NOTICE OF DECISION
June 7, 2005
This letter serves as a Notice of Decision and is issued pursuant to TMC 18.104.170. At the June
6, 2005 public hearing, the City Council approved the applicant's Unclassified Use Permit (UUP)
application. The application is for the construction and operation of a sewer lift station in the
Foster Point Neighborhood. The sewer lift station will allow sewer lines to be extended into the
neighborhood.
The City Council approved the application with the following conditions:
1. Prior to issuance of any building permits for the sewer lift station, the applicant shall
submit a noise study, prepared by a qualified professional showing compliance with
Chapter 8.22 "Noise" of the Tukwila Municipal Code.
2. The fence stats placed in the surrounding perimeter chain -link fence shall be green in
color.
The unclassified use permit shall automatically expire one year after the date of issuance of this
Notice of Decision unless a building permit is obtained within the one -year period. Additionally,
the unclassified use permit shall expire two years from the date of this Notice of Decision unless
substantial construction of the lift station has been completed.

No administrative appeal of the City Council Decision is permitted.
Any party wishing to challenge the City Council Decision must file an appeal in King County
Superior Court pursuant to the procedures and time limitations set forth in RCW 36.70C. An
appeal challenging the DNS may be included in such an appeal. If no appeal of the City Council
decision is properly filed in Superior Court within such time limit, the Decision on this permit
will be final.
The public notice sign must be removed from the site by the applicant after the appeal period has
expired.

The City of Tukwila Department of Public Works has submitted an Unclassified Use Permit for
the construction of a sewer lift station at 13361 56 Ave South. The sewer lift station will serve
the Foster Point Neighborhood. Foster Point is currently not served by sanitary sewer, but
instead utilizes septic tanks and drain fields for waste disposal.
Only one person attended the public meeting held on July 14, 2005 per the requirements for a
Type 5 permit (TMC 18.108.050). The attendee was the property owner where the lift station
would be constructed.
The City issued a Determination of Non - Significance (DNS) on June 24, 2004. The DNS
covered the entire sewer extension for the Foster Point Neighborhood.
VICINITY /SITE INFORMATION
Sewer Lift Station Description
Structural
FINDINGS
The lift station will occupy a 10' by 8'5 "concrete pad. The concrete pad will be elevated six
inches off of the ground. The dimensions of the lift station structure are 8'6" by 8'8 ". The lift
station will be 12'6" tall (See Attachment B and C).
The lift station will be constructed primarily of split face CMU walls. The CMU walls will be
tan in color and have a flat finish. Two large steel doors will be located on the south side of the
building.
The roof of the building will be metal and be painted dark brown. The drains for the gutters will
be fern green in color.
The sewer pumps will be located below the surface of the lift station structure. The lift station
structure will be used to house control panels. Adjacent to the structure will be an emergency
generator. The emergency generator and the lift station structure will be enclosed with sound
proofing materials.

Operational
The lift station will be surrounded with a six -foot tall chain -link fence. Plastic slats will be used
within the fence.
The purpose of the lift station is to move sewer waste material from the Foster Point
Neighborhood across the 56 Avenue Bridge and into the main sewer line on Interurban Avenue
South.
The lift station will operate 24 hours a day.
As noted above, the sewer pumps will be located below ground. In the event of power failure
the lift station will include back up generators. The generators conduct automatic tests once a
week for a period 20 -30 minutes. The generator is tested during day light hours and on
weekdays.
The lift station will be equipped with a telemetry device, which will provide feedback to City
staff on the operations of the facility. The device will also notify City staff in the event of lift
station shut down or power failure.
Surrounding Land Uses
CRITERIA FOR UNCLASSIFIED USES (TMC 18.66. 060)
The lift station will be located within an existing residential neighborhood. Existing land uses in
the area are single family in nature (See Attachment A).
City Council approval of an unclassified use application shall be guided by the nine criteria of
the Zoning Code (18.66.060 TMC) and a determination that the project is consistent with
Tukwila plans and regulations (18.100.030 TMC.) The applicant's response to each of the
criteria is attached to this report (Attachment C). The City Council may approve the project as
proposed, establish conditions on the project approval, or deny the project.
1. Where appropriate and feasible, all facilities shall be undergrounded.
All mechanical portions of the lift station have been located underground. Only the control
panels and backup generator have been located above ground. The panels and generator will be
totally enclosed within a structure. Additionally, a fence will be used to prevent intrusion into
the site by the public.
2. The proposed use will not be materially detrimental to the public welfare or
injurious to the property or improvements in the vicinity.
The proposed lift station will allow the Foster Point Neighborhood to be served by sanitary
sewer. Existing homes in Foster Point are currently served by septic tanks. The presence of
sanitary sewer in Foster Point will allow existing homes that currently use septic tanks to

There are two possible negative impacts associated with this project:
1) Noise
2) Surcharging of domestic sewage
gradually connect to sanitary sewer. These septic tanks and associated drain fields will be
abandoned per Seattle/King County Health requirements.
As noted the lift station will be equipped with pumps and a backup generator. To minimize
noise impacts the pumps will be located below ground and the entire structure will be
surrounded with a noise - damping buffer.
The risk of surcharging of domestic sewage has been minimized by providing power redundancy
(back up generator) and telemetry to provide notification to City staff of mechanical issues.
3. The proposed use shall meet or exceed the same standards for parking, landscaping,
yards and other development regulations that are required in the district it will
occupy.
The lift station will meet the setbacks of the LDR District. Additionally, the lift station structure
is below the maximum height limitation for structures located within the LDR zone. The use
will not generate a measurable increase in traffic in the Foster Point Neighborhood. The
applicant has provided one parking stall for when City staff services the facility.
4. The proposed development shall be compatible generally with the surrounding land
uses.
The proposed use will provide domestic sewer service to an existing City neighborhood. Work
on the site will be limited to sporadic maintenance activities. The design of the pump station
structure is similar to surrounding single- family homes.
5. The proposed development shall to the maximum extent feasible be consistent with
and promote the goals, objectives, and policies of the Comprehensive Land Use
Policy Plan and applicable adopted area plans.
The construction of the lift station is consistent with the following two policies of the City's
Comprehensive Plan:
Policy 12.1.22 Design, construction and maintain facilities so as to minimize their impact
on adjacent neighborhoods and businesses.
The implementation method for this policy of the Comprehensive Plan is the use of public input
on siting of these facilities. Planning Staff held a public open house on July 14, 2004.
Additionally, Public Works (the applicant) held three public meetings and open houses during

the design stage of the Foster /Allentown Sewer Extension Project. These meetings were held on
February 12, 2004, October 27, 2004, and April 21, 2005.
The applicant has designed the project with noise dampers to minimize any noise conflicts for
surrounding residential uses.
Policy 12.1.25 Serve all existing and potential residences and businesses with sewer
utility.
The construction of the sewer lift station will allow the Foster Point Neighborhood to be served
by sewer, thus meeting the City Comprehensive plan requirement of providing sewers.
6. The proposed unclassified use shall, to the maximum extent feasible, mitigate all
significant adverse environmental impacts on public and private properties. Full
consideration shall be given to:
a. alternative locations and /or routes that reduce or eliminate adverse impact;
&
b. alternative designs that reduce or eliminate adverse impacts.
All possible locations for the sewer lift station are within the Foster Point Neighborhood.
Alterative locations are constrained by service area, topography, the location of the Duwamish
River, and development costs.
There is no alternative design that would further minimize the potential negative impacts.
7. In the event that a proposed essential public facility creates an unavoidable
significant adverse environmental or economic impact on the community,
compensatory mitigation shall be required. Compensatory mitigation shall include
public amenities, incentives or other public benefits that offset otherwise
unmitigated adverse impacts of the essential public facility. Where appropriate,
compensatory mitigation shall be provided as close to the affected area as possible.
The proposal is not an essential public facility of countywide or statewide nature.
8. For uses in residential areas, applicants shall demonstrate that there is no reasonable
nonresidential alternative site for the use.
The purpose of the sewer lift station is to provide sewer to an existing residential neighborhood.
All possible locations for the sewer lift station are within the residential neighborhood. The
topography and location of the river channel precludes an alternate site for the lift station outside
of the neighborhood.
9. For uses in residential areas, applicants shall demonstrate that the use provides some
tangible benefit for the neighborhood.

