In particular, you have proposed to upgrade the landscape to complement recent improvements to the building (necessitated by the February 2001 earthquake). The landscape improvements include a significant increase in the amount of shrubs and ground cover around the building perimeter as well as an increase in the number of trees along the Interurban Avenue side of the property. Due to the site's proximity to the Green River, a Shoreline Substantial Development permit was required for these proposed landscape improvements (File No. L01- 073, issued on April 5, 2002). Per TMC 18.60.030(D), the proposed landscape design is approved as a minor, insignificant modification which will have no impact on the project design. Accordingly, review and consideration by the Board of Architectural Review is not required. YOUR APPEAL RIGHTS One administrative appeal to the Shorelines Hearings Board of the Decision is permitted. Any person appealing to the Shorelines Hearings Board may raise certain SEPA issues as part of the appeal to the Shorelines Hearings Board. PROCEDURES AND TIME FOR APPEALING The requirements and procedures for appeals to the Shorelines Hearings Board are set forth in RCW 90.58 and WAC 461.08. V. PROJECT DESCRIPTION Steven M. Mullet, Mayor The proposal is to improve the landscaping at the Southcenter Plaza building. These improvements are being proposed to compliment a building upgrade that was undertaken as the result of the February, 2001 earthquake. The project is bordered on the east by the Duwamish River and on the west by Interurban Avenue South. The entire site is located within 200 feet of the river. The proposed improvements include the following: a) addition and replacement of plant materials; b) repair of portions of the existing asphalt trail; and c) installation of an underground irrigation system. 2. POLICIES OF THE SMA The site is within the jurisdiction of the City of Tukwila Shoreline Master Plan ( "SMP "). The policies of the SMP are categorized into the following elements: A. The Economic Development Element requires that development be economically advantageous to the community, maximize use of the shoreline and consider the visual impact of the development on the surrounding area. B. The Public Access Element requires that the development provide for public access to the shoreline and develop or enhance the trail system. C. The Circulation Element requires that roads and transportation facilities be designed in a way that provides for pedestrian access and recreational activities. D. The Recreational Element requires that recreational opportunities along the river should be preserved and enhanced. E. The Shoreline Use Element requires that uses along the shoreline should be appropriate, protect and enhance the river, be water dependent or compatible with water dependent uses and allow for multiple uses. F. TUKWILA SHORELINE REGULATIONS 0) o w The following are the relevant review criteria as contained in the City of Tukwila Shoreline Overlay g Zone (TMC 18.44): N J The Shoreline Overlay is a district which extends 200 feet landward from the mean high = w i_ W water mark of the Green River, throughout Tukwila. This district is divided into three z = t— management environments with specific regulations. I_ O zt— River Environment - the first 40 feet landward of the mean high water mark. This is 2 n the most restrictive environment and only a llows for limited pubic access, v o transportation and utility uses and structures. OCR ui Low Impact Environment - the next 60 feet landward of the River Environment. i 0 This environment allows structures up to 35 feet, landscaped and screened 0 parking lots, transportation and utility uses and structures. .. Z Ili co High Impact Environment - the next 100 feet landward of the Low Impact i H Environment. This environment allows uses permitted in the underlying zoning Z district. The existing pedestrian trail (located within the 40 -foot River Environment) will be repaired and the plantings along the adjacent edge of the river bank will be enhanced. The work to be performed in the River and High Impact Environments include the addition and replacement of plant materials and installation of an underground irrigation system. TMC 18.44.110 - General Shoreline Regulations All uses within the Shoreline Zone must conform to the following general regulations: (1) The use is in conformance with the regulations of the underlying zone district. Response: The Southcenter Plaza building is located in the Regional Commercial Mixed -Use (RCM) zone and is an allowable use in that zone. (2) The use does not conflict with the goals and policies of the Shoreline Master Program or the provisions of the Shoreline Act and shoreline regulations. Response: No conflicts were identified. L01 -073 April 5, 2002 Page 3 (3) No structures or accessory facilities shall be located over the river unless such structure protects or promotes the public interest. Z Response: No new structures or facilities are proposed under this permit. H z w w (4) There shall be no disruption of existing trees or vegetation within the river environment unless necessary for public safety or flood control, or if allowed as a -I 0 part of an approved shoreline substantial development permit. 0 co iii Response: The plantings on the waterward side of the existing pedestrian trail (located W -, f w ithin the 40 -foot River Environment) will be enhanced for soil stabilization purposes. The existing wildlife Cu co habitat along the riverbank will be protected. 