Moira, in regards to the Sign Code (Title 19, Chapter 19.04), I have the following
questions:
1. Frontage Distances. The approximate frontage distances for the site are as
follows:
International Rnnlevard S - 450 feet (between El Charro on the south and the
WSP on the north)
S 160th Street - 500 feet (between Dollar Rent -a -Car on the west and the new
Military Road configuration of the cast)

CITY OF TUKWILA AND STERLING REALTY ORGANIZATION
1. Parties.

This Agreement is made by and between the City of Tukwila, Washington, a non - charter
°, optional municipal code city (hereinafter referred to as "City ") and the owner of real property

• Attachment A hereto (hereinafter referred to as "Owner ") for the purposes more fully set forth

Owner will voluntarily remove existing signage within the City of Tukwila in order to comply cn
with Ordinance No. 1857, Tukwila's Staged Compliance Sign Amortization Program.

B. The Staged Compliance Sign Amortization Program is a phased program designed to bring all w
signage in the City of Tukwila into conformance with the Tukwila Sign Code (TMC 19) per the §
provisions of Ordinance No. 1857 within a defined time period. Ordinance 1857 was adopted
on November 23, 1998 and its effective date is January 1, 1999. cn d

C. The property, on which the signage subject to this removal agreement is situated, is that z H

Washington (King County Parcel No's 2223049001, 2223049015 and 223049091). w F- uj
D. The Owner has applied for this Voluntary Sign Reduction Agreement through the City's - v
Department of Community Development in order to obtain the benefit of an extension in the o -
time period required for compliance with Ordinance No. 1857 beyond the three -year base w
amortization period the Ordinance provides. • U.

3. Provisions. As evidenced by their respective signatures below the parties agree to the z
following provisions: U cn:
A. Percentage of Reduction and Extension Formula. Ordinance No. 1857 provides for an 0
z
extension of the time period in which to comply with the Ordinance's sign removal provisions
based on the percentage of reduction to signage. Ordinance No. 1857 is incorporated in full
herein by reference.
B. Removal of on- premises signage. The Owner agrees to reduce on- premises signage on
the property identified in Section 2(C) above in order to receive an extension of time by which
he /she or it must comply with Ordinance No. 1857. An extension of the amortization base
time period is available for those persons or entities complying with signage reduction
requirements more fully set forth in Ordinance No. 1857. Attached hereto as Attachment A is
the Notice of Decision issued by the City's Department of Community Development approving
the Voluntary Sign Reduction Agreement. It is incorporated herein as if fully set.
C. Substitution of Signage and Permitting Requirements. Existing on- premises signage may
be substituted with new and /or existing signage, so long as such substitution results in a total
reduction in non - conforming signage. Substitutions with new signs require a permit issued by
the City's Department of Community Development. Sign permits for substitution signage are
subject to the compliance period specified under this Agreement.

D. Extension. Based on the foregoing provisions and based on the Owner's percentage of
reduction, the Owner shall have 7.5 years from January 1, 1999 to fully comply with the City's
Staged Compliance Sign Amortization Program.
E. Expiration. This agreement expires on July 1, 2006. At expiration all signs must be in
conformance with the Tukwila Sign Code.
F. Remedies. The Owner agrees that if he /she or it fails to fully comply with any of the terms
of this Agreement, that the City is permitted by the Owner, and the Owner has the authority to
authorize, the City to enter upon the property and remove the non - conforming signage at
Owner's sole cost and expense. The Owner agrees to reimburse the City for all costs of
removal, including but not limited to, attorney fees, staff costs, dump fees, electrical fees, and
abatement costs. Nothing in this provision precludes the City from pursuing any other
remedies provided by law, including legal or equitable relief.
G. Maintenance and Repair. Nothing in this Agreement relieves the Owner from his/ her or
its obligation to comply with City code provisions regarding the maintenance, safety, and
repair of signage.

' 4. Entire Agreement. This Agreement constitutes the entire agreement between the parties

This letter serves as a Notice of Decision for a Type 2 Decision, that is described in the
Permit Application Types and Procedures Chapter, Tukwila Zoning Code, (TMC

Code.
• Both freestanding signs (on Tukwila International Boulevard and S 160th St) are
nonconforming due to height, setback, size and number (Only one freestanding
sign is allowed for this site.) and must be removed.
This decision was reached following the criteria outlined in the Extended Compliance
Periods under Voluntary Sign Reduction Agreement Section of the Staged Compliance
Sign Amortization Program Chapter of the City of Tukwila Sign Code (TMC 19.30.050.).