The sewer lift station will allow sewer to operate in a section of the City that is not currently
served by sewer. Septic tanks with drain fields are currently utilized in the neighborhood for
disposal of domestic sewage. The use of septic tanks severely limits the prospect of these
properties short platting in the future.
CONCLUSIONS
Conclusions regarding the unclassified use criteria, Section 18.66.060 TMC, are as follows.
(1) Where appropriate and feasible all facilities shall be undergrounded.
The applicant has placed underground those items capable of being put underground. Only the
control panel, generator, and pump house have been placed above ground.
(2) The proposed use will not be materially detrimental to the public welfare or
injurious to the property or improvement in the vicinity.
The applicant has mitigated possible negative impacts of the proposal by providing backup
power and by providing noise dampers. Staff has added one condition to address any possible
noise impacts associated with the project.
(3)
The proposed use shall meet or exceed the same standards for parking, landscaping,
yards and other development regulations that are required in the district it will
occupy.
The project meets all applicable design standards for the LDR zone.
(4) The proposed development shall be compatible generally with the surrounding land
uses.
The use of a pitched roof and earth tone colors allows the sewer lift station to blend into the
existing residential neighborhood. Staff has provided a condition to insure that the fence slats
match the colors of the building.
(5)
The proposed development shall to the maximum extent feasible be consistent with
and promote the goals objective and policies of the Comprehensive Land use Policy
Plan and applicable adopted area plans.
The lift station allows the City to meet a Comprehensive Plan Goal of providing sewer to all
residents in the City.
(6) The proposed unclassified use shall to the maximum extent feasible mitigate all
significant adverse environmental impacts on public and private properties. Full
consideration shall be given to:
a. alternative locations and /or routes that reduce or eliminate adverse impact; &
b. alternative designs that reduce or eliminate adverse impacts.

The applicant has provided noise buffers to reduce noise generated from the site. The testing of
the generator during the weekdays will reduce possible conflicts with surrounding residents. The
applicant has provided redundancy to ensure that in the event of pump failure or power failure
there will not be an adverse impact to surrounding uses.
In the event that a proposed essential public facility creates an unavoidable
significant adverse environmental or economic impact on the community,
compensatory mitigation shall be required. Compensatory mitigation shall include
public amenities, incentives or other public benefits that offset otherwise
unmitigated adverse impacts of the essential public facility. Where appropriate,
compensatory mitigation shall be provided as close to the affected area as possible.
The proposal is not an essential public facility of countywide or statewide nature.
8. For uses in residential areas, applicants shall demonstrate that there is no reasonable
nonresidential alternative site for the use.
In order to provide sewer to the Foster Point Neighborhood the sewer lift station must be located
within the residential neighborhood.
9. For uses in residential areas, applicants shall demonstrate that the use provides some
tangible benefit for the neighborhood.
The proposed use will likely provide the following tangible benefits:
1. Increase property values
2. Allow existing homes to expand
3. Allow for existing lots to be platted (divided) into additional lots
4. Reduce environment impacts associated with septic systems
RECOMMENDATIONS
Staff recommends that the City Council adopt the findings and conclusions of the staff report and
approve an unclassified use permit for a sewer lift station at 13361 56 Ave South with the
following conditions:
1. Prior to issuance of any building permits for the sewer lift station, the applicant shall
submit a noise study, prepared by a qualified professional showing compliance with
Chapter 8.22 "Noise" of the Tukwila Municipal Code.
2. The fence slats placed in the surrounding perimeter chain -link fence shall be green in
color.
Unclassified Use Permits are valid for one year from the date of approval by the City Council
(TMC 18.66.070).

Noise Variance Request
Dear Mr. Cusick:

The Department of Community Development received your letter requesting that the
condition placed on the Unclassified Use Permit regarding compliance with noise
requirements be waived.
In reviewing the documents that were submitted to the Department for approval of the lift
station, it was clearly stated that proper measures would be taken to insure compliance with
the City's noise regulations. Your plan sheets noted that the generator would be made by
Onan, Kohler, or Caterpillar with a hospital grade exhaust silencer. It was also noted that
that with this enclosure the average sound would not exceed 45 dBA at a distance of seven
meters (23.1 feet).
Staff processed your SEPA and Unclassified use application under the understanding that
you could meet the City's noise regulations. The condition placed on the Unclassified use
permit was for you to simply provide documentation demonstrating that the statements that

As is clearly noted in the "Foster Point Generator Noise Study," prepared by JGL Acoustics,
Inc, dated July 22, 2005 the project as currently designed will not be able to comply with
code:
"The bottom line is this: it is impossible to meet the Tukwila noise ordinance sound levels
with your current site plan, because the boundary of the easement is too close to the
proposed generator".

Staff has explored the possibility of issuing a variance for the lift station project. However,
in reviewing Tukwila Municipal Code (TMC) 8.22.170, none of the three types of variances
would apply to this project. Additionally, the JGL Acoustics noise report clearly notes that
there are options that are available to reduce the noise from the lift station.
It appears that your options are as follows:
1. Obtain more easement area for the lift station so that the lift station can comply with
the noise standards at the easement lines. This would not require any changes to the
SEPA application or the Unclassified Use permit.
2. Redesign the noise enclosure to meet the 58 -dBA level at the chain link fence. As
noted in the JGL Acoustic Noise Report this does not meet the noise ordinance at the
property line, but it is well below the ambient noise level at the nearest homes (4).
Any redesign of the facility will require review by Planning staff and depending on the
change in design it may have to go back to City Council for review and approval. The
SEPA application will also have to be amended to reflect the change in noise levels.
DCD is here to assist you with this project. Any plans that are submitted for the project
need to reflect the actual construction project. DCD staff is simply asking you to comply
with the plans that you gave the Department to review. All projects in the City, both public
and private must be able to meet the City development standards. Public projects should
lead by their example in meeting or exceeding city standards.

PROJECT INFORMATION
City of Tukwila Public Works Department has filed an Unclassified Use Permit
Application for the construction and operation of a sewer lift station at 13361 56
Avenue South. The lift station will be approximately 120 square feet in size and will not
exceed 10 feet in height. A 14 -foot pole will be attached to the building. An emergency
back up generator will be onsite to be used as a back up in the even of a power outage.
The property is located in the NW 1 /4 section 14, Township 23W, Range 4E., in the
Foster Point Neighborhood.
You are invited to comment on the project in writing before the meeting or at a public
hearing scheduled for June 6, 2005 at 7:00 PM before the City Council. The hearing will
take place at City Hall in City Council Chambers, 6200 Southcenter Blvd. To confirm the
time and date before the hearing, call the Department of Community Development at 206-

The City of Tukwila Public Works Department, has conducted a noise study for the generator
proposed for the Foster Point Lift Station as required by City Council action on June 7, 2005.
The study done by JGL Acoustics, Inc. indicates that the proposed 25 KW diesel generator will
not be able to meet the noise level of 45 dBA at a distance of 7 meters from the generator with
a standard sound reduction enclosure.
The noise study also indicates the ambient noise level at the proposed project site is an average
level of 60 dBA due to noise from Interurban Avenue South and I -5. When a jet aircraft
passes over the site, the noise level jumps to 90 dBA.
With high ambient noise levels, the Tukwila Public Works Department is requesting a variance
to the City of Tukwila Noise Ordinance Section 8.22.150.4 of Title 8 which limits the noise
from the generator to 45 dBA at 7 meters during the test running of the generator.
The Public Works Department is requesting a noise level of 55 dBA at 7 meters for the
generator as reasonable sound level from the area due to high ambient noise level per the
recommendation of our consultant.