0 H z (8) All perimeters of landfills or other land forms susceptible to erosion shall be provided with vegetation, retaining walls or other satisfactory mechanisms for erosion prevention. Response: Best Management Practices (BMP's) will be used to prevent erosion and sedimentation during construction of the project. A temporary erosion and sediment control plan must be approved by the City of Tukwila prior to construction. (9) All necessary permits shall be obtained from Federal, State, County or municipal agencies. Response: Responsibility of the applicant. (15) Notwithstanding any provisions of this Code to the contrary, removal of any cottonwood tree within the river environment or the low impact environment, which tree is 12 inches or greater in diameter as measured 4.5 feet above grade, shall be subject to the requirements of TMC Chapter 18.54, Tree Regulations. SEPA water quality. 18.44.130 Specific Shoreline Regulations - High Impact Environment Development should reflect the river's role in Tukwila history, protect the long -term public use of the river and reflect community traditions. Development should include high - quality site planning, architecture, landscaping, provide for open space and provide a trail for public access along the river (for areas included in the Green River Trail Plan). Development should maintain views of the water, encourage water enjoyment uses, provide for multiple uses and encourage efficient use of the land. The project will not impact habitat features in or along the riverbank. Water quality will be protected during project construction through the use of Best Management Practices to prevent erosion and sedimentation. The project will not endanger public health, safety, welfare or the capacity of the river to provide long -term community benefits. No over -water structures are proposed under the permit. The project will enhance of site of the existing office building and pedestrian trail, which is an existing long -term use of land adjacent to the river. The proposed landscape improvements enhance the existing pedestrian trail and maintains existing views of the water. A SEPA Determination is not required for the proposed landscape improvements. TUKWILA SHORELINE REGULATIONS The following are the relevant review criteria as contained in the City of Tukwila Shoreline Overlay Zone (TMC 18.44): (1) The Shoreline Overlay is a district which extends 200 feet landward from the mean high water mark of the Green River, throughout Tukwila. This district is divided into three management environments with specific regulations. River Environment - the first 40 feet landward of the mean high water mark. This is the most restrictive environment and only allows for limited public access, transportation and utility uses and structures. Low Impact Environment - the next 60 feet landward of the River Environment. This environment allows structures up to 35 feet, landscaped and screened parking lots, transportation and utility uses and structures. High Impact Environment - the next 100 feet landward of the Low Impact Environment. This environment allows uses permitted in the underlying zoning district. The existing pedestrian trail (located within the 40 -foot River Environment) will be repaired and the plantings along the adjacent edge of the river bank will be enhanced. The work to be performed in the River and High Impact Environments include the addition and replacement of plant materials and installation of an underground irrigation system. The project will enhance of site of the existing office building and pedestrian trail, which is an existing long -term use of land adjacent to the river. The proposed landscape improvements enhance the existing pedestrian trail and maintains existing views of the water. These improvements are being proposed to compliment a building upgrade that was undertaken as the result of the February, 2001 earthquake. The project is bordered on the east by the Duwamish River and on the west by Interurban Avenue South. The entire site is located within 200 feet of the river. The proposed improvements include the following: a) addition and replacement of plant materials; b) repair of portions of the existing asphalt trail; and c) installation of an underground irrigation system. 2. POLICIES OF THE SMA The site is within the jurisdiction of the City of Tukwila Shoreline Master Plan ( "SMP "). The policies of the SMP are categorized into the following elements: A. The Economic Development Element requires that development be economically advantageous to the community, maximize use of the shoreline and consider the visual impact of the development on the surrounding area. B. The Public Access Element requires that the development provide for public access to the shoreline and develop or enhance the trail system. C. The Circulation Element requires that roads and transportation facilities be designed in a way that provides for pedestrian access and recreational activities. D. The Recreational Element requires that recreational opportunities along the river should be preserved and enhanced. E. The Shoreline Use Element requires that uses along the shoreline should be appropriate, protect and enhance the river, be water dependent or compatible with water dependent uses and allow for multiple uses. F. The Historical /Cultural Element requires areas having historical, cultural, educational or scientific value be protected, restored and made accessible to the public. The proposed project is consistent with the goals and policies of the SMP including the provision for public access to the shoreline, the development or enhancement of the trail system and the preservation and enhancement of recreational opportunities along the river. It will not adversely affect land use, economic development, public access circulation or recreation along the shoreline. The following are the relevant review criteria as contained in the City of Tukwila Shoreline Overlay Zone (TMC 18.44): The Shoreline Overlay is a district which extends 200 feet landward from the mean high water mark of the Green River, throughout Tukwila. This district is divided into three management environments with specific regulations. River Environment - the first 40 feet landward of the mean high water mark. This is the most restrictive environment and only allows for