Zoning Code (TMC 18.116.) Appeal materials shall include:
1. The name of the appealing party.

Your application for a Voluntary Sign Reduction Agreement (VSR) between the Sterling Realty
Organization and the City Of Tukwila has been approved. Details of the agreement and the

The criteria used to determine what is a nonconforming sign and the allowable amount of a time
extension is based on the Percentage of Reduction Formula in TMC 19.30 and included in the

As owners of the property for the Lewis and Clark Theatre and Bowl located and 15820
Pacific Highway South (International Boulevard), we are submitting this letter under
protest.
When we last attended a meeting of the Tukwila City Council near the end of last year,
we recall that the staff was going to look at some other possible modifications regarding
"landmark signs" for the Sign Code and get back to the City Council. We also remember
a suggestion that a City Council committee be formed to look at the issue. Since that has
not occurred, we are submitting this letter for the Voluntary Sign Reduction Agreement.
Please find our enclosed Application for a Voluntary Sign Reduction ( "VSR ")
Agreement. Based upon the information that you furnished us (via tax) and our own
records, there are three signs affected under Tukwila's current sign code. Your records
show them as P -1, P -2 and P -3. Listed below are brief descriptions, and the proposed
changes to our existing signage.
P -1
This freestanding sign is located along International Blvd. South and consists of
the name of complex and 2 reader - boards used to list movies playing at the
theatre.

Our proposal is to remove portions of the sign across the top and retain the reader - board,
to be removed as follows:
1. the portion labeled Meriwether's (Exhibit 1 -A/90 sq. ft.); and
2. the portion of the sign labeled (Exhibit 1 -A/900 sq. ft.).
This proposed reduction total

P -2 This freestanding sign is located along S. 160th Street and will become the major
egress/ingress point to the theatre/bowl site. We do not propose to modify this
sign.
P -3 This freestanding sign is located along SR 518. Our proposal is to eliminate this
sign. The proposed reduction for this sign is 800 sq. ft.
Our total existing sign area for all three (3) signs is 3,248 sq. ft. This proposed
reduction represents 39 percent of the total sign areas. Removal of P -3 allows us the
benefit of adding an additional 15% to our total sign area removed.
We have enclosed three 8 x 10 photos of each sign and 3 crude sketches (taken from the
photos) which outline the portions of the sign to be removed.
We hope the above information will be suitable for your review purposes and we will
gladly produce more detailed information, should you need it.

The Voluntary Sign Reduction ( "VSR ") Agreement is an agreement between a landowner and the City of Tukwila regarding non-
conforming on- premises signage. This agreement allows an extended time period of a specified length to bring it into compliance with
Tukwila's sign code standards. The substitution of any existing on- premises signage with other new or existing signage must be
referenced in, and be a part of, an approved VSR Agreement and will require a permit. All VSR's must be executed and approved by the
landowner and the City no later than June 30, 2000. The implementation deadline for all approved and executed VSR's is December 31,
2001. Implementation is accomplished by reducing the square footage of all on- premises non - conforming signage by at least 30 %. All
decisions regarding the Staged Sign Amortization Program are Type 2 decisions under TMC 18.104.O10C and may be appealed to the
Planning Commission under TMC Chapter 18.116. There is no application fee for the Voluntary Sign Reduction Agreement.

The extended compliance period for non - conforming signs covered by a Voluntary Sign Reciuctioh!!`Agreement is
determined using the percent of reduction formula. This formula reflects the reduction ink nbiRon#drming "signage
on a premises (expressed as a percentage) as of December 31, 2001. It is used on a per premises basis to
determine the extended compliance period for non - conforming on- premises signs. The reduction in the total square
footage of all non - conforming signage to be reduced is divided by the total square footage of all non - conforming
signage. A 15% bonus is added to the resulting percentage for each non - conforming freestanding sign (if any)
which has been removed or brought into compliance.

SUBSTITUTION OF SIGNAGE OPTION
Existing on- premises signage may be substituted with other new or existing signage, so long as the
substitution is part of a total reduction in non - conforming signage on the premises. Such substitution must
be under the terms and conditions of an approved VSR Agreement and will require a permit. All decisions
regarding the Staged Sign Amortization Program are Type 2 decisions under TMC 18.104.O10C and may be
appealed to the Planning Commission under TMC Chapter 18.116.