This report presents the results of an acoustical analysis for the proposed generator
serving Lift Station No. 8 near the intersection of Interurban Avenue and 56 Avenue
South in Tukwila, WA. This work was authorized by the City of Tukwila on 6/15/05
through Purchase Order No. PWE32004. The purpose of the noise study is to evaluate
the potential noise impact of the standby generator on the adjacent residential properties.
This study does not address the issue of noise generated by other equipment associated
with the lift station.
Description of the Site and the Equipment
RCOOSTICS.IOC.
The proposed unit is a 25 kW diesel generator set with a subbase fuel tank. The current
design (based on the site plan drawing on C3.01) is to mount the generator on a 3 -inch
thick concrete housekeeping pad that is 3 feet wide and 10 feet long in the northeast
corner of the easement. One end of the generator will be 5 feet from the north end of the
chain link fence that borders the equipment site, and one side of the generator will be 7.5
feet from the chain link fence on the east side of the easement.
The preliminary specifications call for the generator to be manufactured by Onan, Kohler,
or Caterpillar. In addition, the generator is to be provided with a sound reduction
enclosure with a hospital grade exhaust silencer. The specifications further state that the
enclosure shall be sufficient to ensure, that the average sound pressure level does not
exceed 45 dBA at a distance of 7 meters from the center of the generator. I have checked
with the local representatives for both Onan and Kohler, and both manufacturers offer
sound reduction enclosures for their generators. However, none of the standard sound
reduction packages can come close to meeting the specified noise level. The sound

enclosure for the Kohler genset can achieve a noise level of 74 dBA at a distance of 7
meters. Cummins offers three different grades of sound reduction enclosures for their 25
kW machines, and the noise levels range from 73 dBA down to 64 dBA at 7 meters.
However, both manufacturers have experience working with custom enclosure
fabrication companies to achieve lower sound levels, if required.
Tukwila Noise Ordinance
The Tukwila noise ordinance exempts noise from emergency generators in Section
8.22.150.4 of Title 8 — Public Peace, Morals and Safety. This section of the noise
ordinance exempts (at all times during the day or night) "Sounds created by emergency
equipment and emergency work necessary in the interests of law enforcement or the
health, safety or welfare of the community ". Based on this statement, if the use of the
generator is to prevent a health hazard during a power failure, the noise associated with
the unit would be exempt from the noise ordinance sound level limits. However, the
noise from the generator would not be exempt during routing testing of the generator.
The maximum allowable noise level on adjacent residential property is 55 dBA during
the day and 45 dBA at night (between 10 PM and 7 AM). Because the nighttime noise
limit is a much lower sound level, all testing should be done during the daytime hours.
Site Conditions and Existing Noise Levels
The lift station site is located on an easement in the southeast corner of the private
property owned by Gerald Wheaton at 13361 56 Avenue South. The south side of the
easement borders 56 Avenue South. The north and west sides of the easement border
the Gerald Wheaton property, and the east side of the easement borders a neighboring
property (homeowner is unknown). Photo 1 shows both homes and the location of the
future lift station. There are also two property owners on the south side of 56 Avenue
South that may be impacted by the generator noise.
Ambient noise measurements were conducted at the site on June 21, 2005, and the results
are presented graphically in Figure 1. The background noise at this location is controlled
by traffic on Interstate 5 and Interurban Avenue. As you can see from Figure 1, the noise
level is relatively steady, except when a jet flew over the site, with a time - average (Leq)
sound pressure level of 60 dBA. The maximum sound level of the jet was 90 dBA.
Based on this information, it would seem reasonable to strive for an equipment noise
level of 55 dBA. This would meet the requirements of the Tukwila noise ordinance, and
it would not cause a noticeable increase in the background noise level from the nearby
highways.

Predicted Noise Levels
ACOUSTIC 5.10C.
The noise level of the generator will depend upon the actual unit selected and the location
of the listener. The generator with the lowest sound level (for a factory provided sound
reduction package) is the Cummins 25DKAF Quiet Site II Second Stage. The noise level
from this generator is between 61 and 64 dBA at 7 meters, depending upon the direction
to the listener. The expected noise level at the chain link fence (both the north and east
ith this machine will be 75 dBA. This is 20 dBA above the noise ordinance and
bove the daytime ambient noise level. I do not have exact distances from the
tor to the nearest homes, but from the photo it appears to be at least 50 feet. The
Cummins 25DKAF Quiet Site II Second Stage generator noise level at a distance of 50
feet is 55 dBA, which meets the noise ordinance requirements.
If the Kohler unit is selected, the noise level at the nearest property line (the chain link
fence) will be 87 dBA on the north side and 80 dBA on the east side. The Kohler
generator noise level at 50 feet will be 63 dBA, which is not only above the noise
ordinance limit of 55 dBA, it is also above the average daytime background noise level in
the area.
As I mentioned earlier in this report, both Kohler and Cummins can provide generators
with even lower sound levels, but this requires a custom design. On one recent project,
Cummins teamed up with a company named AlumTek in Aldergrove, British Columbia
to fabricate a 35 kW generator to achieve a sound level of 45 dBA at 23 feet. These
ultra -quiet generators are much more expensive and are physically much larger than the
standard generator sets. For example, the ultra -quiet 35 kW generator occupied a
footprint of 14 feet long by 10 feet wide with an overall height of nearly 9 feet. In
comparison, the standard Cummins 25 kW generator is 67 inches long and 31 inches
wide, and the Cummins 25DKAF Quiet Site II Second Stage genset is 84.4 inches - long,
31 inches wide, and 5 feet tall.
Your current generator specification calls for a sound level of 45 dBA at a distance of 7
meters (or 23 feet), but the design drawings do not show adequate space to accommodate
a generator that can meet this acoustical requirement. If you were to modify the site to
allow for space to accommodate the quieter generator, you could expect to achieve a
noise level of 58 dBA at the chain link fence (assuming that the chain link fence is 5 feet
from the unit) and 38 dBA at a distance of 50 feet. This still does not meet the noise
ordinance at the property line (chain link fence), but it is well below the ambient noise
level at the nearest homes.

Summary
The following table summarizes your options regarding the generator noise on this
project. The noise levels presented in this table are only applicable to the best sound
control package that is available from that manufacturer. Noise levels from standard
outdoor weather packages will be significantly higher. The bottom line is this: it is
impossible to meet the Tukwila noise ordinance sound levels with your current site plan,
because the boundary of the easement is too close to the proposed generator. You could
meet the noise ordinance using a custom enclosure, but it would require a significant
increase in the area of the easement.

You can achieve a generator noise level that is below the existing average daytime
ambient noise level at all points beyond 50 feet from the center of the generator pad
(without increasing the size of the easement) if you install the Cummins 25DKAF
generator with Quiet Site Stage II sound enclosure, but you will exceed the noise
ordinance at all points less than 50 feet from the unit.

