Applicant's Response to CUP approval criteria FINDINGS Interior Architects on behalf of Career Education Corporation has submitted for a conditional use permit to operate the International Academy of Design and Technology at the Southcenter Corporate Square facility. The Academy would operate out of the first floor of building six and would occupy all of building seven. In the future, the Academy would also expand into the second floor of building five and the second floor of building six. The only exterior alterations to the buildings would be new signage. Parking for the college will be provided on site and on an adjacent commercial property. Existing Development Southcenter Corporate Square is an existing commercial complex. Southcenter Corporate Square occupies the following parcels 262304 -9143, 262304 -9144 (both owned by Washington Holdings) and, 262304 -9142 (owned by Market Trends). An additional parcel (Parcel # 262304 -9075) is used by Southcenter Corporate Square for parking and is owned by Southcenter Western, LLC. Existing uses in Southcenter Corporate Square are largely office uses. Some of the existing businesses include, First Magnus Financial, King County Housing Authority, Standard Register, and Washington Association of Housing and Services for the aging. The associated parking area for these two buildings is not currently being used. The offsite parking at Andover Park West and Minkler is largely under utilized. United Parcel Service (UPS) does have an agreement with the property owner for use of 80 parking stalls on the site. 2 Staff Report to the Planning Commission L04 -029 Career Education Corporation Page 3 of 8 Surrounding Land Uses Surrounding land uses are all commercial in nature. BACKGROUND Interior Architects on behalf of Career Education Corporation seeks a Conditional Use Permit to operate a college at 645 and 655 Andover Park West. TMC 18.28.040 requires that colleges and universities obtain a CUP from the Planning Commission. The proposed Academy would offer courses in fashion and interior design. Students would be eligible for an Associates Applied Science Degree or a Bachelor of Fine Arts. The Academy would have a total of 250 students on site. The 250 students will be broken up into separate morning and afternoon sessions. The morning session will operate from 8:00 am to noon and the evening session will run from 6:00 pm to 10 pm. One instructional session will occur on Saturday. The morning session would have a total of 112 students and the evening session would have a total of 138 students. During peak hours there would be a total of 50 employees on the site. No students or staff will reside on the site. The applicant is proposing to use building six and seven of the Southcenter Corporate Square site. Building six will be utilized for administrative functions for the Academy. Building seven will consists of four lecture rooms, two sewing labs, a pattern lab, classroom lab, sketch lab, computer lab, and drafting lab. There is also a future lecture area in building seven. This Conditional Use Application also covers the future expansion of the college into the second floor of building five and the second floor of building six. Parking for the Academy will be provided on the Southcenter Corporate Square site and at 575 Andover Park West, which is adjacent to the proposed Academy site. According to Career Education Corporation's website they are one of the largest and fastest growing providers of private, for profit postsecondary education programs in the world. They operate 79 schools, colleges, and universities in the United States, United Kingdom, Canada, United Arab Emirates, and France. 3 Staff Report to the Planning Commission L04 -029 Career Education Corporation Page 4 of 8 CONDITIONAL USE CRITERIA The proposed project is categorically exempt from SEPA review. The proposed project must comply with criteria detailed in TMC 18.64.050, (1 -5), concerning Conditional Use Permits. Applicant's response to conditional use criteria is attached to this staff report as Attachment E. Staff makes the following findings under the city's Conditional Use Permit criteria (TMC 18.64.050): (1) The proposed use will not be materially detrimental to the public welfare or injurious to the property or improvements in the vicinity. The Academy will locate in two existing buildings and parking will be provided on an existing parking lot site. The proposed use will not generate any unusual noise, odor, or impacts on adjacent tenants or property owners. This area of the Urban Center is largely used for office uses during standard weekday work hours. Many of the students at the proposed Academy would attend in the evening and on the weekends. This may prove beneficial to surrounding businesses. (2) The proposed use shall meet or exceed the performance standards that are required in the district it will occupy. There are no new buildings proposed with the project. The existing buildings on the site meet setbacks and height requirements within the TUC zone. Building six will be used as an office and the parking ratio for office uses are listed in Table 18 -7 of the TMC. Office uses have a parking ratio of 3.0 for each 1,000 square feet of usable floor area. Usable floor area is defined as that part of the floor area of any structure, which is actually used from time to time for any commercial purposes, such as sales area, display area, walkways or storage area. Parking calculation shall not include common corridors designed for circulation of people at non - retail establishments, restrooms, elevator shafts and stairwells at each floor, mechanical equipment rooms or attic spaces and exterior loading docks (TMC 18.06.863). The usable floor area for the first floor of building six is 8,730 square feet. Using the parking ratio in table 18 -7 of the TMC the required parking for building six is 26 stalls. 