Conditional Use Permit application FINDINGS The applicant is requesting Conditional Use Permit approval to install a Wireless Communication System (PCS) Base Station at 18700 Orilla Rd S (Bow Lake Transfer Station). The applicant is proposing installation of 4 antennae, to be divided into two sectors and to be mounted 35' off of grade on an existing US West tnonopole. Associated operating equipment will located adjacent on a slab on grade. Existing Development The site is the King County Transfer Station at Bow Lake. Surrounding Land Uses The subject and surrounding properties are zoned Tukwila Valley South. Interstate 5 is directly to the west and the remainder of the surrounding properties are undeveloped and mostly wooded. Orilla Rd S and the 1 -5 on ramp to the southwest are the only other land uses. CONDITIONAL USE CRITERIA The proposed project must conform with criteria detailed in TMC 18.64.050, (1 -5), concerning Conditional Use Permits: (1) The proposed use will not be materially detrimental to the public welfare or injurious to the property or improvements in the vicinity of the proposed use or in the district in which the subject property is located The applicant has included site plans, elevations and photosimulations showing the proposed antennae. The monopole is owned by US West and is occupied by US West, at a 60' height and AirTouch mounted at 50' height. The facility is telecommunications equipment that falls within the safety parameters set by the American National Standards Institute (ANSI) and below the FCC standards for maximum exposure to radio frequency energy. 2 z • 6 • 00 o. w. H F; z Staff Report to the L2000 -012 Planning Commission VoiceStream Wireless 18700 Orilla Rd S (2) The proposed use shall meet or exceed the performance standards that are required in the district it will occupy. The Development Standards for uses in the Tukwila Valley South (TVS) zone include a maximum height of 115 feet. The existing monopole is 60'. Two antennae (one sector) will be mounted facing the north; the other will face the soutwest. At 35' their addition will be virtually unnoticeable. (3) The proposed development shall be compatible generally with the surrounding land uses in terms of traffic and pedestrian circulation, building and site design. As with similar uses, the base station will generate trips during the construction period and, following the completion of construction, up to 1 trip per month for maintenance. No other impacts to pedestrian or transportation movements are anticipated. The operating equipment will be located on a slab on grade about 7' from the antennae and away from any traffic areas. (4) The proposed use shall be in keeping with the goals and policies of the Comprehensive Land Use Policy Plan By co- locating on an existing facility, the proposal abides by the Comprehensive Plan goal of minimizing the number of cellular sites and their possible visual impact while accommodating the expansion of appropriate telecommunications capacity and coverage. 5) Al! measures have been taken to minimize the possible adverse impacts that the proposed use may have on the area in which it is located. The applicant has applied for co- location on an existing monopole in lieu of proposing a separate support structure for their antennae. The antennae will have minimal visual impact due to their small size and location below the arrays of two other carriers. CONCLUSIONS Staff makes the following findings and conclusions under the city's Conditional Use Permit criteria (TMC 18.64.050): (1) The proposed use will not be materially detrimental to the public welfare... The co- location of this proposal on an existing and already approved monopole avoids any new physical intrusions or visual impacts on the surrounding area. Additionally, because of the both the operational bandwidth and low power and high frequency of this station's signals there will be no interference with TV or radio reception or negative health effects (2) The proposed criteria shall meet or exceed the performance standards... The applicant is within the allowed height limits of this zone. No other development standards apply. (3) The proposed development shall be compatible generally with the surrounding... 3 Staff Report to the L2000 -012 Planning Commission VoiceStream Wireless 18700 Orilla Rd S There will be no impacts to the transportation system or the surrounding land uses. The presence of the monopole by the entrance to the transfer station is not incompatible with the existing building or site design. (4) The proposed use shall be in keeping with the goals and policies... The addition of this facility is within the intention of this zone by further developing "high intensity regional uses ". Again, by co- locating on an existing structure this proposal also furthers the Comprehensive Plan goals for the siting of telecommunications facilities. (5) All measures have been taken to minimize the possible adverse impacts... The antennae are being mounted on an existing structure thereby avoiding the clutter that could occur from multiple monopoles. Otherwise, because of the use of this site as a transfer station and its location next to the Interstate, there are no other issues of impact to consider. VoiceStream proposes to construct a telecommunication facility consisting of a two - sector antenna array with two antennas per sector (4 antennas total) mounted at 35' on the existing USWest 60' monopole. The radio transmitter equipment will be located on a recessed slab on grade approximately 7' south of the tower. The proposed project meets the criteria specified in TMS 18.64.030 as follows: 1. The proposed use will not be materially detrimental to the public welfare or injurious to the property or improvements in the vicinity of the proposed use or in the district in which the subject property is situated. Collocation of an additional carrier on the existing three - carrier monopole will not be detrimental to the public welfare or injurious to the property or improvements at the Bow Lake Transfer Station or to the surround vicinity. The proposed use will create minimal impacts since VoiceStream is the third carrier at 35' on the 60' monopole. The tower already supports US West (60') and AirTouch (50') antenna equipment. The additional antennas will have minimal visual impacts and essentially no other impacts to the Transfer Station or surrounding properties. 19807 N. Hundreds of police, fire and other public safety agencies and ambulance departments rely on wireless networks every day. Many emergency calls are placed to 911 or other emergency numbers from cellular phones. A recent survey revealed that almost 70% of those polled believe safety and security are the best reasons to own a cellular phone. 2. The proposed use shall meet or exceed the performance standards that are required in the district it will occupy. As demonstrated in submittal materials (drawings and photosims) the proposed site meets or exceeds all performance standard. The existing monopole facility is • designed and constructed to meet or exceed all Uniform Building Code wind loading requirements for three carriers. Only one maintenance trip per month by authorized personnel is required for maintenance and security checks. No additional buildings will be constructed, as the equipment storage unit is a prefabricated, stand along cabinet. The site design has been approved by USWest and King County and meets the City of Tukwila's design requirements. 4. The proposed use shall be in keeping with the goals and policies of the Comprehensive Land Use Policy Plan. This project is consistent and compatible with the intent of the goals, objectives and policies of the City of Tukwila's Comprehensive Plan and Zoning Code. As the use of wireless services increases, new and expanded utilities are necessary to meet the demand for such services. This facility is needed to provide continuous and dependable service in the area. The Federal Communications Commission requires licensees as VoiceStream PCS III Corporation to provide thorough coverage within their licensed are. Collocation on an existing telecommunication tower reduces the need for an additional tall structure to support VoiceStream antennas. 5. All measures shall be taken to minimize the possible adverse impacts, which the proposed use may have on the area in which it is located. This is an "infill" site that is needed to provide wireless coverage in a very specific area. The proposed facility meets minimum RF coverage requirements for the targeted area. This is demonstrated by the two plot maps (see plot maps) showing VoiceStream's network for this area with and without the Bow Lake Transfer Station. As a matter of company policy VoiceStream always seeks to collocate antennas on existing infrastructures. This proposal is the best alternative to provide wireless service in the targeted area.