City of Tukwila Public Works
Foster Point Neighborhood Improvements
The City of Tukwila Public Works Department is proposing to replace all substandard water
lines, install new sewer lines and construct a sewer lift station in the Foster Point Neighborhood.
After the sewer and water lines are completed, new pavement will be installed in areas disturbed
by the project. Additionally portions of Pamela Drive, which is unimproved City right of way
will be improved to City standards.
Generally, the project is located in the northwest quarter of Section 14, Township 23 north,
Range 4 east, and the southwest quarter of Section 11, Township 23 north, Range 4 east, WM, in
King County. Adjacent subdivisions include Duwamish Terrace, Riverside Park, East Riverton
Garden Tracts 2 Addition, and the Allentown Addition.
The project is located in the Foster Point Neighborhood, between and including Interurban
Avenue South and South 130 Place. Work will primarily occur in the rights of way of 56 and
57 Avenue South, South 133 Street, South 130 Place and Pamela Drive. Outside of
dedicated rights of way, a sewer lift station will be installed north of 56 Avenue South in the
vicinity of the bridge. A water line will also be installed in the South 130th Avenue and 50
Place South, north and west of the Foster Point neighborhood.

The project area is generally flat with the steepest work area having a slope of two
percent. Some of the slopes along the River have a slope in excess of 100 percent. The
River bank will not be disturbed as part of this project.
A Geotechnical report, prepared by Geo Engineers, dated March 4, 2002, found that
native soils consisted of brown fine to medium sand and sand with silt. Native soils were
encountered at a depth of 13 inches. These soils were underneath four inches of asphalt
and nine inches of base course subgrade.
Grading will occur as a result of street improvements that will be made during this
project. Structural fill may be required to be brought in as back fill for new pavement, in
excavated trenches, and as a base for the new lift station.
As with any construction activity there is a chance for erosion. Per City regulations an
erosion control plan will have to be prepared and approved by the City. During
construction BMPs will be employed to reduce any erosion from the project.
An additional 14,357 square feet of impervious surface will be added as a result of this
project. The new surface will be a result of finishing Pamela Drive and the pad for the
new lift station.
Some emissions from construction vehicles will occur during the construction period.
Suspended particles from dust emissions will occur during construction activities.

Areas of the proposal due lie within the 100 -year floodplain.

A diesel powered emergency generator will be used at the lift station during periods of
power failure. The use of the generator will be temporary and on a limited basis.
Site watering and other measures will be utilized during construction to reduce
construction dust. The emergency generator will meet all regulations of the Puget Sound
Air Quality Agency.
The Duwamish River surrounds the Foster Point Neighborhood to the north, south, and
west. There will be work within the 200 feet of the ordinary high water mark. A four -
inch sanitary sewer force main will cross the Duwamish River beneath the pedestrian
portion of the existing 56 Avenue South Bridge.
The existing site conditions allow for the water from the paved streets to flow directly
into the river. As part of this project, catch basins will be installed which will divert the
current run -off of water within the neighborhood.
It is important to note, that existing water run -off into the River is untreated and contains
materials from City streets.
The geo- technical report noted that ground water would likely be encountered during
excavation activities. Trenches will be dewatered during construction and pumped away
from the construction area. The dewatering will only occur during construction activities.
When the project is completed, water run -off will be collected by catch basins and flow
to existing outfalls.
Vegetation in the area includes deciduous trees, evergreen trees, shrubs, wet soil plants,
and water plants.
Since most of the project will be within the City of Tukwila's right of way, very little
vegetation will be removed during construction activities. Native vegetation will be
installed in those areas disturbed within 200 -feet of the shoreline.
The Foster Point Neighborhood is largely developed with single - family homes. Animals
found in the area are typical of urban environments, such as small mammals and birds.
The Duwamish River is home to a variety of fish species, including salmon.

• Energy/Natural Resources
Construction activities will use gasoline and diesel internal combustion engines.
Electricity will be used to operate the sewer lift station and a diesel - powered generator
will be used in the event of power failure.
• Environmental Health
Noise generated by construction equipment will occur on a short-term basis. The project
is located in a residential neighborhood and the contractor will have to comply with the
City's noise standards.
Power failure could result in the discharge of effluent from the lift station. This risk will
be reduced by providing secondary power supply and telemetry to provide early
notification of potential problems.
The lift station will produce a low hum when in operation. Noise from the lift station
operation should be negligible since most of the lift station will be located under ground.
The emergency generator is exempted from noise regulations when operating in an
emergency situation. However, the generator must meet noise regulations when it is
tested. As the sending property is residential and the nearest receiving property is
residential, the generator is not permitted to create a sound in excess of 55 dB(A),
measured at the receiving property.
• Land /Shoreline Use
Most of the project area is zoned LDR. A small area, near Interurban Avenue is zoned
Commercial/Light Industrial.
Portions of the project will be within 200 -feet of the Duwamish River. The sewer line
will also extend over the existing 56 Avenue Bridge. The shoreline is classified as
Urban and is governed under the City's Shoreline Regulation. The applicant has
submitted for a Shoreline Permit.
Portions of the project will lie within the 100- year floodplain. The applicant will be
required to obtain a Flood Control Permit from the pity.
• Housing

No housing is proposed nor will any residential structures be removed. The presence of
sewer lines in the area will likely generate additional platting and construction of new
houses in the area.

• Aesthetics
The only part of this project that will be above grade is the sewer lift station. The lift
station will be 10 feet in height and a 14 -foot telemetry pole will be attached to the roof.
The building will meet all applicable development regulations for height and setback.
Additional design standards can be imposed through the Unclassified Use Permit.
• Light and Glare
There will be a small light located at the lift station. This light will be shielded and face
downward and should not have any impacts on surrounding properties.
• Recreation
The site is located near the Duwamish River and there is a small passive park located off
of Pamela Drive. Foster Golf Course is located to the southeast.
• Historic and Cultural Preservation
No known places or landmarks exist within the project area. The banks of the Duwamish
River were utilized by Native Americans thus there is a small chance that some artifacts
may be unearthed.
The Public Works Department will have an archeologist on site during the excavation of
the lift station.
The City did receive two comment letters, one from the State of Office of Archeology
and Historic Preservation and one from the Muckleshoot Indian Tribe. The City did offer
an invitation to the Muckleshoot Tribe to send a tribal monitor during excavation
activities.
As with any construction activities if any landmarks or evident of historical,
archaeological, scientific, or cultural importance are found on the site, work will stop
immediately and the contractor will notify the City of Tukwila, Washington State Office
of Archeology, and the Muckleshoot Indian Tribe.
• Transportation
During construction there will be an impact to individuals who live in the Foster Point
Neighborhood. This will include road closures, brief closure of the 56 Avenue Bridge,
and removal of the street pavement. The roads in the neighborhood will be restored to
pre - project condition.
A parking stall will be provided on site for maintenance and repair of the lift station. The
lift station will generate approximately one vehicular trip per week.

