This letter represents the City's agreement to extend the short plat expiration date to December 1, 2006. You have also requested some minor changes to the layout of the plat. You have requested to change the access to lot two from the direct driveway to the City street to a driveway via the private access road that will serve lot four. \'This proposed change would impact the stormwater easement on Lot 2. Revised engineering plans and a revised survey will need to b submitted to the City for review. The easement language for the driveway will also need to be revised to reflect the fact that lot 2 will also use the easement area. A maintenance agreement also needs to be prepared sharing the responsibility for maintaining the driveway between lots two and four. A sample maintenance agreement is included with this letter. Your next steps: ❑ Obtain four sets of the revised plat from your surveyor ❑ Obtain four sets of the revised site development plan from your engineer ❑ Prepare the shared maintenance agreement ❑ Revise the easement language for the shared driveway allowing both lots two and four to use the driveway for access. ❑ Submit all of the above items to the City as one submittal Steven M. We have been trying to get contractors to bid work on our project. However, due the smallness of this project we have not received much response. One contractor did respond but his estimate is way above our budget. We are soliciting a bid from Green River Construction who expressed that they can do the work within our budget. Jerry Knudson, the owner, suggested that we wait until the spring of 2006 when the weather is better so we will not be tracking into the street causing siltration into the river. Therefore, we request a 9 — 12 month extension on our project. Please let me know if any additional information is needed for this extension. Tukwila Municipal Code (TMC) 17.12.040 notes, "If the short plat is not recorded within one year of the date of preliminary short plat approval, the short plat shall become null and void. Upon written request by the subdivider prior to the expiration date, the Short Plat Committee may request on extension of not more than one - year ". The short plat needs to be recorded by December 1, 2005 or a letter requesting an extension needs to be submitted to the City by that date. The letter should explain why an extension is needed due to specific issues regarding the short plat and a timetable needs to be provided for when the common improvements will be installed. If you wish to submit for final approval of the short plat, prior to the December 1, 2005 expiration date, please have all documents and maps to the City four weeks prior to the expiration date. TMC 11.12.030 (A) states, Steven M. Mullet, Mayor "The installation of full frontage improvements is required prior to issuance of a certificate of occupancy for new construction, other than single family homes, or prior to final approval for subdivisions and 5 -9 lot short plats and Planned Residential Developments." TMC 11.12.030 (B) describes the required frontage improvements, "Complete street frontage improvements shall be installed along the entire frontage of the property at the sole cost of the permittee as directed by the [Public Works] Director. Street frontage improvements may include, curb, gutter, sidewalk, storm drainage, street lighting, traffic signal equipment, utility installation or relocation, landscape strip, street trees and landscaping, irrigation, street widening, and channelization." Undergrounding existing overhead lines is considered relocation and thus the Public Works Director has authority to place such a condition on the short plat. You also asked about the possibility of a waiver. TMC 11.12.030 (C) does provide for a deferral under certain circumstances, as follows: C. When (due to site topography, city plans for improvement projects, or other similar reasons) the Director determines that street frontage improvements cannot or should not be constructed at the time of building construction, the property owner shall, prior to issuance of the building permit, at the direction of the Director: 1. Pay to the City an amount equal to the property owner's cost of installing the required improvements prior to issuance of a building permit. The property owner shall provide documentation satisfactory to the Director that establishes the cost of the materials, labor, quantities; or 2. Record an agreement which provides for these improvements to be installed by the property owner by a date acceptable to the Director; or 3. This letter supplements the preliminary approval letter mailed to Traci Curry on December 1, 2004. Steven M. Mullet, Mayor Vegetation Easement. The 15 -foot vegetation buffer and easement on lot 2 must be shown on the short plat map. This vegetation easement is an element of the approved surface water management concept submitted by your engineer. The purpose of this easement is to prevent this area from being covered with any impervious surface (including compacted gravel). It may be planted in lawn or other landscaping of the owner's choosing. Easement Documents. Separate easement documents for the access driveway and utilities serving lot 4, and the lot 2 vegetation buffer easement, should be submitted to the city along with the final short plat documents. Upon City approval, the easement documents and short plat must then be recorded (they may all be recorded at the same time). Landscaping. Each new lot within the short plat must be landscaped with at least one tree in the front yard. There is no specific requirement concerning the type of tree. When you have decided what kind of trees you wish to plant and their specific location, I would suggest you consult with Brandon Miles (206/431- 3670). Brandon can help you determine suitability of your selection with regard to potential for root interference with sidewalks and utilities. Water Meters. Individual water meters need not be installed prior