Decision on Substantive Permit: The Community Development Director has determined that the application
for a Tree Clearing Permit does comply with applicable City and state code requirements and has approved
that application based on the findings and conclusions contained in the staff report.
III. YOUR APPEAL RIGHTS
The Decision on this Permit Application is a Type 2 decision pursuant to Tukwila Municipal Code
§ 18.104.010. Other land use applications related to this project may still be pending.
No administrative appeal of a DNS or an EIS is permitted. One administrative appeal to the Planning
Commission of the Decision on the Permit itself is permitted.
A party who is not satisfied with the outcome of the administrative appeal process may file an appeal in King
County Superior Court from the Planning Commission decision.
IV. PROCEDURES AND TIME FOR APPEALING
In order to appeal the Community Development Director's decision on the Permit Application, a written
notice of appeal must be filed with the Department of Community Development within 14 days of the
issuance of this Decision, which is Thursday. January 20, 2005.
The requirements for such appeals are set forth in Tukwila Municipal Code 18.116. All appeal materials
shall be submitted to the Department of Community Development. Appeal materials MUST include:
1. The name of the appealing party.
2. The address and phone number of the appealing party; and if the appealing party is a corporation,
association or other group, the address and phone number of a contact person authorized to receive
notices on the appealing party's behalf.
3. A statement identifying the decision being appealed and the alleged errors in the decision, including
any specific challenge to an MDNS.
4. The Notice of Appeal shall identify (a) the specific errors of fact or errors in application of the law in
the decision being appealed; (b) the harm suffered or anticipated by the appellant, and (c) the relief
sought. The scope of an appeal shall be limited to matters or issues raised in the Notice of Appeal.
V. APPEAL HEARINGS PROCESS
Any administrative appeal regarding the Permit shall be conducted as an open record hearing before the
Planning Commission based on the testimony and documentary evidence presented at the open record
hearing. The Planning Commission decision on the appeal is the City's final decision.
Any party wishing to challenge the Planning Commission decision on this application must file an appeal
pursuant to the procedures and time limitations set forth in RCW 36.70C. An appeal challenging a DNS,
an MDNS or an EIS may be included in such an appeal. If no appeal of the Planning Commission

VI. INSPECTION OF INFORMATION ON THE APPLICATION
Project materials including the application, any staff reports, and other studies related to the permits are
available for inspection at the Tukwila Department of Community Development, 6300 Southcenter Blvd.,
Suite 100, Tukwila, Washington 98188 from Monday through Friday between 8:30 a.m. and 5:00 p.m. The

2: No changes shall be made to the approved plans unless approved by the design professional in responsible charge and the
Building Official.
3: All mechanical work shall be inspected and approved under a separate permit issued by the City of Tukwila Permit Center
(206/431- 3670).
4: All permits, inspection records, and approved plans shall be at the job site and available to the inspectors prior to
start of any construction. These documents shall be maintained and made available until final inspection approval is
granted.
5: Truss shop drawings shall be provided with the shipment of trusses delivered to the job site. Truss shop drawings shall
bear the seal and signature of a Washington State Professional Engineer. Shop drawings shall be maintained on the site
and available to the building inspector for inspection purposes.
6: Insulating materials, where exposed as installed in buildings of any type of construction, shall have a flame spread
index of not more than 25 and a smoke development index of not more than 450. Where facings are installed in concealed
spaces in buildings of Type III, IV, or V construction, the flame spread and smoke - developed limitations do not apply
to facings, that are installed behind and in substantial contact with the unexposed surface of the ceiling, wall or
floor finish.
7: All construction shall be done in conformance with the approved plans and the requirements of the International
Building Code or International Residential Code, International Mechanical Code, Washington State Energy Code.
8: Notify the City of Tukwila Building Division prior to placing any concrete. This procedure is in addition to any
requirements for special inspection.
9: All wood to remain in placed concrete shall be treated wood.
10: There shall be no occupancy of a building until final inspection has been completed and approved by Tukwila building
inspector. No exception.
11: All construction noise to be in compliance with Chapter 8.22 of the City of Tukwila Municipal Code. A copy can be
obtained at City Hall in the office of the City Clerk.
12: Ventilation is required for all new rooms and spaces of new or existing buildings and shall be in conformance with the
International Building Code and the Washington State Ventilation and Indoor Air Quality Code.
13: Equipment and appliances having an ignition source and located in hazardous locations and public garages, PRIVATE
GARAGES, repair garages, automotive motor -fuel dispensing facilities and parking garages shall be elevated such that
the source of ignition is not less than 18 inches above the floor surface on which the equipment or appliance rests.
14: All plumbing and gas piping work shall be inspected and approved under a separate permit issued by the Department of