This project involves the upgrade and installation of sanitary sewer and new water lines
within the Foster Point Neighborhood.
Sanitary waste disposal is currently done through septic systems. Houses in the
neighborhood will be required to connect to sewer if one of the following occurs:

• The property is conveyed to another person
• The existing septic systems fails
• A short plat or subdivision
Determination of Non - Significance
Note: There was an additional comment letter that was sent by property owners in the Foster
Point Neighborhood. The issues raised by the letter were not environmentally focused.
The City will respond to the letter, but issuance of a Threshold Determination should not
be put on hold pending the City's response.
UNCLASSIFIED USE PERMIT REVIEW CRITERIA
City Council approval of an Unclassified Use Application is based on nine (9) criteria (TMC
18.66.060) and a determination that the project is consistent with the Tukwila Comprehensive Plan
(TMC 18.100.030). The City Council may approve the project as proposed, establish conditions on
the project approval, or deny the project.
Please discuss development consistency with the nine (9) decision criteria presented below. Use
additional pages as needed. Please consult the Comprehensive Plan for policies related to your
development. Note that more than one category of policies may apply.
Proposal..
As part of the Foster Point Utility Improvement proposal, a sanitary sewer lift station will be
installed east of the 56 Avenue bridge in the Low Density Residential (LDR) Zone. Sewer lift
stations are listed as an unclassified use in the LDR Zone. Unclassified Use Permits require
demonstration of consistency with the following criteria.
CRITERIA FOR UNCLASSIFIED USES (TMC 18.66.060)
1) • When appropriate and feasible, all facilities shall be undeigmunded.
The mechanical elements of the proposed lift station will be underground. Appurtenant facilities,
such as control panels, will be housed in a 10 foot square building. A back -up generator will be
housed in a second structure of approximate dimensions 3.5 feet by 10 feet. The facilities will be
located on an asphalt pad of about 30 feet by 40 feet.
2) The proposed use will not be materially detrimental to the public welfare or injurious to the property or
improvements in the vicinity.
Minor noise impacts may be associated with the pumps, when in operation. These impacts will be
limited due to the underground location of the pumps. On rare occasions of electrical power failure,
and during maintenance periods requiring operation of the generator, noise impacts will be greater.
The above - ground structures housing the appurtenant facilities will be surrounded by a noise -
damping barrier to mitigate potential impacts. To ensure that the potential for surcharging is
minimized, the facility will include a generator for power source redundancy and telemetry to
provide notification of mechanical issues.
3. The proposed use shall meet or exceed the same standards forparking, landscaping yards and other development
regulations that are required in the district it will occupy.
All structures will meet the parking, landscaping, setbacks, and height and requirements of the LDR
Zone.
4. The proposed development shall be compatible generally with the surrounding land uses.
The proposed use will be compatible with the surrounding single family neighborhood. The above-
ground elements of the lift station will be comparable in scale to single family accessory structures.
Activities on the site will be limited to facilities maintenance.

5. The proposed development shall to the maximum extent feasible be consistent with and promote the goals,
objectives, and policies of the Comprehensive Land Use Polity Plan and adopted arra plans.
The proposal is consistent with the goals, objectives and policies of the Comprehensive Plan. The
following policies are most applicable to the proposed lift station.
Polity 12.1.22 Design, construct, and maintain facilities so as to minimize their impact on adjacent
neighborhoods and businesses.
Polio 12.1.25 Serve all existing and potential residences and businesses with a sewer utility.
6. The proposed unclassified use shall, to the maximum extent fiasible, mitigate all significant adverse environmental
impacts on public and private properties. Full consideration shall be given to:
a. alternative locations andl or routes that reduce or eliminate adverse impacts; and
b. alternative designs that reduce or eliminate adverse impacts.
Impacts from the proposed facility are anticipated to be minimal. Potential locations for the
proposed facility are largely constrained by the service area, topography, the location of the river,
and development costs. All potential sites are within the single family neighborhood. Design of the
facility is largely defined by its function, and will be consistent with City of Tukwila standards for lift
stations. Potential impacts will largely be auditory. The pump facility will be underground, although
appurtenant electrical and control facilities will be housed in surface structures. The above - ground
facilities may produce low -level noise impacts, as part of normal operations. In the event of an
electrical power failure, the generator would produce higher levels of noise impact, although this
would be mitigated by the sound barrier proposed to surround the facility.
7. In the event that a proposed essential public faciliry of a countrywide or statewide nature creates an unavoidable
significant adverse environmental or economic impact on the communi compensatory mitigation shall be required.
Compensatory mitigation shall include public amenities, incentives or other public benefits which offset otherwise
unmitigated adverse impacts of the essential publicfadliry. Where appropriate, compensatory mitigation shall be
provided as dose to the a area as possible.
The proposal does not include essential public facilities of a countywide or statewide nature.
8. For uses in residential areas, applicants shall demonstrate that there is no reasonable alternative site for the use.
The area to be served is zoned for and contains residential uses. The topography and location of the
river channel preclude an alternate site for the lift station outside of the LDR Zone.
9. For uses in residential areas, applicants shall demonstrate the use provides some tangible bereft for the
neighborhood
The proposed lift station is necessary to provide sanitary sewer service to the Foster Point
neighborhood. Sewers will provide a tangible benefit to the property owners.

CRITERIA FOR PROJECTS SUBJECT TO THE CITY OF TUKWILA SHORELINE
REGULATIONS
The proposal is to install sanitary sewers, replace water lines, add catch basins to the existing
stormwater system, relocate an existing stormwater line, replace an existing stormwater line, and
reconstruct a quarry spall energy dissipater at an existing surface water outfall, primarily within
existing rights of way in the Foster Point neighborhood. The project would also include street
improvements to Pamela Drive, which is dedicated but currently unimproved. Installation of a
sewage lift station is also proposed, although this facility will be outside of the shoreline overlay
district. Work and proposed facilities within the shoreline overlay district will occur in the river, low
impact and high impact environments. The areas west of the Duwamish River are regulated
according to standards and policies of the Tukwila Shoreline Master Program. To the east of the
river, the King County Shoreline Management Program applies.
General Shoreline Regulations (TMC 18.44.110)
All uses within the shoreline overlay district must conform to the followinggeneral regulations:
1) The use is in conformance with the regulations of the underlying one district:
The project area is zoned Low Density Residential (LDR) and Commercial /Light Industrial (C /LI).
The proposed utility mains and catch basins are not identified in as regulated uses in either zone.
They are presumed to be similar to and compatible with uses allowed in both zones. The proposed
improvements support the type and intensity of development identified for the LDR Zone. In the
C /LI Zone, proposed improvements are limited to a length of the sanitary sewer force main
necessary to transmit sewage to the City's sewer system.
2) The use does not conflict with thegoals and policies of the Shoreline Master Program or the provisions of the
Shoreline Act and shoreline regulations.
The proposed improvements conform to the shoreline policies and regulations of both the City of
Tukwila and King County, as well as the provisions of the Shoreline Management Act. The portion
of the project area within the Tukwila Shoreline Master Program area of applicability is designated
Urban environment. The City of Tukwila Comprehensive Plan designates the subject shoreline
areas as Urban -Open Space environment.
The proposed infrastructure replacement, installation and upgrades will encourage development as
envisioned in the Tukwila's Comprehensive Plan for the Foster Point neighborhood. The
improvements are also intended to reduce existing potential septic system impacts and minimize
future development impacts to the shoreline and river habitats.
18.44.130 — TMC - River Environment. Within the river environment, an existing stormwater
outfall extending from the South 133` Street right -of -way will be replaced due to poor structural
condition. The stormwater line will be replaced as maintenance at the same size, slope and
alignment. Riprap along the shoreline at the outfall will be salvaged and replaced following
replacement of the outfall line. Additional quarry spalls of 16- inches to 24- inches will be placed at
the outfall to achieve the existing riprap elevation. The riprap serves as an energy dissipater to
reduce the erosive affects of surface water entering the river. The stormwater line is allowed under
the specific shoreline regulations as support facilities for pollution control. Diking is allowed for
erosion control.

