connections therewith, without incurring any legal obligation or liability therefore, provided, that
such construction, maintenance, repair, alteration or reconstruction shall be accomplished in such

The Grantees agrees that they shall be responsible to pay, as to each lot owned, an equal
pro -rata share of the costs of maintaining the utilities installed within the above described
easement. This covenant to pay shall be binding on the heirs, successors, and assigns of the
Grantee to this agreement and shall run with the title to their lot.
The Grantors shall retain the right to use and enjoy the afore described premises,
including the right to use the surface of said easement if such use does not interfere with
installation and maintenance of the utilities. However, the Grantor shall not erect buildings or
structures over, under or across the easement during the existence of such utilities.
This easement shall be a covenant running with the land and shall be binding on the
Grantors and Grantor's successors, heirs and assigns. Grantors covenant that Grantors are the

Dear Ms Mann:
This letter is to restate in writing the corrections needed for the Holttum short plat that we discussed
by phone on May 23, 2000. The purpose of that conversation was to notify you as the
representative of the Holttums about a discrepancy that exists between the stated lot square footage
of Lot 4 and the square footage that is calculated by using the dimensions given on the submitted
site plan. Also, I made a suggestion about the redrawing of the odd shaped lot line in the northwest
corner of Lot 1. Additionally, I have a suggestion for the consolidation of driveways that would
address some of the neighbors concerns over the loss of on street parking as well as reduce the cost
for the developer of Lots 3 and 4. Details of these are given below.
The site plan shows Lot 4 as 6511.54 SF. However, using the dimensions given along the proposed
lot lines, the largest SF dimension calculated is 6343.95. This is short of the required 6500 SF for
the LDR zone.
In our conversation I mentioned that it is probably still possible to achieve the required lot size by
readjusting the boundary between Lots 4 and 3. For example, Lot 3 is shown and calculates out as
6627 SF. Whatever manner you choose to adjust this situation, the final site plan must reflect this
correction.
Concerning Lot 1, further review has given rise to what we feel is a preferred alternative to the
"zigzag" lot line between the northwest corner of proposed Lot 1 and the front of the existing house
on proposed Lot 2. The currently proposed lot line will create an odd and confusing division
between the front yard of both parcels: it will be unclear whose yard is whose. Also, if either future
property owner were to fence along this lot line this would unnecessarily cut -off the "connection"
between the front living area of the existing house and the street that it faces.

We propose a simple alternative to this situation. The lot line could extend from the current
northwest corner of Lot 1 diagonally to the southeast to a point five feet directly east of the
northeast corner of the existing house. (The 5 feet is the required side yard setback.) According to
my calculations this would still create a lot that is above the 6500 SF minimum lot size while
meeting the above stated objective. (Please see the attached site plan.)
As you are probably aware, a number of residents along S 140' ST expressed concern about the
loss of on -street parking spaces caused by the curb cuts needed for Lots 2 and 4. While there is no
alternative to the curb cuts needed for Lot 2 a reduction is the number of cuts could be gained by a
consolidation of the driveway for Lots 3 and 4. If the cut and driveways for these lots occurred
along their mutual boundary, and the existing driveway along the east side of Lot 3 were
abandoned, there could be advantages in two ways: 1) Development costs could be reduced and
2) There would be a loss of less on street parking spaces for both the neighborhood and the future
residents of these lots. (See attached site plan.)
It is my understanding that the required driveway and parking requirements for Lot 2 will be met
shortly. Once these are completed, the items specified in the May 2 Notice of Complete Application
are addressed and the issue stated above corrected this application should be ready for final
approval. Please keep me informed.

Dear Mr. and Ms Holttum:
Your application for a short plat of property at King County parcel 167040 -0218 is complete as
of May 2, 2000. As you know this project has been assigned to me. If you have further questions
during this process, please contact me at the number below.
The application has also been routed to other relevant city departments, in this case Fire and Public
Works for substantive review. Their comments and requirements are listed below. In order for your
application to be approved compliance with these stipulations is required. Once this is done and in
accordance with Tukwila Municipal Code 18.104.130 a final decision shall be issued within 120
days from the date of the notice of complete application exclusive of any time the city is awaiting
further information from the applicant.
Public Works
1) Future development of Lots 3 and 4 may require the installation of a fire hydrant along S 140` 1
ST. Please attach a note on the recording sheet / site plan to both lots 3 and 4 stipulating that if a
fire hydrant is not accessible within 250' by line of vehicle travel to the closest point of the
structure one must be installed at the owners expense, or the structure will need to have interior
fire sprinklers. TMC 14.24.040 (A)(B)(1)(2). A copy of these sections is enclosed.
2) City development regulations require 2 off street parking spaces for each single - family house
on a newly created lot. For Lot 2 a driveway and parking spaces must be created. A look at the
site plan you supplied seems to show two options. One is on the north side of the lot along
S 140th ST. The second is to use the existing 10' wide gravel driveway on proposed Lot 1 as the
access to parking on Lot 2. Option 2 would require an easement to this effect being noted on the
recording sheet along with creating space on the south side of Lot 2 that will accommodate
these two spaces. Other options may be available to address this requirement.