16: VALIDITY OF PERMIT: The issuance or granting of a permit shall not be construed to be a permit for, or an approval of,

18: The applicant must notify the City Utility Inspector at (206)433 -0179 upon commencement and completion of work at least
24 hours in advance. All inspection requests for utility work must also be made 24 hours in advance.
19: Work affecting traffic flows shall be closely coordinated with the City Utilities Inspector. Traffic Control Plans
shall be submitted to the Inspector for prior approval.
20: Any material spilled onto any street shall be cleaned up immediately.
21: Temporary erosion control measures shall be implemented as the first order of business to prevent sedimentation
off -site or into existing drainage facilities.
22: The site shall have permanent erosion control measures in place as soon as possible after final grading has been
completed and prior to the Final Inspection.
23: From October 1 through April 30, cover any slopes and stockpiles that are 3H:1V or steeper and have a vertical rise of
10 feet or more and will be unworked for greater than 12 hours. During this time period, cover or mulch other disturbed
areas, if they will be unworked more than 2 days. Covered material must be stockpiled on site at the beginning of this
period. Inspect and maintain this stabilization weekly and immediately before, during and following storms.
24: From May 1 through September 30, inspect and maintain temporary erosion prevention and sediment at least monthly. All
disturbed areas of the site shall be permanently stabilized prior to final construction approval.
25: Roof drainage shown on plans meets the requirements of geotechnical report by Icicle Creek Engineers, #0473 -001, dated
June 30, 2003 and is approved by Ryan Larson, Seniior Surface Water Engineer. Any changes require approval by Ryan
Larson.

I am enclosing a copy of the approved Tree Clearing Permit, which was signed by the Director of
the Department on January 4, 2005 and the Notice of Decision that specifies the appeal process
for this permit.
Please note that there are no conditions attached to the Tree Clearing permit. There is a required
landscape inspection through the building permit (D04 -219) issued for the construction of the
house. Please make sure that you request the landscape inspection prior to requesting the final
building inspection for the home.

The need for a tree cutting permit for this site was identified through the review of a building
permit to construct a single family home, D04 -219. The site contains slopes over 20% and trees
meeting the definition of "significant tree" are to be cleared in order to construct the new home.
The primary review of the tree - cutting permit occurred through the review of the building
permit. Several corrections to the site plan were required during review of the building permit to
identify the location of the trees to be removed and the location and type of trees to be planted.
A total of six trees will be planted, split between 3 fir trees and 3 maples. The new trees will be
planted on the slopes to the east and north of the building site.
The building permit requires that a landscaping inspection be conducted before finalization of
the permit to ensure that the trees have been installed. Other conditions of the permit relate to
flagging the fifteen foot SAO buffer for the Type 3 stream that runs through the southern portion
of the site and keeping the dispersal trench for the house downspouts outside the SAO buffer
area.
RECOMMENDATION: Approve the tree cutting permit for the site.

