Thank you very much for your letter of November 1, 2004, responding to my letter of October
21, 2004 regarding clearing of trees and brush on your property last May. I apologize for the
lengthy delay in answering.

On February 25, 2005, with your permission, several of us from the Department of Community
Development (DCD) visited the site to review conditions on the property: Minnie Dhaliwal, the
planner assigned to process your request for a boundary line adjustment on the property, Sandra
Whiting, Urban Environmentalist for DCD and me. Ms Whiting dug two test holes to determine
whether conditions existed that indicated wetlands on the property. We also walked portions of
the site to view ground conditions. We observed standing water in a number of places and
vegetation indicative of wetlands. This observation was supported by the hydric soils observed
in the test holes — soils that support wetlands. I am enclosing a copy of the photos taken during
the site visit.
It may be that at the time you cleared portions of the property, site conditions did not indicate
that a wetland existed on your property, however, after visiting the site and viewing site
conditions it appears that there is a wetland on the property.
To bring closure to the code enforcement action on the property, please have a wetland
delineation study prepared that identifies the location of the wetland boundaries and the wetland
type. As part of this study, a site plan should be included that also identifies the areas that were
cleared last May and how these relate to the location of the wetland or its buffers. A copy of the
Sensitive Areas Ordinance (SAO) is enclosed that discusses the requirements for a sensitive area
study. While an updated SAO was adopted on December 13, 2004, the code violation on your
property is regulated under the previous ordinance.
Once we have a wetland delineation study to review, we can determine what mitigation may be
required to compensate for the clearing. The presence of wetland on the site may affect the
future ability of the site to be subdivided.

The City has reviewed your revised Boundary Line Adjustment drawings for the above
referenced property. Please make the following changes and submit a copy for the Director's
approval signatures:
1. The new property line for parcel B must be at least 10 feet from the existing garage on
Lot A.
2. Revise the legal descriptions to reflect the change listed under item #1.
Please incorporate these changes and submit a copy with surveyor's original signature and
stamp. Also, complete the notarized owner's signature column. After we receive the revised and
signed copy, the Director of Community Development will sign the approval section and you
will be able to take it to King County Recorder's Office for recording. Please refer to the
attached handout on recording procedures. Please note that a mylar copy is no longer needed and
King County is accepting paper copies for Boundary Line Adjustment. After the document is
recorded, please provide one copy for our files.

1. Except to the anent that specific assurances are provided In Schedule A-OPMENT
Guarantee, the Company assumes no liability for toss or damage by reason of the
following:
(e) Defects, lens, encumbrances. adverse daims or other matters against the Ile.
whether or not shown by the public records.
(1) Taxes or assessments of any taxing authority that levies taxes or
assessments on real property; or. (2) Proceedings by a pubic agency which may
result in taxes or assessments. or notices of such proceedings. whether or not
the matters excluded under (1) or (2) are shown by the records of the taxing
authority or by the pubic records.
(1) Unpatented mining dims: (2) reservations or exceptions in patents or In Ads
mutilating the issuance thereof; (3) water fights, claims or Ile to water, whether
or not the matters excluded under (1). (2) or (3) are shown by the pubic records.
2. Notwithstanding any specific assurances which are provided in Schedule A of
this Guarantee, the Company assumes no liability for loss or damage by reason
of the following:

to any property beyond the roes of the land expressly described in to
desaiption set forth in Schedule (A), (C) or in Part 2 of his Guarantee, or tide to
streets, roads, avenues, lanes, ways or waterways to which such land abuts, or
the right to maintain therein vaults. turnels, ramps or any structure or
Improvements, or any rights or easements therein, unless such property, debts or
easements ere expressly and speddcally set forth In said desalption.
Defects. tens, encumbrances. adverse claims or other matters, whether or not
shown by to public records; (1) which are created, suffered, assumed or agreed
to by one or more of the Assureds: (2) which result h no loss to the Assured; or

GUARANTEE CONDITIONS AND STIPULATIONS
1. Definition of Terms.
The following temps when used in the Guarantee mean:

a supplemental witting executed by the Company.
(b) 'land': the land described or referred bin Schedule (A). (C) or In Part 2, and
Improvements affixed thereto which by law constitute real property. The term
land does not Include any property beyond the lines of the area described or

for the purpose of imparting constructive notice of matters relating to real
property to purchasers for value and without knowledge.

