City of Tukwila Department of Com727721r72i y Development Steve Lancaster, Director MEMORANDUM July 31, 2002 TO: FROM: Steve Lancaster Tukwila City Council SUBJECT: ANNUAL COMPREHENSIVE PLAN AMENDMENTS FOR 2001/2002 The City Council received the proposed annual amendments to the Comprehensive Plan for 2001/2002 for its briefing on July 22, 2002. A public hearing is scheduled for August 5, 2002 to receive input. Following the public hearing, the City Council will decide whether or not to adopt individual proposed amendments. This decision may be made either on August 5 or at a later date. Steven M. Mullet, Mayor Process to date: Proposed amendments to the Comprehensive Plan and Zoning Code were submitted by December 31, 2001. The City Council held a public meeting on the proposed amendments in March, 2002. At that time, an additional proposed amendment was added for consideration, and two amendments were dropped from further consideration. (For complete background, refer to loose leaf notebooks, distributed March, 2002) A total of four potential amendments were forwarded to the Planning Commission for consideration in 2002. The Planning Commission was briefed on proposed Comprehensive Plan amendments on April 4, 2002, and held a public hearing on May 23, 2002. After its public hearing, the Planning Commission made recommendations regarding the proposed amendments. On July 22, 2002, the City Council was briefed on the Planning Commission's recommendations. At each stage in the process, staff has tried to encourage public involvement. All public meetings and hearings were advertised in the paper. Staff exceeded statutory notification requirements in providing mailings to owners and occupants within 500 feet of the proposed map changes. Cumulative Effects of Recommended Amendments The likely impacts of recommended amendments are varied. Changing LDR to C /LI will allow the possibility of increased development at the City Shops (L01- 076(a). The potential impacts of L01- 076(b) will be limited, and will depend on specific changes to be considered later in 2002 when the City Council reviews updates to the Concurrency Ordinance. Two amendments will address the likely impacts of potential development associated with high capacity transit. L01- 076(c) will encourage transit - oriented land uses near high capacity transit, while L01 -076 (d) will limit spillover parking adjacent to park -n' -ride lots by requiring adequate parking facilities. z Exhibits: 1. These predators who have served their sentences, are often required to get additional treatment until they are deemed safe to live in a community. There is now only one treatment site for newly released sexual predators, on McNeil Island. Legislation has mandated that each county that has sent sexual predators to prison must accommodate their release to secure community transitional facilities, which DSHS will build. These facilities may be very small, with as few as three persons. Communities must have a procedure for dealing with siting of these facilities. The two ways to deal with it are to do nothing and wait for the state to pre -empt a city's siting, or to proactively designate sites. Tukwila is choosing to be proactive on this issue. Staff recommended and the committee agreed that a 3 person facility could be located in the MIC -H zone, if not within 1,000 feet of residential zones, schools or school bus stops, licensed day care and preschools, parks, trails, churches and the like. Steve said the state regulations for the new facilities look to be fairly tough, such as 1:1 supervision whenever a person leaves the facility, and close supervision at the home. The draft is based on a model ordinance drafted by the Kenyon law firm. One issue is the state needs to approve the plan; they are given 60 days notice in which they can comment on a plan before its adoption. Because the state will start these facilities by October 1, it will be best if a draft can be tentatively approved by the Council and sent to the Planning Commission in order to send it to the state by the end of July before the Council formally approves it sixty days later. Recommend briefing to June 24 COW. 2. Comp Plan Amendments The Council approved two amendments to send to the Planning Commission. The Commission approved one, recommended delaying, another, and added two new amendments. The committee agreed with the Planning Commissions' recommendations. Only one is a zoning question, with the other two being use issues rather than site - specific land issues. Recommend briefing at July 8 COW. 3. Crestview Park Complaints Bruce had talked to the citizen who spoke at last night's Council meeting, and had agreed to work with him on his list of actions he would like the city to take. However, Bruce documented how he had worked with Curt Treadwell over the past year and a half. He gave the committee members copies of complaints from Mr. Treadwell, and Parks' responses. He has built a fence that was approved