Project Description
Gaming Consultants Incorporated seeks approval to locate one cargo container at 13975 Interurban
Ave S.
Existing Development
The uses of the property include an office building and associated parking lot.
Surrounding Land Uses
All of the surrounding properties are zoned RCM. The properties that border the property to the north
and south are used for office buildings. There is a vacant lot to the west and Interurban Avenue
borders the property to the east.
Tukwila Municipal Code (TMC) 18.50.060 allows cargo containers to be used in the RCM. All cargo
containers must comply with criteria detailed in Section 18.50.060 of the Tukwila Municipal Code and be
approved as a Type II application:
I) Only two cargo containers will be allowed per lot, maximum length 40 feet.
The proposed cargo container is 40 feet in length and eight feet in width.
2) The container is located to minimize the visual impact to adjacent properties, parks, trials and
rights -of -way as determined by the Director.
The container has been located behind the building on the property. The container was installed
illegally and the container is visible from adjacent properties and Interurban Avenue.
3) The cargo container is sufficiently screened from adjacent properties, parks, trails and rights -
of -way, as determined by the Director. Screening may be a combination of solid fencing,
landscaping, or the placement of the cargo containers behind, between or within buildings.
The applicant has proposed to install Emerald Green Thuja Arborvitae along the eastern edge of the
containers. The purpose of this vegetation is to screen the cargo container from Inteuruban Ave S.
Additional screening will also be provided along the north edge of the cargo container. The
placement of this vegetation will screen the cargo container from the adjacent H and S property.

4) If located adjacent to a building, the cargo container must be painted to match the buildings
color.
The cargo container will not be located adjacent to the building on the site.
5) Cargo containers may not occupy any required off - street parking spaces.
The containers will not be occupying any off - street parking spaces.
6). Cargo containers shall meet all setback requirements from the zone.
The setback requirement for the RCM District are as follows:
The proposed cargo container will meet all setbacks for the district.
7) Outdoor cargo containers may not be refrigerated.
The applicant is not proposing to have a refrigerated unit.
8) Outdoor cargo containers may not be stacked.
Not applicable as the applicant is only proposing to install one cargo container.
CONDITIONS
1. The cargo container cannot be used for human occupancy.
2. Items stored in the container cannot be hazardous or flammable.
3. The applicant shall plant Emerald Green Thuja Arborvitae at sufficient spacing to insure that the
cargo container is not visible from Interurban Avenue or from H and S property to the north. The
Emerald Green Thuja Arborvitae must be at minimum six feet in height at the time of planting. The
applicant is responsible for the care, maintenance, and if necessary the replacement of any dead
screening materials. The landscaping must be installed within 90 -days of issuance of this Notice of
Decision.
CONCLUSIONS
1. The zoning for the property allows the location of a cargo container.
2. The proposed project meets the performance standards that are required in RCM zone.
3. The proposed location of the cargo container will not have a negative visual impact on surrounding
properties.
This decision may be appealed to the Hearing Examiner within 14 days from the issuance of this
Notice of Decision. All appeal material must be submitted to the Department of Community
Development. If you wish to appeal this decision, please call the Department of Community
Development at (206) 431 -3670 to obtain a copy of appeal procedures.

Cargo Container Placement 13975 Interurban Ave S
I hope the following information is what you require. We plan to plant a screen of Emerald Green Thuja
Arborvitae approximately 6 feet tall adjacent to the cargo container. The setback of the cargo container
from the rear property line appears to be 30 feet or more. The lot behind is overgrown vegetation.
If you require any further information, please do not hesitate to contact me.

Dear Mr. Priest:
The City of Tukwila's Planning Department received your application for Special Permission from the
Director to install a cargo container at the address above on September 22, 2004. On October 11, 2004 it
was deemed to be incomplete because certain requirements of the application were not provided:
Please provide the following:
1. The species selection and proposed height of the screening plants that will be planted adjacent to
the cargo container.
2. Please also provide the setback of the cargo from the rear property line.
Please have the above information to the City within 14 -days from the date of this letter.
Also be aware that under current code, Cargo Containers can only be 30 feet in length. The City Council
will be considering extending the maximum permitted length to 40 feet at their regular scheduled meeting
on November 1, 2004. If the City Council decides not to extend the length restriction your cargo
container will have to be removed.

Jarl,
I sent a letter to you dated October 11, 2004 regarding your pending application for a cargo container
(L04 -063). The information needed to be sumbitted within 14 -days which would have been the 25th. I
have still not recieved the information requested.
Code Enforcement has put this matter on hold, with the understanding that the container would recieve the
required permit and comply with code. I would like to resolve this matter as quickly as possible.

As of today the City has not recieved an application for the Cargo
Container. The City will have to resume Code Enforcement Action if an
application is not submitted soon. Do you know when an application will

Thank you for getting back with me. I have the completed site plan
showing the location of the container, description of proposed
screening, dimension of the cargo container, permit fee, and application
complete less the Affidavit of ownership and hold harmless permission to
enter property form. Our managers plan to meet with the property owners
early next week. The complete application will be submitted immediately
afterwards.

here at our main offices today (8/28) from the property managers. We
will not be able to assemble the necessary documentation for permitting
by Monday (8/30). May we requested an extension of time until this