4 Staff Report to the Planning Commission L04 -029 Career Education Corporation Page 5 of 8 All classrooms, computer labs, and other instruction rooms will be located in Building seven. The TMC does not provide a specific parking ratio for college and universities. Instead the TMC requires that the Planning Commission determine the required parking ratio that the proposed college or university would have to meet. Building seven has a usable floor area of 18,244 square feet. City staff analyzed parking ratios for adjacent cities to compare the applicant's proposal. The following are the parking requirements for the proposed Academy if it were located in adjacent cities. Seattle 36 parking stalls Kent 175 parking stalls SeaTac 225 parking stalls These Cities base the required parking stalls on the number of students and employees present and the number of staff members present and do not base the required parking on a person to square footage ratio. Assuming that all Southcenter Corporate Square buildings, with the exception of buildings seven which will be used as classroom space, were developed for office uses, the parking demand on the site would be 200 parking stalls. (3 stalls per 1000 square feet, based upon 66,829 square feet of usable floor area). This would leave 350 parking stalls on site available for the college. The adjacent parking area will be re- striped and will provide 159 stalls. UPS has an agreement to use 80 stalls on the site. Thus, only 79 stalls are available for the college to utilize. Thus there would be a total of 429 stalls available for the Academy. The applicant has noted that the maximum number of students that will be on site is 138 students during evening hours. Additionally, the maximum number of staff on site will not be greater than 50. The Academy will generate the highest demand for parking from 6:OOPM -10PM Monday through Friday. Many of the existing uses in the complex do not operate during this time period, allowing the Academy to have use of a majority of the parking stalls. During the morning session (8:OOAM to noon) a majority of the parking can be accommodated on site. Any excess demand for parking could be met by parking on the adjacent parking lot. 5 Staff Report to the Planning Commission L04 -029 Career Education Corporation Page 6 of 8 Staff recommends that the following parking ratio be used; one parking stall per student present on the site during peak hours, plus one parking stall per classroom. The required parking for the Academy would be as follows: Office Use, Building Six: 26 stalls (TMC Table 18 -7) College Use, Building Seven: 149 stalls Total: 175 required stalls The Academy will have a need for signage on the premises. All signage will have to conform to Title 19 of the TMC and sign permits will be required. (3) The proposed development shall be compatible generally with the surrounding land uses in terms of traffic and pedestrian circulation, building and site design. The traffic circulation and site design will be unchanged as a result of this proposal. Corporate Drive South, a public road is the point of direct access to the site. Corporate Drive South intersects with Andover Park West, which is the main arterial in the area. There is no traffic light at the intersection between Corporate Drive South and Andover Park West. The site can also be accessed via Corporate Drive North. The Academy will be using two existing buildings on the site. The two buildings are connected via a covered atrium. The covered atrium connects to a third building that will not be part of the Academy. There are private walkways that pedestrians can utilize adjacent to the buildings. Sidewalks also exist along Andover Park West and Corporate Drive South (4) The proposed use shall be in keeping with the goals and policies of the Comprehensive Land Use Policy Plan The project is consistent with the following Comprehensive Plan Policies: Policy 1.9.1: The Tukwila Urban Center shall be developed as a high - intensity retail, commercial or light industrial area of regional significance, with mixed use residential uses limited to area adjacent to water amenities, i.e., Tukwila Pond, Green River, and Minkler Pond. The proposed Academy would likely draw students from around the northwest. An 6 Staff Report to the Planning Commission L04 -029 Career Education Corporation Page 7 of 8 additional 250 students and 50 staff members will come to the urban center on a daily basis. The users of the facility will likely have a need for services, which could be provided by the large number of commercial businesses in the TUC. Policy 2.1.10: Design and Support human service programs, such as partnerships for interns and job training, that will enhance the economic well -being of the City. The proposed Academy will offer an Associates Applied Science Degree and a Bachelor of Fine Arts. The Academy will produce an educated work force that business in the area can utilize for labor 5) All measures have been taken to minimize the possible adverse impacts, which the proposed use may have on the area in which it is located. Traffic for the Academy will utilize existing public streets in the area. A traffic impact analysis is not required due to the fact that the buildings have not be vacant for more than 12 months. A pedestrian crossing does exist at the intersection of Corporate Drive North and Andover Park West. CONCLUSIONS 1. The site has adequate parking supply to meet the demands of the Academy. 2. There will be no impacts that would be out of character within the TUC District. 3. The proposal meets an economic goal of the City's Comprehensive Plan and will provide a large number of students and employees to the City's Urban Center. 