1. The revised site plan indicates that water from the downspouts will be tightlined to the Type 3 stream to be
discharged. The City's Sensitive Areas Ordinance does not permit direct discharge of surface water to
watercourses unless the water is coming from detention facilities, presettlement ponds or other surface water
management structures (TMC 18.45.080 B.3., copy enclosed) Direct discharge to the stream would also
require a Hydraulic Projects Approval permit from the Washington State Department of Fish and Wildlife.
Enclosed is a handout prepared by the Public Works Department that includes a discussion on downspout
dispersion systems to assist you in creating a system that meet's City requirements and the recommendations of
the geotechnical report.
2. Please specify the type of trees that will be planted as replacement for the trees removed from the slope areas
and the size. Minimum size for deciduous trees is 2.5 -inch caliper; evergreen trees must be 6 -8 feet in height.
(See TMC 18.54.130 enclosed)
3. The building plans indicate a possible additional living unit if the basement is finished. Enclosed are the
zoning code regulations governing accessory dwelling units for future reference. Please note the size
limitations on the accessory dwelling units and the requirement for additional parking spaces based on the size
of the accessory dwelling unit.

SITE PLAN: The site plan is to contain all of the following information.

(b) Diameter, species names, location and canopy of existing significant trees in relation to
proposed and existing structures, utility lines, and construction limit line;
(c) Identification of all significant trees to be removed and/or relocated.
(d Existing and proposed topography of the site at 2 - foot contour intervals;

(e) Limits of any sensitive area and sensitive area buffer, and mean high water mark of the
river.
CAPE PLAN: The landscape plan is to contain all of the following information.
5(a) Diameter, species name, spacing and location of replacement trees/vegetation to be used to
replace vegetation cleared;
(b) Diameter, species name and location of all significant trees and vegetation to be retained.
(c) Proposed vegetation protection measures.
(d) Any other measures proposed to restore the environmental and aesthetic benefits
previously provided by on -site vegetation.

The materials listed below must be submitted with your application unless specifically waived in writing by the
Public Works Department and the Department of Community Development. Please contact the Department if you
feel that certain items are not applicable to your project and should be waived. Application review will not begin
until it is determined to be complete. ADDITIONAL MATERIALS MAY BE REQUIRED.
The initial application materials allow starting project review and vesting the applicant's rights. However, they in
no way limit the City's ability to require additional information as needed to establish consistency with development
standards.

COMPLETE APPLICATION CHECKLIST TABLE
PROFESSIONAL REVIEW OR RECOMMENDATION: Submittal of, or agreement to submit, a review,
evaluation, recommendation or plan related to vegetation clearing or replacement prepared by a professional
consultant, such as a landscape architect, surveyor, or certified arborist. Services may include, but are not
limited to:
6(a) Providing written evaluation of the anticipated effects of proposed construction on the
viability of trees on -site; and/or
(b) Developing plans for, supervising, and/or monitoring implementation of any required tree
protection or replacement measures; and/or
(c) Post-construction site inspection and evaluation.
SENS ' AREA MITIGATION PLAN
7. Identify measures proposed for mitigation of vegetation clearing in a sensitive area and/or its
buffer per the Sensitive Areas Overlay District chapter (TMC 18.45).
SCHEDULE
8. Proposed time schedule of vegetation removal, relocation, and/or replacement, and other
construction activities which may affect on -site vegetation, sensitive area, sensitive area buffer,
and/or shoreline zone.

9. The Director may require supplemental studies or other documentation, or specify conditions .
for work, at any stage of the application or project as he/she may deem necessary to ensure the
proposal's compliance with the requirements of this chapter, the Shoreline Overlay District
chapter or the Sensitive Areas Overlay District chapter, or to protect public or private property.
These conditions may include, but are not limited to, hours or seasons within which work may
be conducted, or specific work methods.
INSURANCE: In addition to any permit materials or conditions specified pursuant to Chapter 18.54, if in the
opinion of the Director the nature of the work is such that it may create a hazard to human life or endanger
adjoining property, then the Director may require the applicant to submit a certificate of insurance per the
requirements of TMC 18.54.110.
