Subject: L2000 -004 BN / ALLENTOWN Comprehensive Plan / Zoning Map Correction
The Comp Plan/Zoning Maps of the City do not appear to accurately reflect the districts
intended by the City Council and hence the MIC/HI and LDR boundary adjacent to the
BN railyard in the Allentown neighborhood. Exhibit A is a vicinity map of the subject
area.
1. The location of the zone line between the MIC/H district and the adjacent LDR
district does not reflect the BN property boundaries. Exhibit B is the southern area
of Allentown and Exhibit C is a map of the northern area. "Proposed" lines are
shown and accurately reflect railroad property versus private property.
2. The Manufacturing Industrial Center Implementation Plan zoning map of the area
is included as Exhibit D. The MIC Implementation Plan Zoning Map, albeit
small, shows a number of notches that follow parcel/ownership lines versus the
City's official zoning and comp plan maps which are straight lines for most of
their way through Allentown.
Jack Pace, Planning Manager, said that the intention of the Council was to follow the
ownership boundary for Burlington Northern Railroad. The Rules of Interpretation, of
the Districts Established — Map Chapter of the Zoning Code, stipulate that where district
boundaries are indicated on such map as approximately following the lot or tract lines,
the actual lot or tract lines shall be construed to be the boundary of such use district
(TMC 18.08.040(3.)
The proposal is to correct the 200 scale, the 600 scale and 1000 maps in the DCD Offices
to reflect the "proposed" boundary shown on Exhibit B and C so that the maps accurately
reflect actual lot lines of Burlington Northern Railroad.
