The attached staff report was transmitted to the Planning Commission on May 19th with the intention of being presented at a public hearing on May 25th. O~ z Staff Report to the Planning Commission BACKGROUND L2000 -014 Special Permission- Unique Sign Golden Nugget Casino The sign contractor for the Golden Nugget (1 -5 Signs, Inc.) has applied for, and received, a total of four separate wall sign permits on behalf of the Golden Nugget Casino since 1997. The first two sign permits (issued in July 1997 under S97 -065 and S97 -066) allowed the installation of the Golden Nugget logo on the casino's newly constructed awning. This red and white awning ,= z wrapped around the north, east and south sides of the casino. The sign code allows a maximum Lir re 2 of two wall signs for any business (TMC 19.32.140). As a result, the logo was only permitted in 6 v two places on the awning (on the north and east side). Copies of the sign application materials 0 0 are attached. p J The third and fourth sign permits (issued in December, 1999 under S99 -127 and S99 -128) allowed the installation of the Golden Nugget logo on a replacement awning. Like its predecessor, w 0 this awning also wraps around the north, east and south sides of the casino. As referenced above, the sign code permits a maximum of two wall signs for any business. Thus, the logo only g appears in two places on the replacement awning (on the north and east side). The attached sign application materials do not disclose the intent to construct or install additional signage. _ ui w On January 14, 1999 staff was advised of the illegal installation of a permanent wall sign (the image of gold coins, currency and gaming chips). This wall sign wraps around the building, above z Og the existing awning. At that time, two temporary banners were also displayed without sign 11J w permits. On January 14, 1999 these sign code violations were identified by Code Enforcement p under RFA00 -017. p - cp o!-- DECISION CRITERIA w w There are two sign code terms that are pertinent to this issue. They are "sign" and "unique sign ". u- z Cu Definition of "Sign" (TMC 19.08.210): c� O~ "Sign" means any medium, including paint of walls, merchandise, or visual communication Z device, its structure and component parts, which is used or intended to be used to attract attention to the subject matter for advertising or identification purposes. Bulletin boards and readerboards are considered signs. Under this definition, a sign can attract attention in a variety of ways. A sign can provide visual communication (such as an image) without the need for words or text. This visual communication may provide identification as well as an advertisement of the goods and services the business offers. Definition of "Unique Sign" (TMC 19.08.260): "Unique sign" means a building or other structure of unique design and exterior decor, where the entire structure may be considered an advertising device, including but not limited to shapes imitating hats, boots, tires, statues, parts of anatomy, or manufactured items such as airplanes, cars, boats, carriages, or symbols which may or may not contain lettering. The word "unique" as defined in Websters Third means an object that is "unusual, notable or the only one of its kind ". The word "structure" (again, as defined in Websters) means "something constructed or built ". In our sign code, the term "unique sign" is meant to describe a special type of sign that has a definite and unique structure or shape, typically three dimensional in nature. For example, in the 1950's and 1960's actual cars or small planes were installed on the tops of sign poles as advertisements. In some cases, entire buildings took the form of a hat, a boot or a tepee as a means of attracting attention. i Staff Report to the Planning Commission CONCLUSIONS L2000 -014 Special Permission - Unique Sign Golden Nugget Casino The image under consideration is permanently affixed to the exterior walls of the casino. The coins z depicted in the image are gold, in keeping with the business name: "Golden" Nugget. The image is _' extremely large and can easily be seen from passing cars and by pedestrians across the street. The coins, ,i-- z currency and gaming chips in the image are commonly associated with casinos and thus the image attracts rx attention, identifies and advertises the casino via visual communication. The image meets the definition of 6 "sign" as defined in TMC 19.08.210. c0.