to construction of homes on the newly created lots. However, appropriate meter boxes will be required prior to final plat approval. Based on the City's review of your short plat submittal, short plat preliminary approval is granted subject to the conditions stated below. There are three basic steps in the approval process, Preliminary Approval, Final Approval and Recording. These three steps and their requirements are described as kiilows: I. The conditions are to ensure that the short plat is con: ;intent with the City's policies and regulations. A. Preliminary Approval Conditions General a. This easement must be shown on the short plat map. Required Documents a. A new title report will be required when you submit for final approval. b. The easement documents.for the access driveway and utilities for proposed lot four shall be submitted. These documents will be recorded separately from the final short plat document. Common Improvements/Utilities a. The driveway for proposed lot four that will be located on lot 2 must be constructed prior to final approval. b. The utility lines for proposed lot four must be brought to the area of proposed lot four prior to final approval. c. The existing overhead utility lines shall be underground per City ordinance. d. All new utilities within the short plat area shall be placed underground. e. The existing homes within the short plat area shall be connected to sanitary sewer prior to granting of final approval. The existing septic systems for the two homes shall be abandoned per Seattle - King County Heath Department requirements. Landscaping a. Per TMC 17.20.030(G)(1), each new lot within a new short plat shall be landscaped with at least one tree in the front yard to create a uniform streetscape. Prior to final approval each lot within the short plat shall have a parkway maple planted in the front yard of each lot. The trees must be at least two inches in caliper at the time of planting. Appeals This short plat approval decision is appealable to the Hearing Examiner. One administrative appeal of the decision on the short plat. If no valid appeals are filed within the time limit the decision of the Department will be final. In order to appeal the decision a written notice of appeal must be filed with the Department of Community Development within 21 days of the issuance of the Notice of 2 Appeal materials shall include: 1. The name of the appealing party. II. Final Approval III. Recording Decision (12/01/2004). The requirements for such appeals are set forth in Tukwila Municipal Code 18.116. 2. The address and phone number of the appealing party; and if the appealing party is a corporation, association or other group, the address and phone number of a contact person authorized to receive notices on the appealing party's behalf. 3. A statement identifying the decision being appealed and the alleged errors in the decision. The Notice of Appeal shall state specific errors of fact or errors in application of the law in the decision being appealed; the harm suffered or anticipated by the appellant, and the relief sought. The scope of an appeal shall be limited to matters or issues raised in the Notice of Appeal. Any appeal shall be conducted as an open record hearing before the Hearing Examiner. The Hearing Examiner's decision on the appeal is the City's final decision. A party who is not satisfied with the outcome of the administrative appeal process may file an appeal in King County Superior Court from the Hearing Examiner's decision pursuant to the procedures and time limitations set forth in RCW ch. 36.70C. The next step is to install the necessary improvements and submit the necessary short plat documents in compliance with the conditions of approval. All documents must be submitted together and only after the required improvements have been installed. After the documents have been found to be in order and all requirements of the short plat have been met, the Chairman of the Short Subdivision Committee signs your short plat final mylar which constitutes a grant of final approval. In addition, all inspections relating to public works improvements must be completed by the time of final approval. It is your responsibility to record the City approved short plat documents with the King County Department of Records. The short plat is not complete until the recording occurs and copies of the recorded documents are provided to the Department of Community Development. After recording, the County returns the recorded originals to the City within four to six weeks at which time your short plat is considered complete and you can obtain individual 3 building permits for each lot. You can shorten this process by hand delivering a copy of the recorded short plat to the Department. The final short plat must be filed with the King County Department of Records by December 1, 2005, exactly 12 months from the date of this preliminary approval or the application will expire. Please keep this date in mind in the coming months. The City is in no way obligated to remind you of this expiration date. The City may grant one extension of not more than twelve months. The request for an extension must be made in writing and must be submitted to the City prior to the expiration of the short plat. If the short plat approval expires, subsequent development permits that are related to the short plat shall also expire and any vesting will be lost. The following items need to be addressed prior to preliminary approval being issued. Planning Department of Community Development Steve Lancaster, Director 1. Lot four is proposed to be a flag lot, which is not permitted in the City. Tukwila Municipal Code (TMC) 17.20.010 (F) (1) notes, "Each lot must have access to a public street that is approved at the time of plat review; however; rather than designing flag lots, access shall be accomplished with common drive easements ". Access to lot four will have to via a private easement on an adjacent lot. Additionally, the access point to the public right of way for lot four should be shared with the lot where the easement is located. 