The Grantor /Grantee shall retain the right to use the surface of the easement as long as such use does not interfere with the easement rights granted, but shall not, however, have the right to: a. Plant trees, shrubs or vegetation having deep root patterns which may cause damage to or interfere with the constructed storm system within the easement. c. This letter serves as the Notice of Decision per TMC 18.104.170. This decision is appealable to the Hearing Examiner and any appeal must be filed before the end of the 21 day appeal period on March 16, 2001. For additional appeal information contact the Project Planner. There are three basic steps in the short plat approval process: 1. Preliminary Approval This letter constitutes your preliminary approval. The application was reviewed by the Tukwila Short Subdivision Committee and approved with conditions. The conditions imposed are to ensure the short plat is consistent with the City's policies and regulations. PRELIMINARY APPROVAL CONDITIONS Utilities Drainage design for Lots 1, 2 and 3 shall meet City of Tukwila Surface Water Ordinance Requirements. Extension of the sewer and water lines to the lots shall be approved by the appropriate utility. As -built plans shall be provided to the Public Works Department. Water lines only need to be constructed from the main to the water meter for short plat approval. Water . meters will be located along S. 150 St. Water service from the water meter to the lot ;t=- w lines /individual houses will be installed along with the D permits for construction of the 6 = houses. Prior to development of Lots 3 or 4, the following will be required: If there is no fire hydrant within 250 feet of all building sites, then the houses must be sprinldered. This requirement must be stated on the face of the recorded plat, and must be met prior to issuance of any building permits for Lot 3 or Lot 4. General f. You will need to obtain all required permits prior to beginning any construction. For water and sewer permits, contact the individual provider District. For City of Tukwila utilities, paving and grading, contact Kathleen DeJesus of Tukwila Public Works at (206) 433 -0179. The infrastructure plan shall be prepared and stamped by a licensed civil engineer. The Public Works department will make a decision on your undergrounding waiver request prior to issuance of a miscellaneous permit. g. Install all required site improvements, including those proposed in the short plat application and those identified above as a conditions of approval. If you would like to bond the sewer, road, drainage or electrical undergrounding you must submit 2 cost estimates for the work and a Developers Warranty Request form (see attached). z • { Short Plat L2000 -035 Page 3 h. Submit a set of recording documents in either legal or record of survey format that meet the King County Recorder's requirements and contain the following items: z a 1. A survey map as described in the application checklist which is consistent with all of E- z • the conditions of approval. See attached redlines. Also, I am requesting approval by the City of Tukwila for the posting of a performance bond for installation of the asphalt driveway (item I). The following is my justification for appeal. a.) I already submitted my proposed drainage design along with the results from the percolation test. b.) 1 will comply with this condition and install the water line for lot 2,3 & 4 on the opposite side of the access road within the utility /access easement. c.) I will comply with this condition. d.) I will comply with this condition to the extent that I will pave the driveway from the street to the property line and use gravel inside the property line for (2) car off - street parking. e.) I would like to appeal this condition because the fill material will be removed upon escavation of the foundation for lot 2. However, the access road turnaround will utilize the fill material. This fill material is a gravely/ sandy material which is common in this area. The fill material has been on -site now for nearly one year and has had vehicle traffic over it. It appears very suitable for construction and paving of the asphalt access road turnaround. f.) I would like to appeal this condition because, I was informed by your department during the preliminary review meeting, the installation of a sprinkler system was the alternative to installing a fire hydrant. g.) I already obtained the permit from the City of Tukwila to demolish the existing structure on lot 3. h.) I would like to appeal this condition because I plan to live in the new building on lot 2. I have designed the infrastructure plan myself and if it meets all your requirements, I don't see why it can't be approved without a professional civil engineering stamp of approval. i.) I would like to appeal this condition because I plan on applying for the building permit for lot 2 and concurrently install all the utilities for lot 2, 3 & 4. Also, I plan to obtain the financing to accomplish both concurrently. However, I wish to defer the installation of the asphalt driveway upon completion and final inspection of the building permit for lot 2. I propose the posting of a $7000.00 performance bond with my Bank. j.) Surveyor's document will comply with all the requirements listed. A 20 foot wide paved access road with an all weather surface built to Public Works and Fire Department standards must be provided to any new structures. Your latest proposal meets this requirement, though the turnaround should be shifted to the south 10 feet to straddle the property line between lots 2 and 3. The lot to the west of your site that uses the existing driveway will need to be included as a beneficiary of the access easement. d. The existing front house will have access from S. 150 St., therefore a new private paved driveway will need to be installed to serve the house. e. A letter from a geotech will be required stating that fill placed initially without benefit of a permit and