� 0: Under S99 -127 and S99 -128, the Golden Nugget Casino already has the maximum number of wall signs w =` permitted by code. Any additional wall signage, of any type, is illegal. u) L'- LL w 0: The image in questions does not meet the definition of a unique sign. The image is photographic and has 2 been glued to the building. Gunn On behalf of our client, the Golden Nugget Casino, we take this opportunity to discuss the Golden Nugget's unique sign permit application for its decorative wall mural. Originally, Golden Nugget did not apply for a sign permit for this decorative wall mural since it does not contain any advertising copy pursuant to the definition of "on premises sign" contained in Tukwila's municipal code. The Planning Department, however, felt that the decorative mural is in fact a sign and should require a permit. After consultation with the City Attorney, the parties agreed that the Golden Nugget should apply for a unique sign permit to resolve the permitting issues. I. The Decorative Mural Is a "Unique Sign" The decorative mural fits within the City's definition of a unique sign, which describes a unique sign as: A building or other structure of unique design and exterior decor, where the entire structure may be considered an advertising device, including but not limited to shapes imitating hats, boots, tires, statues, parts of anatomy, • or manufactured items such as airplanes, cars, boats, carriages, or symbols which may or may not contain lettering. TMC 19.08.260. The Golden Nugget's mural depicts coins, chips, and other symbols associated with games of chance. No lettering appears on the mural, instead the mural functions for purely aesthetic purposes to enable the building to act as an advertising device. The unique design and decor of the mural merely enhances the overall exterior design of the building. The Decorative Mural Is Consistent with the City's Zoning Code and Comprehensive Plan. Notably, besides the definition of a "unique sign" the municipal code does not contain any additional criteria for determining whether a unique sign should be permitted. Therefore, we look to consistency with the City's Zoning Code and Comprehensive Plan to find that permitting the decorative mural as a unique sign is appropriate. The Golden Nugget is located within the Regional Commercial Mix Zone and one of the stated purposes of this zone is to "promote attractive development." TMC 18.26.010. The term "attractive" has no meaning unless it means attracting customers. A purely subjective opinion of a passerby as to what he or she finds more or less beautiful cannot serve as the basis for evaluating the legitimacy of a business. Accordingly, the purpose of the decorative mural is to enhance the attractiveness of the Golden Nugget to customers and by doing so to attract further development to the downtown area. According to the City's Comprehensive Plan, the Golden Nugget is located within the Interurban Avenue South Corridor. One of the goals for the City's transportation corridors is to present a more attractive form of development along major streets. The Golden Nugget's mural meets this goal by presenting a decorative facade to pedestrians and passengers in automobiles. Tukwila Comprehensive Plan, Goals 1.8 and 8.1. The decorative mural also supports the City's goal to "preserve signs that are exceptional and significant." Tukwila Comprehensive Plan, Goal 8.1.15. The decorative mural is unlike any other sign in the City and should be preserved as a significant attempt to draw customers without using advertising copy. III. The Decorative Mural Is Consistent with the City's Sign Code. One of the stated purposes of the City's Sign Code is to ensure that city streets are orderly and that safety is increased by minimizing clutter and distraction. TMC 19.04.020. The decorative mural will in no way add to any visual clutter or distraction, nor will it be a blight on the City. Instead, the mural will add to the attractiveness of the Interurban Avenue area. The mural is simple and properly scaled to the building and its lack of advertising copy ensures that it will not cause traffic problems. In fact, a new building with a mirrored glass facade is likely to cause more impact to motorists and passersby with regard to glare and distraction. Encouraging small scale murals in the Regional Commercial Mix Zone can only enhance the character of the City. For these reasons the unique sign permit for the Golden Nugget's mural should be approved. We look forward to discussing our unique sign application with you and City Staff. Boeing is anticipating either leasing the facility to two (2) separate tenants or selling the property. This project will be required to go through design review and obtain a shoreline permit. Gunn On behalf of our client, the Golden Nugget Casino, we take this opportunity to discuss the Golden Nugget's unique sign permit application for its decorative wall mural. Originally, Golden Nugget did not apply for a sign permit for this decorative wall mural since it does not contain any advertising copy pursuant to the definition of "on premises sign" contained in Tukwila's municipal code. The Planning Department, however, felt that