We have completed a detailed review of your revisions to the Boundary Line Adjustment,
submitted on December 24, 2001. Please make the following revisions:
1. The approval signature block for the Chairman of the Short Subdivision Committee
(Sheet 1 of 2) should be modified to indicate that it is the Tukwila Short
Subdivision Committee.
2. The Title Block on both plan sheets should be modified to indicate that it is a City
of Tukwila Boundary Line Adjustment.
Please make the revisions indicated above and have the Boundary Line Adjustment
documents properly signed and notarized. You may then submit the boundary line
adjustment documents for final approval. After these documents have been found to be
in order, and all of the requirements of the boundary line adjustment have been met, the
Chairman of the Short Subdivision Committee will sign the boundary line adjustment,
constituting a grant of final approval.
The boundary line adjustment is not complete until final approval has been granted by the
Short Plat Committee, the recording occurs and copies of the recorded documents are
provided to the Department of Community Development. It will be your responsibility to
record the City approved documents with the King County Department of Records. You
will need to pay the recording fees and submit your approved original boundary line
adjustment to the King County Department of Records.

After recording, the County returns the recorded originals to the City of Tukwila within 4 -6
weeks, at which time your boundary line adjustment is considered complete. You can
shorten this processing time by hand - delivering a copy of the recorded boundary line

referenced short plat.
1. The file number is shown on both sheets of the Boundary Line Adjustment.
2. The bearings and distances of the original legal description for Lots A and B
have not been revised. The legals for both lots reflect what is shown of record
and is what was furnished in the title report. I have shown deed bearings and
distances on the map page on Sheet 2. As far as the revised legal descriptions,
I have made the revisions you requested.
3. We have provided copies of the four recording numbers you requested.
4. The TCI Cable agreement is enclosed for your review. There is not sufficient
information to locate this agreement on the drawing.
We have also enclosed 4 copies for your additional review. Please give me a call if you

parties, either oral or in writing, and replaces all` other or previous Right of Entry
Agreements relating to the subject matter hereof for the PROPERTY.
12. The benefits and obligations of this Agreement shall be considered as a. covenant
running with the land, and shall inure to the benefits of, and be binding upon, the
successors, assignees, heirs and personal representatives of the OWNER and,.COMPANY.
OWNER agreees to disclose said agreement to any subsequent OWNER of the property.
13. If legal action is necessary to enforce any provision of this Agreement, the prevailing.
party in such action shall be entitled to recover its costs and expenses of such action,
including reasonable attorney's fees as determined pursuant to such action.
14. The undersigned OWNER or authorized agent hereby represents that he/she is the
OWNER of the PROPERTY, or the authorized agent of the OWNER, with full authority
to bind the OWNER to the terms and conditions of this Agreement.

15. The OWNER shall not use nor permit the use of the COMPANY'S SYSTEM installed
by the COMPANY or its agents, or any part of such SYSTEM for any purpose other than
the transmission of the COMPANY signal. In particular, but without limitation, the
;COMPANY'S SYSTEM shall not carry signals from or become attached to a master
' antenna, individual outdoor antennas, antennas for reception of signals from satellites,
other cable systems or operators, or any other means of providing television signal.
16. The OWNER agrees that the Services provided herein are for the private viewing only

Dear Ms. Lumb,
I've been asked to submit the Hillcrest Apartments' boundary line adjustment
project that you have discussed with Andy Lane at Foster Pepper. Enclosed you will find
four copies of the boundary line adjustment application. Included with the application
are the application checklist, affidavits of ownership and permission to enter, proof of
title documents, and an original site plan with 4 copies. As you and Andy discussed, a
number of items on the checklist are not applicable to this project. Those items are
identified on the submitted checklist. I have also included the $50 application fee.
The boundary line adjustment is necessary because the Hillcrest Apartments
property is subject to an existing landslide hazard. As you know, the construction of a
retaining wall will help preserve the existing buildings onsite. Engineering
considerations dictate the location for the retaining wall. Unfortunately, that location is
within the City's required property line setback. To avoid locating the wall in the
setback, we need to move the property line between the Hillcrest Apartments and the
Wade Cook building approximately 10 feet eastward (with a corresponding northward
expansion of the Wade Cook property). Without the approval of the boundary line
adjustment, the retaining wall cannot be constructed.
