Harris 979 Industry Dr, Tukwila, WA 98188 RE : Your letter dated September 9, 2004 Dear Mr. Harris: Cizy of Tukwila Department of Community Development Steve Lancaster, Director You have inquired about locating your Roto Rooter business at 14120 Tukwila International Boulevard in Tukwila, Washington. It is the City's understanding that Roto Rooter engages in plumbing and septic contractor services. The property in question is zoned Neighborhood Commercial Center (NCC). TMC 18.22.020 (24) does allow plumbing shops to locate in the NCC zone provided that there is no outside of storage of materials (TMC 18.22.020 (24)). As you are aware the large billboard style sign on the property is non - conforming and any alterations to the sign or any additional signs will require total conformance with the City's sign code. Sign permits are required for any permanent or temporary signage. The property owner of the site also needs to be aware of the following code provision of the Tukwila Municipal Code. TMC 18.70.040 (6) notes: "Any structure, or structure and land in combination, in or on which a non - conforming use is superceded by a permitted use, shall thereafter conform to the regulations for the zone in which such structure is located, and the nonconforming use may not thereafter be resumed" The car storage on the site is non - conforming and should Roto- Rooter locate on the site, Roto Rooter would be a permitted use and thus the car storage use would not be permitted in the future. When we went to your office today, September 9, 2004, we were told that your office was not sure where we fit in the zoning matrix. Our office is currently in Tukwila and we would like to continue running our business out of Tukwila. Could you please let us know if we fit into your zoning matrix? With the approval of our new sign (see copy of sign), the landlord has agreed to take down the dilapidated billboard that is currently on site. We plan making necessary improvement to the property, such as paint, refinishing the asphalt, fixing the fence and cleaning the brush behind the buildings.