by council eighteen months ago, and has gotten security to lock the park at dusk. It would also likely require removal of the Public Recreation Overlay. Possible impacts from future commercial, office or light industrial uses permitted in the C/LI would depend on the type and scale of eventual development. Any type of more intensive development could generate additional traffic and noise impacts, as well as potential loss of recreational and residential land. Given the site's location, the fact that it is publicly -owned and the fact that a Metro lift station is already on the property, development of single - family housing is unlikely even with the current LDR designation. According to Parks Director Bruce Fletcher, the Public Recreation Overlay is not considered to be a significant factor on the site. 3) Is the proposed change the best means for meeting the identified public need? What other options are there for meeting the identified public need? Comprehensive Plan/Zoning Code map changes are the best means for meeting the general public need for expanded use adjacent to the City maintenance facility at the George Long Shops. It might be possible to carry out bus maintenance for the Tukwila School District without making Comprehensive Plan/Zoning Code map changes since this very specific proposed use could be considered a combination of both the school and mass transit facilities that are allowed as conditional and unclassified uses in the LDR zone. This method would be less efficient. 4) Will the proposed change result in a net benefit to the community? If not, what result can be expected and why? The Public Works Department proposes development of services which could benefit the community by consolidating bus maintenance services to be provided for the Tukwila School District. CONCLUSIONS Redesignating the subject parcel from LDR to C /LI will extend the boundary between LDR and C /LI northward by one lot, and eliminate the Public Recreation Overlay (PRO). The resulting expansion of C /LI and the reduction of LDR would make the existing zoning boundary more uniform, while eliminating the potential for housing and/or public recreation on site. The redesignation would enable the City of Tukwila to expand the usable space at the George Long Shops if desired. Depending on how any future development was handled, parking and maintenance operations at the site could be highly visible along Interurban Avenue, as well as from the Foster Golf Links. Comprehensive Plan and zoning issues have been adequately addressed. When development occurs on the site, issues of site design, screening and the relationship of the Interurban Trail to the site will need to be resolved through environmental review and landscape requirements, and depending on the scale of improvements, through the Design Review process. There is the rental "Log House" also on park land on 140th in LDR. Unfortunately all the park lands have been thrown into LDR instead of their own zone. Both are eventually slated to be demo'd or removed. There is no long range plan for the 140th property. That property was purchased with open space funds under the auspices of a river trail linkage but a trail through and active golf course presents a liability. (Known inhouse as another Don William's Land Grab using public funds). The residential land use will go away. Since the proposed S. 154`'' Street stop is the interim terminus of the light rail line and since the commuter rail stop serves the region, each station is likely to draw large numbers of individuals coming from out of the area. Most will come in automobiles, which will remain parked for the day while the owner takes the train or light rail. In addition, busses will transport riders from the S. 154 station to SeaTac airport. Tukwila's Zoning Code provides no specific requirements for parking associated with a Park - and -Ride lot. Chapter 18.56 (Off - Street Parking and Loading Regulations) Section 18.56.100 (Uses not specified) states that the Planning Director has jurisdiction set the requirements for off - street parking facilities foruses (such as Park - and -Ride or high capacity transit stations) not specifically mentioned in the Code. To expand on what is written in the Zoning Code in order to avoid the type of spill -over parking in the neighborhood which has occurred adjacent to Park n' Ride lots, we are seeking a Comprehensive Plan amendment which will specify that parking facilities shall be adequately sized. REVIEW CRITERIA Planning Commission review is required for Comprehensive Plan and Zoning Code amendments. The Planning Commission may recommend approval, recommend approval with conditions or recommend denial of the amendment based on a clear compliance with the criteria which follow. The Planning Commission's recommendation will be forwarded to the City Council, which will make the final decision. 