4. The proposal meets all development standards within the TUC. 5. There are no foreseen impacts from the proposed Academy. RECOMMENDATIONS Staff recommends approval of the Conditional Use Permit with the following parking calculation requirement: One parking stall per student present on the site during peak hours, plus one parking stall per classroom. Using this ratio a total of 149 parking stalls will be required for the college use on the property. CEC trains students in interior design and fashion. Sessions operate Monday through Friday in the mornings, between 8:00 am and noon, and in the evenings, between 6:00 pm and 10:00 pm. There will also be classes on Saturdays between 8:00 am and 1:00 pm. The student body nor the school operations represent any threat to the public welfare or property. 2. All key site elements are existing and no changes are required by CEC. Existing parking is being assigned to CEC. The quantity is 8 stalls per 1000 square feet. CEC will lease 30,000 square feet of space. That amounts to 240 stalls — ample for a maximum of 138 student and 50 administrators scheduled to be on site at any given time. Further information was requested, and that information is provided in this letter. We appreciate your attention to this issue and ask for a determination just as soon as possible on whether a conditional use is required. The property is located within the Tukwila Urban Center District. The Permitted Uses in this District include "schools and studios for education or self improvement." Section 18.28.020 (47). On the other hand, "colleges and universities" are permitted in this District as conditional uses under section 18.28.040. The Code does not define schools, studios, colleges or universities. For uses that are not specifically called out in the list of Permitted Uses, the Code allows the Director to consider such uses to be Permitted Uses when "similar in nature to and compatible with other uses permitted outright within this district." Section 18.28.020 (54). We have reviewed the Code and the portion of the Comprehensive Plan on the Tukwila Urban Center. Based on the characteristics of the use we are proposing, we believe the use is properly characterized as a "school for education or self improvement" or is very similar to that Permitted Use. For the reasons described below, our activities do not fall within the scope of what is identified as "colleges or universities." The proposal is for the International Academy of Design and Technology. There would be approximately 20,000 square feet of classrooms, and approximately 10,000 square feet of administrative office space. The school's projected first year total population would be approximately 250 students. At times of peak attendance, there would be approximately 112 students during the morning session and 138 students per evening. There would be approximately 50 total employees on site at peak times. 2985 Greenspoint Parkway, Suite 600, Hoffman Estates, IL, 60195 The school would operate from 8:00 a.m. to 10:30 p.m. Monday through Friday, and from 8:00 a.m. to 1:00 p.m. on Saturdays. Two instructional sessions would occur each weekday: one in the morning between 8:00 a.m. and noon, and the other between 6:00 p.m. and 10:00 p.m. On Saturdays, one instructional session would occur. The class curriculum is limited to fashion and interior design. Students would be eligible to receive an Associates Applied Science degree or Bachelor of Fine Arts. Parking spaces will be determined by the Planning Commission based on an evaluation of traffic generation from the proposed use. Your staff asked for information on the parking requirements that apply to such uses in other jurisdictions. In the case of the City of Renton, for "colleges, universities, arts and crafts schools /studios, and trade or vocational schools," the parking requirement is one for each employee plus one for each three students residing on campus, and additional bus parking if buses are kept at the school for transportation of students. As another example, the City of SeaTac distinguishes between "vocational schools" and "colleges and universities." The City of SeaTac parking requirement for the former is one space per employee and one for every 10 students, and for the latter it is one per employee and 0.7 spaces per student. In the case of the proposed International Academy of Design and Technology, we propose eight spaces per 1,000 square feet, for a total of 240 parking spaces. Given the characteristics of the proposed use, the International Academy of Design and Technology is much more similar to a "school for education or self improvement" than it is a "college or university." Unlike a college or university, the proposed use has a limited curriculum, a limited time when instruction is offered, and a limited number of students. There are no students who would reside on the site. Based on these factors, we ask for your determination that our use proposal would be considered a "school for education or self improvement" or a use similar to that, such that it is a use permitted outright. Yet, in order to have a 35 foot tall sign, the building that Tuff shed occupies must be at least 35 feet in height. Tukwila Municipal Code (TMC) states, "any permitted freestanding sign shall be limited in height to 35 feet...provided that no freestanding sign shall be higher than the building which it identifies..." All freestanding signs must be setback a foot for every foot in height from all property lines (TMC 19.32.070). The size of the sign is based upon the total linear feet of frontage of the property has along the road. Up to 200 feet of frontage, maximum sign area for one side of the sign is 50 square feet and 100 sq ft for all sides, between 200 and 400 feet of frontage, no sign face can be greater than 75 sq ft with 150 sq ft permitted for all sides. Over 400 feet of frontage, no side can be greater than 100 sq ft and 200 sq ft is the max for all sides. Please see TMC 19.32.140 (D) Table 2. As I noted on the phone, each site is permitted one freestanding sign (TMC 19.32.140 (D) (1). The bakery, which is in the same building has a freestanding sign. If TUFF shed wants to install a freestanding sign they would have to resolve this issue with the bakery and the property owner.