2. The proposed house on lot four does not meet the required front setback of 20 feet. 3. The development plan shows easements that are not shown on the short plat document. All existing and proposed easements for the proposed short plat need to be provided on the short plat document. 4. What is the purpose of the 15 foot vegetative buffer on lot three? 5. The existing garage on lot five needs to have a rear setback of ten feet. The proposed short plat has the setback being five feet. 6. If the existing house on proposed lot five served by a septic system? If so, the location of septic system needs be shown on the site development plan. Steven M. TMC 17.20.030 (G) (1) notes, "Each lot within a new subdivision or short plat of five lots or greater shall be landscaped with at least one tree in the front yard to create a uniform landscape ". The plan provided only had landscaping on one lot. Each lot needs to include one tree, a suggestion in tree species that the City would have is the use of "Emerald Queen Maple" on each lot. The trees must be at least two inches in caliper at the time of planting. 8. The pending BLA needs to be recorded with King County before preliminary approval will be granted by the City for the short plat application. The following comments are FYI from the Department of Community Development and do not need to be completed prior to preliminary approval. However, they will need to be completed prior to final approval being granted. 1. Add the file number to plat document as L04 -022. 2. There is a typo on page two where the lot areas are listed. 3. Please note the redlines on the short plat cover page. Please correct all typos. Public Works Department 1. Revise sheets 1 and 2 of 2 per redlined comments. 2. A refund request for the permit fee is currently being processed by the City's Finance Department and will be mailed to the person who is on the check in two to three weeks. A letter from the Department on May 10, 2004, noted that the application was incomplete and requested additional information. On May 24, 2004, the additional information was submitted to the City. Based on a review of your application for submittal requirements for Preliminary Short Plat, your application is deemed complete as of June 4, 2004. A notice of land use application will be distributed within 14 days of this date. The next step is for you to install the notice board on the site within 14 days of the date of this letter. You received information on how to install the sign with your application packet. If you need another set of those instructions, you may obtain them at the Department of Community Development (DCD). Also, you must obtain a laminated copy of the Notice of Application to post on the board. This notice is also available at DCD. After installing the sign with the laminated notice, you need to return the signed Affidavit of Posting to our office. As was noted at the front counter sufficient information was missing from the short plat application. As of May 1, 2004, the short plat application and SEPA application are deemed incomplete and additional information is required in order for the City to begin review of the application. The following needs to be submitted: 1. Title Report: Clearly establish status as legal lot(s) of record, ownership, all know easements and encumbrances, must be dated within 45 -days of application filing. 2. Four copies of the Plat Survey Map with the following information: a. The plat survey must include the name of the plat, graphic scale, space for the City of Tukwila file number, and north arrow. It shall be drawn with black ink in record of survey format and include the elements listed in TMC 17.04.060. b. Legal descriptions of the existing and proposed lots. c. WHEREAS, a sewer plan identifying seven residential and two commercial areas has been prepared with a prioritized construction schedule; and WHEREAS, the City of Tukwila has granted the Val Vue Sewer District the right to install and operate the salutary sewer system for the Duwamish neighborhood; and WHEREAS, sewer lines meet Washington State Department of Ecology standards; and WHEREAS, a Sewer Connection Charge will be paid at the time of connecting or before final building permit approval to the Val Vue Sewer District for new facilities; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF TUKWILA, WASHINGTON, HEREBY ORDAINS AS FOLLOWS. Section 1. Duwamish Sewer Connection Charges. Duwamish area homes - as spelled out by Section 2 of this ordinance, existing on November 30, 2002 - will be required to connect to the sewer and pay the associated connection charges if any portion of any building is situated within 250 feet of a sanitary sewer Lire or lateral, and it a) septic or health problems are identified by king County Health Department that require repair of the septic tank system, or b) the home changes ownership, or c) remodeling occurs, adding a bathroom or bedroom Section 2. Service Area Boundaries. The Duwamish service area is bordered by the Duwamish River on the north and the east, East Marginal Way South on the west and Interurban Avenue South on the south, as shown on the map attached to this ordinance (Exhibit A). Section 4. Severability. If any section, subsection, paragraph, sentence, clause or phrase of this ordinance or its application to any person or situation should be held to be invalid or unconstitutional for any reason by a court of competent Jurisdiction, such invalidity or unconstitutionality shall not affect the validity or constitutionality of the remaining portions of this ordinance or its application to any other person or situation. Section 5. Effective Date. This ordinance or a summary thereof shall be published in the official newspaper of the City, and shall take effect and be in full force five days after passage and publication as provided by law.