the decorative mural is in fact a sign and should require a permit. After consultation with the City Attorney, the parties agreed that the Golden Nugget should apply for a unique sign permit to resolve the permitting issues. I. The Decorative Mural Is a "Unique Sign" The decorative mural fits within the City's definition of a unique sign, which describes a unique sign as: A building or other structure of unique design and exterior decor, where the entire structure may be considered an advertising device, including but not limited to shapes imitating hats, boots, tires, statues, parts of anatomy, or manufactured items such as airplanes, cars, boats, carriages, or symbols which may or may not contain lettering. TMC 19.08.260. The Golden Nugget's mural depicts coins, chips, and other symbols associated with games of chance. No lettering appears on the mural, instead the mural functions for purely aesthetic purposes to enable the building to act as an advertising device. The unique design and decor of the mural merely enhances the overall exterior design of the building. The Golden ' w 0 Nugget is located within the Regional Commercial Mix Zone and one of the stated M purposes of this zone is to "promote attractive development." TMC 18.26.010. The term g n- u_ . "attractive" has no meaning unless it means attracting customers. A purely subjective co d opinion of a passerby as to what he or she finds more or less beautiful cannot serve as the w' basis for evaluating the legitimacy of a business. Accordingly, the purpose of the z 1— decorative mural is to enhance the attractiveness of the Golden Nugget to customers and z O by doing so to attract further development to the downtown area. w w Do According to the City's Comprehensive Plan, the Golden Nugget is located within o co the Interurban Avenue South Corridor. One of the goals for the City's transportation w w corridors is to present a more attractive form of development along major streets. The i- c� Golden Nugget's mural meets this goal by presenting a decorative facade to pedestrians u_ p: and passengers in automobiles. Tukwila Comprehensive Plan, Goals 1.8 and 8.1. The w z decorative mural also supports the City's goal to "preserve signs that are exceptional and U =. significant." Tukwila Comprehensive Plan, Goal 8.1.15. The decorative mural is unlike z �" any other sign in the City and should be preserved as a significant attempt to draw customers without using advertising copy. III. The Decorative Mural Is Consistent with the City's Sign Code. One of the stated purposes of the City's Sign Code is to ensure that city streets are orderly and that safety is increased by minimizing clutter and distraction. TMC 19.04.020. The decorative mural will in no way add to any visual clutter or distraction, nor will it be a blight on the City. Instead, the mural will add to the attractiveness of the Interurban Avenue area. The mural is simple and properly scaled to the building and its lack of advertising copy ensures that it will not cause traffic problems. In fact, a new building with a mirrored glass facade is likely to cause more impact to motorists and passersby with regard to glare and distraction. Encouraging small scale murals in the Regional Commercial Mix Zone can only enhance the character of the City. For these reasons the unique sign permit for the Golden Nugget's mural should be approved. Box 1678 Bellingham, WA 98227 -1678 March 2, 2000 Heather, for your reference, here is the explanation for the mural not needing a sign permit. 1 -5 Signs applied for permits for the Golden Nugget signage on November 17, 1999, which included 2 signs, as allowed by code enclosed in the permit information package. The decorative wall mural was never considered as part of signage because it has no wording or text, and consists of thin, 1/16" panels, which have no structural impact on the project. As cited in Tukwila City ordinance 19.08.140, "'On- premises sign" means advertising copy specifically related to the primary lawful use of the premises.' Further on in 19.08.210 of the code, "sign" is broadly defined to include any medium, structure or component parts, used to attract attention and it continues that this applies to bulletin board and reader boards. Again, the code points to the fact that a sign is a structure with text. The mural, of course, has no such text or structure, being merely a flat image. Our intent was to comply with sign ordinances as outlined in the code, which as far as we know, we did. We were told that Debbie Ritter, however, filed a complaint with Tukwila Code Enforcement who cited the Golden Nugget for its decorative mural, although there are numerous other examples of similar decorative elements at surrounding enterprises and the code appears to point to text as being the defining element regarding signage.
