home construction on the newly created lots, the following two items
will need to be installed per Tukwila Public Works Standards.

plat shall dedicate the 25 -foot easement and the 20 -foot access road to the City. The road
running north/south must meet Fire Department turn around requirements temporarily
(hammerhead required), until the permanent road is installed. The owners of the new lots, as
well as the existing owners, must sign a no- protest agreement to construct their portion of the
public road when the appropriate time comes. (see enclosed illustration)
Septic System
1. You will need to decommission the septic tank and connect the existing house to the
pressurized sewer line. Decommissioning the septic usually entails pumping, disinfecting,
breaking holes in it, and filling the tank with sand or gravel. You will need to provide the
City documentation of pumping and you will need to notify King County Health Department.
Storm Water
1. Schematic design drawings have not been submitted for storm drainage on the site. The City
utilizes the King County Surface Water Design Manual, along with storm water standards in
the Tukwila Municipal Code. Your engineer should refer to these standards in developing
these plans. Please contact Ryan Larson, at 433 -0179 to discuss the storm water detention
requirements for this site.
Plat Map
1. Provide a plat map that meets the criteria on the attached short plat checklist.
2. The plat map must be signed, stamped and dated by a licensed surveyor and use vertical
datum NAVD 1988 and horizontal datum NAD 83/91.
Site Work
1. Contact Mike Cusick at 206 -433 -0179 for approval of the pressurized sanitary sewer system
before completing the site map. Please provide drawings and specifications for the sanitary
sewer pump.
2. Provide a site map which meets the criteria on the enclosed short plat check list which is
signed, stamped, and dated by a licensed civil engineer and uses vertical datum NAVD 1988
and horizontal datum NAD 83/91.
3. Provide 10' separation horizontally or show installation on a shelf per City standard and
sleeve the sewer line.
4. Where water and sewer lines cross, place the water line at least 18 inches above the sewer
line.
5. Provide drawings for the sanitary sewer pump.
6. Show all power underground from the power source.
Planning
1. A geotechnical report, meeting City requirements, prepared by a geotechnical engineer and
based on field work performed by that engineer is needed for the proposed short plat.
2. The survey must include both the boundary line adjustment and short plat legal descriptions
for before and after the adjustments /platting are approved.

3. The site plan must accurately reflect the location of existing structures and a building
envelope for structures on the proposed new lots.
4. An example of a survey for a short plat is enclosed to illustrate the format for your surveyor.
This format must be used to record the short plat with King County.
The items noted in the Public Works checklist that are needed on the site plan and other plans are
also needed for Planning Review.

1. The applicant has the option of treating the west side of the structure as a side yard or
front yard setback, in view of the lack of specificity in the Zoning Code definition of
front yard setback. The applicant has opted to treat the west side of the property as a
side yard. The setback is 5 feet for side yards. The north side of the structure will then
become a rear yard setback, which requires a 10 -foot setback. A boundary line
adjustment has been submitted to provide additional area so the 10 -foot setback can be
met.
2. The site plan submitted with the revision is not to- scale. My understanding of the
proposed revision is that at least a five -foot setback from the west property line is
proposed along the entire west side of the structure. Prior to the pouring of the new
foundation, a surveyor must document that the building is at least 5 feet from the west
property line. This setback then will be confirmed by the building inspector.
3. No projections are permitted into the yard setbacks except roof eaves may project 18-
inches into the setback.

This situation has arisen through an innocent error. An error we are in the process
of trying to correct through legal channels with the City of Tukwila. In order to do any
work on the structure to correct the situation, we are required to submit new plans for the
renovation of our home. Until the city gives us information on requirements, we don't
know what exactly the plans will look like. Currently due to your conversations with the
city, we are under a "stop work order". We fully intend to remove the building from your
property when the city gives us permits required to commence that work.
As part of the process, we have initiated a short plat that would improve the road access
and bring sewers to the property. This unfortunately all takes time to process through the
many city departments.
We feel that the improvement of the road and the running of sewers down will benefit
both our property and yours. The cost of running the sewer would be expensive for either
of us. Also, the time will soon come that we both will be forced to connect to sewers. But
by installing them now and spreading the cost over several lots makes the cost more
bearable.
If you felt that such an improvement would be beneficial to you and the value of
your property, we would be happy to make a connection available to you in trade for the
East 10 feet of your lot. This would solve the situation, save you the expense of
engineering and creating your own sewer line and give us more funds towards the
expenditure of the sewer line and pump system we require.
I hope you can bring yourself to work with us to the benefit of all. We do not wish
to live at odds with our neighbors. I am sure you, like us, own a home to enjoy and not
cloud it by brewing ill feelings of those around us. Please let us hear from you either by

The City Attorney's Office has been asked to review the situation leading to your
construction of a structure that encroaches upon the property of your neighbor. You received a
letter from Duane Griffin, Tukwila's Building Official, dated August 29, 2001 wherein you were
notified to cease work on the house you are constructing at 14924 62 Avenue South because of
the encroachment. The letter requested that you provide a survey prepared by a licensed land
surveyor. You were given 30 calendar days from the date of the letter to provide the survey.
After receipt of the stop work order, you had conversations with both Carol Lumb and
Jack Pace, of the Department of Community Development, on possible options to resolve the
setback violation. A copy of the property survey was included as part of the materials in an
application for a short plat for the two parcels you own submitted on October 10, 2001. The
short plat application was apparently submitted as a way to address the setback issue.
In the interim, your property continues to encroach onto the property of your neighbor.
Such a continuous encroachment constitutes a trespass upon the adjacent property. Although
you have submitted a short plat application seeking a short plat approval that would effectively
modify your yard configurations and also modify setback requirements, that application does not
insulate you from potential liability for the continuing trespass. You should be aware that you
continue to trespass upon your neighbor's property at this time at your own peril.
Additionally, the encroachment constitutes a violation of City code. Such a violation
must be corrected immediately. If the violation is not abated immediately, the City will seek
legal redress. This means that you must, at a minimum, remove the structure from your
neighbor's property immediately. You may disregard the stop work order only to the extent
necessary for you to take measures to remove the encroachment. The City expects that the
encroachment will be removed within the next two weeks.

The City will expeditiously process your short plat application, but cannot make any
guarantees or assurances to you that it will be approved. The City considers the building permits
noted above to be apart and separate from your short plat application. The building permit and
the structure you have erected, therefore, will not be factors in the consideration of your short
plat application.
The Department of Community Development will notify you soon of substantive issues,
if any, that must be addressed prior to a decision on the merits of the short plat. In the meantime,

access and hammerhead for this short plat. Following a site visit and
consideration of requirement in the Tukwila Municipal Code, I have decided to
grant an exception per TMC 17.28 and approve Mr. McGrath's proposal for
access.
Public Works will allow the access from 62 Avenue South to remain a private
drive. Public Works will not require right -of -way dedication as a condition of this
short plat. Public Works will require evidence of how access and maintenance to
all four lots will be guaranteed for the future.

Access Road
1. This access will need to be paved and the impervious area included in the
storm drainage calculations.
Septic System
1. You will need to decommission the septic tank and connect the exisiting
house to the pressurized seewr line. Decommissioning the septic means
usually entails pumping, disinfecting, breaking holes in it, and filling the tank
with sand or gravel. You will need to provide the City documentation of
pumping and you will need to notify King County Health Department.
Plat Map
1. Provide a plat map which meets the criteria on the attached short plat check
list.
2. Signed stamped and dated by a licensed surveyor and using vertical datum
NAVD 1988 and horizontal datum NAD 83/91
Site Work