limited public access, transportation and utility uses and structures. Low Impact Environment - the next 60 feet landward of the River Environment. This environment allows structures up to 35 feet, landscaped and screened parking lots, transportation and utility uses and structures. High Impact Environment - the next 100 feet landward of the Low Impact Environment. This environment allows uses permitted in the underlying zoning district. The existing pedestrian trail (located within the 40 -foot River Environment) will be repaired and the plantings along the adjacent edge of the river bank will be enhanced. The work to be performed in the River and High Impact Environments include the addition and replacement of plant materials and installation of an underground irrigation system. TMC 18.44.110 - General Shoreline Regulations All uses within the Shoreline Zone must conform to the following general regulations: (1) The use is in conformance with the regulations of the underlying zone district. Response: The Southcenter Plaza building is located in the Regional Commercial Mixed -Use (RCM) zone and is an allowable use in that zone. (2) The use does not conflict with the goals and policies of the Shoreline Master Program or the provisions of the Shoreline Act and shoreline regulations. Response: The plantings on the waterward side of the existing pedestrian trail (located within the 40 -foot River Environment) will be enhanced for soil stabilization purposes. No trees will be removed. (8) All perimeters of landfills or other land forms susceptible to erosion shall be provided with vegetation, retaining walls or other satisfactory mechanisms for erosion prevention. (9) Response: Best Management Practices (BMP's) will be used to prevent erosion and sedimentation during construction of the project. A temporary erosion and sediment control plan must be approved by the City of Tukwila prior to construction. All necessary permits shall be obtained from Federal, State, County or municipal agencies. Response: Responsibility of the applicant. (15) Notwithstanding any provisions of this Code to the contrary, removal of any cottonwood tree within the river environment or the low impact environment, which tree is 12 inches or greater in diameter as measured 4.5 feet above grade, shall be subject to the requirements of TMC Chapter 18.54, Tree Regulations. Response: No cottonwood trees will be removed in connection with this permit. Development should include high - quality site planning, architecture, landscaping, provide for open space and provide a trail for public access along the river (for areas included in the Green River Trail Plan). Development should maintain views of the water, encourage water enjoyment uses, provide for multiple uses and encourage efficient use of the land. The project will not impact habitat features in or along the riverbank. Water quality will be protected during project construction through the use of Best Management Practices to prevent erosion and sedimentation. The project will not endanger public health, safety, welfare or the capacity of the river to provide long -term community benefits. No over -water structures are proposed under the permit. The project will enhance of site of the existing office building and pedestrian trail, which is an existing long -term use of land adjacent to the river. The proposed landscape improvements enhance the existing pedestrian trail and maintains existing views of the water. SIGN INSTALLATION AND SPECIFICATIONS Sign Size and Placement Sign Content SIGNS The sign(s) shall be 4'x4' in size, placed no closer than five (5) feet from the right -of -way at the mid -point of the more heavily traveled public street fronting the property (see Figure 1). A minimum of one sign is required at each project site. Additional signs may be required for larger sites or for properties with several street frontages. Hand lettered signs are not acceptable. Signs meeting the established criteria may be obtained from any professional sign company. W U = 0 z RESPONSIBILITY OF THE APPLICANT The applicant shall be solely responsible for the construction, installation, maintenance and removal of the notification sign(s) and the associated costs. The sign(s) shall be erected no later than fourteen (14) days after the Department of Community Development has issues the Notice of Completeness and will remain erected until the date specified by the Department. The applicant shall sign an affidavit, stating that the sign (s) were installed and posted in accordance with all City codes and ordinances. The affidavit of posting shall be submitted to the Department of Community Development by the applicant within fourteen (14) days following the issuance of the notice of completeness . If the sign is made illegible, removed or otherwise destroyed prior to the date of the final public hearing or final action by the City of Tukwila, the applicant is responsible for the immediate replacement of the sign. Failure to maintain the notice board in good condition is cause for the discontinuance of the review of the application until the notice board is replaced and remains in place for a specified time period. RESPONSIBILITIES OF THE DEPARTMENT OF COMMUNITY DEVELOPMENT The Department shall provide the applicant with all information necessary for the installation of the public notification board. These materials include a copy of the City logo, size and material requirements, and illustrated examples of a posting board. The Department will also determine the type of decision being rendered for this application and specify to the applicant the duration of the posting period. The Department shall post the Notice of Hearing on any posted notice board(s) erected pursuant to TMC 18.104.110 at least 14 days prior to any public hearings on Type 3, 4 and 5 decisions, open record appeal hearings on Type 2 decisions and closed appeal hearings on Type 4 decisions.