1) Describe how the issue is addressed in the Comprehensive Plan. Goal 13.4 Public Transportation, Transit, Rideshare and Personal Rapid Transit calls for "Efficient transit capacity that will reduce single- occupancy vehicle trips to, from and through Tukwila and provide public transportation for Tukwila residents who depend on it. The need to limit potential impacts associated with regional travel is alluded to in Policy 8.2.1 (Pacific Highway Chapter) which calls to "Mitigate transportation impacts associated with regional travel by the use of extensive amenities, transit service and appropriate siting of new uses, including the highway itself." The possible negative impacts of high- capacity transit stations on adjoining areas is not adequately addressed. We believe that there is a need for an additional policy to address these potential impacts and to specify adequately -sized parking facilities. 2) Impacts The proposed amendment would limit potential negative impacts arising from having inadequate parking for high capacity transit stations. 3) Is the proposed change the best means for meeting the identified public need? What other options are there for meeting the identified public need? We believe that the proposed change is the best means to address the identified public need for adequate parking to service high capacity transit stations. Other possible options would be to: • Rely on Policy 8.2.1 with its general direction to mitigate transportation impacts in the Tukwila International Boulevard corridor through extensive amenities; • Revise design review guidelines to include parking requirements for high capacity transit stations; • Include specific parking requirements addressing high capacity transit in the Tukwila Urban Center (TUC) Plan. • Rely on the Zoning Code (Chapter 18.56, Section 18.56.100 Unspecified Uses) • Deny the request. 4) Will the proposed change result in a net benefit to the community? If not, what result can be expected and why? The proposed changed will benefit the community by ensuring that adequate parking is provided to accommodate demand generated by high capacity transit stations. Neighboring areas will be spared the negative impacts of overflow parking from the station. Police will not be required to ticket violators' cars. The neighborhood will not need to have (and the City will not need to administer) residential "parking zones." CONCLUSIONS The Planning Commission pursuant to Tukwila Municipal Code (TMC) Chapter 2.36.030 hereby makes the following conclusions: Requiring adequate parking facilities will make clear Tukwila's intention that the demand for parking spaces generated by high capacity transit stations will be met on -site, rather than through parking on neighborhood streets, or via unauthorized parking on nearby private property. The Comprehensive Plan contains the broad land use goals and policies that will guide Tukwila for the next 20 years. The Zoning Code carries out the Comprehensive Plan's policies with specific requirements for land development. This year, in addition to Tukwila's regular yearly process, the State of Washington has mandated that all cities also review their Comprehensive Plans to be sure that they are up to date with statewide planning requirements and the Growth Man- agement Act (GMA). The City of Tukwila has submitted one application with several parts. The remaining amendment was proposed by a member of the public. The City is evaluating the feasibility of providing school bus maintenance and associated parking for = w f- the Tukwila School District at the George Long Shops. The existing maintenance facility site is _ z F- inadequate in size to accommodate school bus parking, maneuvering and circulation. The School I— 0 District anticipates the need for a change of maintenance provider during the latter part of 2002. w ul The City owns a parcel of property adjacent to Interurban Avenue South from south 139 Street to v N South 140 Street. The property is bounded on the north by Seattle City Light and on the east by the p H City's Public Works Maintenance Facility (George Long Shop). All of the City's fleet maintenance w w is performed at this facility. King County Metro operates and maintains a sewage lift station in the H v northwesterly corner of the property. u- 0 w z The parcel is approximately 34,650 square feet in area and is zoned Low Density Residential (LDR) c) with a Public Recreation Overlay (PRO). Zoning for properties to the east and south is Commercial p ♦— Light Industrial (C/LI). Zoning for properties to the north, including Foster Golf Course, is LDR Z (PRO). Zoning for properties to the west along Interurban Avenue is Regional Commercial Mixed Use (RCM). The housing nearest the site is an apartment complex located to the north on the westerly side of Interurban Avenue. Single family housing is located several hundred feet westerly of the site beyond the RCM properties. ANALYSIS The current zoning of Parcel 0002800006 does not allow uses that are being contemplated by the City and School District. Rezone