A Miscellaneous Permit from the Department of Public Works will be needed for construction
of a new residential driveway. Driveways shall be paved for a minimum distance of 20 feet
from the edge of any existing road pavement. One is enclosed for your convenience.
3) The "proposed utility easement" on Lot 1 must be changed to "utility easement ".
Fire Department
1) Show the location of the fire hydrant to the west of the site. I believe there is one at the
intersection of S 140''' and 53' Ave S.
Planning
1) Per the discussion at our joint meeting between planning and public works, a bond must be
posted for the demolition or removal of the carport/garage on Lot 3 and the shed on Lot 4.
Again, this is to insure that these structures will not remain if no houses are built on these lots
within one year. [TMC 17.20.030 (B)(4)]
This determination of complete application does not preclude the ability of the City to require that
you submit additional plans or information, if in our estimation such information is necessary to
ensure the project meets the substantive requirements of the City or to complete the review process.

(P -SS)
INFORMATION
A short plat (or short subdivision) is the division of property into nine (9) or fewer lots. City review is required to
ensure that development and infrastructures are satisified, the action is consistent with the Tukwila Comprehensive
Plan, and the plat is properly recorded.
REQUIREMENTS: The City has extended the range of administratively approved short plats from 1 -4 lots,
to a maximum of nine (9) lots. However, short plats of 5 -9 lots are required to provide public notice,
environmental review and development standards specified for subdivisions (creating over nine lots).
PROCEDURE: Within 28 days of receiving your application, City staff will determine if it is complete based
on the attached "Complete Application Checklist Table ". If not, you will be mailed a letter outlining what
additional information is needed.
Short plats are reviewed by the Short Plat Committee in a four step process.
1. Preliminary approval: Approval of lot patterns, access and infrastructure schematic design.
2. Construction permit approval: Approval of detailed construction drawings.
3. Installation of required improvements.
4. Final approval and recording: Final City approval of all construction, City Council acceptance of any
infrastructure or property to be turned over to the City and recording with King County.
Applicant may apply to defer certain on -site improvements until after recording the final short plat, due to project
phasing or engineering considerations. The applicant shall include a List of specific deferred improvements, a cost
estimate from the contractor who will do the work and a financial warranty equal to 150% of the cost. The
warranty may be cash, an assigned savings account or an irrevocable letter of credit.
Short Plat Committee decisions are based upon the following criteria:
(TMC 17.12.030.A) CRITERIA FOR PRELIMVIINARY APPROVAL OF SHORT PLATS :
A. APPLICATION: The following items are required,..in quantities specified by DCD, for a complete application for
final short plat approval. Items may be waived if in the judgment of the Short Subdivision Committee said items
are not applicable to the particular proposal:
1. Completed Short Plat Final Approval Form.
2. Completed Application Checklist.
3. Documentation of the square footage of each lot and mathematical boundary closure of the subdivision,
of each lot and block, of street centerlines, showing the error of closure, if any.
4. A final survey which complies with the standards set forth in TMC 17.04.060 and with all certificates
signed except of those to be signed by the City and those to be signed at recording.

5. A title insurance mi. Jrt confirming that the title of the land in the. proposed subdivision is vested in the
name of the owners whose signatures appear on the plat's certificate.
6. A bond in a form acceptable to the City Attorney pursuant to TMC 17.24.030 if improvements are to be
deferred.
7. Legal descriptions of all the tracts located within the boundaries of the short plat.
8. As -built plans for all new roads and utilities.
9. Binding maintenance agreements to provide for the maintenance of commonly owned private facilities.
10. Signatures on the following certificates on the face of the plat (when appropriate) from the surveyor that
prepared the plat, the King County Treasurer, Seattle -King County Health Department, City of Tukwila
Finance Director, Owner's Affidavit and Certificate of Dedication as identified in TMC 17.04.060.
(TMC 17.12.030(c)) CRITERIA FOR FINAL APPROVAL OF SHORT PLATS:
1. All requirements for short plats as set forth in the Subdivision Code are met.
2. All terms of the preliminary short plat approval have been met.
3. The requirements of Chapter 58.17 RCW, other applicable state laws, and any other applicable City Ordinances
have been met.
4. All required improvements have been installed in accordance with City standards or an improvement agreement
with financial guarantee pursuant to TMC 17.24.030 has been entered into by the applicant and accepted by the
City.
5. That the plat is technically correct and accurate as certified by the land surveyor responsible for the plat.