Also within the River Environment, a water line will be installed in 130 Place South and South 50t
Place, extending north and west from the Foster Point neighborhood to the Allentown Addition
neighborhood. Construction will occur within 25 feet of the river bank, but within a paved right -of-
way.
A sanitary sewer force main is proposed to pass through the River Environment within the
improved right -of -way of the 56 Avenue South bridge. South of the bridge, a portion of the work
will occur outside of the improved right of way at the outer edge of the River Environment, where
the force main alignment leaves the 56t Avenue South right -of -way through an improved public
area before extending into the Low Impact Environment and northwest to the existing manhole.
18.44.140 TMC - Low Impact Environment. Some of the proposed utility improvements would
occur in the low impact environment within improved and unimproved existing rights of way,
within and northwest and southwest of the Foster Point neighborhood. Utilities are an allowed use
in these areas. A small portion of the Pamela Drive street improvements may occur within the low
impact environment. Public roads are a permitted use in the low impact environment.
18.44.150 TMC - High Impact Environment. Portions of the utility improvements are proposed for
development in the high impact environment. These improvements will include mains in rights -of-
way. All uses allowed in the underlying zoning are allowed in the high impact environment.
3. No structures or accessory facilities shall be located over the river, unless such structure protects or promotes the
public interest.
A sewer force main is proposed to be installed over the river, attached to the 56t Avenue South
bridge structure. The main will convey sewage to the west, making sanitary sewer service available
to the Foster Point neighborhood. This promotes the public interest by removing the need for
septic systems in close proximity to the river.
4. There shall be no disruption of existing trees or vegetation within the river environment, unless necessary for public
safety or flood control, or if allowed as part of an approved Shoreline Substantial Development Permit.
The application requires a Shoreline Substantial Development Permit. Within the river
environment, the only area where vegetation may be disrupted is in the vicinity of the replacement
stormwater outfall line extending from the South 133" Street right of way and the quarry spall
energy dissipater at its terminus. Landscape restoration is proposed along the river to include a
mixture of riparian trees, shrubs and groundcover.
S. No effluents shall be discharged into the Green River which exceeds the water quality classification as established
by the State for the adjacent portion of the river.
Surface water, collected in catch basins throughout the Foster Point neighborhood, will be
discharged to the river via three existing outfalls. Water quality will be consistent with established
State classifications for the adjacent portion of the river.
6. All State and Federal water quality regulations shall be strictly complied with.
State and federal water quality regulations shall be met under the proposal.

7. Wildlife habitat in and along the river should be protected.
Disturbance of wildlife habitat will be limited to the minimum necessary to make the infrastructure
improvements. Any disturbed areas will be replanted with native vegetation following construction
activities.
8. All perimeters of landfills or other land forms susceptible to erosion shall be provided with vegetation, retaining
walls or other satisfactory mechanisms for erosion prevention.
No landfills are proposed as part of this application. Excavation and replacement of about 113
cubic yards of material will occur as part of the replacement of the outfall extending from South
133r Street. Riprap will be removed from the shoreline for replacement of the stormwater outfall
and be replaced, with supplemental material as necessary, to the original elevation.
9. All necessary permits shall be obtained from Federal, State, County or Municipal agencies.
All necessary permits have been applied for or obtained from federal, state, county and municipal
agencies.
10. Dredging for purposes other than for navigational improvements or flood control is prohibited.
No dredging is proposed as part of this application.
11. Mining is prohibited along the river shoreline.
No mining is proposed as part of this application.
12. Solid waste disposal is prohibited along the river shoreline.
No solid waste disposal is proposed as part of this application.
13. No property will be acquired forpublic use without dedication by orjust compensation to the owner.
Improvements will primarily occur within existing public rights of way. Land for the proposed
sewer lift station will be purchased by the City.
14. Landfilling is prohibited within the river channel unless such landfill is determined by the Planning Commission
to pmtect orpmmote the public interest.
No landfilling within the river channel is proposed as part of this application. Riprap will be placed
along the shoreline at the outfall proposed for replacement consistent with the existing condition.
15. Notwithstanding any provisions of this Code to the contrary, removal of any cottonwood tree within the river
environment or the low impact environment, which tree is 12 inches orgreater in diameter as measured 4.5 feet above
grade, shall be subject to the requirements of TMC Chapter 18.54, Tree Regulations.
According to TMC Section 18.54.050, construction and maintenance of streets and utilities within
City- approved rights -of -way and easements is exempt from the application of TMC Chapter 18.54
and does not require a Tree Clearing Permit. In the shoreline overlay district, any potential tree
removal will occur within approved rights -of -way and easements.

TUKWILA GOALS AND POLICIES:
In general, the proposed improvements will have limited impact on the shorelines. Most of the
improvements will be below -grade in developed rights -of -way. Proposed improvements in the area
subject to the City's Master Program are limited to installation of a sanitary sewer force main from
the bridge to a sanitary sewer manhole north of the Interurban Avenue South right -of -way.
The proposal furthers the following applicable City of Tukwila goals and policies:
,Shoreline Use Element
Goal 1. Encourage appropriate development in suitable locations without diminishing the quality of
environment along the shorelines of the river.
Goal 2. Shoreline activities should be consistent with the overall goals for development along the river.
The proposed improvements will not change the quality of environments along the Duwamish
River, and would support the development envisioned in the Comprehensive Plan.
Conservation Element
Goal 3. Encourage the protection of resources and ecology of the river and its shoreline.
Goal 4. Water quality in the river should. be sufficiently high to permit human use and provide a suitable
use and habitat for desirable forms of aquatic life.
Conversion of the Foster Point neighborhood from septic systems to public sewers will protect
water quality for habitat and human use.
Additionally, the proposal is consistent with Tukwila Comprehensive Plan Shoreline Element.
Policy 5.1.1. Urban -Open Space Environment: In the Urban —Open Space Environment, priority shall be
given to the following:
- Maintenance of existing single family residential development patterns; and
- Redevelopment of existing commercial and industrial areas, with enhanced access to the river; and
- Protection and restoration of natural environment features and riverbank characteristics
The proposed improvements are intended to serve the existing single - family development within the
Foster Point neighborhood.
CRITERIA FOR PROJECTS SUBJECT TO THE KING COUNTY SHORELINE
REGULATIONS
The City of Tukwila is required to administer annexed areas based on the Shoreline Management
Plan which was in place at the time of annexation, until a new Plan is adopted and approved by the
State Department of Ecology. There are some areas in Tukwila that are still subject to the King

County Shoreline Master Plan. Shoreline substantial development permits subject to King County's
Master Plan will be reviewed against the shoreline regulations found in K.C.C.25.16 particularly
K.C.C. 25.16.040 below.
K.C.C.25.16.30 General requirements:
A. Nonwater related development and residential development shall not be permitted waterward of the ordinary high
water mark.
The only places where improvements are proposed waterward of the ordinary high water mark is at
the 156 Avenue bridge, where a force main is proposed to be hung from the underside of the
bridge at
B. Except in those cases when the height requirements of the underlying Zones are more restrictive, no structure shall
exceed a height of thin y-fve feet above average grade level. This requirement may be modified if the view of a
substantial number of residences will not be obstructed, if permitted by the applicable provisions of the underlying
Zoning, and f the proposed development is agricultural, water related or water dependent.
No structures are proposed in excess of thirty -five feet.
C. All development shall be required to provide adequate surface water retention and sedimentation facilities during the
construction period
All construction activities will follow City of Tukwila regulations for surface water retention and
sedimentation.
D. Development shall maintain the first fify fiet of property abutting a natural environment as required open space.
All shorelines are designated Urban. All improvements proposed for the area subject to the King
County Shoreline Master Program would occur in developed road rights -of -way.
E. Parking facilities except parking facilities associated with detached single family and agricultural development shall
conform to the following minimum conditions:
1. Parking areas serving water related or a nonwater related use must be located beneath or upland of the
development with the parking area serves.
2. Any outdoor parking area perimeter, excluding entrances and exits, must be maintained as a planting
area with a minimum of five feet.
3. One live tree with a minimum height of four feet shall be required for each thirty linear feet of planting
area.
4. One live shrub of one gallon container size or larger shall be required for each sixty linear inches of
planting area.
5. Additional perimeter and interior landscaping of paring areas may be required, at the discretion of the
Director, when it is necessary to screen parking areas or when large parking areas an proposed.
No parking facilities are proposed within the area subject to the King County Shoreline Master
Program.
F. Collection facilities to control and separate contaminants shall be required when stormwater runofffrom
impervious su would degrade or add to the pollution of recipient waters or adjacent properties.
Water quality for waters discharged to the Duwa*nish River will be consistent with State and federal
water quality standards.