of the property to C/LI without PRO would allow land use compatible with the City's maintenance facility operation and long term needs. RECOMMENDATION Add the evaluation of the Comp Plan and Zoning changes of Parcel 0002800006 to the Comprehensive Plan Amendment list for 2002. Short of rezoning the property, an argument could be made that the bus maintenance /parking usage is a combination of both the school and mass transits facilities that are allowed as conditional and unclassified uses respectively. RECOMMENDATION We recommend that senior management address this issue with Community Development before we proceed with awarding the consultant contract. Comprehensive Plan changes for certain transportation issues, sensitive /critical areas and emergency update issues are the only means to incorporate recent requirements of the Growth Management Act and bring Tukwila's Plan into compliance with State regulations. A review of the C/LI and LDR zoning in the vicinity of S. 135 MacAdam and 48 Avenue South was deferred from an earlier amendment process. Transportation - related policies are needed to address the impacts of high capacity light rail development. 3. Why will the proposed changes result in a net benefit to the community? If not, what type of benefit can be expected and why? Revising the Comprehensive Plan to meet State requirements will benefit the community through consistent planning guidelines. A review of the zoning in the vicinity of S 135 and 48 Avenue will be useful in determining if a change is required. Transportation policies relating to high capacity transit will ensure that development impacts will be appropriately addressed. COMPREHENSIVE PLAN AMENDMENT (TMC 18.80.010) In addition to the items discussed below, the City of Tukwila will continue work on other topics related to the Growth Management Act including: 1) the Shoreline Management Program; 2) design guidelines; 3) working with neighboring jurisdictions regarding the Potential Annexation Area; 4) transportation- oriented development, and 5) the Tukwila Urban Center Plan. 1. A detailed statement of what is proposed and why; The City of Tukwila will update its Comprehensive Plan to address two general types of amendments. These include: 1) changes needed in order to be consistent with certain requirements of the Growth Management Act which have been instituted since the Plan was adopted in 1995 and which have not been addressed as yet in yearly amendments; and 2) other needed changes, including a map change and two new transit- oriented policies. The focus of the amendment work will be fulfilling requirements of the State of Washington Growth Management Act. The City of Tukwila will also consider a map change which had been deferred from the a prior amendment cycle (Attachment A), as well as two amendments addressing development associated with and resulting from high capacity transit routing (Attachment B). 2. A statement of the anticipated impacts of the change, including the geographic area affected and the issues presented by the proposed change; Plan amendments will focus on topics in the Comprehensive Plan which require revision in order to comply with recent changes to the Growth Management Act. Issues will include: 1) updating the Sensitive Areas /Critical Areas work to include Best Available Science and to provide an inventory; 2) updating certain transportation- related requirements; and 3) defining "emergency" procedures for amending the Comprehensive Plan. Updating the Sensitive /Critical Areas will ensure that the Best Available Science is incorporated into the regulations and that a complete inventory of sensitive and critical areas is made. Future development projects adjacent to watercourses, wetlands and steep slopes throughout Tukwila will take this information into account. Revising transportation work to meet 2025 transportation projections is a further requirement of the GMA. This will ensure that projects throughout Tukwila are designed with the most accurate traffic information. Tukwila has clear procedures for its annual Comprehensive Plan updates, but lacks a definition of what would constitute an "emergency" for purposes of triggering an "emergency" amendment outside of the standard yearly process. In addition, a map change, suggested by the public in 2000 but deferred until 2002, will also be considered. This proposed change would evaluate Low Density Residential — LDR adjacent to Commercial /Light Industrial —C/LI near MacAdam Road/S. 135 and 48 Avenue S. Two additional policies will be added to further implement Transportation Goal 13.4 (Public Transportation, Transit, Rideshare, and Personal Rapid Transit). These would pertain primarily to development in transportation corridors. 3.An explanation of why the current comprehensive plan or development regulations are deficient or should not continue in effect; The Comprehensive Plan is being updated to reflect all required revisions to the Growth Management Act.
