Project Description STAFF REPORT TO THE DIRECTOR DEPARTMENT OF COMMUNITY DEVELOPMENT March 11, 2005 City of Tukwila Public Works Department, Mike Cusick 6300 Southcenter Boulevard Tukwila, WA 98188 (206) 433 -0179 The project is located in the City of Tukwila along Fort Dent Way and Interurban Avenue; north of I -405, east of I -5 and west of the Green River. Zoning and Comprehensive Plan Designation: The c urrent Z oning and C omprehensive P lan designations of the areas adjacent to the project site are Regional Commercial Mixed Use (RCM) and High Density Residential (HDR), Medium Density Residential (MDR) and Low Density Residential (LDR). The project involves the construction of gravity and force main sanitary sewer for upgrades to the City of Tukwila's system. The project includes 2,100 lineal feet of 8 -inch sanitary sewer in Interurban Avenue, running northwest from Fort Dent Way; and 700 lineal feet of 4 -inch force main sanitary sewer in the center of the cul -de -sac at Fort Dent Way, running southwest to Interurban Avenue. II. Policies of the Shoreline Management Act/Shoreline Master Program The project is subject to Tukwila Shoreline Master Program. Shoreline Regulations SHORELINE MANAGEMENT Shoreline Substantial Development Permit (18.44.80) Any substantial development within 200 feet of any shoreline must receive a shoreline substantial development permit prior to issuance of any local permits by the City. The construction of the proposed sewer main is within the paved portion of Interurban Ave South and Fort Dent Way. These street are within 200 feet of the Green River. General Shoreline Regulations (18.44.110) 1. The use is in conformance with the regulations of the underlying district The project location is within City of Tukwila right of way. Adjacent zoning designations include Regional Commercial Mixed Use (RCM) and High Density Residential (HDR), Medium Density Residential (MDR) and Low Density Residential (LDR). No specific development regulations govern the installation of sewer main. The proposed sewer main would not cause any foreseeable conflicts with the adjacent RCM, HDR or LDR zoning and thus would conform to applicable zoning regulations. 2. The use does not conflict with the goals and policies of the shoreline master program or the provisions of the Shoreline Act and shoreline regulations: The proposed project is to construct an 8" sanitary sewer line within paved portions of existing street. The proposed project would cause no impacts to the shoreline environment. The use is consistent with the goals and policies of the shoreline master program and the provisions of the Shoreline Act and shoreline regulations. 3. No structures or accessory facilities shall be located over the river unless such structure protects or promotes the public interest. No structures or utilities will be constructed over the Green River. No impacts are anticipated to the river as a result of this project. 2 N/A NINO 4. There shall be no disruption of existing trees or vegetation within the river environment unless necessary for public safety or flood control, or if allowed as part of an approved shoreline substantial development permit. There will be no disruption of existing vegetation in this river environment as a result of the proposed project. S. No effluent shall be discharged into the Green River, which exceeds the water quality classification as established by the State for the adjacent portion of the river. No discharge of effluent will occur due to proposal. 6. All States and federal water quality regulations shall be strictly complied with. Applicant is responsible for meeting all state and federal water quality regulations. 7. Wildlife habitat in and along the river shall be protected Wildlife should not be impacted by this project. 8. All perimeters of landfills and other land forms susceptible to erosion shall be provided with vegetation, retaining walls, or other satisfactory mechanism for erosion prevention. Erosion and sedimentation controls will be used to ensure minimal disturbance to the river. Much of the area adjacent to right -of -way is developed. If any areas are disturbed, they shall be restored and re- vegetated immediately. 9. All necessary permits shall be obtained from Federal, State, County or municipal agencies. The project was issued a SEPA Determination of Non - Significance (DNS) by the City of Tukwila. Applicant is responsible for obtaining any applicable Federal or State approvals. 10. Dredging for purposes other than for navigational improvements or flood control is prohibited. 3 11. Mining is prohibited along the river shoreline N/A 12. Solid waste disposal is prohibited along the shoreline N/A 13. No property will be acquired for public use without dedication by or just compensation to the owner All work is proposed within existing right -of -way or existing easements. 