The City received duplicate land use applications regarding the old Lewis and Clark Theater
site located on International Blvd.
One of the applications was L04 -050, a conditional use permit application to operate the
Neighborhood Life Center Church.
The applicant has chosen to withdraw the CUP application. Planning staff worked on the
permit application for not more than two hours.
Please refund a portion of the permit fee in the amount of $1,900 to the applicant.

Theaters, I am writing to withdraw our pending Conditional Use Permit
application with the City of Tukwila, and also to request a refund of the $2000 fee
that was paid —less any applicable charges.
I appreciate your office working with us during very unusual circumstances. It
has been a pleasure to deal with you...and I look forward to reinitiating the
process at a future date.

Dear Rev. Vanderhoff:
As you are aware, Cendant Car Facility has been issued Design Review approval by the City
to convert the existing Lewis and Clark site into their regional facility.
Neighborhood Life Center currently has a pending Conditional Use Permit on the site.
However, it appears that this CUP is in conflict with the approved Cendant Approval.
Staff would suggest that Neighborhood Life Center submit a letter to the City withdrawing
the application. The City would be willing to refund a portion of the application fee.
Should circumstances change or Neighborhood Life Center finds another suitable site in the
City of Tukwila it would be necessary for you to resubmit the application material.
If you choose to withdraw the application, please provide the letter to the City within 14-
days.

The City has reviewed your letter dated September 16, 2004 regarding the pending
Conditional Use Permit (L04 -050). In the letter you asked that the pending CUP be put on
hold until March 1, 2005 and that the pending building permits be released to the Church.
The City is agreeable to putting the pending CUP application on hold until March 1, 2005.
For safety reasons, planning will allow the pending building permits to be released. Please
be advised that the Department is not making a determination on the underlying land use
issue, thus any improvements being done to the interior of the building are being done at the
Church's own risk.
If you should find a new site to locate your church within the City of Tukwila please be
advised that a CUP will still be required and needs to be obtained before the church begins
to operate.

Dear Brandon,
In response to our meeting today, I am writing to request that our Conditional Use
Permit application (file # L04 -050) be put on hold until March 1, 2005. As we discussed,
Neighborhood Life Center is on a month -to -month lease agreement with Avis Rent A Car
for the theater space, and they expect that we will have to vacate the premises by the
aforementioned date.
By that time, we will either continue the CUP process for the theater (if the
situation changes for Avis), continue the process for another Tukwila site, or withdraw
from the process in the event that a new location pulls us away from the city area. Our
hope is to stay in this city for the life of the church!
I am also requesting that the pending development permit application for stages
being built in theaters 4 through 7 (Permit File No. D04 -244) be processed so that we are
able to make the facility a safer environment by removing the need for long cords and
cables on the floor areas.
Thank you for your consideration of these matters. I appreciated the opportunity
to meet with you and Nora Gierloff today. Please let me know if you need any other
information or if you have any questions. I look forward to hearing your response soon.

The Department of Community Development received your Conditional use application on August 10, 2004 for
Neighborhood Life Center located at 15820 International Blvd.
Based on a review of your application for submittal requirements for a Conditional Use Permit, your application is
deemed complete as of August 27, 2004. A notice of land use application will be distributed by September 10, 2004.
In order for the City to distribute the Notice of Application, mailing labels (both for tenants and property owners)
must be submitted to the Department of Community Development. The next step is for you to install the notice board
on the site by September 10, 2004. Because of the size of the parcel, the City will require that two public notice boards
be installed, one to face towards International Blvd and the other to face South 160 Street. You received information on
how to install the sign with your application packet. If you need another set of those instructions, you may obtain them at
the Department of Community Development (DCD). Also, you must obtain a laminated copy of the Notice of
Application to post on the board. This notice is also available at DCD. After installing the sign with the laminated notice,
you need to return the signed Affidavit of Posting to our office.
This determination of complete application does not preclude the ability of the City to require that you submit additional
plans or information, if such information is necessary to ensure the project meets the substantive requirements of the City
or to complete the review process.
This CUP has been scheduled to go before the Planning Commission on October 28, 2004 at 7PM. You will be
receiving more information regarding the hearing within the next couple of weeks.
On a related matter, there are currently building permits pending for Neighborhood Life Center, please note that these
permits cannot be issued until the pending land use application has been completed.

(h) Show the 100 yr. flood plain boundary and elevation as shown on FEMA maps.
(i) Plan, profile and cross - section for any right -of -way improvements.
(j) Show planned access to lots, driveways, fire access lanes and turn- arounds.

REVIEW CRITERIA
The review criteria for various types of projects are shown below. Please discuss development consistency with each
criteria. Then, refer to the Tukwila Comprehensive Plan for project consistency with the policies. Please note that more
than one category of policies may apply.
Criteria for Conditional Uses (TMC 18.64.030)
1. The proposed use will not be materially detrimental to the public welfare or injurious to the property or
improvements in the vicinity.
There will be no physical changes to the property structure unless approved by the City Planning
Department and required building penults are issued. The grounds and facility will be kept clean and
be constantly monitored to reduce potential mischief. The church facility will enhance the vicinity's
welfare by providing wholesome, values -driven programs available to people of all ages and cultures
that will assist in developing responsible community citizens.
2. The proposed use shall meet or exceed the same standards for parking, landscaping, yards and other development
regulations that are required in the district it will occupy.
Since we are currently on a month- to-month lease, there are no proposed changes to the
landscaping or parking at the facility. Parking Space requirements for churches am the same as the
theater's requirements; there are over 1100 parking spaces with less than 3000 fixed seats available.
3. The proposed development shall be compatible generally with the surrounding land uses.
Neighborhood Life Center is a multi - cultural, multilingual church. Our constituents are people of all
ages and backgrounds —much like the clientele of the Lewis & Clark Theater for the last 40+ years.
We are surrounded by other small businesses, Fellowship Bible Church, and apartment complexes.
4. The proposed use shall be in keeping with the goals and policies of the Comprehensive Land Use Policy Plan.
Recognizing that the facility being used is located at a key gateway to the City of Tukwila,
Neighborhood Life Center's goal is to transform the former theater building into a community
conference center that will become a neighborhood focal point for wholesome entertainment,
education, civic events, as well as family and personal spiritual development.
5. All measures shall be taken to minimize the possible adverse impacts which the proposed use may have on the area in
which it is located.
We believe in, and practice, being good neighbors with those who are around us. Our organization's
purpose is to help better the lives of the people around us, and to bless the city in which we reside.
We recognize that anything we do that could have an adverse impact on the area around us would
be detrimental to our own existence as well, and it would be contrary to our vision, purpose, and core
values.