inspection (stop work order) is suitable for construction of the private access road and future single family house foundations. If the fill is not acceptable it will have to be removed. The after the fact permit M12000 -192 did not address this issue. Fire Protection f. Prior to development of Lots 3 or 4, the following will be required: If there is no fire hydrant within 250 feet of all building sites, then the developer shall install a fire hydrant capable of a 1000 gallon per minute flow. This requirement must be stated on the face of the recorded plat, and must be met prior to issuance of any building permits for Lot 3 or Lot 4. General g. The existing garage cannot remain on Lot 3 on its own because a garage must be accessory to a house on the same lot. You may either demolish the garage after obtaining a permit from the City (contact Tammy Beck at 206 - 431 -3670) or post a bond for 150% of the cost of demolition if a new house will be built on the lot within one year. If the new house is not built by that deadline the owner must agree to let the City demolish the garage at the owner's expense. h. You will need to obtain all required permits prior to beginning any construction. For water and sewer permits, contact the individual provider District. (L2000 -035 submitted 6/1/2000) This letter was sent by the applicant of a four lot short plat (with one existing house). The lot is a "standard" @ 160' x 312'(deep) lot on S150th St east of TIB. Both Johanna and I have reviewed it as "ok" but with certain conditions. In the past week during a review of revisions Johanna became aware of the code language in 17.20.030 C 5d: "For residential subdivisions, the proposed private access roads do not serve more that four lots nor are more than 200 feet in length." The proposed access road is 250' to the lot line of Lot 4. When Johanna became aware of this she spoke to Steve about it and, from what she told me, he felt it would be OK to approve but that he wanted a letter from the applicant explaining the situation. She did not tell me about any of this until I asked her about her revisions for which I had been waiting. That is how the letter got to Steve. I do not know if the code language above applies in this situation. It clearly states "For residential subdivisions... ". This is a residential short-plat. Both are otherwise clearly differentiated throughout Title 17 "Subdivisions and Plats ". Additionally, because of the lot and structure configuration on the lot to the south, there is not a likely chance of the future need for a continuous street between S 150th (the street this plat will access) and S 152nd. If Lot 4 was removed (merged into Lot 3) the access road would only extend 200'. But because the proposed plat has sufficient room for this fourth lot and there being no likelihood of further subdivision to the south, I did not question the issue of access road length. As I have not received any response to the first set of comments, all issues are considered outstanding at this time. Below are outlined the Public ,Works, Planning and Fire Department comments and the preliminary requirements needed for approval of this file. Public Works ( 1) The Tukwila Subdivision Code allows private access roads to be no longer than 250ft and serve no more than 4 lots. Your plan shows a private access road exceeding 250fi. The plan shall be revised to show the access road terminating at the south end ofproposed lot 3. A paved residential driveway (minimum of 10 ft, maximum of 20 ft wide, with a maximum slope of 15 %) shall connect the future residence on lot 4 with the private access road. Also, clarify if the existing house at 4031 S 150`x' St will use the proposed access road or if a new driveway off of S 1506 will be constructed. All new lots must provide a minimum of two off - street parking spaces. �-- 2) Show the.location of the nearest fire hydrant and distance to the property, measured by means of vehicular travel. (See new Fire Department comment below.) 3) Submit an infrastructure /utility plan prepared by a licensed civil engineer showing: a) The design of the private fire department access road with the 20 ft wide required pavement surface along with a pavement cross - section. The comments are then compiled by the lead planner in charge of the file and forwarded to the applicant. Because of the outstanding issue of land altering without a permit (see letter of August 8 from the City Of Tukwila Public Works Department) Public Works has not completed their review. Consequently this letter will address only comments from both the Fire and Planning Departments. Once the land altering permit issue is resolved and the Public Works review is completed, their comments will be sent to you. There may be additional comments from Planning based on those from Public Works. Below are outlined the Planning and Fire Department comments and the preliminary requirements needed for approval of this file. Planning 1. The site plan must show the legal descriptions of the proposed lots. As configured, but without comments from Public Works, the lots shown meet the minimum lot size required. 2. The site plan must show the footprints of likely structures. This is necessary for the reviewer to see if required setbacks and lot coverage can be met with a "typical" house configuration. 3. Before final approval of the short plat, the structure on lot 3 must be demolished. TMC 17.20.030 B 4 requires the demolition of any accessory structure remaining aldhe on a lot. The structure "must be demolished before preliminary approval or the landowner must provide a bond or other financial guarantee...in the amount of 150% of the cost of demolition..." 4. A driveway maintenance agreement must be included on the site plan. 5. Lot 1 will have to provide driveway access and two off street parking spaces. The site plan must show if the access to these two spaces will be off of S 150th St or the access road. 6. A "Grant of Esmt Jun24 -54" was included with your submittal.