14. Landfilling is prohibited within the river channel, unless such landfill is determined by the Planning Commission to protect or promote the public interest. N/A 15. Notwithstanding any provisions of the Code to the contrary, removal of any cottonwood tree within the river environment, or the low impact environment, which tree is 12 inches or greater in diameter as measured 4.5 feet above grade, shall be subject to the requirements of TMC Chapter 18.54, Tree Regulations. No removal of vegetation is proposed for this project. Specific Shoreline Regulations The majority of the project falls within low impact and high impact environments. There are no anticipated impacts to the shoreline as the project is located within the existing developed right -of -way. Specific use regulations -river impact environment (18.44.130) This portion of the code requires that `utility easements where necessary shall be landscaped with live ground cover or natural grass cover ". The project is to construct an 8" sanitary sewer within the paved right -of -way. No other disturbances are anticipated as a result of this project. 4 Specific use reEulations -low impact environment (18.44.140) Utilities are permitted in the low- impact environment. Specific use regulations -high impact environment (18.44.150) All uses allowed in the underlying zoning district are allowed in the high impact environment. IV. Comments A letter was received from the Muckleshoot Cultural Resources Program stating that several archaeological sites have been recorded in and near Fort Dent Park, and archaeological material may extend underneath these adjacent roadways. The letter also requested that a professional archaeologist be present during construction to assess the possibility for archaeological resources. It is not practical to conduct an exploratory excavation to determine if any resources exist prior to construction. No deep excavations are planned for this project. All work will occur in areas that have previously been disturbed. However if any artifacts are encountered during any of the excavation activities, all work will be stopped and the State Office of Archaeology and Historic Preservation and the concerned tribes cultural committees and staff will be notified. Also, a letter was received from King County Wastewater treatment division requesting a set of construction drawings as King County's Interurban Force Main and water reuse lines are located near the project site. The letter also requested that King County be notified prior to starting construction in the field. A copy of the letter was provided to the project manager who will co- ordinate any construction issues with King County. V. SEPA and other approvals Minnie Dhaliwal, Senior Planner The project was also subject to SEPA review and was issued a Determination of Non - Significance by the City of Tukwila on February 1, 2005. V. Recommendations Approval of the shoreline substantial development permit. Type 2 Permit (shoreline permit only) 2 RESPONSE TO FORT DENT SEWER EXTENSION GENERAL SHORELINE REGULATIONS 1. The use is in conformance with the regulations of the underlying zone district. The proposed 8" sanitary sewer lift is not in conflict with the underlying zone district. 2. The use does not conflict with the goals and policies of the shoreline master program or the provisions of the Shoreline Act and shoreline regulations. The proposed 8" sanitary sewer is not in conflict with the Shoreline Master Plan. 3. No structures or accessory facilities shall be located over the river unless such structure protects or promotes the public interest. The proposed 8" sewer line will not be constructed over the Green River. The project will be constructed in existing paved streets. 4. Thee shall be no disruption of existing trees or vegetation within the river environment unless necessary for public safety or flood control, or if allowed as a part of an approved shoreline substantial development permit. There will be no disruption of existing trees or vegetation within the river environment. 5. No effluent shall be discharged into the Green river which exceeds the water quality classification as established by the State for the adjacent portion of the river. No sewage effluent will be discharged into the Green River. Sediment from the excavation will not enter the Green River. 6. All State and federal water quality regulations shall be strictly complied with. Water quality regulations will be in strict compliance with both State and federal requirements. 7. Wildlife habitat in and along the river should be protected. No wildlife habitat will be disturbed. All work shall occur in the paved street. 8. All perimeters of landfills or other land forms susceptible to erosion shall be provided with vegetation, retaining walls or other satisfactory mechanisms for erosion prevention. No vegetation will be disturbed. All work is in the pavement. Per the King County Soil Manual, the existing soil types show only a slight chance of erosion. Notwithstanding any provisions of this Code to the contrary, removal of any cottonwood tree within the river environment or the low impact environment, which tree is 12 inches or greater in diameter as measured 4.5 feet above grade, shall be subject to the requirements of TMC Chapter 18.54, Tree Regulations. No trees will be removed in the scope of this project. All work done in the paved areas of the street.
