III. YOUR APPEAL RIGHTS The Decision on this Permit Application is a Type 2 decision pursuant to Tukwila Municipal Code § 18.104.010. Other land use applications related to this project may still be pending. No administrative appeal of a DNS or an EIS is permitted. One administrative appeal to the Planning Commission of the Decision on the Permit itself is permitted. A party who is not satisfied with the outcome of the administrative appeal process may file an appeal in King County Superior Court from the Planning Commission decision. IV. PROCEDURES AND TIME FOR APPEALING In order to appeal the Community Development Director's decision on the Permit Application, a written notice of appeal must be filed with the Department of Community Development within 14 days of the issuance of this Decision, which is Thursday. January 20, 2005. The requirements for such appeals are set forth in Tukwila Municipal Code 18.116. All appeal materials shall be submitted to the Department of Community Development. Appeal materials MUST include: 1. The name of the appealing party. 2. The address and phone number of the appealing party; and if the appealing party is a corporation, association or other group, the address and phone number of a contact person authorized to receive notices on the appealing party's behalf. 3. A statement identifying the decision being appealed and the alleged errors in the decision, including any specific challenge to an MDNS. 4. The Notice of Appeal shall identify (a) the specific errors of fact or errors in application of the law in the decision being appealed; (b) the harm suffered or anticipated by the appellant, and (c) the relief sought. The scope of an appeal shall be limited to matters or issues raised in the Notice of Appeal. V. APPEAL HEARINGS PROCESS Any administrative appeal regarding the Permit shall be conducted as an open record hearing before the Planning Commission based on the testimony and documentary evidence presented at the open record hearing. The Planning Commission decision on the appeal is the City's final decision. Any party wishing to challenge the Planning Commission decision on this application must file an appeal pursuant to the procedures and time limitations set forth in RCW 36.70C. An appeal challenging a DNS, an MDNS or an EIS may be included in such an appeal. Where facings are installed in concealed spaces in buildings of Type III, IV, or V construction, the flame spread and smoke - developed limitations do not apply to facings, that are installed behind and in substantial contact with the unexposed surface of the ceiling, wall or floor finish. 7: All construction shall be done in conformance with the approved plans and the requirements of the International Building Code or International Residential Code, International Mechanical Code, Washington State Energy Code. 8: Notify the City of Tukwila Building Division prior to placing any concrete. This procedure is in addition to any requirements for special inspection. 9: All wood to remain in placed concrete shall be treated wood. 10: There shall be no occupancy of a building until final inspection has been completed and approved by Tukwila building inspector. No exception. 11: All construction noise to be in compliance with Chapter 8.22 of the City of Tukwila Municipal Code. All inspection requests for utility work must also be made 24 hours in advance. 19: Work affecting traffic flows shall be closely coordinated with the City Utilities Inspector. Please note that there are no conditions attached to the Tree Clearing permit. There is a required landscape inspection through the building permit (D04 -219) issued for the construction of the house. The site contains slopes over 20% and trees meeting the definition of "significant tree" are to be cleared in order to construct the new home. The primary review of the tree - cutting permit occurred through the review of the building permit. Several corrections to the site plan were required during review of the building permit to identify the location of the trees to be removed and the location and type of trees to be planted. A total of six trees will be planted, split between 3 fir trees and 3 maples. The new trees will be planted on the slopes to the east and north of the building site. The building permit requires that a landscaping inspection be conducted before finalization of the permit to ensure that the trees have been installed. Other conditions of the permit relate to flagging the fifteen foot SAO buffer for the Type 3 stream that runs through the southern portion of the site and keeping the dispersal trench for the house downspouts outside the SAO buffer area. RECOMMENDATION: Approve the tree cutting permit for the site. The revised site plan indicates that water from the downspouts will be tightlined to the Type 3 stream to be discharged. The City's Sensitive Areas Ordinance does not permit direct discharge of surface water to watercourses unless the water is coming from detention facilities, presettlement ponds or other surface water management structures (TMC 18.45.080 B.3., copy enclosed) Direct discharge to the stream would also require a Hydraulic Projects Approval permit from the Washington State Department of Fish and Wildlife. Enclosed is a handout prepared by the Public Works Department that includes a discussion on downspout dispersion systems to assist you in creating a system that meet's City requirements and the recommendations of the geotechnical report. 2. Please specify the type of trees that will be planted as replacement for the trees removed from the slope areas and the size. Minimum size for deciduous trees is 2.5 -inch caliper; evergreen trees must be 6 -8 feet in height. (See TMC 18.54.130 enclosed) 3. The building plans indicate a possible additional living unit if the basement is finished. Enclosed are the zoning code regulations governing accessory dwelling units for future reference.