G. The regulations of this chapter have been categorized in a number of sections; regardless of the categorization of the
various regulations, all development must comply with all applicable regulations
H. Development proposed on shorelines of the State shall maintain setbacks, provide easement or otherwise develop the
site to permit a trail to be constructed or public access to continue where:
1. There is a proposed trail in the King County Tail System; or
2. Part of the site is presently being used and ahs historically been used for public access.
No development is proposed that would impede public access to shorelines. All improvements
proposed within the area subject to the King County shoreline regulations are within developed road
rights -of -way.
25.16.160 Utilities.

Utility facilities may be permitted in the urban environment subject to the general requirements
section (Section 25.16.030) of this chapter, provided:
A. Utility and transmission facilities chalk
1. Avoid disturbance of unique and fragile areas;
2. Avoid disturbance of wildlife spawning, nesting and rearing areas;
3. Overhead utility facilities shall not be permitted in public parks, monuments, scenic recreation or
historic areas.
The proposal is consistent with the requirements. The unique and fragile areas will not be disturbed,
except the portion of the river bank where the outfall from South 133r Street will be replaced.
Replacement will match the existing alignment, slope and size. Such construction will not occur
during high water. No in- stream work is proposed.
No overhead utility facilities are proposed in public parks, monuments, scenic recreation or historic
areas. The sanitary sewer force main will be attached to the existing bridge structure, and will not
affect views or activities on, under or in the vicinity of the bridge.
B. Utility distribution and transmission facilities shall be designed so as to:
1. Minimize visual impact;
2. Harmonize with or enhance the surroundings;
3. Not create a need for shoreline protection;
4. Utilize to the greatest extent possible natural screening.
The proposed improvements will be largely underground, except for the end of the outfall and the
sanitary sewer force main, as it crosses the 256 Avenue South bridge. Construction on the outfall
proposed for replacement will match the existing armor rock upon completion. No additional
shoreline protection will be required.
C. The construction and maintenance of facilities shall be done in such a way so as to:
1. Maximize the preservation of natural beauty and the conservation of resources;
2. Minimize scarring of the landscape;
3. Minimize siltation and erosion;

S. Avoid disruption of critical aquatic and wildlife stages.
Minimal and temporary impacts to the natural beauty and resources will occur as a result of the
proposed improvements. Most work will occur in developed rights -of -way. Where development
outside of developed rights -of -way occurs, BMPs will be implemented, consistent with City
requirements, to minimize the potential for siltation and erosion. Since the majority of the proposed
improvements will occur outside of the immediate shoreline habitat areas, little or no disruption of
critical aquatic and wildlife stages are anticipated.

rights of way are paved. Apart from utility infrastructure and the 56 Avenue South bridge, no structures exist within the rights
of way. Existing infrastructure within the developed rights of way probably occurred over time in piecemeal fashion. No dates
of completion for separate elements are known.

The proposal includes several elements: Replacement of existing water mains, installation of sanitary sewer lines, including
a force main, installation of stormwater catch basins, relocation of an existing stormwater line, in kind replacement of an
existing stormwater outfall as maintenance, construction of a sanitary sewer lift station, paving a new roadway in an existing
dedicated road right of way. Following utility construction, existing roadways will be repaved with asphalt.
Construction within the developed rights of way to replace or install utility lines will involve trenching; import of bedding
material, if necessary; installation of the utility facilities; backfilling the trench with the excavated material; and repaving of the
roadway. The repaving will include creating asphalt wedge curbs to channel surface water runoff. The 56 Avenue South
bridge crossing for the proposed force main will be accomplished by attaching the main to the underside of the pedestrian
alkway along the edge of the bridge. The proposed main will run beside, and not lower than, the main structure of the
bridge, except for an understructure crossing at the west end of the bridge.
Construction of Pamela Drive will include installation of utility lines, grading, installation of roadbed materials and paving. The
pavement will include asphalt wedge curbs. The majority of the right of way for Pamela Drive is within 200 feet of the
Duwamish River shoreline. Disturbed areas will be landscaped with native vegetation immediately following construction.
he stormwater outfall extending from 133rd Avenue South will be replaced to match the existing alignment, slope and size of
pipe. The work will require a trench six feet deep and three feet wide from the existing storm drain manhole 1436, as shown
on Figure C1.04 of the accompanying plan set, to the existing outfall location. 113 cubic yards of material will be removed
and replaced. Standard erosion control measures will be followed, including silt fencing, hydroseeding and minimizing the

time of construction to limit the exposure of soil along the river. Existing rock armor on the bank will be removed prior to
construction and replaced along with additional quarry spalls pf 16 inches to 24 inches as necessary to achieve the existing
elevation.
7b. DESCRIBE THE PURPOSE OF THE PROPOSED WORK AND WHY YOU WANT OR NEED TO PERFORM IT AT THE SITE. PLEASE EXPLAIN ANY SPECIFIC NEEDS THAT HAVE INFLUENCED
THE DESIGN.
The intent of the upgrades is several fold. Sanitary sewer facilities will be installed to minimize the risk of ground and surface
water contamination from septic systems and to prevent potential transport to the Duwamish River. A lift station and force
main are necessary to convey effluent from the Foster Point neighborhood, due to the elevation of the neighborhood and the
need to cross the river. Water system facilities improvements are necessary to increase capacity by upsizing and looping the
lines. The storm system is proposed for upgrade with additional catch basins, as the current system is inadequate to capture
and convey much of the existing runoff from impervious surfaces. Stormwater line replacement is due to poor structural
condition. The quarry spalls at the outfall are intended to dissipate energy of the stormwater entering the Duwamish and
thereby reduce erosion and sedimentation.
The repaving of existing developed roads is proposed for normal street maintenance, as well as repair of damage to the
roadway resulting from the utility trenching activities. Repaving will also allow the creation of curbs to retain surface water
within the roadway and convey it to catch basins. Construction of Pamela Drive is necessary to make the roadway more
consistent with the City's roadway standards, and to allow the installation of utilities, including surface water facilities.
7c. DESCRIBE THE POTENTIAL IMPACTS TO CHARACTERISTIC USES OF THE WATER BODY. THESE USES MAY INCLUDE FISH AND AQUATIC LIFE, WATER QUALITY, WATER SUPPLY,

The characteristic uses of the Duwamish River are recreation, fish and aquatic life habitat, scenic open space, and surface
water conveyance. These primary uses are not anticipated to be detrimentally affected by the proposed construction
activities. As noted, the sanitary sewer and surface water improvements are intended to reduce contamination, erosion, and
sedimentation impacts to the river.
Proposed actions to avoid, minimize and mitigate detrimental impacts include implementation of appropriate temporary
erosion and sedimentation control plans consistent with water quality standards, minimizing the area of impacts to vegetation,
and replanting disturbed areas with native vegetation.