2. Notice of Claim to be Given by Assured Claimant.

4. Company's Option to Defend or Prosecute Actions; Duty of Assured Claimant to
Cooperate.

Stipulations have been provided to the Company, a proof of less or damage signed and

6. Options to Pay or Otherwise Settle Claims: Termination of Lability.
In case of a daim under this Guarantee. the Company shall have the following
additional options:
(a) To Pay or Tender Payment of the Amount of Liabiay or to Purchase to
indebtedness.

were authorized by the Company up to the time of purchase. Such purchase,
payment or tender of payment of the kill amount of the Guarantee shad terminate

given b the Company by the Assured the Conpany offers to purchase said
indebtedness. the owner of such indebtedness shad transfer and assign said

provided for in Paragraph (a) the Company's obligation to the Assured under this

7. Determination and Extent of Liability.
This Guarantee is s contract of bdemnity against actual monetary loss or damage
sustained or incurred by the Assured claimant who has suffered loss or damage by
reason of reliant upon the assurances set forth in Es Guarantee and only to to
anent herein described. and subjed to the Exclusions From Coverage of This
Guarantee. The ttabiiy of the Company under this Guarantee to to Assumed shad not
exceed the bast of:

Assured mortgagee. as limited or provided under Section 6 of terse Conditions
and Stipulations or as reduced under Section 11 of these Conditions and

(e) the difference between the value of the estate or interest covered hereby as

I. Limitation of Liability.
(a) If the Company estabashes the title. or removes the alleged defed. San or
encumbrance, or aces any other matter assured against by this Guarantee In a
reasonably dagent manner by any method, inducing itigaaon and the

10. Payment of Loss.

11. Subrogation Upon Payment or Settlement.
Whenever the Company shall have settled and paid a daim under this Guarantee, all
right of subrogation shall vest in the Company unaffected by any ad of the Assured
daimant.
The Company shed be subrogated to and be entitled b all rights end remedies which
the Assured would have had against any person or property in rasped to the claim had
this Guarantee not been issued. If requested by the Company, the Assured that
transfer to the Company all rights and remedies against any person or property
necessary in order to perfect this right of subrogation. The Assured shalt permit the
Company to sue. compromise or settle in the name of the Assured and to use the name
of the Assured in any transaction or ltigaton involving these rights or remedies.
If a payment on account of a claim does not fully cover the loss of the Assured the
Company shall be subrogated to all rights and remedies of the Assured after the
Assured shall have recovered Its prindpal, interest, and costs of collection.
12. Arbitration.
Unless prohibited by applicable law, either the Company or the Assured may demand
arbitration pursuant to the Title Insurance Arbitration Rules of the American Arbitration
Assodation. Arbitrable matters may include, but are not limited to. any controversy or
claim between the Company and the Assured arising out of or relating to this
Guarantee. any service of the Company In connection with is Issuance or the broach of
a Guarantee provision or other obligation. All arbitrable matters when the Amount of
Liability is 51.000,000 or less shall be arbitrated at the option of either the Company or
the Assured. At arbitrable matters when the amount of lability is In excess of
$1 .000.000 shad be arbitrated only when agreed to by both to Company and the
Assured. The Rules In effect at Date of Guarantee shad be binding upon the parties.
The award may Include attorneys' fees only if the laws of the state in which the land Is
located permits a court b award attorneys' fees to a prevailing party. Judgment upon
the award rendered by the Arbitrator(s) may be entered in any court having Jurisdiction

The law of the situs of the land shall apply to an arbitration under the Title Insurance

request.
13. Liability Limited to This Guarantee; Guarantee Entire Contract.

be construed as a whole:
