The planting as completed meets the specifications of the approved landscape for the number, variety and general planting plan. However there are two (2) Gaultheria Shallon and three (3) Mahonia Aquifolium that are distressed and appear dead. On the river side of the river trail there are two (2) Thuja Plicata that will need to have surrounding fast growing blackberry vines cleared as this growing season (2002) progresses and again in future years. As you know, the approved planting plan includes a two -year post- project maintenance program for the replacement of dead and unhealthy plants and the maintenance of a cleared area around all plants, as well as necessary irrigation. Please instruct your landscape contractor to replace the dead plants and clear the encroaching blackberry foliage. These tasks should be completed as soon as possible to assure a healthy growing season for the plants in question. I will now "sign -off' the final inspection on your permit. The final signed copy is for your records. Please note that final approval does not effect your obligation to observe the two -year post - project maintenance program mentioned above. As a result, I will be handling the processing of your Shoreline permit conditions. Your Shoreline permit will expire on October 12, 2002 (two years from its issuance date). All of the conditions set out in the permit must be satisfied within that time period. If substantial progress has not been made before the expiration date of the Shoreline permit, the matter will be returned to Code Enforcement. As you were advised in our November 6th letter, no work may commence on the site until your Land Altering permit (MI2000 -082) has been issued. However, in order to obtain the permit, you must first amend it to incorporate the scope of work established under the Shoreline permit conditions. The proposed plantings will replace significant trees located in a critical area sensitive area. For this reason, the following standards (per TMC 18.54.130(3)(c)) will apply: 1. Minimum sizes shall be 2.5 inch caliper for deciduous trees, 6 to 8 feet in height for evergreen trees, 24 inches in height for shrubs, and 1 gallon for groundcover. 2. These were sent to your office as well as posted at the site. On November 3, 2000 the appeal period for this permit expired. The next step in this process is to begin work,. fi fulfilling the conditions. Please contact this office with the estimated time frame in which you plan to do this work. Mullet, Mayor Department of Community Development Steve Lancaster, Director CONDITIONS OF APPROVAL FOR THE SHORELINE SUBSTANTIAL DEVELOPMENT PERMIT SIMVEST PROPERTIES 6410 S 143RD ST, TUKWILA L2000 -017 October 5, 2000 Based on the Recommendations in the attached Staff Report the following are the Conditions of Approval of this Shoreline Substantial Development Permit: 1) Revise the Landscape Plan to reflect the need to create a strong visual buffer and replace lost wildlife habitat. Recommendations to do this are as follows: a) Better screening and maintenance. To create a strong visual buffer between the area of development (the quarry spalds) and the pedestrian trail. The row of trees on the south side of the planting plan (see Area 1 on Attachment B, Landscape Plan) shall be Western Red Cedar. This is a preferred tree species for a river zone. To achieve a strong visual buffer during the time before tree maturity, tree spacing shall be no more than 10' on center. b) The row of trees on the trail side of the planting plan (see Area 2 on Attachment B, Landscape Plan) shall be comprised of deciduous varieties, such as Pacific Dogwood and Oregon Ash, 15' on center maximum. To achieve the proper screening effect in conjunction with the Red Cedar, a minimum of 7 trees appropriately spaced will be necessary. c) Intersperse Salal and Oregon Grape at @3' on center as a replacement for the proposed "Pacific Northwest Low Grow Wildflower Mix ". These plants will screen the lower visual sight line area that will not be screened by the Wildflower mix and will be heartier and longer lasting than the mix. d) Because of the above planting scheme, do not use slats in the existing chain -link fence facing river. The suggested plantings will adequately create a strong but attractive visual buffer between the trail area and the area of quary spalds. e) Include a maintenance plan to assure the survival of the plantings. TMC 18.54.160 (D) Maintenance Responsibility states, "All ...replacement trees and vegetation ....shall be maintained in healthy condition by the property owner throughout the life of the project... ". Mullet, Mayor Department of Community Development Steve Lancaster, Director September 27, 2000 To: Jack Pace, Planning Manager Fm: Art Pederson, Assistant Planner Re: Shoreline Permit for Simvest Properties 6410 S 143`d ST (File No. L2000 -017) Background This project involved the clearing of all vegetation in an approximately 20,400 SF area of this 64,000 SF parcel and the laying of 680 tons of quarry spalds over the cleared site. Prior to the clearing, this parcel was thickly wooded with an upper story of various sized mature cottonwood trees and an under -story of various deciduous shrubs. It was the only such parcel along this side of the river between the Fort Dent/Black River pedestrian bridge and the Riverside Inn. (See Attachment A, Aerial Photograph.) The work performed was 60' -70' feet from the Ordinary High Water Mark and was within both the Low and High Impact Environments. The width of the Low Impact Environments that were involved varied from 25' on the east end of the site to 40' on the west. The Shoreline application and checklist were submitted after the applicants received a correction notice from Code Enforcement for already doing the clearing without permits in violation of WAC 173 -27 -280 and TMC 18.44.110 (9). No Tree Clearing Permit was submitted per TMC 18.44.110 (15) and TMC 18.54. Once notice was received, applicants submitted Shoreline and SEPA applications. At that time, applicants stated they didn't intend to use the site for any particular use. The intention was to "clean up" an overgrown lot that was occasionally used as a dumping spot by tenants and others. A landscape- screening plan was included with these submittals. (Note: 7/28/2000 W &.H Pacific for Quest Communications [formerly US West] submitted a Conditional Use Permit to construct a 45' monopole on this site within the 200' Shoreline Zone.) Applicable Statutes and Review Criteria 1. Application for and issuance of a Shoreline Substantial Development prior to the commencement of any work in a shoreline zone. TMC 18.44.110 (9). 2. Application of the requirements of the Tree Regulations, TMC 18.54 when removing any Cottonwood tree with a caliper of 12" or greater in a Shoreline zone. Issues -J E: O As all work was done prior to submitting the Shoreline and SEPA checklists, it was not possible �. to properly inventory the existing site conditions. Consequently, it is unknown what possible g diversity of flora was on the site. The predominant ground cover was Cottonwood. On the �. checklist the applicant listed the removal of the following number of Cottonwoods, #3 of a 12" — s w 18" diameter, #6 of 4" -8" and #12 of 1"-3", a total of 21 trees, as well as low brush of unknown z !-- variety. This number of trees is probably correct however their diameters are questionable. The z O. site is surrounded by cottonwoods to the west and to the north by the river. The trees to the west w are almost all of a 1' and greater diameter. Some fallen cottonwoods on this site are greater than n o 2' diameter. A recently fallen cottonwood immediately on the trailside of the property fence was p —2'+ in diameter. The cottonwoods on the riverside of the trail are 2 -3' in diameter. Additionally, w I-- aerial photos of the site obtained from the University of Washington Map and Photo Library, and = 0 taken in 1995, show the removed trees to be equal in size to those in the immediate surroundings. F .z' Because the trees in question were removed without obtaining the required Tree Clearing Permit, tali no site plan identifying the diameters and location of each tree was undertaken as per TMC p f-'. 18.54.080 (1). If some of the trees removed were of an 18 " -24" diameter their replacement Z would require 6 for each removed. In this case, at a minimum of #3 trees at this diameter, the number of replacements would be 18. If greater than 24" their replacement would require 8 for each removed. In this case, at a minimum of #3 trees at this diameter, the number of -. replacements would be 24. (TMC 18.54.130 [3] [b]) Recommendations The City of Tukwila Shoreline Regulations are intended as a guide to development action before any action is taken. In this case because the work was done before an adequate survey and assessment of the site could be made, the benefit of the shoreline regulations as a guideline to prior action is not available. The shoreline requirements instead must be used to remediate the damage of the illegal work done. Based on the applicable code sections cited above, the requirements for remediation are as follows: 1) Revise the Landscape Plan to reflect the need to create a strong visual buffer and replace lost wildlife habitat. GAAPPH >N I AND11CF APPACHOR1 1NF nnr 1 ^Imrno 1 CRITERIA FOR PROJECTS SUBJECT TO KING COUNTY SHORELINE REGULATIONS The City of Tukwila is required to administer annexed areas based on the Shoreline Management Plan which was in place at that time, until a new Plan is adopted and approved by the State Department of Ecology. The King County general shoreline regulations for these "Urban" designated shorelines are presented below. 25.16.030 General requirements. A. Nonwater related development and residential development shall not be permitted waterward of the ordinary high water mark. B. Except in those cases when the height requirements of the underlying zones are more restrictive, no structure shall exceed a height of thirty -five feet above average grade level. This requirement may be modified if the view of a substantial number of residences will not be obstructed, if permitted by the applicable provisions of the underlying zoning, and if the proposed development is agricultural, water related or water dependent. C. All development shall be required to provide adequate surface water retention and sedimentation facilities during the construction period. D. Development shall maintain the first fifty feet of property abutting a natural environment as required open space. E. Parking facilities except parking facilities associated with detached single- family and agricultural development shall conform to the following minimum conditions: 1. Parking areas serving a water related or a nonwater related use must be located beneath or upland of the development which the parking area serves. 2. Any outdoor parking area perimeter, excluding entrances and exits, must be maintained as a planting area with a minimum width of five feet. 3. One live tree with a minimum height of four feet shall be required for each thirty linear feet of planting area. 4. One live shrub of one - gallon container size or larger shall be required for each sixty linear inches of planting area. 5. Additional perimeter and interior landscaping of parking areas may be required, at the discretion of the Director, when it is necessary to screen parking areas or when large parking areas are proposed. F. Collection facilities to control and separate contaminants shall be required where stormwater runoff from impervious surfaces would degrade or add to the pollution of recipient waters or adjacent properties. The City of Tukwila annexed approximately 5.7 miles of the Duwamish/Green River as part of a 1988 annexation. State law requires that the City of Tukwila regulate these annexed shorelines based on the latest approved Shoreline Master Plan. Shorelines which are subject to the King County regulations are generally located on the north side of the river starting at 138th St and 126th St. REQUIREMENTS: All improvements over $2,500 and within 200 ft. of the Duwamish/Green River require a "Shoreline Development Permit" except the following: • Owner - occupant construction of a single family house and/or pier construction when the pier is less than $2,500 in salt water and $10,000 in fresh water; • Normal and catastrophic maintenance and repair; • Normal bulkheads common to single family residences; • Habitat improvements which are part of a watershed plan; • • Hazardous waste remediation when approved by the State; • Emergency construction; • Any Federal Treaty rights. PROCEDURES: Within 28 days of receiving your application, City Staff determines if it is complete, based on the following "Complete Application Checldist. If not, you will be mailed a letter outlining what additional information is needed. A shoreline permit decision is administratively made by the Director of the Department of Community Development, unless the application request of the applicant be joined with another land use application which requires a public hearing. The City's decision will be transmitted for review by the State Shorelines Hearings Board who may take jurisdiction for 21 days. No construction may occur during that time, although building permits may be reviewed. Where existing woodland soil conditions remain, na addition of organic mulch will be necessary. 6. Planting activities shall follow typical drawings provided as a part of this planting plan. Compacted root mass shall be broken —up slightly to free constricted roots prior to planting. For facultative wet trees and shrubs, soil shall be saturated at Time of planting, or supplemental Irrigation may be required. 7. Trees shall be held in place with one 2 "x 2" hemlock, fir, or cedar stoke and secured with #14 gauge steel wire. A two —year post — project maintenance program shall be undertaken to assure the establishment of the re— vegetated areas. Efforts during the maintenance period include: a. Maintaining a cleared, mulched two (2) foot radius area around all shrubs and trees, All encroaching weeds shall be cleared from this area throughout the two —year plant establishment period, b. All planting beds shot: be kept clear of weeds and ether plants not included in the planting plans until' all ground cover plants have established and provided adequate cover through the planted areas. Owner shall provide a 2" over of fertile mulch throughout the planted areas to reduce the occurrence of weeds. Mulch stroll be applied each spring. Weeding efforts shall be conducted no leas than three times during the period pf April 1 through Oct. 30. c. For the first two years of plant establishment, the owner shall provide irrigation to ensure plant establishment os shown on drawings, specifically during the period of April 1 through October 31.