USEFUL DEFINITIONS

• construction of a new bridge or modification to an existing bridge over a navigable waterway.
The following definitions are presented to help applicants In completing the JARPA. They may not necessarily represent
specific language from the laws implemented through JARPA.
Ordinary High Water Mark or Line means the visible line on the banks where the presence and action of waters are so
common as to leave a mark upon the soil or vegetation: Provided, that In any area where the ordinary high water line cannot
be found the ordinary high water line adjoining saltwater shall be the line of mean higher high water and the ordinary high
water line adjoining freshwater shall be the elevation of the mean annual flood.
Mean Lower Low is the 0.0 tidal elevation, determined by averaging each day's lowest tide at a particular location over a
period of 19 years. It is the tidal datum for vertical tidal references in the salt water area.
Mean High Water and Mean Higher High Water Tidal Elevations at any specific location can be found in tidal benchmark data
compiled by the United States Department of Commerce, Environmental Science Services Administration, Coast and Geodetic Survey,
dated January 24, 1979. This information can be obtained from the Corps of Engineers at (206) 764 -3495.
The determination of tidal elevation is obtained by averaging each day's highest tide at a particular location over a period of 19 years,
measured from mean lower low water, which equals 0.0 tidal elevation.
Shorelands or shoreland areas means those lands extending landward for two hundred feet in all directions as measured on a
horizontal plane from the ordinary high water mark; floodways and contiguous floodplain areas landward two hundred feet from such
floodways; and all wetlands and river deltas associated with the streams, lakes, and tidal waters which are subject to the provisions of
90.58 RCW.
Shorelines means all water areas of the state, including reservoirs, and their associated wetlands, together with the lands underlying
them, except stream segments upstream of the point where mean annual flow is less than 20 cubic feet per second, and lakes Tess
than 20 acres in size.
Wetlands means areas that are inundated or saturated by surface water or ground water at a frequency and duration sufficient to
support, and that under normal circumstances do support, a prevalence of vegetation typically adapted for life in saturated soil
conditions. Wetlands generally include swamps, marshes, bogs, and similar areas.
Bridge means any structure including pipelines and conveyor belts, which transports traffic or materials across a navigable water.
Aquatic Tidelands means the area between the ordinary high tide line and extreme low tide line, unless otherwise established.
Aquatic Shorelands means the shore areas of non -tidal navigable lakes or rivers between the ordinary high water line and the line of
navigability unless otherwise established.
Aquatic Bedlands means the area waterward of and below the line of navigability on non -tidal rivers and lakes, or below the extreme
low tide mark in navigable tidal waters, or below the outer harbor line where a harbor has been created.

GUIDANCE FOR COMPLETION OF DRAWINGS
General Information. Three types of illustrations are needed to properly depict the proposed activity: Vicinity Map, Plan View, and
Cross - Sectional View. Drawings to scale should be prepared using clear printing, black ink, and the fewest number of sheets possible.
Include the scale. The importance of clear accurate drawings cannot be overstated. At a minimum, drawings must contain the
following information; other information may be required depending on project type. If you have questions regarding completing the
drawings, call the appropriate agency.
1. Vicinity Mao. A copy of a county or city road map, or a U.S. Geological Survey topographic map may be used. Include:
a. North arrow.
b. Name of waterbody (and river mile if appropriate).
c. Location of the proposed activity (indicate with a circle, arrow, X, or similar symbol).
d. Provide latitude and longitude of the site to the nearest second.
e. Provide directions to the site.
2. Plan View. This drawing illustrates the proposed project area as if you were looking down at the site from overhead.
a. North arrow.
b. Name of waterbody and direction of water flow.
c. Location of existing shoreline.
Tidal Waters: Show the Ordinary High, Mean High, Mean Low, Mean Higher High, and Mean Lower Low Water
Marks or Lines, and /or wetland boundaries. Indicate elevation above datum.
Non -tidal waters: Show the Ordinary High Water Mark or Line, Meander Line, and /or wetland boundary.
d. Dimensions of the activity or structure and impervious surfaces, distance from property lines, and the distance it
extends into the waterbody beyond the Ordinary High, Mean High, Mean Higher High, and Mean Low Water Mark or
Line, and/or wetland boundaries, as appropriate.
e. For Corps permits, indicate the distance to Federal projects and/or navigation channels (if applicable). To ascertain,
call the Corps Regulatory Branch Office at (206) 764 -3495.
f. Show existing structures on subject and adjoining properties.
g. Indicate adjoining property ownership.
h. If fill material is to be placed, identify the type of material, amount of material (cubic yards), and area to be filled
(acres).
1. If project involves dredging, identify the type of material, amount of material (cubic yards), area to be dredged,
method of dredging, and location of disposal site. Dredging in areas shallower than -10 feet needs to be clearly
identified on drawings.
j. Identify any part of the activity that has been completed.
k. Indicate types and location of aquatic, wetland, riparian and upland vegetation.
I. Erosion control measures, stabilization of disturbed areas, etc.
m. Utilities, including water, sanitary sewer, power and stormwater conveyance systems (e.g., bioswales).
n. Indicate stormwater discharge points.
o. Proposed landscaping where applicable (for complex landscape plans, please attach a separate drawing).
p. Where applicable, plans for development of areas on or off site as mitigation for impacts associated with the
proposal.
q. On all variance applications the plans shall clearly indicate where development could occur without approval of a
variance, the physical features and circumstances on the property that provide a basis for the request, and the
location of adjacent structures and uses.
3. Cross - Sectional View. This drawing illustrates the proposed activity as if it were cut from the side and /or front. Include:
a. Location of water lines.
Tidal Waters: Show the Ordinary High, Mean High, Mean Higher High, and Mean Lower Low Water Marks or Lines,
and/or wetland boundary.
Non -tidal waters: Show the Ordinary High Water Mark or Line, and/or wetland boundary.
b. Water depth or tidal elevation at waterward face of project.
c. Dimensions of the activity or structure, and the distance it extends into the waterbody beyond the Ordinary High, the
Mean High, the Mean Higher High and Mean Low Water Mark or Line, and/or wetland boundaries.
d. Indicate dredge and /or fill grades as appropriate.
e. Indicate existing and proposed contours and elevations.
f. Indicate types and location of aquatic, wetland, and riparian vegetation present on site.
g. Indicate type and location of material used in construction and method of construction.
h. Indicate height of structure.
4. Clearance and Elevations. Applies to Coast Guard Bridge Permits only.
a. Vertical clearance measured from Mean Higher (tidal waters) or Ordinary High (non -tidal water).
b. Horizontal clearance between piers or pilings.
c. Bottom elevation of the waterway at the bridge.

The surcharging risk is mini by redundant power supply
(emergency generator) and telemetry to provide early
notification of potential problems.
1 • What types of noise exist in the area which may affect your
project (for example: traffic, equipment, operation, other)?
The proposal is to improve public utility and transportation
infrastructure. The project would not be affected by external
noise impacts.
2. What types and levels of noise would be created by or
associated with the project on a short -term or long -term
basis (for example:.traffic, construction, operation, other)?
Indicate what hours noise would come from the site.
Short-term noise impacts will result from construction
activities.
The only potential long -term source of noise resulting from the
proposed improvements would be from the lift station and
back -up generator. The lift station will produce a low hum
when in operation. Since the facilities will be below grade,
these noises should be muffled and negligible. The operation
of the above - ground facilities may also produce'minor noise
impacts. In emergency situations when electrical service is not
available to the lift station and during periods of equipment
maintenance, the emergency generator will produce more
significant audible impacts.
3. Proposed measures to reduce or control noise impacts, if
any.
The lift station facilities will be surrounded by a noise barrier to
reduce potential impacts, and the generator will be equipped
with noise attenuation features.
